SC: Arroyo can appoint new chief justice

The Supreme Court on Wednesday gave President Gloria Macapagal Arroyo a go signal to appoint the replacement of retiring Chief Justice Reynato Puno.

A radio dzMM report said that SC magistrates ruled that President Arroyo can appoint any vacant positions in the judiciary until her term ends in June 30. The decision came after an hour of closed door deliberations by the Court en banc.

The voting:

Nine justices said ‘yes” (Roberto Abad, Lucas Bersamin,Arturo Brion, Teresita De Castro,Mariano Del Castillo, Jose Mendoza, ,Diosdado Peralta, Jose Perez,and Martin Villarama Jr,)

One dissented (Conchita J Carpio-Morales);

Three inhibited (Chief Justice Reynato Puno, Antonio Carpio, Renato Corona);

Two said case is premature as there is no justiciable controversy (Presbitero Velasco and Antonio Eduardo Nachura).

The justices also ordered the Judicial Bar and Council to submit to President Arroyo its shortlist of possible nominees for Chief Justice. Puno, the incumbent Chief Justice, is retiring on May 17.

Hindi nasama sa report ng Al Jazeera ang parte ng sinabi ni “Jesse” , ang hitman ng mga Ampatuan na ngayon ay gustong mag- state witness, ang parte kung saan sinabi niya kung gaano kadikit ang mga Ampatuan kay Gloria Arroyo.

Humihingi si Jesse ng proteksyun dahil sabi niya kapag makalaya sina Ampatuan, patay siya. Sabi niya, “Hindi lang siya mapera. Malapit kay Gloria. Kapag pumunta si GMA sa Maguindanao sa bahay ng mga Ampatuan, ang tawag ni Andal Ampatuan Jr, mayor ng bayan ng Datu Unsay sa kanya ay, “Ina”. Ang tawag naman ni Arroyo kay Andal Senior ay, “Ama”.

Close talaga sila, ano.

Itong si Jesse ay bodyguard ni Datu Kanor, pinsan at best matalik na kaibigan ni mayor Andal Jr na ang palayaw ay “Unsay”, pangalan ng bayan kung saan siya ang mayor. Kasama siya doon sa masaker at sinabi niyang nambaril din siya. Hindi niya alam kung ilan ang napatay niya.

Same faces, no surprises.

Heeding the Supreme Court, President Gloria Macapagal-Arroyo Wednesday replaced Executive Secretary Eduardo Ermita and at least five other Cabinet officials running for local posts in the May 10 national elections, Malacañang announced.

Ms Arroyo tapped Transportation Secretary Leandro Mendoza as her new executive secretary in a Cabinet revamp prompted by the Supreme Court ruling that appointive officials running for election were deemed resigned.

Ermita, 74, is seeking a seat in Congress in his Batangas hometown.

Press Secretary Crispulo Icban Jr. admitted that Ms Arroyo’s moves were prompted by the high court ruling that officials running for election were deemed resigned and should leave their posts effective March 2.

Only in Arroyo’s administration: cabinet members as “guests” in a cabinet meeting

Malapascua Island, Cebu. – President Arroyo had an innovative explanation for the presence of Cabinet officials seeking elective positions in May in last Tuesday’s Cabinet meeting in Palawan when she announced they were only there “as guests.”

Trade Secretary Peter Favila said Arroyo wanted to put on record that the concerned Cabinet officials are just “guests” to prevent any future legal question.

“She wasn’t laughing. Nobody laughed,” Tourism Secretary Joseph Durano said when asked if Arroyo made the announcement in jest.

Ang salot ni Gloria Arroyo

Kamakailan binatikos ni Deputy Presidential Spokesman Gary Olivar ang mga kandidato nga ginagawang isyu pa rin daw ang kanyang amo na si Gloria Arroyo samantalang busy raw ngayon sa pag-aayos ng kanyang “legacy” .

Pagkatapos sirain ang lahat na institusyon pagdemokratiko para lamang maprotektahan ang sarili, gusto ni Gloria Arroyo mamahalin siya ng taumbayan? Nahihibang siya kasama na rin ang kanyang mga alagad.

At akala naman niya maniniwala ang taumbayan na hihinto na si Arroyo sa kanyang pagka-ganid sa kapangyarihan? Eh di sana hindi na tumakbo sa pagka-kongresista.

Kung magpapaloko pa ang taumbayan kay Arroyo, talagang dapat lang talaga tayong magdusa.

Isyu pa rin talaga si Arroyo ngayon kahit hindi siya kandidato sa pagka-pangulo. Kasi sa baho ni Arroyo, kung sino ang kanyang didikitan nagiging mabaho na rin. Tingnan nyo ang nangyayari ngayon kay Gilbert Teodoro, ang opisyal na kandidato ng Lakas-Kampi, partido ng administrasyon? Kahit pa maraming may gusto kay Teodoro, hindi rin talaga nila masikmura na kinakampihan niya si Arroyo.

Choose well

Former Defense Secretary Avelino “Nonong” Cruz was not one of the speakers in last Friday’s forum of the “The Powers of the Presidency: Preventing Misuse and Abuse” but he was asked to say something when the issue of the Ampatuans’ private armies came up inthe question and answer portion.

Cruz gave a two- word advice for the coming May elections: “Choose well”. He said it will go a long way in instituting reforms in governance if we have a president that will lead by example.

He, of course, didn’t ask to vote for the presidential candidate he is advising: the Liberal Party’s Benigno Aquino III.

Karina Constantino-David, former chair of the Civil Service Commission, also stressed the importance of choosing a president with integrity because she said, “in the final analysis it is the character of the President, his/her honest dedication to public service and not just to power that will speall the difference between decency and judiciousness on the one hand and mis-use and abuse on the other.”

A conspiracy to continue illegitimate governance

Gloria Arroyo must be the happiest person today.

While the people are pre-occupied watching the Senate circus and other political entertainment, she is laying down the infrastructure for what looks like her last try to stay in power beyond 2010.

The group that calls themselves Former Senior Government Officials (FSGO) has information of a sinister plot by Arroyo and her allies that will spell the death of democracy in this country.

The FSGO issued a statement that warns of “A Conspiracy to Continue Illegitimate Governance.” Let it not be said that we were not warned:

Talaga naman. Hindi ko alam kung sino ang mas matindi ang tama, si Gloria Arroyo o si Marlene Aguilar-Pollard.

Kasi, sabi ni Aguilar-Pollard nakilala raw niya si Mayor Andal Ampatuan sa isang gabing pamamalgi niya sa detention quarters ng National Bureau of Investigation at sinabi niya sa media na huwag daw husgahan ang suspek sa pagpatay ng hindi kukulang sa 57 na tao sa Maguindanao dahil “mabait” naman daw. Dios mio naman!

Ito namang si Arroyo, sa interview sa kanya ni Joe Taruc sa DZRH, sinabi niya na “swerte” raw ang susunod sa kanya dahil matatag daw ang ekonomiya na kanyang iiwanan. “Alam mo siguro, suwerte yung susunod na pangulo sa akin.Iyong susunod na administrasyon maipagpatuloy lang niya, uusbong ang ating bansa.”

Arroyo exits June, Puno retires May, raise vital legal questions

The Paramount question is: Under the 1987 Constitution, can an outgoing President Arroyo still appoint the successor to Chief Justice Puno?

The forthcoming retirement of Chief Justice Reynato Puno and President Macapagal-Arroyo’s impending exit from power present an interesting legal question that will have an impact not only on our Supreme Court but on our country’s future as well.
