Raising level of shamelessness

The Ombudsman’s “brazen somersault,” in the words of the highly-respected Jovito Salonga, clearing all Comelec officials on the P1.3 billion poll automation deal shows how deeply enmeshed Gloria Arroyo is as she discards subtlety in the endless paybacks that she is and will be making just to continue holding on to her stolen power.

The “brazen somersault” that Salonga said did not refer to the Ombudsman’s departure from its June 28, 2006 report which recommended the indictment of Comelec officials and eight Mega Pacific (MPC) officers and that impeachment charges be filed against elections commissioner Resurreccion Borra.

That report was actually lame because it absolved other elections commissioners involved in the approval of the deal including Chairman Benjamin Abalos.

The Ombudsman’s “brazen somersault” was from the Jan. 13, 2004 Supreme Court decision voiding the anomalous P1.3 billion contract with Mega Pacific.

It’s also the perfect description of Ombudsman’s Merceditas Gutierrez decision to ignore the report which her field investigating officer, Ma. Olivia Roxas, submitted last Sep. 4 which recommended that all respondents be held “criminally, administratively and civilly liable.”

It was Roxas who exposed the personal connection of Abalos with the Tansipeks, two principal incorporators of Mega Pacific eSolutions Inc (MPEI), the company that signed the contract with Comelec although the contract was awarded to MPC . Abalos is a wedding godfather to a child of the Tansipeks.

In her report, Roxas said: “The issues in the instant case may appear to be complicated. In reality, however, the issues to be addressed are simple enough. Was there illegal transaction? Should herein be held responsible therefore? To the questions given, the established facts and evidence presented by the complainants, there can only be one answer and that is in the affirmative.”

Much earlier, during the watch of Ombudsman Simeon Marcelo, there was already a resolution dated June 23, 2005 recommending the filing of impeachment complaints against Abalos, Commissioners Borra, Mehol Sadain, and Florentino Tuazon on the grounds of graft and corruption and betrayal of public trust and held Commissioners Luzviminda Tancangco and Pablo Ralph Lantion liable for two counts of graft each.

That resolution was reported in Malaya (July 4, 2006 issue) and Kilosbayan newsletter. The Ombudsman has ordered an investigation on that leak saying, “this incident must not be left ignored as it served no other purpose but to undermine the processes undertaken by this Office. In view whereof this Office hereby refers this matter to the internal affairs bureau for investigation and imposition of appropriate sanction on the persons responsible.”

The “brazen somersault” has stripped the office of the Ombudsman under Gutierrez of whatever is left of its credibility.

The brazenness was shocking even if it was not totally surprising. Everybody knew that Arroyo cannot allow Abalos to be punished. She owes a lot of her bogus presidency to Abalos. Although it was Comelec Commissioner Virgilio Garcillano who supervised the cheating operations, the thwarting of the will of the people could not have happened without Abalos’ cooperation.

Abalos and company earned their protection from criminal prosecution when Arroyo was declared winner even if election results showed her losing to Fernando Poe, Jr.

But then there was the Supreme Court which ordered the Ombudsman “to report, on pain of contempt its final determination whether probable cause exists against any of the public officials involved” in the Mega Pacific deal.

Arroyo has the right person in the Ombudsman to do that: Merceditas Gutierrez, classmate of her husband Mike Arroyo.

Gutierrez’ decision to absolve Abalos and his fellow respondents in Mega Pacific deal signals the new level of shamelessness that the Arroyo is resorting to for her continued survival.

We saw it recently when she pinned four stars on AFP chief Hermogenes Esperon even when the Commission on Appointments had yet to act on his promotion to lieutenant general (three stars). She has to make Esperon happy for his role in the 2004 elections and for keeping her in power now.

The Ombudsman’s decision absolving Abalos and company does not settle Arroyo’s debt with him and to everybody that cheated for her. In fact, her list becomes longer. Add to that list Gutierrez and overall deputy ombudsman Orlando Casimiro.

Money and positions are no longer enough. She will have to violate more laws, ignore traditions and destroy institutions.

Arroyo will have to fall one of these days. Sadly, she will bring down the country with her.

