Armed Forces chief Gen. Hermogenes Esperon Jr. today told lawyers of the Army and Marine officers implicated in last year’s failed power grab to sue him before the courts for ordering their clients’ court martial.
Esperon issued the challenge as he confirmed that a pre-trial investigation panel recommended the dropping of the charge of violation of Article of War 67 (mutiny) for lack of evidence.
The panel recommended the trial of the officers for the lower offenses of violation of AW 96 (conduct unbecoming an officer and a gentleman) and AW 97 (conduct prejudicial to good order and military discipline).
The military tribunal’s president, Lt. Gen. Alexander Yano, on Tuesday directed military prosecutors to furnish the defense copies of the pretrial investigation report “in the interest of fairness.”
The defense has been asking for a copy of the report for months.
Esperon, after accepting the report of the pretrial investigation panel in October last year, referred the 182-page document to his staff judge advocate, Col. Pedro Davila, for another review.
Davila came out with a pretrial advice, which Esperon said recommended that the officers be charged with mutiny.
“Based on that (pretrial advice), I made my decision …That’s the duty of the chief of staff. Now, they want to contest that? Okay, lets go to the court, follow the rule of law, due process, that’s all,” he said.
Esperon said initial investigations conducted by the Army, when he was still Army chief, also recommended trial for mutiny.
Esperon said he used the pretrial advice and the pretrial investigation report as bases for coming up with a decision.
“These are two references that I used to arrive at a decision as to who will be charged or not and I have the sole authority for that.”
“As to what the lawyers are saying, well, they can argue and argue but that’s their role. So let us argue on that in court. Instead of raising their arguments in other places, let us argue that in court,” he said.
Defense lawyers, after court martial proceedings on Tuesday, accused Esperon of abusing his authority for ignoring the recommendation to drop mutiny charges.
Lawyer Francisco Chavez said the military tribunal “is an illegally constituted panel because it was created by a person who has glaringly and gravely and grossly abused his discretion in creating this panel.”
Chavez also said Esperon has “no authority to reverse the findings and conclusion of the investigating panel.”
Esperon belied this.
“Not at all, I can do many things against them, this is just controlled,” he said.
Asked if this was intended as a threat, Esperon said: “No, no, no. I do not have to threaten them although they have threatened me by fighting government, they have threatened me physically.”
“They were even willing to harm my family. That was in their plans. That’s all I can say, you will see that later on,” he said.
Lawyer Trixie Angeles, counsel for accused Capt. Ruben Guinolbay, said she got a copy of the pretrial investigation report which she said is not different from the one that was leaked to media and posted on the internet.
“Our concern is in the delay of the release, why we had to beg for something that is due to us anyway,” she added.
Told Esperon’s decision was based on the PTI and on Davila’s pretrial advice (PTA), Angeles said: “Then we are entitled also to the PTA and to an explanation by the chief of staff as to how he made a reliance on this one, his own evaluation of the evidence that has been presented.”
Angeles said they will ask for a copy of the PTA in the next court martial hearing on March 16. “Remember what was (decided) in the last hearing was that we are entitled to notice and opportunity to be heard.”

Pre-Trial Investigation panel, OTJAG says, no basis for prosecuting the officers, yet Esperon insists there is, what in the world is this legal hocus pocus?
Military Law is enshrined in the National laws; if police investigations say there is no basis to prosecute an accused for murder, why should DoJ prosecutor insist on prosecuting a suspect?
Same is true in military structures. Court Martial is a court of law but in the military. OJAG is military prosecutor, if he says, there is no basis for prosecuting the accused, why continue with the farce?
The PTI report clearly states that there is no evidence, basis to prosecute Gen Lim and Querubin and a few other officers with Article of War pertaining to mutiny and conduct unbecoming an officer, so why does this Esperon Supot insist on prosecuting them?

Malakas ang loob ni Assperon kasi alam niya na hawak niya si tiyanak sa leeg. So, he can do anything that he pleases with these incarcerated soldiers. Tiyanak has so much clout with our justice system from the lower courts to the supreme court. Six years of sitting as a bogus president has allowed her to fill in judges and justices who cater to her whims.
I do not believe that Assperon’s family is threatened by these soldiers. On the contrary, the incarcerated soldiers’ families fear Assperon’s wrath. He should really fear the after effect of what he is doing to these soldiers. The gravity of what he and tiyanak are doing to the incarcerated soldiers’ families, both of them are causing children to be fatherless and motherless. Some of the soldiers’ children have to stop schooling because the meager salaries of their incarcerated parent/parents have to be used for hiring of lawyers, travels to and from the detention center. Imagine the lost time of the other parent who has to jaggle between visiting the incarcerated parent and her household responsibilities. Imagine the stigma of having a parent incarcerated for standing up for the truth. The children of these incarcerated officers will have a distorted picture of honor and justice. They will question why the wicked get ahead in life and the principled ones are punished. Some of these children will end up not finishing their schooling and maybe end up as addicts or simply misfits. Assperon should be afraid of these consequences and the bitterness he has caused to these families will have a long lasting effect. Assperon will not forever be shielded by tiyanak and his bodyguards. He will one day be on his own. If he does right by these soldiers now, he will have a legacy of being able to bridge his position and that of these erring officers’. He should dialogue with them instead of incarcerating them. If he made a mistake of blowing up the “coup” plot to justify tiyanak’s declaratiomn of the martial law like 1017, it is not too late to right the wrong. Dialogue is the key. Compromise is a solution. He should not burn his bridges.

