Life has presented to me in many ways, from my exploits in the field that eventually earned me the Medal of Valor, a new lease on life after being left for dead in 1989 and to my current incarceration.
During all these episodes of my life, I have both witnessed and felt human suffering and desolation. After a long process of discernment while in confinement, I resolved to do something about human suffering- not through any other modality but through faithful, competent and committed public service.
I do not assume to be the solution to all these problems. I definitely am not. It takes the collective effort of every member of this society to make things improve. All I can do on my end, is to make the best effort possible to make society better, stand by my principles and fight for what is right in the appropriate forum; if not for myself and one generation, for our children and their children as well.
I thought that if I do not try to at least offer myself to give our people an alternative, then all the sufferings I have witnessed and felt would be rendered meaningless.
I plan to run for the Senate in the coming 2010 elections with this dream that we all share, a prosperous and vibrant Republic of the Philippines that bestows to its citizens the benefits of freedom, good government and a developing modern state; that fosters the unity of the family, respects human rights and upholds the dignity of all.
I have no political pedigree. I have no political machinery. I have no financial resources. But I do have honor. I do have principle. I do have courage.
We all fight our own battle hoping each one could make lives better.I believe I am ready to take on this new role, perhaps no longer as a warrior, but as a simple statesman.
With your support, this dream is not far-fetched. There is hope for this country and our people. All we have to do is believe.

Dear Friend,
May the Peace of Christ be with you!
I have no doubt in my mind that the Lord has all the while been preparing me for public service. I was left for dead in 1989, and He allowed me to spring back to life. I have been imprisoned as a soldier, but I fully regained the honor and right to wear a soldier’s uniform after having been awarded the Medal of Valor in 2001. As my military career was very much back on track, I was again challenged to choose between right and wrong, between honor and injustice, between good and evil.
Even as we all work for a vibrant and prosperous Philippines, my dream is for every Filipino to enjoy the essence of freedom from poverty, fear, and injustice, to feel the tangible benefits of good governance, and to live comfortably in a society that fosters the unity of the family, protects human rights, and upholds the dignity of all.
I have not had an easy life. My life story has been replete with vivid encounters with injustice poverty, corruption, and war. These painful experiences have shaped this dream. I never succumbed to the lure of material wealth. The physical, mental, and emotional hardships have been painful, but I never sold my soul.
I am fully aware that some people would insist that men in uniform should stay away from politics; that we would serve best our nation if we were fighting wars in Mindanao; that we have no business in meddling with the affairs of the state as we have been formed and trained in the rudiments of war, and not in the civil service, much less in politics. I agree but that assumes that the people who have been entrusted with the public trust have been sincere, honest, and have been true to their pledges.
As a young soldier, armed with idealism and the fire of youth, I have offered my life to defend this country from ALL its enemies. I have suffered long and hard for the principles that I hold dearly. Many of my loved ones have suffered with me – maybe not physically, but certainly have shared in the misery and hardships that I have endured. The fire of idealism still burns in me, but I have been wiser not to engage fire with fire.
With a lot of circumspection, I have decided to run for the senate in 2010. I have no political pedigree. I have no political machinery. I have no financial resources. But I do have honor. I do have principles. I do have courage.
I believe I am ready to take on this new role, with your prayers and support this dream is not too far- fetched. It takes the collective effort of every member of this society to make things improve for a country in disarray… a country that has been plundered… a country whose hope is running dry…
All I can do, on my end, is to make the best effort possible to make society better, stand by my principles, and fight for what is right. There is hope for this country and our people, all we have to do is believe.
This I will do, if not for myself and our generation, then at least for our young children and their children. My warmest personal regards and God bless us all.

God has His plans, and there must be a reason for everything that is according to His perfect will! it is support and prayers from people like you that make all of us survive po. if we count our blessings, compared to those who lost their parents in combat or those who are abroad as OFWs, we are still very lucky.

