Davide’s swearing in stirs foreign service

The swearing-in of Chief Justice Hilario Davide Jr. last Sunday as permanent representative to the United Nations in Cebu in the midst of Asean activities is causing a lot of concern among foreign service officers.

They sense something sinister. Davide’s appointment, despite his being past 70 years old, has already caused demoralization in the foreign service corps.

In a letter to Arroyo today, Michael G. Macaraig, president of the DFAPA (Department of Foreign Affairs Personnel Association), asked “Bakit? Dahil po ba na walang kwalipikadong tao na dito sa aming sangay manggagaling?” (Why, is there no one qualified from the DFA?)

Macaraig said of the more than 2,300 foregn service corps, 78 hold the position of chief of mission.

He said in the military, Arroyo would not dream of appointing someone oustide of the armed forces to represent the institution abroad. “Ang ipinagdadamdam namin dito sa aming hanay ay bakit kami baliwala sa aming Pangulo?” (We feel hurt tha we are being taken for granted by our President.)

Here’s Sen. Rodolfo Biazon’s take on Davide’s appointment:

I would say that the appointment is ad interim, meaning he can already perform the functions, this happened to me after my retirement from the AFP when I was nominated 2x by former Pres Cory Aquino to be ambassador to Russia but I was rejected 2x by the Commission on Appointment, and at the second appointment as a matter of fact, there was issued agreement by the Russian govt, meaning I was accepted and I could already perform my duties, but I refused to go to Moscow without the confirmation and true enough I was rejected by the Commission on Appointment and probably because I got mad I ran for the Senate, and that is why I am here.

In the case of Davide, he can perform, he can go there, IF there is a need for an agreement from the UN for his posting, I do not know if there is such a requirement. I think we should avoid what happened to Ambassador Bolton of the USA, he was not confirmed and yet he occupied his post in the UN without confirmation, and now that the Democrats won in the Legislature, there is a great possibility that He would not be confirmed. That is why I think he had to resign and another one had to be appointed by Pres Bush..I hope this does not happen to our Ambassador appointee because we might have a new composition of the 14th Congress.

The sessions will end June and there might not be enough time for the confirmation of Justice Davide to the UN post. This would be a decision of the chief justice. I hope what happened to Bolton would not happen to Davide. If Davide is not confirmed by the CA, what kind of presentation will you be able to provide being a representative of our country to the UN. This will decrease his effectiveness

    I would like to think that people making up our foreign service have not lost their sense of honor and their courage.

Six years ago this Saturday, then Chief Justice Hilario Davide suddenly appeared at a religious Shrine in Mandaluyong City, from out of nowhere, mounted a stage and for some still unexplained reason, suddenly swore in the Vice President, Gloria Macapagal Arroyo, as President. He could not have been validly acting as Chief Justice, since there was no CASE that could have conceivably brought him there. But the crisis he spawned by that singular act of brazen violation of the Philippine Constitution is still ongoing. There was, on that fine Saturday morning of 20 January 2001, no case before said Chief Justice Davide, other than a Presidential Impeachment Trial, which, for some reason, he abandoned though it was validly being held in the Senate of the Philippines under completely proper Rules. Instead, the Chief Justice, was a co-conspirator in the demolition of Philippine democracy as we know it.

    The final resolution of the conundrum he put the Constitution into is not yet in sight and can only be guessed at, even as he mounts the World Stage with his Barrio-class mind imagining that thinking people don’t know what a Derelict he is of Sacred Duty, what a traitor he is to that quintessentially necessary condition for Justice to be done: the cold neutrality of an impartial Judge.

    Davide simply chucked out the entire section of the Constitution on Presidential Succession and Public Accountability. He is a complete disgrace as a Judge and a Justice of the High Court.

    Davide is a faker now, hoping to leave for foreign climes, where his exposure will naturally await its domestic efflorescence.

    But he cannot escape History, because his decisions are the Gordian Knot in Philippine history, with Erap and GMA tying us all up in knots of illegitimacy and irresolvability.

    Eventually it will become obvious to all how Davide destroyed democracy by Judicial Putschism six years ago.

    He cannot escape that judgment.

    Just how often the Constitution had been violated by the very people sworn to uphold it? The SC, the last bastion of Justice was the perverter of the contitution by its justices laying the laws into their hands or simply don’t know what they are doing.

