Ang kalakaran sa DOJ

Sa paglilibre ni Justice Secretary Raul Gonzalez ang sarili sa kaso nitong “Alabang Boys”, kailangan niya ilalaglag ang kanyang mga tauhan.

Kunwari pina-imbistigahan niya ang napabalitang suhulan sa pagpalaya sa mga “Alabang boys” na sina Richard Brodett, Jorge Joseph and Joseph Tecson. Ngunit binira rin niya ang Philippine Drug Enforcement Agency lalo pa si Maj. Ferdinand Marcelino kung bakit raw hindi hinuli ang nagtangkang sumuhol sa kanila.

Si Marcelino pa ang may kasalanan. Pambihirang buhay naman ito.

Sinabi ni Marcelino na binigay niya ang ibang detalya ng tangkang panunuhol sa executive session ng committee ay iyon ay confidential. Sinasabi ni Marcelino na madali lang sabihin na “bakit hindi mo hinuli, bakit hindi kayo ng entrapment operation” ngunit hindi madali yun.

Isa dahilan, sa text pinadaan ang bribe try. At hindi na sila nagkaroon ng pagkakataon ng entrapment sa dami at bilis ng mga pangyayari.

My ilang minuto sa hearing kahapon sa House of Representatives na si Gonzalez ang nagtatanong kay Marcelino. Bakit ganun? Pareho silang resource persons doon. Dapat ang nagtatanong ay ang mga congressmen na miyembro ng committee. Mabuti lang pinahinto ni Rep. Roilo Golez.

Para lumamig ang ulo ng mga tao doon, isinalang ang dating artista na si Dave Brodett, ang kanyang asawang si Marisa at ang kanilang anak na Anthony na nagsabing totoo na drug user at pusher talaga si Richard. At kinukunsinti pa raw ng magulang, lalo na ng nanay.

Magsasalita na sana si Marisa Brodett tungkol sa suhulan kaya lang naisip niyang kumunsulta muna sa abogado.

May isang tanong si Atty Alvaro Lazaro na paulit-ulit tinatong rin ng ibang congressman: “Ano ba ang kalakaran sa DOJ?”. Ang ibig sabihin ng kalakaran ay karaniwang gawain.

May koneksyon ang tanong na ito ni Lazaro sa Memorandum Circular 46 ng department of Justice na pinalabas noong Hunyo 2003 ni dating Justice Secretary Simeon Datumanong na lahat na kasong lampas sa limang taon na pagkakulong ang sentensya, lalo pa sa kaso ng smuggling at droga, kailangan may automatic review ng secretary of justice.

Binalewala kasi ng mga DOJ prosecutor itong Memo Circular 46 at nagpalabas ng resolusyon na wala raw dahilan para sampahan ng kaso sina Brodett, Joseph at Tecson at maari nang palabasin bago mag-Pasko. Pinanindigan ni State prosecutor John Resado, Senior State prosecutor Philip Kimpo at Chief State Prosecutor Jovencito Zuño na ang “kalakaran” daw sa DOJ ay pinapalaya na ang mga suspek kapag may resolusyon na pabor sa kanila kahit hindi na-review ng secretary of justice.

Magkano naman kaya ang presyo ng “kalakaran” na yun?

Dahil nga na eskandalo na ang kaso nitong “Alabang boys”, nagpalabas raw ng order si Gonzalez noong, Jan. 5, na lahat ngayon ng resolusyon ay kailangan dumaan sa kanya. Noong Lunes lang yun.

Sa tingin ng madla, may nangyari talagang bayaran sa DOJ. Hindi lang kina Zuno, Kimpo, Resado.

    Those who know Raul Goonzalez say that he’s very strict with the things he does and study very carefully the documents he approves and signs. If this is so, why is DOJ rocked with scandals under his leadership? It’s very inconceivable that the did not know what was going on in his department. Many high profile cases were dismissed. His department dismissed cases on mere technicalities despite hard evidences. Had this drug case involving the rich Alabang Boys not exposed in the media and public, we wouldn’t know how rotten and corrupt these DOJ prosecutors are. In the end, it’s hard to believe that Goonzalez was not aware and not part of the scandals. He takes orders from Malacanang. So, if he was involved…so was Malacanang.

    Vic, I’ve mentioned a few times that the DOJ has what they called “Ateneo Mafia” inside beginning the time of Nani Perez.
    Many are still there…but of course today, not all are from Ateneo.

Kailangan ay mas tulungan at bigyan ng support sila ngayon para lalong tumibay at hindi matuso sa mga buwitre sa gobyerno natin.     DKG, i agree sa sinabi mong paki-lifestyle check itong John Resado. Ang dapat pa nga ay lahat ng mga prosecutors at pati na rin yung hepe nila ay maisama sa lifestyle check.

