The discussions in the previous post on this question of how the next president would handle Gloria Arroyo have been vibrant. However, I noticed that some quoted just a part of the answers which could be misleading.
For my column for Abante I got all the answers of the four presidential aspirants: Senators Manny Villar, Benigno Aquino III, Francis Escudero and Defense Secretary Gilbert Teodoro.
Although Che-Che Lazaro didn’t ask exactly the same questions to all the interviewees, more or less, you have an idea of their stand or lack of stand.

Q: Speaking about the Office of the President, how would you handle GMA?
A: Well, again, sa akin, sinasabi ko kanina, na yan ay trabaho ng judiciary. Kung may magpa-file sa kanya ng charges, she will have to defend herself sa mga charges na yun, sa judiciary natin. Hindi tama na ang pangulo na ang makikialam dyan. Sa judiciary natin.
Q: Would you pardon her? Just in case, she’s convicted ha?
A: Hindi, mahirap naman sagutin mo kaagad yan. Dapat alam mo yung mga circumstances din naman kung mako-convict nga siya o hindi.
Defense Secretary Gilbert Teodoro:
Q: So, if GMA, if cases are filed against her, and you are president, what will you do?
A: You’re not supposed to do anything because there are institutions that are supposed to do that.
Senator Francis Escudero:
Q: Kung masintensyahan si GMA, will you consider pardon? Presidential pardon?
A: Sa ngayon, hindi. At kung saka-sakali man, hayaan nating taong bayan ang magdesisyon kaugnay sa sensitibong bagay na ito. Hindi kahinaan ang pagtanong sa sambayanan ng opinyon nila, partikular sa mga sensitibong bagay na maaaring pagmulan ng kaguluhan. Kabilang na, katulad ng nabanggit ko, ang cha-cha. Kadalasan, ang nagiging problema natin, nagmamarunong ang mga opisyal. Inaangkin nila lahat ng talento, galing at dunong kaugnay sa pagpapasya. A: “First of all, I want closure dun sa many issues and she seems to be either directly, peripherally involved in some of these. Having said that, my father did teach me rather that democracy’s test is your ability to defend the rights of your enemies, especially, not just of your friends. Yung paniwala niya, pag pumayag kang may maapi yung isang grupo, eventually lahat ng grupo aapihin. Yung grupo ng lipunan, ano? So kung ayaw mong ikaw na lang ang natitirang aapihin, ay siguraduhin mo sa umpisa pa lang pinagtanggol mo na yung karapatan mo. So, in our system, innocent until proven guilty. I will ensure that she gets all of her rights–people around her, etc, members of this current administration. At the end of the day, I want closure. Yung pasensyahan na lang kung san umabot.”

Walang magagawa dahil nakaupo pa si Merceditas, and she has to finish her term. Yung mga magigiting kuno, like Salonga, went to the House, kahit alam nilang matatalo. Kumuha ka na lang sana ng bato para ipalo sa ulo mo.
I keep repeating, simple lang yan. If Merceditas loses her license, she ceases to be the Ombudsman, because the Ombudsman must be a lawyer. So i-demanda ng disbarment. People have been disbarred for less.
This what a good President should have answered to the Question of what to do with GMA and her administration..
1. As the New President, and to remake the country or to mould the country into one that will be considered among the Nations where Justice and Equality are the prime principles of its foundation…To Call an Independent Judicial Inquiry to Investigate all the Allegation of Criminality and Abuse of Power during the 10 years of her tenure and if evidence warrants to bring all implicated to Courts and Prosecuted in accordance with Due Process and Punished accordingly, including forfeiture of assets acquired by Criminal means.
2. That a New and Comprehensive Law be immediately drafted and that will deal with all the issues in the past in regards to the Culture of Impunity among the Officials In Power and its circles and to Reform the Judiciary.
These Two will be a Good Start.