    Most of the cases I interpret for the courts in Japan actually are mostly violations of the Immigration Laws of Japan, so when it comes to these cases especially with the US actually adopting a lot of the procedures in dealing with these overstaying and working illegally cases including categorizing these violations no longer as special cases but as felonies or crimes.

    Thus, regarding the case of Bolate, I cannot understand why the DFA would even suggest to the US to wait for the Philippine Department of Justice to file a case against him when all that the US can do is give him a suspended sentence and deport him immediately to the Philippines regardless of whether or not the government of the bogus president would like him back to the Philippines or not.

    The US should know better than to be hoodwinked to keep Bolate in the US especially with the bogus president and her husband powerful enough to protect him ala-Garci! Nanloloko pa ang mga ungas! Talagang mga walanghiya na. Tangna hindi na nahiya na hanggang sa ibang bansa daladala ang mga pagkagarapal! Sa kadadaya, nagmumukha tuloy na talagang mga bobo at inutil!

    The Ombudsman which under the law acts as investigator, litigator and prosecutor instead of an Arbiter Can not be expected to be Independent. My understanding of the role of an Ombudsman is that of a body entrusted to investigate complaints by “ordinary” member of the Public also known as the Taxpayers and Citizens against the employee (s) or an agency of the government which they pay to serve them..And after gathering the evidence through proper and clearly defined process will submit his recommendation and reports to the intended parties where a subsequent action may or not be taken..In this case the Office of the Ombudsman is nothing but an Extension of the very Authority who appointed and established it for its own sinister purposes.

  5. This administration is a syndicate and not a democratic government. GMA and her minions has just declared the Philippines their turf. Vic is right, the Ombudsman is an extension of the appointing authority. I agree Manuel, this country will rise again after the pretender falls.

    I don’t know the procedure in Canada, but over in Japan, though the government has established an ombudsman in the Ministry of Trade to handle trade issues only, the function is the ombudsman is more or less left to the NGOs and NPOs, who work hand in hand even with political organizations, the media and the Japanese Federation of Bar Associations. This is the reason why I guess we can prosecute erring officials, elected and bureaucrats, over here more effectively resulting in more permanent removal of those proven to be corrupt.

    I don’t know why this cannot be done in the Philippines if they really want to have these crooks removed permanently.

    I would opt for a more independent and powerful press in the Philippines as a matter of fact with more honest, committed and dedicated journalists like Ellen.

    who are toiling to push the country forward
    who never waited for GMA to step down before doing something good
    who are creating signs that a country is flourishing

  12. As individuals, we did not stop doing what we are doing, right? We need to work to earn a living, support family, enjoy life, etc.

    The government’s role is to support the citizenry and provide a level playing field. Gloria haven’t done the best that she could because she’s busy fire-fighting! If she was just legit, and could work hand in hand with the populace, the concerted effort could have better results. Unfortunately, it’s not so. If she really loves the country, she should have stepped down. Kaya lang, sarili lang she’s so selfish…

    There are signs that the economy is moving, though not at a blistering pace like China. But at least moving.

    Yes, it is still a jobless growth. But its a great start. And for foreign investors who always look at figures, the numbers give reasons for foreign direct investments to come here.

    Yes I know the country lags behind all ASEAN in inflows of FDIs. But a start had been made, headed in the right direction.

    And before I forget – never will I give credit to GMA for any positive economic movement the country makes.

    The credit belongs to the Filipino people who still believe in their country and choose to work for progress instead of just bitching.

    I’ll take that as a personal challenge – that our country can flourish even with GMA around – without me becoming an OFW or me migrating to the West.

    On the issue of legit, I’ll say it again – she’s legit, as any and all ‘evidence’ on cheating are on the padding of her lead, not to change the outcome.

    Besides, will you deny working hand in hand with her government, for the good of the many, just because she’s not ‘legit’?

    Yes, there will be better results, if instead of bitching all the noisy anti-GMA just cooperated for the improvement of the situation of our poor countrymen.