    Ang sabi ni Chief Justice Reynato Puno, he is in favor of reopening to the public the Statements of Assets Liabilities and Networth (SALNs) of Supreme Court justices and other members of the judiciary.

    Dapat pati yung sa DOJ, Ombudsman at Sandigan ay maipubliko rin ang kanilang SALN.

    Raul Goonzalez needs more funds for his son who’s a congressman. And of course he needs the money for her other family.

    Major Marcelino comes from a very humble beginning…even until now. His mother’s house in Bulacan badly needs repairs but he has no money to fix it. His older sister died of cancer because he did not have the P80,000 to prolong her life. He was able to study at a private Catholic high school on scholarship graduating with honors. He was not able to continue college for lack of money. So, he worked as police reporter. It was during job that he got to interview the PMA Commandant. He got hold of an application; applied and passed. The rest is history.

    On Dec. 18 at around 8:30 a.m., Caloocan Mayor Recom Echiverri alighted from his car at West Triangle, Quezon City, approached coeds from JASHMS and started mashing and groping one of the girls, a 19-year-old mestiza. The Barangay chairman of the place and several witnesses confirmed the incident. To date the Mayor has not issued a formal denial. He has refused to be interviewed by the media.

    May isang kaso kung saan nabaril ang isang pamangkin ko sa isang club sa Parañaque nung mamagitan siya sa dalawang nag-aaway na kapwa niya kilala. Maaga nilang naramdaman na ilalaglag sila ng Fiscal dahil ni hindi man lang nakulong yung suspect matapos maaresto. Binigyan ng pinsan ko ng isang “manok” yung fiscal makulong lang yung bumaril kahit isang araw, walang nangyari. Dahilan ng fiscal, nasa opisina na ni Zuño ang papeles para pirmahan.

    Sinundan ng pinsan ko sa opisina ni Zuño na may kasamang tatlong manok (o 3M Pizza pie) pa. Titignan daw niya ang magagawa. Wala ring nangyari, self-defense daw kaya nadismiss.

    Paanong self-defense a may baril yung suspect at yung pamangkin ko nasa kotse yung baril? Pareho raw kasing nanggaling sa firing range kaya alam nung suspect na may dala rin yung pamangkin ko. Kahit saan tignan, walang self-defense dahil hindi naman hawak ng pamangkin ko yung baril niya nung putukan siya. Saka ano’ng karapatan ng prosecutor na magsabing self-defense yun? Sa korte na yun huhusgahan ang mahalaga sa fiscal, may pamamaril na nangyari, narecover yung baril at maraming witness, kasama na iyung unang kaaway, na ang bumaril sa pamangkin ko ay yung suspect mismo. Prima Facie yun at malakas ang probable cause.

    Noon pa ay marami na akong natutunan dito sa kaso ng pamangkin ko:
    1. Na hindi lang suspect ang hinihingian ng “manok” sa DOJ, pati biktima rin
    2. Na walang kasiguruhan na makukuha mo ang gusto mo kahit marami kang ibinatong manok o pizza
    3. Na kapag ang nakalaban mo sa kaso ay may manukan, o factory ng pizza, walang mangyayari kahit batuhan mo ang fiscal, pati na si Zuño
    4. Na ang hustisya sa Pilipinas ay may presyo, at tumataas yan depende kung parehong handang magbigay ang parehong panig, siyempre yung mas maraming manok o pizza ang mananalo.

    Wala nang pag-asa ang gobyernong ito, lahat ng bagay, pera-pera lang.

    The only time that Zuno laid low was under Cuevas and Tuquero’s leadership. Zuno made up for the lost time (money) by being a partner in crime of Nani Perez…until this day.

    Witness si Arnold Clavio doon sa Senado noon, and to this day, Arnold repeats on radio and swears by it, that the specimen signatures Iggy Arroyo made in front of the senators and that piece of paper later shown by Mosqueda to media that the PNP Crime Lab “confirms” to be authentic ARE NOT THE SAME samples.

    Yung na-test sa PNP siyempre, pirma na nung tunay na Jose Pidal!

    Kaya naman Regional Director ang reward nung gago. Pero mas gago yung mga kababayan niya, sa Estancia iloilo, akalain mong ibinotong mayor doon!     I know of a friend who also paid DOJ to have a case in Aklan dismissed. High department level, as in highest.

    That’s why all these seeming confusion in the interpretation of Memorandum Circular 46 is intentional.

    As pointed out in the hearing, it was only last Monday that Siraulo Gonzalez issued an order for him to review all resolutions on drug cases.

    That justifies the actions of Resado, Kimpo and Zuno.

