The four-month old Philippine baseline law got its first test last Friday and it failed miserably and embarrassingly.
Last Friday, CNN reported a Chinese submarine collided with an underwater sonar array towed by the destroyer USS John S. McCain off the Philippines.
Other wire reports from Washington D.C. described the location as “off Subic Bay” in Zambales. Chinese media said the encounter was near Scarborough Shoal.
The Philippine government version of the location of the high seas collision, given two days after the incident, was closer to that of China. Defense Assistant Secretary Alberto Valenzuela said “it was 125 nautical miles off Subic, near the Scarborough Shoal, which is 123 nautical miles from Subic.”
Under the baseline law, Scarborough shoal is part of Philippine territory classified as a “regime of islands.” Inclusion of the shoal in Philippine territory was protested by China which also claims the shoal as well as the whole of South China Sea.
From the three versions of the location of the collision, it can be concluded that it is in Philippine territory. It can be likened to two quarreling bullies bringing their fight into the front yard a third party, which, in this case, is the Philippines.
What did the Philippines do after seeing the two intruders fighting in its front yard? Press Secretary Cerge Remonde, who showed his ignorance of the baseline law, said the “the two ships were outside Philippine waters.”
Someone please give Remonde a copy of the baseline law and the UNCLOS (United Nations Commission on the Law of the Sea) treaty which the Philippines signed. Underline please the part where maritime regimes or zones are defined: territorial sea (12 nautical miles from the baseline), contiguous zone (24 nm), economic exclusive zone (200 nm), continental shelf (200 nm) and extended continental shelf (350 nm).
Don’t forget to give Remonde a copy of the Philippine Constitution and bookmark Article I, “The National Territory” which says. “The national territory comprises the Philippine archipelago, with all the islands and waters embraced therein, and all other territories over which the Philippines the Philippines has sovereignty or jurisdiction, consisting of its terrestrial, fluvial and aerial domains, including its territorial sea, the seabed, the subsoil, the insular shelves, and other submarine areas. The waters around, between, and connecting the islands of the archipelago, regardless of their breadth and dimensions, form part of the internal waters of the Philippines.”
Valenzuela said there’s nothing to be concerned about because the incident occurred inside the country’s 200-mile exclusive economic zone but outside the country’s 12 nautical mile territorial waters. “Our concern is that we must be sure that no foreign vessels enter our territorial waters without authority. We cannot prohibit them from passing through (in economic zones),” he said.
Valenzuela is not quite accurate because since the new baseline law classifies Scarborough Shoal as regime of islands, it generates its own territorial and contiguous zones. That means 12 nautical miles from the shoal is still Philippine territorial waters.
By Valenzuela’s description that the incident happened “125 nautical miles off Subic, near the Scarborough Shoal, which is 123 nautical miles from Subic” proves that it was inside Philippine territorial waters which he himself said we should have jurisdiction over any ship in that area.
Harry Roque of Center Law Philippines, asks, “What were the Chinese submarine and the American destroyer doing in our waters in the first place?”
The first statement from Philippine Navy spokesman Edgard Arevalo said there was no request for the US for its warship to enter into Philippine waters and that there was no RP-US military exercise that would justify its presence there.
Valenzuela, on the other hand said the US ship actually came from an exercise between US and the Philippines and passed by Subic to refuel and for other logistics needs before sailing out of Philippine territorial waters.
It is understandable for Philippine officials to downplay the incident because what can they do? Protest the intrusion of the US and China?
One of the four attributes of a state is sovereignty (others are people, territory and government), the supreme right of the state to command obedience within the state.
The incident showed the sad reality that we cannot command obedience from intruders in our own territory. Without sovereignty, there is no state. What are we then?

Sen. Trillanes’ version should have been adopted in full, meaning Scarborough would have been included in the baseline, then the incident is clearly within territorial waters of RP, happening only 2 n.mi. away from the baseline.

