This is the latest from Harry Roque:
A status hearing was held yesterday, 20 September 2006 in Milwaukee on Bolante’s Habeas corpus petition. Bolantes lawyer insisted on a hearing, while the US OSG maintained that no hearing was necessary since the pleadings contain all relevant factual and legal issues. We are awaiting word on what happened to that hearing.
We have, however, been furnished copies of the latest pleadings consisting of the response of Condelizza Rice and the reply thereto of Bolante. The salient points are:
In Condi’s answer, she said that the detention of an arriving alien without a visa is a lawful basis for detention. Likewise, she asserted that Bolante is not entitled to bail as an arriving alien subject to exclusion proceeding.
In his reply, Bolante alleged jurisdcitional issues insisting that Rice and the other cabinet offcials being sued, and not just the warden of the Kenosha facility, could be impleaded. Noteworthy in the reply is confirmation that Bolante has indeed been denied bail since they attached a copy of the Immigration court ruling dated 13 September which says :”Respondent is an arriving alien and charged with inadmissibility under section 212 (a) (7) (A) (i) (I). Respondent’s bond motion does not present any argument about jurisdiction, it is well settled that this court does not have jurisdiction over bond for an arriving alien, see 8 CFR 1003.19 (h) (2)(i)(B)”
This order confirms my earlier report that the motion for Bail was DENIED and not merely “not tackled” as reported by an internet news organization last 14 September 2007.
My position remains the same: Bolante only has two options: voluntary deportation or incarceration. I will now add: Good for him!

Well! Well! At least, the Pilipinos are getting justice at last, somewhat, with the help of the USA. I would prefer Bolate remain incarcerated in USA forever, if it’s possible to the remaining of his useful life, how long would, matter not. What’s now important is that he’s in jail, since July 7, 2006, I believe, when he was picked up, held ever since behind bars, like a convicted criminal that he is. To my perspective, it’s worth a portion of the P728 million. However, it would be nice, very nice indeed, if this Bolate case would’ve have a more happy ending for the sake of the Philippines and justice. And why not!
If I may add, we should give credit and well deserve thanks to Atty Harry Roque for staying in with this case and updating the Pilipinos. Illegitimate Gloria’s admin. supposedly a transparency govt, was nothing but a lie. And why am not surprised about illegitimate Gloria’s lying? In addition, as Atty Roque stated, “they will hunt Bolate wherever he goes to get justice.” Great!

The case and RP’s future lie on the hands of the Americans, whether you believe it or not. If Bolante’s case is tied to Nicole’s rape case and other unseen reasons favoring the US interest, Bolante might still get away. Incidentally, where does Atty. Roque get the money and funds to pursue Bolante in the US such as his traveling expenses and the other necessities? Out of his own pocket or funded by the Senate from Magsaysay’s Committee?
Not to meaning to be too cynical, it remains unclear to me why Atty. Roque is going the extra mile in the case of Bolante. For whatever reasons Atty. Roque may have in pursuing this case so “heroically,” nevertheless, he must be thanked for all his efforts. At least we are kept abreast with this case, as Gloria and her Legions are, true to form, gagging the TRUTH.

What I said was I was being supported by Someone Very Powerful Up There! Roque definitely has the same patron even in giving him the courage and brain to do what he is doing now.

It reminds me of a member of the Japanese Amicus Curiae who was ironically a die-hard Bush critic being assigned as defender for Bush. Ironically, he was able to defend Bush, et al even on the basis of the evidences presented in the people’s court where the defendants were convicted in absentia! The actual trial will soon be held I believe in the Hague of these tribunal that was started in 2003 soon after the attack on Iraq.

