China’s critical study on South China Sea Arbitration Award

Months before the second anniversary of the Arbitral Tribunal’s decision on the case filed by the Philippines to nullify China’s nine-dash line map and other issues in the South China Sea, China commissioned a study which was completed in December 2017.

Published by Oxford University Press, “The South China Sea Arbitration Awards: A Critical Study” is an intimidating 548 page assertion by China of its ownership of the waters, reefs, shoals, rocks in the Spratlys as part of its claim over almost the whole of South China Sea.

It’s good that President Duterte has Harry Roque with him as he seems to have been convinced by China to start the joint exploration in Reed Bank also known as Recto Bank – an undertaking that China had been wanting to do and had been generous with its enticement to the Philippine government.

In an interview with Karen Davila in ANC’s Headstart, Roque, presidential spokesperson, said the cooperation with China will be taking off from “the result of a joint maritime seismic exploration agreement. This will now actually entail joint exploration and possible exploitation of natural resources.”

“We have gone beyond determining if there are resources” and “The only issue is now, is it commercially viable,” he said.

Roque and Davila were talking about the Joint Marine Seismic Undertaking or JMSU entered into by the Philippines, China and Vietnam on March 14, 2005.

The Joint Marine Seismic Undertaking, JMSU for short, is back in the news.

It was mentioned by former president Gloria Arroyo and her executive secretary, Eduardo Ermita, to stress that cooperation with China in South China Sea is possible during the launch of the book, “The Ocean Space or the Maritime Area of the Philippines,” a primer on the law of the sea, at the House of Representatives, where Arroyo is a currently a member.

The primer, published by the University of the Philippines, is timely at this time when the Philippines, under President Duterte has reconciled with China, in contrast to the toxic relations during the Aquino administration.
During the press conference Arroyo said, “The language, it was without prejudice to the filing of a protest. And since it was just a research survey, it does not affect the respective positions of the countries on issues related to the claim.”

The current word war between the Philippines and China is another proof of the continuing curse of Gloria Arroyo on the Filipino people.

The latest series of diplomatic protests lodged by the Philippines with China and submitted also to the United Nations have its roots to the controversial Joint Marine Seismic Undertaking entered into by the Arroyo government with China in 2005 which allowed China and later on Vietnam to explore not only the Philippine-occupied islands in the disputed mineral-rich Spratlys but areas that are clearly Philippine territory.

The JMSU was initialed during Gloria Arroyo’s 2004 visit to China which paved the way for the signing of at least two graft-riddled deals : North Rail and national broadband network with ZTE agreements.