I know a lot of Filipinos in Japan for example who understand what quality of life is by working in Japan, and their refusal to put their talents to good use in the Philippines is proof enough for me that right now the Philippines does not have anything but a lying cheat, who replenishes the country’s coffers with promissory notes from lenders, and as the raven says, “‘Tis and that and nothing more!” And these borrowings as when her father was president will go on and on until the lenders may try perhaps to claim ownership of the Philippines for monies borrowed from them that this and future generations of Filipinos will never be able to pay, the same thing in fact that my professor, Teodoro Agoncillo, used to pump into our young heads with the Bansot’s father doing the same borrowing spree that the daughter even brags she will continue to do as long as she clings to the pillars of the palace by the murky river. Tarantado talaga!

    I must say, I admire your tenacity for believing that Gloria is not the single, major divisive reason for what’s happening in the country.

    I’m trying earnestly to believe you alas, I know people in the country today who, in spite of their qualifications, cannot find a job because, one, I put it to lack of bona fide investments in the country, two, there is an enormous political instability from which lawlessness arises because of lack of trust in Gloria’s governance.

    However, I am sure that if you, and those as gifted with the same convictions and tenacity as you, joined the ranks of those who oppose Gloria’s extremely rotten governance, I am absolutely certain that the country will get rid of the major Philippine disaster perched in Malacanang and after that we can all move on.

  18. You talk of data and statistics which the government also pads. Hehehehe….Padding is a way of life in the pretender’s Enchanted Kingdom. I love this country, I believe in the Filipino, but I definitely do not believe this administration. Apathy leads to enslavement. If you still don’t get it, check out how much the OFWs bring in to this country. Its what keeps the economy afloat. But that is not real progress, progress is when the quality of life is felt by the poorest of the poor. When you see investments flourish and you don’t hear of any kind of corruption, there’s progress. Today, 26 million Filipinos are forced to subsist on a mere P36 a day. Yes, we’re headed somewhere, but not in the right direction.

    We have ombudsman everywhere here, from municipal government, to provincial, military, federal, and every newspaper publication like the Toronto star, Canada’s biggest by circulation, has its own ombudsman.

    The primary duties and obligation of ombudsman in every level, is to entertain and to police their respective scope of responsibility and entertain complaints from the Public. Upon receiving complaints, the ombudsman will either call his/her office investigators to initiate investigation and upon conclusion will either cite the results or reports to the intended parties for follow-up action. The reports could include recommendation for criminal charges, which is always the responsibilities of the crown prosecutors, or cite the infraction for the proper authorities to correct.

    In newspaper and other media, the ombudsman has to answer complaint from the public regarding the behavior of its entity and pass judgement as to the liability of the media concern if the break its established guidelines. It is some kind of buffer zone before going directly to the court for sometimes trivial matter that could easily settled satisfactorily by the ‘wizard’ of an ombudsman.

    As with our judges and our courts official, they are presumed totally independent from Politicians and political parties and be accepted as such until otherwise exposed. And our investigative reporters are just as good as anyone’s and we have countless anonymous tips line by phone, in person or on-line to reports all the infractions of the Game..     Esperon ‘sacks’ colonel for seeking dismissal of coup raps vs 38 officers

    The military leadership has denied rumors about the sacking of a military prosecutor who allegedly had recommended dropping the case against sus-pected coup plotters.

    Armed Forces of the Philip-pines (AFP) Chief of Staff Gen. Hermogenes Esperon Jr. claimed that the testimonies and evidence against the alleged mutineers were strong and sufficient.

    Text mes-sages circulated yesterday, saying Esperon had sacked a certain Colonel Henares from the Judge Advocate General’s Office (JAGO) for recommending the dismissal of charges against 38 officers facing court-martial for the alleged coup plot early in the year led by former Army Scout Rangers commander Brig. Gen. Danilo Lim, former Marine Corps Commandant Maj. Gen. Renato Miranda and Marine Col. Ariel Querubin for lack of evidence.

    Lim and Querubin, with Miranda’s knowledge, allegedly planned to lead a mass withdrawal of support from President Arroyo last Feb. 24, the 20th anniversary of the popular revolt that ousted then President Ferdinand Marcos.

    The same text messages said Henares’ findings angered Esperon and prompted the military chief to sack the colonel, “a righteous man from JAGO.”

    Esperon clarified that “there

    is no Colonel Henares with JAGO” and that Col. Al Perreras, the deputy Judge Advocate General, was handling the case against the officers.