Norpil, are you a lawyer? Are you still practicing? What do you specialize in? At least, we have someone here who has legal background. A court interpreter or criminal investigator doesn’t have all the knowledge to provide legal information in this blog. For instance, how could someone so stu…I refuse to continue the word…to state that US Permanent Residents could perform jury duties in US courts. Of course even if you’re not in the US, Norpil, you know that only US citizens can act as jurors.
sorry npongco, i am not a lawyer which is why i said i am true to my unprofession.i said this more of a joke and trying my grotesque sense of humor.as i have said before i am an engineer but i cannot say no to a lady even though i have not seen her yet, that is why i accept the position of a defender.
just to continue, to justify myself. though i am not a lawyer, i also have been many times in court due to interpreting though the payment here is not so high at that time which was at least 15 years ago.some years ago i was appointed as layman or jury on call.i donot know in the usa but in norway one must be a citizen and no previous records.the difference here is that the judge can overrule the jury unlike the ones i have seen in american films.my experience had been only on misuse of children and misuse of working regulations like getting jobless payment when in fact one is working.
To insinuate that Atty. Roque is getting money for his effort, or that he is being used by anyone is an insult of the highest degree to the integrity of this man, to whom his people in fact should be grateful for what he has accomplished so far because in the US, at least, we see that there still is a rule of law, and that regardless of any attempt to do a Gloria (meaning graft and corruption Pidal-style), we have seen how the truth and justice prevail.
It is actually just a matter of knowing the applicable articles of the law to try to stop any attempt at circumventing the law, especially by one who simply has to agree to be deported as the law requires and provides. The A to A procedure in fact is better than having the word “DEPORTED” stamped on one’s passport although I suppose the word “CANCELLED” had been imprinted on Bolate’s passport over his B1/B2 visa.
It was actually what we have tried to do here. Right Ellen? Look for the applicable law and see how feasible the claims of Bolate would be. I give you five, Ellen! I give fellow UPian, Atty. Roque, too!!! 3 cheers!

The tribunal has to have only three judges. The victims of the abuses may do well as witnesses. We cannot have a prejudiced panel of judges. It is conflict of interest if indeed we want to be fair.
To question the source of funds of Atty Roque is beside the point. We know that it is not coming from the evil couple. What matters is he is doing it for the Filipino people, and whoever is patron or patrons, we know that they are for truth and justice.
For Bolate to agree to being incarcerated that long even as a detainee is showing enough of what kind of crook sans any decency this person is. Biro mo iyong makulong ka and be treated like a true criminal and possible enemy of the state! Gosh, walanghiya na talaga ang taong ito—like his amo!

Atty. Roque has already emphatically stated that he is not getting any renumeration for his effort that in fact is what majority of Filipinos should be doing or wanting to do by all means. I believe him. I know he is capable of doing just what he has already stated as he is moved by his love for his country and people even against all odds.
I, for one, have spent thousands and even millions of yen in my advocacies for Filipinos in Japan. My group for instance is privileged to get fundings from the Japanese government after I registered our group officially as an NPO. But aware of the greedy people who want to take advantage of such funding, I am not getting such fund but teach my members to raise the needed revolving by some other more creative ways!
To Atty. Roque, thank you for all that you have accomplished so far. Next will be the finale that will prove if indeed the Filipinos can be saved and deserved to be saved from a maldita na kire pa spoiled brat!

You’re right, I just read Atty Roque’s statement posted by Ellen.
The only division I observe in fact is the division between the bloggers, who deserve to be blogging here, and the detractor or detractors posing as pro-GMA, anti-GMA and in between.
I know one that I have encountered in some e-forums and wonder if this guy is a woman or a man for he/she can blog in both female and male names, and then quarrel with himself! It’s easy to detect these entities as a matter of fact even when they blog in as anti-GMA compared to the real Macoys, who cannot be bent and stick to their guns.
Unfortunately, a lot of them cannot even get into the blog most of the time especially when it is occupied by these Internet Brigade who try to give the impression that the the struggle is over and everyone may just as well give up!
Thanks to the likes of Atty. Roque. What he did is more than enough. It proves that number is not important, and even a lonely person can do a miracle if he is right and knows what he is doing!!!

i do’nt think one can say that the japanese system in the field of engineering is patterned after the germans, may be some fields but not in general.i am a member of the international asso of bridge and structural engineers and i have not heard of this.just recently in a symposium in budapest where some talk about standards in japan, to me it looks like more american than german.

