Update: Concerned Citizens Movement to appeal Ombudsman’s ‘fatally flawed’ decision clearing GMA
The Concerned Citizens Movement, whose members stood as complainants in the only complaint that included Mrs. Gloria Miguel Arroyo as respondent for violations of the Anti-Graft and Corrupt Practices Act in connection with the NBN-ZTE deal , will appeal the recent decision of the Ombudsman to charge only Chairman Abalos and Chairman Abalos with violations of the anti-graft and corrupt practices act before the Sandiganbayan, which they described as “fatally flawed”.
“This a decision that sanctions impunity. Why should only two co-conspirators be charged when the facts are very clear that the Spouses Miguel and Gloria Arroyo were co-conspirators to the criminal acts committed in the botched NBN-ZTE deal? In a conspiracy, the act of one is the act of all”, Roque who is both a complainant and counsel declared.
The CCM also challenged anew the correctness of the Ombudsman stance that the President is both immune from investigation and from suits. According to the group, the principle of presidential immunity has been revised since it was first applied in Philippine jurisprudence.
Roque explained: “Presidential immunity finds no demonstrable textual commitment in the letters of our Constitution. It was merely a result of jurisprudence intended to improve the administration of public administration. The assumption is that without the said immunity, the President may run out of time to govern since all her time will be devoted to defending herself in court. Since the concept was first applied in our jurisprudence as early as 1910 in the case of Forbes vs. Chuoco Tiaco, it has since been revised by the our own Philippine Supreme Court, citing the US case of Clinton v. Jones. Today, the prevailing view as held in the case of Estrada v. Desierto, is that immunity should only be for official acts: “It will be anomalous to hold that immunity is an inoculation from liability for unlawful acts and omissions. The rule is that unlawful acts of public officials are not acts of the state and the officer who acts illegally is not acting as such but stands on the same footing as any other trespasser. Indeed, a critical reading of current literature on executive immunity will reveal a judicial disinclination to expand the privilege especially when it impedes the search for truth and impairs the vindication of a right”(Estrada vs. Desierto, (353 SCRA 452).
Construing this decision of the Ombudsman with the decision of the Supreme Court in Neri vs. Blue Ribbon Committee which upheld Neri’s invocation of privilege in refusing to answer questions that would clearly show the President’s culpability, Roque said that this latest Ombudsman decision, if unchallenged, will result in presidential Impunity and a license for all Presidents to commit any and all criminal acts such as other acts of graft and corruption and even killings, torture and enforced disappearances.
Aside from Roque, other CCM members who stood as complainants are: Josefina Lichauco, Consuelo Paz, Renato Constantino jr., Guillermo Cunanan, Roel Garcia, Bebu Bulchand, Perla Bandiola, and Maria Flor Querubin.
CCM members were also joined in the said Petition by Former Vice-President Teofisto Guingona, and representatives from Bayan Muna, Gabriela, ACT, Kilusan Mayo Uno , Courage and Bayan.