I was just thinking, maybe those people in the opposition doesn’t really want Merci out as Ombudsman. Why? Because they might need her “services” sooner or later, they know she can be bought or can compromise. There are so many ways to skin a cat and these so called bright lawyers / legislators couldn’t even think of any other than to try and impeach her. Which is next to impossible.
The Integrated Bar of the Philippines (IBP) should discipline its erring members like Ombudsman Gutierrez. Selective persecution or justice is the norm of the Office of the Ombudsman. The Arroyo government spared its political allies and cronies from justice while prosecuting small fry.

Calling an independent judicial inquiry to investigate all the allegations of criminality, abuse of power, committed by Gloria and her people, etc…This is included in presidential prerogatives.
And that is exactly what I’d like to hear from our presidential wannabes.
It is easy to hind under the cloak of walang pakialam sa ganito ganyan ang executive powers, eg., “Hindi puwedeng makialam sa judiciary,”, “Pasensyahan na lang” — punyeta — hindi naman sila sinasabihang makialam sa judiciary. What we want is for them to outline ang kanilang punyetang policy of what to do with Gloria stemming from allegations of corruption, election cheating, etc.

Villar’s answers are punyetang non-answers. Sa kaganidan at pag insert ng funds sa budget — kaya ng punyetang iyan na maging matapang.
Nakalusot ang putan…..Teodoro dahil ang tanong sa kanya ay leading question. Tama lang si Teodoro, what can a president do when cases have already been filed. The question was a non-question, completely irrelevant.
Escudero’s answer is judicious but not necessarily showing of backbone.

Sa tanong na kung anong gagawin kay GMA, kung sa forum, blogs, opinion polls, tv shows at iba pa, para sa mga galit kay GMA dapat parusahan ang isasagot.
Pero kung politiko ang tatanungin tulad ng 4 na gustong tumakbo bilang pangulo, maninimbang sila kung ano ang dapat isasagot. Importanteng hindi vindictive ang dating nila at hindi naman napakalambot. Marahil si Erap lang ang makakapagsabi na ipapakulong at walang pardon kay GMA at mahina ang utak niya.
Kung may sasagot sa kanila na kulong at walang pardon, magbubunyi sa internet, sa kampanya at kung saan pa na kinabibilangan ng mga galit kay GMA. Pero hindi naman sila ang kabuuan ng boboto. May mga boboto din na wala nang pakialam kay GMA sa Mayo at para sa kanila ang bagong presidente ay para sa kinabukasan nila at hindi sa nakaraang pangulo.
Yung pagpapakulong, hindi trabaho ng pangulo. Sa pardon ng pangulo, maraming considerations para sa isang pangulo bago magbigay ng pardon kaya mahirap sa kanila na sa ngayon makakapag sabi na kaagad kung mag bibigay ng pardon o hindi.
Sa tingin ko, kahit sino ang mananalo, bibigyan ng pardon si GMA kung sakaling maconvict sya.

Tactically, the presidential wannabes would have been lusot. There’s absolutely nothing confrontational or pakialam in that answer; it merely shows true grit! It’s tactically viable, it’s doable and it’s clear…
An answer along the lines of “formation of an independent body to investigate” (just like what is done anywhere else in the world) was tactically viable vis-a-vis the electorate, would have shown balls and goddamn determination to, at the very least, do something so that this country could move a bit forward even at a snail pace.
There is nothing in that fomulation that warrants non-application of due process of law. On the contrary, it would show the world that the Philippines which has always been barbarian in its approach to things politics have the men and women prepared to face head on the problem of corruption or allegations of corruptions at the highest. level

Kaya nga I posted in another thread about it eh, anong dapat na sagot nila when asked if they will pardon Gloria once convicted? A simple NO answer would’ve suffice. Ang dami pang explanation and at the end of their answer, nothing clear or concrete. Malabnaw ang mga sagot nila.
Bakit hindi ininterview ang aking manok na si Erap na nag-declare naman na? Bakit si Chiz hindi pa nagde-declare ininterview na? Ano ang tawag sa ganyan? Nagtatanong lang po ako!!!!