    Resado gave a lot of weight on what he described as “incredible” the “budol” (fake) money story of PDEA. It’s unbelievable daw na sinuklian pa ni Brodett the PDEA agent that posed as buyer.

    Maj. Marcelino explained that Brodett was high at that time. He said nagtawanan nga sila sa office over that.

  37. Off topic, Ellen where is that thread about Dennis Garcia, I can’t find it anymore. Idol ko si Dennis at the time I started learning to play bass. It’s a pity he gave up music for advertising. The last time I saw Hotdogs live was their first reunion concert at Enchanted Kingdom, minus Dennis. When I asked his brother Rene why Dennis wasn’t around he said Dennis was busy with his business in the states.

    ng akala ko na pag abogado ka mahusay ka sa English..as almost all legal documents are written in English (or Spanish noong araw)..kung mali-mali how is he/she present the arguments; how will motions be written; paano susulatin ang summation? kung sabagay mayroong libro na Legal Forms.
    Kung sa bagay dito din sa America ngayon mali mali din ang grammar and spelling..

    Tongue: I think years ago..noong bata ba si Isabel..there was a well known lawyer, Felixberto Verano..who if I am not mistaken was a senator or a law professor…yong na mention mo sa itaas baka tatay niya..kung sino mang abogado dito na kasing edad ko or older than I am would have heard of this one…hindi Isabel ang pangalan ko pero kalaro ko siya!

    So what if it is improbable na magsusukli ang pusher? The money, fake or not, would have the fingerprints of the seller; proof that something was sold. The sachets of cocaine, they would also have fingerprints. Physical evidence always trumps haka-haka (improbable na magsukli, therefore, hindi nangyari).

    Mayroon bang magiting na fiscal sa QC or Alabang? Puntahan ng PDEA, then file the case. Kapag nasa court na, the only way that the Sickotary of Justice can step in is if a motion for reinvestigation is GRANTED by the judge.

    Oops, that presumes the sickos do not have the judge in their pockets.

    Former solicitor general Frank Chavez called on Secretary Gonzalez to place the state prosecutors involved in the case of the “Alabang Boys” under preventive suspension pending the completion of an internal investigation.

    “This is what I have been saying all along. This is the ‘Department store of Justice’ where lawyers can get the resolutions they want for their clients for the right price,” he said.

    Do you know what Sec. Gonzales meant when he said, “Between the devil and the deep blue sea tayo,” when Malacanang ordered him to reopen dismissed drug cases?

    When Zuño was being considered as Ombudsman, he was being projected in media as “uncorruptible”. It’s a good thing, this “Alabang boys” incident happened. He has been unmasked.

    Resado told Lazaro, the PDEA lawyer, that it was Zuño who signed.

    This Gonzalez, kunyari lang yan pa-investigate but right now I’m sure right now, they are into damage control operation. Babalikan pa si Marcelino.

    As in any corrupt agency, the bribe money is divided among the groups…the higher up gets the most and the lowest the least.
    It’s only when one is unhappy with the division or is not given his share that the mess gets leaked out.

    Criminals first bribe the arresting officers. If they fail, they go to the fiscal or prosecutor. The longer and the higher the case goes, the more money the criminals need to give.

    FYI…Zuno just “looks decent”. He is not. He was supposedly fixed by a notorious lawyer who handles drug-related cases, and is an election fixer as well. The lawyer is a law partner of Matt Defensor, who chairs the House Committee on Justice, and is a bosom buddy of Mike Defensor as well. Together they used to hold orgies at Discovery Suites, along with Ricky Sandoval, all “ecstasy” fueled.

    MANILA, Philippines — If Philippine Drug Enforcement Agency Director General Dionisio Santiago had his way, he would want the death penalty restored as punishment for convicted drug users and pushers.

    In an interview Thursday, Santiago said this was “very urgent,” since drug use in the country was a “security threat.”

    ….Remember Lim Seng who was executed by Marcos? One reason why the criminals have become bolder today is the abolition of death penalty.

Fellow readers, what’s going on now is clear and blatant disrespect of the law by the very same people who are sworn to uphold it. DOJ is one that can be bought. PDEA for its part have done everything in its might to implement their mandate but as you see, these are elite individuals or have connections with the high and mighty. The law is different for these people. They are only good in social functions, they donate to charities, they rub elbows with the shakers and movers of society but they are just the same rotten eggs inside! Drugs to these people is part of their socialization, but for the lumpen even a brgy. tanod can arrest you and you rot in the city jail. Nobody will lift a finger for you (no 3 manok, even in literal terms). So my point is, like the movie “Untouchable” Malone said ” they pull out a knife, you pull out a gun, they send your men to the hospital send their’s to the morgue”. There’s no other way I could think to teach these brats a lesson. May I also bring this issue regarding the Tanay boys, these alabang shits don’t even come close to the merits of the case. Why don’t the AFP see this picture and just release these honorable men and woman. Give these people their right and justice! We already see that in this admin good deeds are punished or if not doubted and put in question but the lawbreakers/drug dealers are rewarded if you happen to have an Alabang address. What a shame! To me I think when these shits are getting their way by money and circumvent the law then I would also circumvent the law and sorry to say kangaroo justice of Ka Roger would be much welcome and implemented. To end this litany of mine I say there’s only law I follow, article 38 and section 45.