Roque is getting money for his effort, or that he is being used by anyone is an insult of the highest degree to the integrity of this man, to whom his people in fact should be grateful for what he has accomplished so far because in the US, at least, we see that there still is a rule of law, and that regardless of any attempt to do a Gloria (meaning graft and corruption Pidal-style), we have seen how the truth and justice prevail.

Norpil, we have actually two good policewomen but one is a fake who only knows how to bla-bla and feeds wrong information to unsuspecting readers. Yea, it’s unfair to accuse of Atty. Roque of being bribed to pursue Bolante’s case. It’s even worse to suspect that he’s a mole from Malacanang pretending to be against Bolante but in reality secretly helping him in the US. Nevertheless, can we blame people these days for being suspicious of our officials in the country be they advocates like Roque? No. Whoever would have imagined that Senator Angara was a traitor and a Palace spy in the opposition? Who would have expected those witnesses to jump to the administration side? Who would have thought that this Senator Miriam Santiago with her level of position would be kissing and licking GMA’s ass these days? Who would have expected Imee Marcos defending Kris Aquino? The Marcos and Aquino families are mortal enemies. We can’t be sure these days. We just have to keep our guard real close.

BOAC, MARINDUQUE—A provincial board member of the province is set to file a resolution this week for the provincial government, through the office of Gov. Carmencita Reyes, to request assistance from the national government to mitigate the impact of the oil sludge that has affected 15 coastal barangays of the province.
Board member Alan Nepomuceno, committee on public order and safety chair, also expressed optimism that the investigating body, led by the provincial government and the Provincial Environment and Natural Resources Office, would soon be able to pinpoint the culprit.
“Whoever caused this incident has to answer for the consequence,” said Nepomuceno.
The office of Rep. Edmundo Reyes, lone representative of the province, is currently seeking financial assistance from the National Disaster Coordinating Council of the Office of Civil Defense to help affected fishermen.
The fishermen’s fish catch has dwindled since last week and has greatly affected the villagers’ only livelihood.

Mystery ship suspected of dumping bunker oil -—–ABS-CBN News
A still unidentified ship that anchored near a Marinduque port four days ago is now suspected of having dumped used oil in the waters of the province after “oil sheen” was found floating in the area Sunday morning.
Residents of coastal barangays in Marinduque discovered the “oil sheen,” describing it as film-like and glossy.
This prompted provincial authorities led by the Philippine Coast Guard in the region to conduct a cleanup.
Vicente Paragas, regional executive director of the Department of Environment and Natural Resources, said the said ship sighted 12 miles from Laylay Port in Barangay Boac, Marinduque, may have been the source of the used oil.
“Our initial information is that the ship docked 12 miles from the Laylay Port from September 14 to 16. And then when they left, the oil sheen was already there floating,” Paragas said.
Authorities took samples to determine what kind of oil was dumped, suspecting it to be bunker fuel.
“We still could not determine the volume of the oil sheen, but the cleanup has been done,” he said.
Paragas said the “oil sheen” affected 12 barangays in the island, including Maligaya and Kawit.
Mayor Meynard Solomon of Boac said he asked the Coast Guard to search for records of the unidentified ship.

Chemical spilled into Bauan sea -—–ABS-CBN News
Some 400 liters of a chemical used to manufacture vinyl products spilled into the sea off Bauan, Batangas Saturday morning, ABS-CBN News reported Sunday.
Police Officer 2 Eliseo Dolor said the chemical was accidentally dumped into the waters off the coast of Barangay San Miguel, which is near the Batangas Bay Terminal Incorporated.
Dolor said the accident occurred while the tanker Ginga Falcon was transferring the chemical to another vessel owned by Mabuhay Vinyl Inc. An initial reports said the mechanical hose used to transfer the chemical was connected to the wrong pipe of the Mabuhay vessel.
Ginga Falcon was carrying 4,000 metric tons of caustic soda, Dolor added.
The municipal health office in Bauan has yet to determine the negative effects of the chemical spill on the health of residents and marine life.
No casualities were reported as of posting time. Officials were also uncertain on the extent of ecological damage.