The Office of the Ombudsman has dropped graft charges against President Gloria Macapagal-Arroyo and her husband in connection with the scuttled $329-million NBN-ZTE deal, but recommended the prosecution of former election chief Benjamin Abalos and ex-Socioeconomic Planning Secretary Romulo Neri.
In a 144-page decision, the office cleared Ms Arroyo of charges that she violated the anti-graft law for refusing to punish violators of the act and for obstructing the apprehension and prosecution of criminal offenders.
The ruling said Ms Arroyo was immune from suit and cited decided cases to explain that a sitting President could not be criminally charged and was entitled to protection when her authority was being questioned in court.
As for First Gentleman Jose Miguel “Mike” Arroyo, who was likewise charged with violation of the anti-graft law for allegedly brokering the National Broadband Network (NBN) deal with China’s ZTE Corp. to wire the nation’s bureaucracy digitally, the ruling said there was no evidence against him.
“The panel has not been presented with convincing and solid evidence directly or indirectly linking respondent (Mike Arroyo) in the project. Suffice it to state that only surmises and conjectures have been presented … To be certain, these presumptions cannot be given any weight,” it said.
Also absolved of liability were Pangasinan Rep. Jose de Venecia Jr., Department of Transportation and Communication Secretary Leandro Mendoza, DOTC Undersecretaries Lorenzo Formoso and Elmer Soneja, and ZTE officials Yu Yong, George Zhuying, Fan Yan and Hou Weigui.
Abalos was ordered charged with violation of the anti-graft law for taking interest and intervening in a contract “completely alien to his duties,” as shown by his bribe offer of P200 million to Neri and the $10-million offer to Joey de Venecia, namesake son of the former House Speaker and a losing bidder in the NBN project. Also cited was his instruction to Rodolfo Lozada Jr., Neri’s consultant in the deal, to protect their “130”—obviously a hefty commission.
Without scintilla of doubt
“It is without a scintilla of doubt that the actions of respondent Benjamin Abalos, a former chairman of the Commission on Elections, are highly suspect, reprehensible and should in no manner or measure be countenanced by those in public service,” the resolution said.
“The most glaring of all, a question that Abalos continues to keep mum about, are the reasons for his inordinate and extensive interest in a project that is completely alien to his duties and functions as chairman of the Commission on Elections,” it added.
It further said that Abalos’ presence in a conference in China with ZTE officials “speaks volumes into Abalos’ conduct as a peddler of undue patronage.”
On the other hand, the ruling said Neri, now head of the Social Security System, is to be charged with conferring with Abalos on the project although Abalos was not supposed to have any role in it, and for meeting with ZTE officials when the NBN project was under assessment.
As the then chief of the National Economic Development Authority (NEDA), Neri should have been more prudent in his actions since the agency was then evaluating the NBN deal, it said.
Golfing with ZTE
“On the contrary, Neri acquiesced in attending lunch meetings, conferences and golf games not only with Abalos but with ZTE officials as well. His actions speak more than a thousand. The chain of circumstantial evidence linking Neri to the deal between Abalos and ZTE officials cannot be broken,” the ruling said.
“This panel cannot close its eyes to the conduct or misconduct, to be precise, of Neri, as Director General of the NEDA, in charting his course of actions leading to the approval of the NBN,” it said.
In a phone interview, Abalos expressed surprise at the ruling.
“I’ve been charged with corruption of public official based on the testimony of Neri in the Senate,” Abalos said. He recalled Neri’s testimony that while playing golf, Abalos had said that “may 200 siya dito (there’s 200 for him here).”
“I don’t know what that 200 means. He assumed that it was P200 million,” Abalos said. “From mere assumption and mere guessing, you’re charging me of corruption? I’m not disturbed by this development. I will file a motion for reconsideration.”
Neri, reached by the Inquirer in Hong Kong, said that “when I played golf with Abalos, I had no idea what would be discussed.”
He said he could not remember playing golf with ZTE officials and that his meeting with them was in the presence of Chinese embassy officials.
Gutierrez inhibited herself
The resolution was dated April 21 and approved Aug. 27 by Overall Deputy Ombudsman Orlando Casimiro, and signed by Deputy Ombudsman for the Military Emilio Gonzalez III, Assistant Ombudsman Rodolf Elman, Deputy Special Prosecutors Jesus Micael and Robert Kallos and Director Caesar Asuncion.
A note at the end of the ruling, released last night, stated that Ombudsman Merceditas Gutierrez inhibited herself from the case.
The release of the decision came in the midst of an impeachment complaint against Gutierrez, a law school classmate of Mike Arroyo, for allegedly sitting on major corruption scandals besetting the Arroyo administration.
The ruling stemmed from the separate complaints filed two years ago by Akbayan Rep. Risa Hontiveros, Bukidnon Rep. Teofisto Guingona, lawyer Harry Roque, Emmanuel Villanueva, Dominga Padilla, Roel Garcia, Bebu Belchand, Fr. Jose Dizon, Oliver Lozano, Ernesto Francisco, Carlos Padilla and Roberto Pulido.
It was mailed to the office of Hontiveros and arrived at 5 p.m.
‘Fall guys’
While Hontiveros expressed satisfaction with most of the Ombudsman’s decision, she said she was suspicious of the timing of the release of the findings, coming as it is amid the impeachment hearings against Gutierrez and on the eve of an election year.
But Hontiveros said this would not weaken the impeachment complaint, since Gutierrez was still liable considering that her office had sat on the case for two years. There were also other charges in the complaint.
She also believes Gutierrez was pressured to release the findings since the NBN deal could be used as an election issue, and that Abalos and Neri were made the “fall guys” despite their apparent vow of silence.
“It’s not enough that there are fall guys. The highest persons responsible should be charged,” she said.
Hontiveros also vowed to monitor the progress of the case, since she had heard rumors that Malacañang wanted to hold the release of the findings. She also pointed out that Gutierrez had filed defective charges before, which led to the dismissal of the case. With a report from Kristine Alave

Good suggestion. There is one kink, however. The Ombudsman has a term of office (seven years). Merceditas was appointed in 2005, so has until 2012.

2. Most, if not all his cabinets during his stint, walked out on him, yet he had the brazeness to lay fault on them.
3. Signing a few RA’s and EO’s does not make you a good president. He signed RA 8747 knowing it’s a hoax, it’s akin to legislating the stoppage of huweteng, where most of his money comes from in the first place.
4. Why on earth would a VP gamble? To flaunt your newly acquired power?
5. Whatever happened to the casino worker who took a video of Erap gambling?
6. No comment on his womanizing but how he did them equates again to flauntiness.
7. You rarely see him visit the poor of Ilocos Region, the Cordilleras, the Bicol Region, Visayas, and Mindanao to show his empathy. It’s always his same rhetorics: Basta si Erap, para sa mahihirap!!! This is what I mean about the poor millions of our motherland: hibang! It’s a negative form of inspiration.
The poor masses is a voting bloc. Until they come out from their darkness hours and view their lowest of the low form of livelihood; that none had changed for decades, they should cohesively vote for someone other than Erap.