    Davide as a Chief Justice, in one stroke got carried away by his personal emotion and interest and forgot that Justice has no feelings and emotions and also blind, but deliberate on the points of law with the independence above that of ordinary dinezens and with that decision had perverted the Constitution beyond redemption. And it take only one person to do it and destroy the whole Democracy and the Process and Being rewarded by another Pervert (don’t know which is the bigger of the two) to do more pervertion on the other field we have known as the United Nations. May he got exposed and disgraced among the better men and women..

I challenge anybody to read the Constitution and see if there’s such a provision as “constructive resignation” in it. He administered the oath to gma as president–illegally and unsconstitutionnally.

    Now of course, he gets a big pay off for his act, no doubt a monumental case of quid pro quo.

    He’s a failed politician, a failed Chief Justice and a disgrace to the nation in his appointment as Philippine Ambassador to the UN.

  32. 2001, Jan.- Davide unconstitutionally or rather illegally sworn in the Great Switik to be acting president. I remember the supporters of this crook of a judge praising him in fact. I even almost quarreled with a fellow UP alumnus, a very good friend in fact, regarding the speech Davide made during the commencement exercise at UP that year with him praising himself for “a job well done.”

    2007, Jan – The gesture was returned with the unconstitutional and/or illegal appointment to the UN by Davide. This time, my friend and I share the same sentiment that Davide should be sent to jail with all those who co-plotted the removal of a duly elected president and have cheated on Filipinos ever since.

    Just a thought. What’s so significant about January? It seems that the Great Switik gets active in plotting all her acts against the Philippine Constitution, the Philippine nation and even the Filipinos in January as when she bragged about plotting the removal of Estrada “as early as January 2000,” her swearing in by Davide in January 2001 to coincide with the inauguration of the new US president to make it look that she had the blessing of America, and now, lo and behold, another slap on the Philippine Constitution, the inauguration of Davide as Philippine permanent representative to the UN!

    Filipinos in fact can protest against this appointment especially if the members of the Commission on Appointments will dare insist on their rights, duties and responsibilities to uphold the law regarding this appointment. They should start making noise now before Davide flies to New York.

    Another way to do this is to talk to some foreign journalists, who have written on the anomalies committed by Filipino diplomats in the UN. This can prove more potent in stopping crooks like Davide from sitting there at the UN unless of course the guy has a hide worst than a crocodile’s!

    Remember, Anna, the British journalist who exposed Siason when he was UNIDO chief in Vienna? Some New York-based foreign or even American journalist can do the same with Davide although such may prove to be very damaging to the already rotten image of the Philippines diplomacy-wise despite expensive propaganda to make the Great Switik look good! It’s a sacrifice worth trying to do for the sake of restoring the rule of law in the Philippines.

As ambassador to the United Nations, Davide would have the duty to ensure that Philippine interests are protected in all the international treaties that the organization is crafting and implementing. For that, he would get at least $30,000 ( P1.5 million) a month, representing $20,000 free housing plus some $10,000 in salary and allowances.

    And just as I was swearing to the top of my voice na halos pumutok ang litid ko sa leeg when I heard yesterday that the bitch has sworn in this waste of space named Davide, the curtains in the main hall of the Supreme Court, (Yes the FIFTEEN MILLION PESO-curtains!) caught fire, causing water damage to the whole place. Of course, the P200,000-apiece chairs for the justices were soaked, too.

    These items were part of the impeachment complaints filed by Congressmen Wimpy Fuentebella and John Michael Duavit which included among others, luxury cars, and 2 vacation homes for the justices which were purchased during this fake Chief Justice’s term.

    Was it a mere coincidence, or a naughty job to remind us of Davide’s sins?

Kahapon lang, yung meyor namin, si (pareng) Peewee Trinidad just as he was to re-assume his position after serving suspension (the suspension expires upon entering the election period) was barred by policemen, and together with his Vice and councilors, they were told that the Ombudsman has ordered their dismissal and also banned them as candidate for any elections. Rene Saguisag tried to intervene, calling for a dialogue, to no avail.

Tatakbong meyor si Dy sa Mayo kaya naman nagsampa umano ng bagong kaso ang mga barangay opisyal na ngayo’y empleyado ng City Hall laban sa grupong wala sanang katalo-talo sa susunod na eleksiyon.

    Wala na akong nakitang mas garapal pa dito. Sukdulan na pambababoy at paghamon sa katinuan ng mga tao ng Pasay. At sa buong bansa.