One thing that I can’t quite get over with is the following report by Ellen’s re Esperon’s question directed to a jr officer:

The young officer replied, “Sir, it’s only you who can answer that.”
The mere mention of a possible involvement in the “‘Hello Garci’ operation” is (1) already a tacit acceptance by the CSAFP that the operation INDEED occured and (2) an implicit understanding by the interrogator that his credibility is tainted. (And I’m trying to be objective here.)
With that for a backdrop, what really is in the mind of Esperon?
Did he think that by asking that question, he has convinced the junior officer, who is only one of the many “involved” in the so-called attempt to create a mutiny, that there was no ‘Hello Garci’ operation?
Junior officers are NOT (yet) imbued with a sense of military corruption which has long invaded the top echelons of military power. For the most of them, they are still bound by honour, integrity, loyalty.
These junior officers are the ones who lead the troops in combat and NOT the senior officers, let alone Esperon, whose main duty today it seems is to torture these young men and women into submission to a military tenet that they have not been trained or prepared for: to cheat, to cheat, to corrupt, to corrupt and to unlearn the military values of honour, integrity, loyalty that they were moulded in.
Let’s forget the senior officers for the moment, Querubin, Lim, Miranda and a couple of others.
Let’s talk about these courageous, principled and idealistic junior officers: Hasn’t it occurred to Esperon and to Gloria that if these junior officers even begin to question what had happened in 2004 known as the “Hello Garci Operations”, that they owe it to these young junior officers to at least explain what happened?
No less than a command conference is required to put forward some kind of explanation.
Esperon is Gloria’s OFFICIAL TORTURER of these officers.
The nation owes these young officers a bit of gratitude – they have been putting their lives ON THE LINE (NOT ESPERON NOR HIS mistahs from Class 74) so that the nation may fall soundly asleep even in the midst of all the problems in the Philippines.
It is only right for the public, media, everybody to DEMAND that Esperon and Gloria to either RELEASE THEM for having failed them or to press for a speedy and just trial.
Esperon is extremely lucky – had my son been among these young officers and treated by Esperon the way he is doing now, Esperon would be a dead duck!
There is no longer any respect for the law in the Philippines, not even the military could be relied upon to apply military law… Esperon is NOT FIT to be the chief of the military.

Decision makers do not necessarily stick it out according to Hoyle (the books). They are rigged with that function to have the last say. Lawyers should be aware of that. Many medals and battles were won not in accordance to the fine prints of the OPORD (operations orders). Some leaders may have followed only tacit orders but failures may leave them on their own before the courts,at Plaza Miranda or the community. The end may not always justify the means with us, eh? There is no such thing as absolute prerogative. Even if CS, Esperon has prerogative, his action should be based on sound discretion.
The respondents’ lawyers opine that Esperon’s prerogative is to modify the recommendations but he cannot reverse recommendations for dismissal.
That’s common sense, why would you form an investigating team and ignore their recommendation?

Anything pertaining to military, i.e., particularly that which has touches the lives of officers and men of the AFP, can be Esperon’s prerogative provided that same prerogative does not go counter to military laws and national laws – and more importantly, that it doesn’t, in any manner whatsoever, create injustice or lead his subalterns to commit something illegal!
His prerogative must be all that’s legal – otherwise, when prerogatives become abusive, he should be relieved illico!
St. Thomas Aquinas says that Law is a product of RIGHT REASON. It is through right reason that the divine will is accomplished. What if some pathologically sick and incompetent fool like Esperon makes the law happen? Does the divine still see the product of its will then?
Esperon will not just burn in hell, he will die leaving a lot of wounds to the families, the soldiers, the friends and relatives of all the accused. Because of this, his soul will never find rest. Esperon will continue to grind his teeth even after his death for he has caused the misery and pain of many in this world.
Aristotle said that man’s ultimate goal is happiness, and happiness can only be achieved through virtue. And virtue, only through the mean of the extremes. Espron will never find happiness. He will be as empty as a bubble. His family, his name and his descendants will have to bear the karma in the future.
If I will ever get to encounter an ‘Esperon’ in my life, I will have to raise hell and raise all my defenses. Mahirap pagkatiwalaan ang Esperon.