Maybe the question was asked because of what Gloria did, she pardoned Erap. Nagkaroon na ng some sort of “precedent”. Kaya parang ang tanong ikaw (they) din ba bibigyan mo ng pardon si gloria pag na-convict?

The interviewer had at that very moment, and absolutely great privilege of probing the character of the candidates, of “titilating” the minds of those presidential wannabes but blew it big time!
Lazaro’s question to Teodoro was absolutely non-sensical. It allowed Teodoro to answer THE ONLY answer that was judicious and absolutely right reply. In the end, the interviewer bogged down and enabled the candidate to have A+!

Anna, It’s has been a pleasure learning the abc of politics living in this country for soo long..just for example, last election, the Conservative Party (which I proudly belong for a long time) promised to overhaul the country’s Accountability Law to avoid the repeat of the sponsorship scandal in answer to the Public outcry…and that was the very First agenda of the Party once elected to Lead..the overhaul of the Accountability Act. with more than 200 amendments including abolishing political contributions from businesses and Labour union..now the source of political campaign funds will only come from the citizens with equal limits to all and no one can give anyone monies to contribute for himself. And even lobbying was prohibited, until further notice…it take guts for Conservative Party to abolish contribution from businesses as it is the Biggest source for the Conservatives funding, but Payback in kind is always expected, and that is not in the best interest of the Whole.
Pardon so Far, can only be granted by the Queen and so Far, she does Not grant it so often except under extra-ordinary Circumstances..you do the crime, you do the Time…that is the Rule.

It never even occurred to me to ask about the question of pardon, not because I’m vindictive but simply because I find that we have to focus first and foremost on obtaining clarity of position first from the candidates, eg., what will they do about this incessant question on allegations of corruptiosn and abuse committed by the Arroyo admin?
Unless their position is clear, a pardon, or non pardon is irrelevant, particularly during election time.

I think na tanong na sa minamanok mo yang tungkol sa pardon. Ang naalala kong sagot niya ay malamang bibigyan nya rin sya ng pardon kasi daw matagal na niya pinatawad ang mga nagkasala sa kanya. Re: Form an independent body to investigate
The bottom line is that an independent body can only submit to the Office of Ombudsman its findings. Then it will review documents and evidences before it will file a case to the Sandiganbayan. Ombudsman and Sandiganbayan justices are Arroyo’s appointees. Unless, a special court is created purposely to try Gloria Arroyo and her cohorts for their crimes against the Filipino people.
It doesn’t matter Diego — what we want is clarity of position from the candidates.
The fact that they would be willing to form an independent body to investigate would show clarity of position. At the same time, it would have been tactical vis-a-vis the electorate, because it would free the candidate from appearing vindictive, because the creation of such body would be predicated on the rule of law but most of all, it would show the character of the candidate, i.e., prepared to tackle the issue head on.
We have to start some place, we simply mustn’t cave in or give up just because we believe things would be “lutong macao”.
Corruption is a killer, abuse of power is criminal… the future president of the republic must tackle these issue head on.
Diego, I stated, a Judicial Inquiry, and the New President as per Executive Prerogative can give that Inquiry special Power, like power to Subpoena and cite party of interest for Contempts and Contradiction and Perjury with Heavy Penalties, power to issue Search warrant and Arrest and it is doable and even Congress can have that Power and it is within the the President constitutional power. I also say it is a good start..the second suggestion I have is to immediately reform the Judiciary that will handle the Cases arising from the Inquiry.
Among the four presidential wannabes, no one has definite action plan what to do with Gloria. It seems they have a neutral stand or gray line on the issue. The rule of law shall go its course not pressured by general public or special interest group consensus. Anyways, the next president of the republic is not campaigning for the re-election.