    Maari bang tanggalin ang mga opisyal ng Ombudsman lamang? Maari bang i-disqualify ng Ombudsman lang ang kandidato kahit di dumaan sa korte ang kaso? Bakit si Jalosjos na nakakulong, pwedeng tumakbo? Wala namang kasong graft si Peewee, bakit pwedeng i-suspend kahit election period na?
    Bakit yung konsehal na kasamang pumirma sa resolusyon, di nakasuhan, acting mayor pa? Ano ang soluyon sa ganitong hayagang pagbaluktot sa mga batas? Kaya pa bang masagot iyan ng hustisya sa Pilipinas?

    O ibasura na lang ang batas at sistema ng hustisya?

    Retired chief justice Davide should not accept the position of United Nations permanent ambassador for the sake of delicadeza. His appointment violated Foreign Service Act based on age limit. As an ex-Chief Justice, he should uphold the law not deliberately violates it for the reason of self-interest. Bayad-utang ni Gloria wala ng iba.

    One of the problems before us is that there is a devide of classes in the Philippines, don’t you see it! Whereas when you look around the world the class system is becoming out-moded. The only people holding on to their so called ‘class’ is the wealthy filipino. The phrase used by some ‘everyone is equal’ are only words, just words.
    Davide and his actions are an insult to the people in the Barrio’s and all filipino’s are better to understand that.

    Its time for them, the Foreign Service, to gain the respect of the International Community. If they don’t move to get that respect, then who is there to do it. Its the old age problem that they want someone else to correct it for them, but who!. The ball is in the Foreign Service Officers court and they need the guts to take action.

  70. Gloria is the typical SNOB just like her mother was – she’s always loved to be called a SNOB from an early age (Butch Tuason and a former best friend of hers confirmed that); until today, she looks down on people thinking they are of the lower caste.

    Uttering “Yuck” (utterly devoid of civility) when she met Ellen at the taping of a show was symptomatic of a real SNOB (sine nobilitate, sans noblesse, without nobility).

    What she doesn’t realize is that by being so, people who matter and who know particularly from here, laugh at her in silence – they may not say it to her face but the thinking is there.

    Gloria Mandaraya’s sense of values are totally warped. No wonder, she didn’t think it out of character to talk about Enchanted Kingdom. What a snob!

    He is a complex charlatan, he is thoroughly sophisticated in the ways of violating the Constitution, he is absolutely impure as in absolutely corrupt and worst, he is not only mentally dishonest, he is also a crook of the highest order.

    Nothing barrio-class mind there in the real sense of barrio-class minded folks, “simple, unsophisticated, pure and honest.”

    Wonder what Dean’s definition is of “barrio-class mind.”

    Forgiveness is a Christian virtue. But forgiveness should come with justice. Such familiar statement was often used by Cory Aquino against the late dictator Marcos. Hence, much more it should be applied to this Arroyo who did much worse than Marcos. Too bad Bing Rodrigo’s soul is not totally resting in peace. Tatahimik lang ang kanyang kaluluwa kung tuluyan nang mapatalsik si Arroyo. If we all want Bing’s soul to have everlasting peace, let’s hasten the removal of this Arroyo.

    Sana sinabi ni Bing ang lahat ng alam niya tungkol sa Telecom scam at katotohanan bago siya namatay. I remember her retracting her statement after that scandal during the early years of Arroyo’s presidency. Hindi na kasi tinuloy ni Bing at tumahimik na lang. Kaya ayon, nawala na lang parang bula ang kaso ni Mike Arroyo. Ang masama pa, akala ng iba may aregluhan nangyari. I must admit I was among those who thought she reached a compromise with the Arroyos so she became quiet. Again, she should have revealed everything she knew before she died. Pero ganoon pa man, igalang na lang natin ang decision niya.

Kaunting respeto lang kahit na hindi kanais-nais ang opinion. Okay ba? Of course Ms. Rodrigo could have confided the truth to her loved ones and those close to her. But, the better venue would have been testifying in the court when she was still healthy and strong. It’s an undeniable fact that she was silent all of a sudden.     I learned of Bing Rodrigo’s death from her fellow Assumptionista. She died broken hearted and much maligned by the Great Switik. If you come from a decent family like her, the kind of treatment she got after exposing the bogus couple could really prove fatal. Iyan ang tunay na may delikadeza!