What for do we need to define the limits of our territory? So that foreigners outside will not enter our territory? What for do we need a defense system? So that we can defend ourselves against foreign invasion? So that we can defend our sovereignty and integrity?
Then how do we define the Americans training in tropical environment warfare in Luzon and in Mindanao? How do we define the actions of the Americans in familiarizing with operational requirements of warfare in an area as the Philippines which is strategically valuable to them? How do we define their actions of having a military base inside our military base in Zamboanga not even our soldiers can enter without their clearance? What were we able to do through out history with the killings of our Filipinos in Central Luzon and in Basilan who happened to stand in their way in their claimed operational area which have been deep inside our territory? What were we able to do with American rape cases against our Filipinas?
In the 1930s and beyond, we tried to control the entry of the Chinese in our country, and tried to arrest their advance towards our economic bases. We never succeeded because the Americans with her mighty military behind, intervened to provide legal protection to the Chinese. Many of us Filipinos have already been dislodged from our economic bases. When we tried to recover our retail bases in the 1920s, their cloned Philippine Constabulary intervened. When we tried to establish legal barriers by limiting certain businesses only to those who are Filipino citizens, many of the papers stating ownership of Filipino citzenship fell into the hands of the Chinese. Thus, many of the original Filipinos among us still remained displaced from our economic bases until today. In fact many Chinese are continuing to enter our territory up to today increasing their population and their hold of our resources. While many of us original Filipinos are leaving our home to find food for our family.

How do we define the actions of our government led by someone whose claim to legitimacy over the presidency is the continued refusal of evidences of GMA in the tampering of the 2004 election results to be presented to an investigation, of collaboration with these foreigners? How do we define such actions which instead of defending us against the onslaught of these foreigners, the assumed Philippine government have even been defending them?

I think the AFP only work as soldiers of Gloria Arroyo against the Filipino people. They are not supposed to stop foreign invaders. Who are foreign invaders anyway. Pero pare, dito sa countryside maraming botanteng gusto ng pagbabago pero wala silang magawa dahil sa mga makapangyarihang galamay ni pandak and that includes the COMELEC. During the canvassing, garapalan talaga ang ginawa nila at ang ordinaryong botante ay walang nagawa. Ang mga galamay ay kumpleto sa pera, goons , baril at mga COMELEC officers.

While continuing as a friendly nation, we must get stronger to drive out the insurgency in the south and ensure no foreign states trespass us. We should probably increase naval cooperation with the US. We need them to detect the Chinese and such. At the same we must be careful to guard our sovereignty.

The hands of AFP is still tied up pag sinabi ng congess at senado na up to this lang ang kaya ng budget pero look at their pork barrel “overwhelming”. kaya nga madalas ang coup co ro coup sa hanay dahil demoralisado puro na lang porma, may star ka nga wala naman kwnta. para pag sinabing territorial patrol we have reliable ships and fighter planes that will really intercept intruders. sa radar capability pa lang kita na lahat sila. wait natin yung sinasabing coast watch station na gagawin sa remotest place pero busy sa shipping lanes like Balabac Island.

I don’t want to defend the members of Congress (on the whole, most of them are a bunch of do-lally, so-called lawmakers) but fair I must be: the AFP modernisation bill was passed into law during the time of Ramos precisely providing for the modernisation of the armed forces, i.e., purchase of materiel, etc.
For the purpose, several military bases, foremost of which was Fort Bonifacio, was sold with the caveat that the proceeds would go into the purchase of basic military firepower, eg., aircraft, boats and for the modernisation of the army,some electric rice cookers, er mali pala (wink wink), I mean whatever they needed to fight effectively.
But what happened? Fort Santiago has been sold to the highest bidder, army became one major base poorer and the AFP is still as impoverished as ever in terms of war gadgets.
When Erap took over the helm — that was the time when the AFP modernisation law was supposed to take real effect — he said, coffers were empty. Where did the monet go?
Ramos is responsible in major part for the terrible condition of the AFP today. It was during his time when the Fort Bonifacio sale was sealed. Private developers have struck it rich since them and I’m sure many of those who were involved in the deal govt side also received a piece of the pie, but the recipients of the proceeds of the sale, i.e., military, are still stuck in 18 forgotten era!
What happened to the money?
In other words, Crisabonis, Congress has done its part… what else can they realistically do? It’s the executive part that has not done its part!