Ako po ay natutuwa at nakikiayon sa napakaraming posters dito na nagbibigay ng suporta para kay Col Querubin, a Medal of Valor Awardee and potential AFP Chief of Staff who all need but to bootlick to enjoy the perks and power that go with the position. Pero he opted for integrity and its consequent discomforts and incarceration. Karapat-dapat siya sa Senado. Karapat-dapat sa kanya ang boto natin.
Gayunpaman, we need to do more than this po. We all know how the Administration is so rattled and scared to put Col Querubin in the Senate. As we see it, this early — hindi pa man tumatakbo yung tao sa Senado (nagsabi lang ng intent niya) — dine-demolish na kaagad. How would it be possible then for him to seat in the Senate without the machinery… the funding and organization… to counter the expected cheating machine of GMA that would be thrown full force against him?
We, corruption-weary, and abused citizens by our so-called leaders need to organize for him. Col Querubin needs our all-out support.
Martin, can an account be opened for Col Querubin where possible financial support can be poured in for his campaign? He needs an organization that would secure votes for him. And this means money. Without that, expect him to lose.
Likewise, can we organize such that nation-wide chapters can be set up this early for his campaign? Nakakulong yung tao at ngayon pa lang, expect na lalo siyang ididiin ng sindikatong nakaupo. hi Valdemar! i think the colonel is not denying it. the defense simply says that his actions do not constitute a crime as defined by the articles of war, granting but not conceding all the testimonies of the witnesses are true.
in order for an attempt to exist, the offender must have initiated the act and begun the stages of execution, and was prevented from pursuing it by a force other than his own free will.
according to the our Revised Penal Code, an act or crime has three stages of execution. an attempted act. a frustrated act. a consummated act. in Colonel and the 27 other’s case, there cannot be said to be an attempt for several grounds. however, we will reserve this discussion so as not to jeopardize the defense’s case.
a proposal to commit a mutiny, not being a political offense, is not punishable as far as i know (tama ba attorney?). attempting to create one is. according to my criminal law professor in UP, mutiny is not considered a political offense unlike Rebellion. in this case, there has been no attempt. why? the answers will be made known come the turn of the defense to present its case.

i’ve done my own research about this last year and consulted several criminal law authors about the charge. i am not surprised why it was already dismissed in the Pre Trial Stage for lack of grounds to bring the cause of action in court.
here’s another definition of an attempt as defined by Feria and Gregorio. “There is an attempt when the offender commences the commission of a felony directly by OVERT acts, and does not perform all the acts of execution which should produce the felony by reason of some cause or accident other than his own spontaneous desistance”.
furthermore, INTERNAL ACTS such an IDEA, DESIRE, PLAN, RESOLUTION, or PROJECT, are NOT punsihable no matter how immoral, ijmproper or sinister the may be.
External acts are likewise not punishable while the rights of society and or individuals are not injured.
According to another author, Reyes, he cites the case of People vs Lamahang. the court in this case ruled that “it isouropinion that the attempt to commit an offense which the RPC punsihes is that which has a logical correlation to a particular and concrete offense; that, which is the beginning of the execution of the offense by overt acts of the perpetrator, leading directly to its realization and consummation. The attempt to commit an indeterminate offense, inasmuch as its nature in relation to its objective is AMBIGUOUS, is NOT A JURIDICAL FACT from the standpoint of the Revised Penal Code.”
Meaning to say, even if all of what Esperon, Martir, etc etc says is true, (we know alot of their testimonies are falsities), they are still not enough to convict the Colonel and his co-accused.
The mutiny case against Miranda, et al case should have been dismissed at the onset for lack of probable cause considering the insufficiency of evidence to constitute a crime. Furthermore, given the constitutional presumption favoring the accused, a word of Esperon or Martir as opposed a word of Querubin or Lim would be tilted in favor of the accused, as mandated by the Revised Penal Code. Therefore, given the circumstances, the accused led by MGEN Renato Miranda and Brig Gen Danny Lim should be acquitted, or at least dismissed for lack of evidence.
No wonder the Staff Judge Advocate wrote a hideous Pre Trial Advise being from that law school in Makati. (im kidding attorney, my favorite lawyer is from that school as well.)

the court, in the case of People vs Tayag, also laid the elements from an attempt to exist. we must remember that all three elements must be proven in a competent court, beyond reasonable doubt.
First, the intention to commit a specific felony; Second, the COMMENCEMENT of execution DIRECTLY by OVERT acts; and Third, Interruption due to causes other than offender’s spontaneous desistance. with emphasis on the last phrase. these three elements will have to concur for the crime to be considered in existence.
i do not know how the defense will utilize the law to lampoon the prosecution’s case, there are just too many defense angles. as far as i know, no crime has been committed in any stage of execution.
second of all, this i am not so sure of this though (judges are usually trained for this – computation of penalty). even if convicted, an attempt to commit mutiny is only punishable by 6 months to 6 years, i think since it is several degrees lower than Reclusion Perpetua which is the maximum capital offense. therefore, even if convicted, having been in jail for 3 years is well enough time served. so either way, panalo sina General Miranda, Lim, etc sa case.
i am sure the members of the panel understand this clearly, the law member Col Aleido seems to be doing her job in educating them of the basics in Criminal Law. i think they know this too. we just have to have faith in God for the case tobe resolved promptly.

sorry just had lunch. anyway, hope i gave Alana a background on the status of the case, and its legal basis for claiming that no mutiny existed.
it is as simple as this. for example: i may plan and want to murder somebody, let us say, because that somebody is peddling lies about a loved one of mine. however, even if that plan is known, it cannot be considered an attempt to murder for purposes of punishment in the RPC in consideration of the fact that no overt act took place. it could be another crime, but definitely not attempted murder. in juxtaposition with mutiny, for example, i may want and plan to commit mutiny, but unless i do any overt act and am desisted by a force other than my own free will, it is not attempted mutiny. maybe conduct unbecoming or conduct prejudicial, which has already prescribed in this case by the way, but definitely NOT mutiny.