    He maintained that the case against the 38 officers is strong.

    Military prosecutors, Esperon said, have “incontrovertible evidence” against the alleged coup plotters, particularly the videotaped withdrawal of support of Lim, which video was never shown in February but was leaked several months later.

    “Talking about evidence, does not the taped withdrawal of support by Lim constitute incontrovertible evidence?” Esperon said in a text message sent through his spokesman, Lt. Col. Bartolome Bacarro.

    “And we have voluminous testimonies and other evidence against Lim” and the other officers, the AFP chief added.

    Esperon said Perreras has not yet submitted the JAGO panel’s report to him, which was originally due in mid-September.

    In earlier interviews, the AFP chief said he would immediately convene a court-martial to try the 25 Army Scout Rangers and 13 Marine officers accused of the alleged coup plot if the JAGO recommends it.

    What about the records, in print and broadcast media detailing the withdrawal of support by Angie Reyes (and Esperon included when he was a colonel and PSG Dep Cdr) for Erap? Perhaps, we should NOW revive the charges against these general scalawags for mutiny?

    Enrile, the prince of Martial Law during the Marcos era is becoming a terror prince in the Senate.

    What did Enrile think? That he’s still the prince of Marcos court when he threatened to slap Senator Pimentel?

    Enrile has never been a man of finesse but it seems he’s starting to be afflicted with altzheimer’s too.

    So you’re one of those who has no problem living in with cheaters?

    Kahit hindi nag-cheat mananalo naman eh, kaya legitimate na? That’s terrible reasoning. But for the sake of argument, what should be the punishment because she cheated? In the same vein, what should be the punishment for the nursing board examinees who cheated? Can we also say that because even if they did not cheat papasa naman, kaya ipasa na lang?

    We have to be consistent with our values!

    May I place on record three threats that I am told have been leveled against my person in the last few days.

    The first threat was reportedly aired by a fellow senator who did not like our stand opposing his motion to end the period of interpellation in the anti-terrorism bill.

    The threat’s content had to do with his purported intent to slap me and presumably Sen. Jamby Madrigal for her insistence that she should be allowed to interpolate the sponsor of the bill. To make certain that we understand what the sponsor of the anti-terrorism bill threatened to do, let me put on record that our people ordinarily understand the word “slap” to mean hitting the face of a person with an open palm.

    Duels

    In the olden days, slapping another would be a prelude to a duel whereby the protagonists are supposed to prove their manhood by wounding or slaying one another. That manner of settling disputes, happily, is a thing of the past. In fact, dueling is now deemed a criminal offense in the revised penal code.

    Thus, slapping another person nowadays is no longer the way to prove a point. Since civilization has now defined what constitutes good manners and right conduct, people are no longer supposed to prove the validity of their advocacies by clubbing those who hold different views as the prehistoric cavemen did or by piercing them with rapiers. One famous sword duel in France took place on 23 February 1870 between Édouard Manet, the famous painter, and Louis Edmond Duranty, an art critic. In the US, probably the most famous duel of honor involved the use of pistols. I speak of the duel between Alexander Hamilton and Aaron Burr in July of 1804.

    Social mores, refined

    In any event, I suggest that the refinement of societal mores or conduct in the world brought about by modern civilization has replaced the need to resort to physical violence when ideas clash. Courts of law are there to thresh out divergences of views when these are no longer remediable by extra-judicial negotiations. And naturally, in the halls of the legislature, legislators are expected to settle their conflicting outlooks by rational debate, not by slugging it out in the manner that Manny Pacquiao resolves supremacy in the ring against all challengers with the power of his mitts.

    There should, therefore, no justification for threats to use violence and much less for the actual resort to physical combat by the legislators of the land to settle disagreements on matters under discussion in the Senate or in the House.

    By submitting ourselves to the restraining influence of civil discourse and debate, we reign in our baser instincts and we are, thereby, enabled to contribute to a more rational, sane and responsible discussion of issues that affect the welfare of our people.

  32. (Here’s the continuation of Sen Pimentel’s privilege speech to the Senate, this portion below contains his views on why he is opposed to the Anti-Terrorism Bill as it is proposed by Sen Enrile:)

    Protecting basic liberties

    That said, I would now like to explain the opposition stand against curtailing the right of the senators to ask questions of the sponsor of the anti-terrorism. The stand is based on nothing else but on our desire to ensure that the fundamental rights of our people are upheld and their basic liberties, protected even as we craft a law on terrorism.