    If our drug enforcement agency and prosecuting judges only know the business side of this mess and the revenue that can be generated thru exchange of information to catch the big fish and its international source ,this country will be better . The big fish can pay more bail or thru confiscation of their assets ( confiscating is the best legal way of accumulating revenue) just think about it. To catch the big fish , the small fish must be gathered in jail.

    The case against the ‘Alabang Boys’ is not the only high-profile case dismissed by the Department of Justice. Data from the Philippine Drug Enforcement Agency (PDEA) legal prosecution service reveal that there were nine other cases dismissed from 2003 to 2008.

    The most common reasons for dismissing the cases are lack of evidence and illegal arrest. Among these are:

    Naguillan, La Union clandestine laboratory
    Date of operation: July 9, 2008
    Date dismissed: November 12, 2008

    Allegedly the biggest haul of illegal drugs seized in the country, the shabu laboratory was raided and evidences were hoarded into six trucks for investigation. Evidences found included: burners, 24 LPG tanks, 52 cauldrons, 80 sacks of soda potassium hydrate, 79 bottles of iodine crystals, 15 barrels of phosphorous, 65 boxes of ethanol, and other items suspected to have been used to manufacture shabu. An estimated 180,000 kilos of shabu or equivalent to P1 trillion can be manufactured with these materials. Four months after the raid, the case against police superintendent Dionisio Borromeo, PO1 Rodolfo Damian Jr, Eusebio Tangalin, George Cordero, and Joey Abang, five of the six arrested suspects, was dismissed. In January 4, 2009, Justice Secretary Raul Gonzalez, heeding the call of President Arroyo, ordered the reinvestigation of the case.

    Pagsawitan, Sta. Cruz Laguna clandestine laboratory
    Date of operation: October 30, 2007
    Date dismissed: January 10, 2008

    Authorities arrested 10 members, with Singaporean, Chinese-Filipino, and Chinese nationals in a drug raid considered as one of the biggest hauls in the country. Chinese-Filipino Bruce “Mr. Tan” Ong, Abdul Gaafar Bonsalangan, Cosami Patimbang, Singaporean Soon Foo Siong, Malaysian Chin Soon Goon, and Chinese nationals Bg Tou Heoung and Jameson Go were captured along with bottles of hydrochloric acid, sodium hydroxide, barium sulfate, sodium acetate, and other equipments used in manufacturing shabu. According to PDEA deputy director for operations Rodolfo Caisip, the laboratory was in operation for more than a year and exports illegal drugs to other Asian countries. The case was dropped three months after due to “insufficiency of evidence.”

    Subic Smuggling Case
    Date of operation: May 25, 2008
    Date dismissed: August 27, 2008

    An estimated P4.62 billion-worth of illegal drugs was confiscated while in transport to Subic. The kilos of shabu were sealed in carbon boxes and were labeled as computer parts. Investigations led authorities to the warehouse owned by Anthony “Anton” Ang, where 60 more boxes of illegal drugs were found. Subic Bay Metropolitan Authority administrator Armand Arreza claimed that Ang tried to bribe the Presidential Anti-Smuggling Group and SBMA agents with P50 million to dismiss the case. His case was dismissed three months after the incident.

    Calumpit, Bulacan clandestine laboratory
    Date of operation: December 22, 2006
    Date dismissed: November 23, 2007

    Joint efforts of Philippine and Chinese agents resulted in the arrest of members of one of the biggest drug syndicates in Asia. Three Chinese suspected members of the syndicated were arrested in NAIA. These Chinese nationals pointed to a laboratory in Bulacan. Fourteen Chinese nationals and two Filipinos were arrested and P1.5 billion worth of shabu was confiscated. Filipino suspects Cesar Santos and Monching Padanganan were dismissed after 11 months while the 14 arrested Chinese nationals were “charged in court with pending warrant of arrests.”

    200 pieces of Ecstasy
    Date of operation: February 22, 2008
    Date dismissed: June 16, 2008

    Ivan Sarmiento was arrested in a buy-bust operation conducted by the Philippine Drug Enforcement Agency in Makati while handing over 200 pieces of ecstasy worth P147,000. Four months after, Sarmiento was dismissed due to “insufficiency of evidence.”