Simply equated into “Issues raised, Issues answered”. Resorting to ad hominem by supporters of a candidate does not do justice to that person, instead, it raises more doubts and questions. Questions that there might be something to hide. My one piece of unsolicited advice, confront the issues directly and avoid the fallacies of arguments that might boomerang.

there are certain issues that ought not to be dignified, especially when grounded on malicious gossip, baseless intrigues or useless innuendos from the minds of idle people with wild imaginations. the most fair way to respond is by taking the issues against anybody to court, otherwise, it shall remain just gossip. this is the way society should work, otherwise, society will be consummed by crabs pulling each other down. that way, the accused will be as accountable as the accuser.
when i was in high school, the late Fr. SEDITION.
This offence, which, as designated in the present Article, is by the earlier writers nearly identified with mutiny, is, in the more recent treatises, distinguished as being a resistance to the civil power, demonstrated by riot or aggravated disorder. Thus Simmons says:-” Sedition is supposed to apply to acts of a treasonable or riotous nature, directed rather against the public peace and the civil authority than military superiors, though necessarily involving or resulting in insubordination to the latter.” No instance of a trial, under this Article, for sedition, as thus defined, is known to have ever occurred in our (US) military history.”
Wnthrop’s Military Precedents page 579.
Your father’s acts were directed towards the civil authority. So the proper jurisdiction lies in the civil courts, following the above precedent; and also because our jurisprudence says non service-related cases are tried by the courts.
Mas hirap ang prosecution in civil courts, because they will have to apply the Revised Penal Code; sedition requires a tumultuous affray. There is no evidence to that effect. They chose to prosecute under military law, dahil bailable ang sedition sa courts; and because judges have security of tenure, and like Judge Lorredo and Pozon, may choose to abide by the law and not that woman’s whim.

I used to be a regular reader only in this blog but since Vina, Semper Fi and Alana posted their comments I can’t stomach what they are saying.
I thought the Marines are the best in the AFP but after what Semper Fi said that the Marines would vote for Esperon rather than Col Querubin, mag Scout Ranger na lang ako. The marines I know are disciplined, true defenders of the country and the State. But times have changed.

That depends on the charge. If the imposable sentence is punitive, death, etc, then it is criminal. If the highest sanction is dismissal or dishonorable discharge, then it is disciplinary. Disciplinary here, is akin to administrative, but administrative within the military.
In the earlier post, by civil courts, I meant the civilian courts, although the charge would by criminal (sedition). But the point is, our jurisprudence has separated service-related issues from purely criminal issues. The facts as alleged, not being service-related, the proper jurisdiction lies with the civilian courts.

Esther, just like you, I regularly read Ms Ellen’s blog. I comment once every blue moon. I’d rather read than comment. I dare you Esther to post anything offensive that I said in this thread of almost 200 comments.
I am beginning to wonder why there is such a frantic effort to defend the Col when I haven’t raised any issues yet. I didn’t even say anything to his detriment. I only wanted to get different perspectives. Esther, the Col wrote of his intention to run for Senator of the Republic. Ms Ellen posted it here, and I believe, with his permission. He is asking for support, and of course our votes. You have your one vote and I have my one vote. If you want to give your vote blindly, I do not care. But I do care for my one vote so I need to have an informed choice. Is that wrong Esther?
What I didn’t realize is that when Ms Ellen posted the Col’s letter here in her blog, we are all supposed to only write praises. Had I known that that was the case, I could have just been content on reading and passively watching the spectacle of “back-patting”.
Esther, if you are a keen observer, you will notice that offensive language comes from the supposed close friends and relatives of the Col. If we talk of “reflections”, then that definitely reflects on the character of our subject matter here, the Col candidate. So if you please Esther, jaded eyes is the last thing we need for voters at a critical moment in 2010.