    In other words, the opposition is not against the enactment of a law that would set out the country’s response to the threat of terrorism. We are not against stamping out the menace of terrorism. We are not against fighting terrorists.

    Invalid thesis

    What are we against is the facile excuse being peddled by the advocates of antiterrorist legislations that to do so, we must sacrifice our civil liberties and our human rights. In brief, the simplistic thesis of the proponents of the antiterrorist laws is that it is necessary to desecrate the basic tenets of our democratic institutions just so we can fight the perils of terrorism.

    I deny the validity of that view. I believe, for instance, that the bill on terrorism as worded is not at all needed to combat the hazards of terrorism. In fact, as worded, it is more a threat to the lives and liberties of our people than a beneficent legislation that will safeguard the values of freedom, justice and peace that our democratic experiment upholds.

    Most menacing

    The opposition submits, Mr. President, that this bill is arguably the most menacing of all the bills that we have had the privilege of discussing. No other bill emasculates the protective provisions of the constitutional bill of rights. No other bill menaces the poor, the oppressed, the unconnected, the voiceless and the powerless more than the bill in question. No other bill has the potential for abuse by the unscrupulous leaders of the country than the bill that we are considering.

    That is why we do not accept the simplistic argument that we should do away with the period of interpellation because anyway we will have the chance to ask questions during the period of amendments. Such an argument is not even remotely a rational response to the anxieties that we speak of.

    People’s questions

    We need to ask the questions that our people would like to ask but do have the chance to do so for the simple reason that they are not members of this chamber.

    We need to ask the questions as to why we have to subject our people to the possibility of being punished for the crime of terrorism for acts that are already penalized in the revised penal code?

    The mass or single killing of people, the bombing of buses, trains, airplanes, water depots and power systems, for instance, are already penalized in the revised penal code. If the penalty for those heinous deeds is considered inadequate, all we have to do is raise the penalty wherever the Constitution allows such a course of action.

    Option to the powerful

    There is no need to enact another law that would give an option to the powerful to choose which legal device to use in prosecuting suspects of the horrible acts now attributed to terrorists. Because once the option is given, there is reason to believe that the powerful – especially the unscrupulous ones – would use the more potent of the options to attain their ends.

    In my opinion, given the choice whether to prosecute suspects based on the same set of facts under the revised penal code or under the antiterrorist legislation, the latter would be the easy option. For example, if an electric power system is burned down, the prosecutor could, if he wants to, prosecute suspects under the revised penal code or, once approved, under the proposed anti-terror legislation.

    Unscrupulous choice

    It is true that the under the latter legislation, the intent of the perpetrators “to sow panic, terror, etc”, may qualify the act into a terrorist offense.

    While a prosecutor may choose to sue them under the revised penal code, still it is possible that he may – if pressured by his superiors or for some other base motives – choose to investigate them for an act of terrorism. Then, he can get them arrested without a warrant, put them in detention for 15 days, and after 15 days, ask for an extension of time to detain the suspects perhaps on the ground that he needs to gather more evidence against them, and on what would appear to be valid reasons, cause the extended detention of the suspects.

    In that manner, the suspects without being convicted by the courts of law would already have been deprived of their liberty for a long period. The horrifying scenario does not end there for the innocent victims of over zealous guardians of our liberties. The prosecutor could sue them for being terrorists and there would be no end to their travails in prison until the case is terminated for the simple reason that the case would not be bailable.

    To repeat, all the acts that are now defined as crimes committed by terrorists are already embraced in the revised penal code. It is only the addition of words and phrases such as “to sow widespread fear, anxiety and panic among the populace” and to coerce the government to give in to a “given demand” etcetera that stretches the scope and intent of the criminalized acts in the bill to become offenses of terrorists.

    Intimidating citizenry

    I fear, Mr. President, that the intended legislation may in the end be used to intimidate the citizenry into becoming docile lambs ready to do their bidding. For if the citizen can be investigated on suspicion that he is a terrorist, under the bill, he may be deprived of his basic liberties without court intervention in the guise of the need to ensure the safety of the citizenry and the security of the State.