I am not for Gibo, but he is right in saying it is not his duty to prosecute Gloria. And conveniently so with that arrogant flare of sureness. He knows it is the duty of the Ombudsman (whose own impeachment initiative had been dropped like hot potatoes for “lack of substance” to file the cases against gloria and her minions. But as we all know that Mercy is the marjorette ass-licker of gloria and her band of thieving cabal, filing any case against Gloria is totally un-heard of.

So we have the independent judicial inquiry and after the findings go to court but and that is a big BUT, as long as Gutierez is in there, lusot pa rin si Gloria. The case will not be tried by the international court of justice where justices are independent. It will be under the Sandiganbayan jurisdiction.
The crimes of Gloria are well known and documented and anybody who has that evidence can go direct to court and file a case. The only real problem is Merciditas Malditas whose office is the prosecutor. Get rid of her and half of the problem is solved. She is a constitutional officer but as they say there are several ways to skin a cat.
Setting up an independent judicial inquiry will take a very long process. It’s almost the same as going into a court case hearing both sides. Going into the actual court cases will take longer with delays and postponements that will add more to another long process. And add to that the drafting of comprehensive or judicial reform. As if we don’t know how Philippine congress works that maybe some of us will not live that long to see the light.
Going direct to court is a short cut way to the problem of Gloria. Take the case of Erap. Gloria set up a special court to try him instead of an independent inquiry. Even to that it took more than six years before a decision. How much more if we go through a judicial inquiry commission.
An independent Ombudsman and justices will do the trick. Merciditas and company will be well-advised to resign, impeach them or anything as long as they are not there. Doors are there for a reason and we want to see justice done and it must not only been done, but it must be seen to be done in a transparent and fair process.
Would we be able to find untainted members of the Independent Judicial Body? The ten year illegal stay of the boobuwit in the palace corrupted virtually all our institutions.
Another ally just got picked to the Supreme Court. Except for one more appointee, our Supreme Court will soon be an Arroyo Supreme Court!
While the Chedeng is in her high chair, expect no conviction for the boobuwit and her cronies. Mabilis pa sa alas cuatro na may magfile ng mga criminal offences against these hoodlums after they step down from power (kung sakali mang matalo sila) tapos action agad si Chedeng at sasabihin niyang walang basehan ang mga allegations. Dismiss niya kaagad and mga cases. No one can be tried for the same offense kaya libreng libre na si boobuwit at ng mga aso niya!
Dalawang motorcycle bandits lang ang kailangan at tapos na ang problema! Pretty much like the Vice Mayor and his wife who were gunned down lately. Although the interviews are helpful in a way to help us know the candidates, I find CheChe Lazaro’s interviews lame even boring especially the on Noynoy Aquino.
Since it’s profiles, she should have watched and learned from Oprah and Christiane Amanpour.
Cheche is sensible and articulate but her lack of a good grasp in politics showed in these interviews. Sayang.

The easiest question in the interview went to Noynoy, yet even in his answer to a simple question he has to depend from his late father which makes me wonder how he will react and answer if he was asked about granting a presidential pardon to Gloria.
All she asked: “Si GMA kakasuhan mo ba?”

I remember before this Dud Dato got elected. The bicolanos were so passionate of dumping his ass to the gutter. They’re shouting “Bicol is for Bicolanos”, No Kapampangan will rule us! The effect of “one can of cornbeef and a kilo of rice” must have worked it’s magic again! And no doubt that’s the danger of the national elections comes May 2010, easily manipulated and twisted voters.
I have lingering doubts about having a special tribunal to hear what has become inevitable. Parang shades of the Erap experience all over again. Remember his complaint? That Gloria created a special court to convict him. If I were the candidate, I would be very careful in my comments about this and rightly so. Campaign promises have a morbid way of coming back to haunt u later. Again, remember Erap’s campaign promise to have Marcos buried in the Libingan? He reaped the whirlwind and had to backtrack.