Agreed parasabayan. But if I remember right, the issue presented (habeas corpus of Martin’s mother) was whether or not the case can proceed, even without Esperon’s signature, and even after the pre-charge report that there was no probable cause.
My theory here, is that even if the facts alleged are admitted, that there was a walkout (sitdown, whatever you call it), and a call to withdraw support, that was directed against the civilian authority, not a military superior. So, by the definition of mutiny, no mutiny was committed.
If a different issue is presented, one can go again to the Court of Appeals or Supreme Court for a petition for a writ of prohibition.
Chi, I have a strong feeling that Alana, Semfer Fi and whatever his other names are, is one and the same. Again, this person must really be full of anger,self pity,envy and all the other debilitating emotions. It is not healthy to always think the worst of other people. But it happens. The best weapon is just to ignore his/her. We always have to look at the BIG PICTURE. If he is just being used by the “powerful” people for a demolition job, then his /her own choice.

In the primaries, where the presidentiables are picked, a solicitation letter is sent to ALL the voters by the party a voter has registered to. Again, another solicitation letter is sent months before the real presidential election. The primaries take two years! The presidentiables to from state to state to debate on issues of prime importance to the voters. It is also very common that candidates have dinner parties hosted by their supporters. If the party is hosted by a Hollywood topnotch actor, per plate can run into a thousand a plate or even more. With Obama, there was even a paryy hosted where per plate was a hundred thousand dollars. Being invited to these fund raising activities is an honor and priviledge. These fund raising activities are all legal. In the case of Obama, it was the meager contribution of the little people that catapulted him to his position. He was virtually unknown but with the SUPPORT of the people(some even used their credit cards), Obama won! There are political organizations soliciting campaign funds all year long. Your Santa Barbara friend should know this if she is a US citizen.
This is why the US has economic freedom for each of its citizens. The citizens contribute to their candidates’ finances. IT IS ABSOLUTELY LEGAL!

Isusubo na lang niya, iluluwa pa kung may nangangailangan. Kaya nga nakakulong siya. Malambot ang puso niya sa mga naaapi. Para naman siyang BULLDOG sa mga NANGAAPI. I just read in the Inquirer that the Col officially announced his intent to run for the Senate in 2010 through the Facebook social internet as well.
I also learned that a few of the dismissed Magdalo are also running for local public positions. Kung si pandak nga eh puro military ang nasa KEY positions niya. This means that military men have the capability and the capacity to serve the people. Unfortunately, some of those in positions of power now would rather protect the corrupt queen rather than the people. Hopefully this will change when more of these incarcerated officers are involved in re-moulding the nation!

I could go into details about Obama’s treatment by some in here who now purport to support the Colonel despite lacking political experience but in the interest of good taste, won’t go down that road. However, these anti-Obama’s prior pitiful positions rest on two points: 1. his political experiences were not enough; and, 2. after he won the presidency, barely weeks in office, comments from same people here said “he is all talk”, “too much teleprompter” and even blamed him when stocks were plummeting. When he took over, the stocks was at 6500 points, now it’s 8500.
People just need to get-off riding the silver horse of their political party, we are old enough to make our own decisions and convictions. You can’t simply applaud and agree with an idiot who wants your president to fail. You become part of the problem.
I firmly believe in the “fairness doctrine” and personally won’t even question his qualifications. He has every right to seek a senate seat. Let the Colonel run for political office, if after his stint in the senate, he became rich and

Malacañang said detained Marine Colonel Ariel Querubin was “free to dream” about running for senator in 2010.
Deputy presidential spokesman Anthony Golez said that while he could not comment on Querubin’s qualifications, he said the Marine officer’s participation in an alleged plot to unseat President Gloria Macapagal-Arroyo in 2006 “does not show any good.”
“Malaya tayong managinip, pwede tayong managinip ng ganon [Everybody is free to dream, we can all dream that way],” Golez said when asked about Querubin’s declaration that he would seek a Senate seat in 2010.
“Hindi ko kilala si Colonel Querubin, ang pagkatao niya, ang pag-defy niya sa chain of command, nakikita ko, to me that does not show any good [I don’t know Colonel Querubin personally but his defying the chain of command, the way I see it, does not show any good],” the spokesman said.
Golez said it was up to Justice Secretary Raul Gonzalez to comment on the legality of Querubin’s candidacy.
Querubin is among 28 Army Scout Ranger and Marine officers charged with mutiny before a court martial over an alleged coup plot in February 2006.
Querubin said he was ready to campaign from detention.
If he runs and wins, Querubin will become the second detained military officer linked to a supposed oust-Arroyo plot to win a Senate seat, after ex-Navy lieutenant Antonio Trillanes IV in 2007.
Trillanes has not been allowed to leave his Fort Bonifacio detention to perform his duties as senator.

He earned 8 gold crosses, distinguished conduct star and the much coveted Medal of Valor all combat awards that showed his stability under pressure. He also went on schooling abroad several times and did his Masters in Australia. He also went for UN mission which all required strict neuro-psychiatric test. He reached the rank of full Colonel and was confirmed by the commission on appointments requiring again NP clearance.
