After 27 hearings, the military court has finally arraigned yesterday 28 officers for mutiny in connection with the alleged February 2006 plot to withdraw support from President Arroyo and the Marines stand-off. But neither a guilty nor a not guilty plea was entered by any of the accused, with their defense counsels entered a special plea contesting the charge against them.
The detainees, led by former Marines commandant Maj. Gen. Renato Miranda all entered a special plea to demur the charges against them on the grounds that the facts of their charges do not constitute a punishable act, and that more than one offense is charged in any particular specification. Some junior officers as basis for their demurrer cited that the offense as charged exculpated them from any participation. The defense lawyers were given 20 days to submit their written arguments for their demurrer and the prosecution 15 days to respond after receipt thereof.
The arraignment came 3 days before Armed Forces Chief of Staff Gen. Hermogenes Esperon Jr. ends his 3-month extension.
Esperon is the convening authority that created the special general court martial trying the case of the 28 officers, in reversing the recommendation of a pre-trial investigation committee that cleared them of mutiny.
Most of the accused waived the reading of the charge against them before they entered special pleas, but most of the senior officers preferred to be read the charges while standing in front of the panel members of the court.
One of the accused, Marines Col. Ariel Querubin said he chose to hear the charge of mutiny that never happened if only to make the court hear the irony of facing a trial for a crime that never transpired.
While Capt. Ruben Guinolbay dispensed of the reading of the charge, he chose to address the court with a statement. Guinolbay who has fought many battles and won them together with Esperon in Mindanao said, “it’s been two long years of incarceration, two long years of doing nothing. Two years were taken out of our lives waiting for justice. As Gen. Esperon told me seven days before I was sent to jail, to make the military justice take its course, I (should) put my trust in the military justice system. I don’t ask for mercy, I only ask the court to look at the case as it is. We were exonerated by a pre-trial investigation panel but that was changed with just one stroke of a pen. We were unjustly jailed and we don’t deserve a second more in jail.”
Aside from mutiny, the 28 officers are also facing charges of “Conduct Unbecoming of an Officer and Gentleman” and “Conduct Prejudicial to Public Order and Military Discipline” that were supposed to have prescribed when the court failed to arraign them two years from the alleged date of the commission. The court has yet to rule on the issue of prescription.
Yesterday, both the defense and prosecution argued whether they will also arraign the officers for the other charges. But since there were opposing views on whether the lesser offenses have prescribed, the defense was given 30 days to submit their position paper and the prosecution their objection after receipt thereof.

Next time these military officers move, they should make sure they take down Esperon and his master — Gloria. Then we will see less of these hocus pocus bogus arraignments, trials, etc.
Even if the ass will be retiring, these 27 honorable officres will have to put up with the evil bitch for another two years, perhaps. Whoever succeeds the ass will of course follow the “chain of command” and will continue to detain them. I am not hopeful that this kangaroo court created by ass will be any different in the next two years while the evil bitch is in power.
So, valiant men of honor, hang in there! Justice will be served one way or the other, not coming from this cheating, lying and murdering regime.

I don’t trust that Yano will do something positive about the case of the Tanay boys and the remaining Magdalo.

Mutiny charges against the accused should have been out of the picture by now but that didn’t satisfy the inflated ego of Esperon, he acted as accuser and judge at nilutong macaw niya ang case and charges were finally filed. How the case will end depends entirely on the whims of Esperon and Gloria. Don’t count out Esperon as yet. He maybe out as COS but he still has his Gloria and his puppies in the loop and unless incoming Yano carries his balls with him, and be his own man all the accused can kiss goodbye to a fair trial. Esperon’s pride and ego can not accept losing to officers under his command and sending them to jail is his only comfort zone.
I agree with you Chi and Bitchevil! Isa sa mga conditions ng pagiging CS ni Yano ay ang siguradong pananatili ng mga Tanay Boys sa detention. Although I could see that Yano distanced himself from the ass as much as he could, nakuha pa ring iinitiate ni ass si Yano by having Yano dismiss the 40 detained enlisted men in Tanay on Christmas day and also he was able to make Yano swear that he will not re-open the Mayuga report. What do you expect? Soldiers are trained to just follow even if their leaders are known criminals! Kaya nga nakakulong ang mga Tanay Boys because they went against the grain and followed their conscience.

Wow! Walang imbestigasyon na tama, na-indict? Iyong tinagal nila sa kulungan without proper investigation, etc. should have been ground enough for dismissal of their cases. Tindi naman ng kawalang ng proper criminal procedure sa Pilipinas.
Sa amin pinakamatagal na ang 20 days para ma-indict ang isang nagkasala sa batas at kung walang makuhang ebidensiya, pinapakawalan. Matinik kasi ang mga bar associations dito at talaga namang pinangangalagaan ang kanilang mga miyembro para na rin sa pagmamanatili ng reputasyon ng kanilang mga organisasyon at propesyon. Bakit hindi iyan magawa sa Pilipinas?

Col Querubin is back in V Luna hospital. He is being treated for his ulcers, follow up treatments for his blocked arteries and intermittent high fever and chills due possibly to a malaria strain. More so, is the stress of his incarceration and the fight for his life and career.
Even the other incarcerated, Col Segumalian and Maj Doctolero were likewise treated recently and may even be under treatment to date.
Who would not get sick in the unventilated cells asspweron had put them in. Most of these officers have a daily routine to excercise but even that has been taken away from them. The evil bitch and the ass are acting like they are on top of the world now. Let us see where they will be when the tide turns!
Esperon is trying to defends his allegedly harsh treatment of the detained officers. But no matter what he does now, the fact remains, that he dodged the Hello Garci inquiries, and refused to face due process, but the men he calls “destabilizers” he compels to undergo trial and jail, even if they have no fault or crime. Big fat coward.

i don’t see any hope for the 28 officers even with esperon’s retirement. gloria arroyo will make sure they will stay in jail while she’s in power. they won’t stand a chance against this vindictive regime.
“‘Tanay boys’ rule out seeking pardon.” says a Malaya report. Iyan ang tunay. Tama nga naman sila. Bakit sila hihingi ng pardon e wala naman silang kasalanan. At saka tarantado lang ang hihingi ng pardon sa isang mas kriminal gaya ni Gloria Dorobo na magaling lang lumandi. Gutom na ang mga kababayan niya nakangiti pa rin ang ungas komo hindi siya nakakaranas ng gutom ng mga kababayan niya. Libre tsibog pa kasi ang ungas, paid for with money from the national coffers. Bakit hindi pa humihirit ang mga pilipino?