    Thus, we need to ask why must the armed elements of the government be empowered to pick up Juan or Jose or Pedro surreptitiously or before the eyes of his family without a judicial warrant, detain him for several days simply because in their opinion he is a terrorist or maybe an accomplice of a terrorist?

    Desecrating privacy

    We need to ask why the little nipa hut of Juan or Jose or Pedro or the sophisticated office or home of Paul or Ernest or Frank should no longer be considered his palace so that none is allowed to enter but upon his bidding? In the guise of searching for terrorist materials without a judicial order, the nipa hut or the palatial home or elaborate office of suspects are no longer sacred despite the mandate of the Constitution.

    We need to ask why should anyone’s telephone be tapped by the police or the military indefinitely or his or her emails and correspondences be scrutinized because a paranoid government functionary is suspicious that he or she has ties with terrorists?

    Indeed, there may be valid reasons to do so but that is precisely why we want to ask questions of the sponsor so that he will tell us the reasons why the anti-terror bill would be worded in the manner he is proposing it to be worded.

    Right to question

    For the record, all that I wanted to do when I opposed the sponsor’s move to abbreviate the period of interpellation on the anti-terrorism bill was to enable our colleagues who wanted their turn to ask questions of the sponsor. And when they are through, I also would have wanted to have my turn to ask him questions.

    In short, the reason why we wanted to avail of the period of interpellation is to discover from the sponsor, himself, the scope, the intent, the rationale, the necessity, the wisdom, the efficacy etc of the proposed legislation. And in the process, probably suggest that certain safeguards against abuses be instituted in the bill.

    But the majority wanted the bill rushed.

    Why the rush?

    In this connection, I wonder why there is a need to rush the enactment of the bill?

    It may be admitted that the modern world needs protection from the acts of terrorists.

    Still, as the US experience has shown – after they rushed the approval of the Patriot Act, the original anti-terrorism bill – their legislators have now found out that there was need for a more thorough debate and judicious discussion of the amendatory bill now pending in the US Congress.

    2nd threat

    I will have other points to raise on this issue the next time around but for the moment, let me proceed to the second threat that was reportedly leveled against me.

    I understand that MegaPacific lawyers have threatened to sue me in the courts of law because I continue to raise questions over its deal with the Comelec that resulted in the questionable of questionable automated counting machines.

    The lawyers are well advised that I raise the questions on what I consider as an anomalous deal that prejudices the people to the tune of over a billion pesos not only as a citizen but as a senator.

    I do not intend to be cowed by their threats. I recognize their right to sue any person including myself on this issue. But they are not going to prevent me from speaking on it until we get the redress that our people deserve from the anomalous Comelec-MegaPacific contract.

    In fact, we are going to the Supreme Court as soon as my lawyers are ready with our petition. There we will argue until they are blue in the face why we have the right to raise the issues we have made for the benefit of the people.

    3rd threat

    And finally, another threat of a different kind has been directed at me. I will not honor this threat because it is inherently evil and does not deserve our dignifying it with a detailed reply.

    Doing job to the hilt

    One thing is certain: I won’t slacken my efforts to see to it that our people’s expectation of the role of the Opposition is done to the hilt. There will be no favors extended or expected in the discharge of our duty as senators of the land. No amount of threats from any source will prevent us from doing our job: that is to protect the rights of our people to the best of our ability.

    You can say all you want, but the rules on presidential electoral protests are clear – if the protest will not change the outcome, the protest will be dismissed.

    I already said earlier that GMA is not toally off the hook, as you can file charges against her in 2010.

    Impeachment is another remedy. But two complaints failed already. Kindly ask the bright boys of the ‘united opposition’ why two impeachment attempts have failed. Its their fault, they still believe that GMA can still be removed by people power if they pontificate ad nauseam, instead of focusing on reaching the required number of votes.

    Don’t worry, you’ll still have a chance to impeach GMA in 2007, 2008 and 2009.

    I realize that everything that we say in this blog don’t make any difference in the law-making process and implementation. That includes you. But in here we can mirror the values people hold on to. By saying that all politicians are cheaters, you don’t necessarily mean that you agree with them, right? You don’t believe that because everybody is doing it, it means it is correct, do you?

