“Come hell or high water, Gloria arroyo cannot be caretaker president when her term ends noon of June 30, 2010,” sabi ni Lacierda sa programang “Strictly Politics” ni Pia Hontiveros sa ANC kung saan pinag-usapan ang kinatatakutan na failure of elections sa May 10, 2010.
Dati kasi pinapalutang ni National Security Adviser Norberto Gonzales ang ideya na “caretaker” president daw si Arroyo hanggang magkaroon ng bagong president? Hindi na nakuntento sa siyam na taon sa Malacañang, ang pinakamahaba na pag-upo ng isang presidente na hindi naman binoto ng taumbayan (maliban kay Ferdinand Marcos).
At paano naman magkaroon ng sitwasyon na kailangan ang “caretaker president”?
Marami ang nagbabala sa isang sitwasyon na hindi aandar ang mga makina ng Comelec. Ito kasi ang ang kauna-unahang election na computer na ang magbibilang ng boto.
Ang Youth Vote Philippines naman na nire-representa ni Maxine Tanya Hamada ay nag-alala baka pumalpak ang telecommunication companies katulad ng PLDT, Smart at Globe na siyang magpapadala ng resulta ng eleksyon.
Sinabi ni James Jimenez, spokesman ng Comelec na imposible ang failure of elections dahil hindi naman maaring masira lahat ang 80,000 na makina nila sa buong bansa. Kung may masira man, meron silang nakahanda na 1,200 na reserbang makina na sa loob ng dalawa hanggang apat na oras ay madala sa kung saan ang may problemang presinto.
Sabi ni Jimenez, isang libong botante ang nakalista sa bawat presinto at kumpyansa silang magiging maayos ang pagboto sa loob ng 12 oras, mula 7 ng umaga hanggang 7 ng hapon.
Mga 300 na pangalan ang nakalista sa balota kung saan kukulayan lang ng botante ang bilog sa tabi ng pangalan ng gusto niyang kandidatato. Sinubukan na raw nila ito ay mga lima hanggang 10 minuto lang, tapos na ang pagboto.
Kung magkakaproblema talaga sa computerized counting, pwede namang bilangin ng mano-mano ang mga boto katulad ng dati, sabit niya. Kaya imposible talaga ang failure of eleksyon, sabi niya.
Ngunit kung mangyari man yun, tatawag ng special elections. Pagdating Hunyo 30 na wala pang bagong presidente, sabi ni Lacierda klaro ang Constitution na ang magiging acting president ay ang Senate President. Kung hindi pwede and Senate president, ang Speaker of the House. Kung hindi pa rin pwede itong dalawang opisyal, magkaroon ng session ang Congress at pipili sila ng acting president na siyang mamahala ng bayan hanggang magkaroon ng bagong presidente na binoto ng taumbayan.
Ellen, di pwede ang proven na bantay-salakay na maging caretaker ng bansa. Ayaw lang mawalan ng trabaho ni Norberto Gonzalez. Tsaka sino ang magtitiwala sa isang presidente na may kumpletong hukbo ng kawatan? Maglubay sila!
Nang mapanood ko ang interview ni Arnold Clavio ng Unang hirit kay comelec chairman Melo ay tinanong niya ito kung ang mga voting machines ng Smartmatic ba ay rerentahan o bibilhin? Nagulat ako sa sagot ni Melo: Hindi pa raw napagpapasyahan ito (?!). Huh? Tapos na ang bidding pero hindi alam kung renta o bili ang mga mga makina/computers?

Mr. Melo hindi ka dapat pang magtagal sa puwestong iyan dahil sa mga pinagsasabi mo. Hind ka dapat igalang pa. Kaylanman ang COMELEC ay hindi mo pag-aari. Niluklok ka lang diyan ng Dimonyita mong amo. Pera ng hirap na bayan ang involve dito so dapat ipaliwanag mo ang lahat ng detalye ng proseso. Dapat lahat ay LEGAL at TRANSPARENT. Huwag mong daanin sa ‘technicalities’. Ikaw ang sisishin ng lahat kapag nagkaroon ng problema sa eleksiyon 2010. O baka naman KASAMA ito sa plano mo at ng Amo mo?

Failure of election nga. Ang Senate president at House Speaker ay matatapos ang termino kasabay ng Pangulo sa katanghalian ng ika-30 ng Hunyo, 2010. Dahil sa “failure of election” wala ding halal na mga bagong Congressman at mga Senador(maliban doon sa 12 na hanggang 2013 pa ang termino). Ang Constitutional provision na tinutukoy ni Atty. Lacierda ay para lamang sa isang pangyayari na merong “electoral protest” pero hindi sa “failure of election”.

The most that can vote with 80,000 machines from 7 am to 7 pm is only 11.5 million out of 40 million voters if it will take a voter 5 minutes to fill his ballot. According to Comelec, it will take a voter 5 to 10 minutes to complete his ballot.

But not all will vote, historically about 85% only.
(500 voters per precinct/10 simultaneously) x 85% voter turnout x (10 mins/voter)= 425 mins. per precinct = 7.083 hrs per precinct
At 12 hrs from 7am to 7pm, they still have 5 hours to mobilize the flying voters, the dead, the turtles and the birds to vote for the admin candidate.
That computation is good only in the ideal situation and accounts only for the time of filling the ballot. The problem begins when long lines are formed in the counting machine. If it will take only one minute to line up and insert the ballot, fine. But for every minute added to the average, ,b>additional 7 hrs will have to be extended!
Even in hell, they would not have time to feel the heat. They’d be so busy shaking hands with their friends.

I don’t recall reading anything about any poll-watch body who will be allowed (if they can) to monitor the data flow and connection from the voting machines to its assigned servers.

Thank you all. What a relief! Now I see that there’s really no cause for alarm. What would really matter is not the time needed to fill up each ballot nor the length of the lines. We only have to consider the time alloted for inserting the ballots. For this, an average of less than a minute per ballot is most likely. Time to look for other problematic areas.

Compare this to betting on lotto. During long queues for the big jackpot draws, one fills out his ticket for only 6 combinations maximum and falls in line and pays, all for about 15-20 mins.
In elections, you also have wait for the BEI inspector to locate your name on the registry, list your ballot number, then you sign the list and thumbmark it and he applies indelible ink on your finger. You fill out the ballot for 28 positions max, and again fall in queue at the machine. The 10-12 mins Comelec estimate may not be conservative enough.
Note that for many voters who have no similar experience with the shading type of ballot, the Election inspector will have to explain what has to be done and it may take time.

There is also a problem if the voter shades out the wrong space and would want to change his vote, it cannot be done. And shading out two spaces, nullifies the vote for the particular item. Again, the inspector will be engaged in discussion with the voter.
Not counting the possibility of brownout and machine breakdown. The machine may come with independent power source such as UPS, but how do you fill out your ballot in the dark? Will the Comelec provide emergency lights, too?