    There’s a difference between saying “that’s not right, but I can’t do anything about it” vs. “that’s not right but everybody is doing it, then it’s ok”. Part of self-empowerment is believing and doing things that we know are correct. We can’t help what others do or believe, but we have control over ourselves.

    norpil, it the other way around here. we want our political leaders to stay forever if they do their job and retire them the next election if they don’t. One such example is Hazel MacCallion, now approaching her 90 and have to give up her driver’s lincense and eventually avail herself of the limousine service provided by the ever grateful residents of Mississauga for serving them the last 30 years or more and still going strong and voter just go out and vote for her, not knowing is she has an opponent or none. And she said she had no other plan execept to serve her people to her last day. But usually, politicians are decent enough to retire on their own to give others in their party a chance to lead. Like Premier Klien of Alberta, who finally retire, despite winning majorities, election after election. Matured they are, that they don’t rules to conduct themselves. thanks..

    Whoever is saying that there was no iota of evidence to prove any irregularity (in the ACM scam)is definitely brainless. The machines were tested at DOST using “DEMO” software, or technically, incomplete and unreliable programs that only worked perfectly if they used it in accordance with the supplier’s parameters. But of course, it is the customer that dictates the specifics, and the software must be customized to fit the buyer’s needs. Which at the time was not satisfied by the “stock” program that went with the machine.

    That being the case, the DOST gave it failing marks despite outperforming the other qualified bidder. Based on this comparison, and its lower price, the COMELEC proceeded to award the contract to Mega Pacific Consortium, a separate entity from the winning bidder, Mega Pacific e-Solutions, Inc. MPES however failed in eligibility due to its financial inadequacy.

    That is where the irregularity happened, since the bidder failed financial eligibility, it awarded the contract to a consortium.

    The machines were delivered, and PAID, despite the uncertainty whether the complete, secure, and accurate final software could be delivered on time for the May elections.

    That is the second irregularity. A Billion Pesos released for a delivery of thousands of machines that would have been deemed useless should the supplier fail to make the corrections in time for elections which is merely a few months away, if at all they can ever achieve to rewrite a fool-proof software. It’s like buying a music player, say MP7, which hardware is way ahead of today’s latest MP4. But you don’t have guarrantee that the manufacturer will be able to provide the software later. What did you just buy? An expensive high tech gadget-looking paperweight.

    The third irregularity is that the COMELEC disregarded their own rules several times and proceeded to award, and PAY!, Mega Pacific the Billion Pesos (wow!, magkano kaya ang for the boys? and the Girl?).

    There are a hundred other reasons to cancel this contract, if you ask Gus Lagman but the most glaring of the other ones, for example, is the requirement that the machines should have been used in an election where voters number to at least 20 million, or something like that. That, to people familiar with bidding in the government, is undoubtedly spells lutong-makaw. Add to it the budgetary/price limit, then you have disqualified the European/American suppliers from partiicipating early on.

    If these things are not anomalous, I don’t know what is.

    Tapos itong estupidang Ombudsbitch tigas-mukhang sasabihing she will stand-by the recomendation.

No matter how you guys admire Pimentel, I still think he’s a trapo and an opportunist. Many already were forgiven by Erap.   102. You said it, Anna, charity is not something that should be broadcasted here and there, or that one who does charity calls himself/herself noble and should be given an award!!!

    As the Bible says, “But when thou doest alms, let not thy left hand know what thy right hand doeth: That thine alms may be in secret: and thy Father which seeth in secret himself shall reward thee openly.” (Matt. 6:3-4)

    This reminds me of a Filipino in another forum who even makes this kind of charity look obscene by turning the charity into some kind of beauty contest of some sort—paramihan ng abuloy! It is disgusting really. What it encourages are vanity and “garapalan”

    Apparently, anything done for the wrong reason, result in nothing beneficial. The beneficiaries tend to be abusive and lazy. Nakasahod na lang pirmi ang mga kamay.

    Those who would want to do charity would be better off trying to fast for a day (no food and water for 24 hours) and the money for such be given to charity. (Isaiah 58:1-12)
