Tanay boys’ resist handcuffing;court martial proceedings stalled

In a show of defiance, military officers facing court martial for the supposed power grab attempt in February 2006 yesterday refused to be brought to the court in handcuffs.

The court martial proceedings were held in Camp Capinpin in Tanay, Rizal, where 26 of the 28 accused Army and Marines officers have been detained for almost two years.

The court opened proceedings at around 10:30 a.m. and recessed for lunch about two hours later after discussions on the absence of 24 of the accused officers.

It was supposed to resume proceedings at 2 p.m.

At around 3:30 p.m., two companies (about 240 soldiers) in full battle gear and aboard three trucks formed a few meters from the detention cell of the officers who refused to be brought to the court in handcuffs on the ground they had not been convicted.

It was a “show of force,” said Lt. Col. Charlie Galvez, assistant chief of staff for civil military operations of the Army’s 2nd Infantry Division based in Camp Capinpin, of the deployment of troops.

“They just wanted to flex their muscle. The court had been diplomatic to give some compromise but in this case, there is a need to impose the will of the court,” he said.

About 15 minutes later, the court reconvened only to adjourn shortly because of the absence not only of the accused but also of the defense lawyers.

Col. Arnulfo Marcos, commander of the AFP custodial center, said he was ordered verbally by Col. Ireneo Espino, chief of the AFP headquarters support group, to bring the accused to the court in handcuffs “for security reasons.”

But the accused “refused to come in handcuffs,” Marcos told the court on questioning of defense lawyers.

There was also an order for the accused to be brought to the court in batches of four.

Marcos was later pressed by defense counsel Dante Atienza for his apparent double standard in enforcing the order.

Atienza noted that four of the accused, Brig. Gen. Danilo Lim, Col. Ariel Querubin, Col. Orlando de Leon and Maj. Francisco Fernandez, were brought to the court without handcuffs.

Lim was brought to Camp Capinpin from the PNP custodial center in Camp Crame where he has been detained for the November 29 Manila Peninsula standoff. He used to be detained in Camp Capinpin along with 26 other officers led by Maj. Gen. Renato Miranda, former Marines commandant.

A 28th accused, Capt. Dante Langkit, is detained at the Army headquarters in Fort Bonifacio, Taguig.

Tempers flare

Marcos, irritated by Atienza’s barrage of questions, challenged the defense lawyer to a fistfight.

An irked Atienza and fellow defense lawyer Alex Avisado moved that the court declare Marcos in contempt.

But Maj. Gen. Jogy Leo Fojas, the court’s president, merely censured Marcos for his remarks.

Pressed by Atienza why four of the accused were transported to the court without handcuffs, Marcos said it was Fojas who ordered him to “bring the four (accused) even without handcuffs.”

Unruly behavior

Fojas later admitted the court planned to arraign the accused in batches because the accused, he said, were unruly in previous hearings and the defense lawyers could not control their clients, referring to a hearing last December.

Defense lawyer Vicente Verdadero belied Fojas’ statement, saying the accused were “just expressing their grievances” for the court’s decision not to allow some of the accused to exercise their right to peremptory challenge.

“They would like attend the proceedings but they were prevented… what is the military afraid of that warrants their handcuffing? If they (military) want to humiliate them, they are not going to succeed,” said Verdadero who represents Lim.

Co-conspirators

The defense moved for the postponement of the proceedings because of the absence of the other accused. It said proceeding with the arraignment without the other accused in attendance is “irregular.”

Defense lawyer Trixie Angeles said the accused could not be arraigned since they are charged as co-conspirators.

“This stage of the proceedings is crucial because they are charged with conspiracy. Their presence all throughout is essential,” she said.

Prosecution lawyer Col. Jose Feliciano Loi said there will be no irregularity if the court proceeds with the arraignment because “we are not going to proceed with the arraignment of those who are absent.”

“It will not prejudice the others because we are going to proceed with the arraignment of those who are here.”

The court sided with prosecution.

Hypertension cases

At the resumption of the hearing, the four officers who earlier showed up were no-shows.

Querubin, De Leon and Fernandez did not show up because they also did not want to be handcuffed, Marcos said.

Lim was brought back by his custodians to Camp Crame because his blood pressure shot up to 180/120.

Lim was brought to Tanay in a six-vehicle-convoy guarded by scores of Special Action Force members. He was aboard a PNP-marked pick-up. Another pick-up and two vans had policemen on board. A medical van and a truck of SAF personnel also made up the convoy.

The defense lawyers also did not return to the courtroom.

Two of them explained their absence. Verdadero said his blood pressure also went up after eating squid and “binagongan” for lunch. Rodrigo Artuz said he has to go back to Camp Aguinaldo to attend a meeting of retired generals.

  2. The court and the prosecution’s sinister plan to railroad the proceedings was unmasked today. They are going to arraign the 28 oficers by batches. That’s illegal because teh charge is conspiracy. The offense of one is the offense of all.

    Nagkandabuhol-buhol ang kanilang mga palusot hanggang sinabi na ni Fojas when it was revealed that it was he who said that Lim, Querubin, De leon and fernandez may be allowed to attend hearing without handcuffs while they required others to be handcuffed.

    Kaya pala gusto lang niya apat lang ang na sa court for the arraignment.

    Talagang makakamura ka talaga.

    With their decision of only four allowed to attend the hearing, matindi talaga ang kanilang takot. Without all charged officers in attendance, they and lawyers will be out of the loop. Ginugulo talaga ng mga walanghiya ang hearing!

    At saka, malay natin kung ano ang gagawin sa batches of four while on transfer from detention to the place of hearing! Really sinister! Naku, naglalaro ang isip ko!

    Now who the hell is this Col Arnulfo Marcos, kamag-anak ba ni Apo ito? I can’t understand why he is challenging a defense lawyer to a fistfight. An officer an gentleman must be cool, calm, compassionate and understanding at all times. Diplomacy and not brutality is the name of the game. It’s good Atty Atienza kept his cool. Marcos should be dismissed from the service.
    Ka Rose, whoever wins as president of the usa is immaterial to the philippines. Philippines has not reached a standard where america could seriously deal business with – political, economics, intellectual, etc. Except maybe for manpower – nurses, aides, skilled workers – we have nothing to strongly negotiate with.
    When the country is free from corruption and has good governance, maybe we could compete globally. Until then, hope springs eternal. Rizal is already crying in his grave.

Ang mga guardiya niya at escort nasa tabi lang at nasa likod niya habang siya’y naglalakad kahit saan na parang mga bodyguard niya. Well, rape is a lesser evil and less crime than those who want truth, justice and welfare of the soldiers. May idea ako…bakit hindi na lang mang-rape ang mga Magdalo soldiers para tulad sila ni Jalosjos?

    roughly ang ratio ay 8:1 ang bantay..ang laki ng takot..at saan naman pupunta ang mga officers na ito..hindi ba pag may tumakbo na prisoner ay shoot to kill? I wonder how much it cost them to send this many soldiers…ang aarte ..overkill..walang magawa sa buhay nila..kundi bantayan ang mga “gentlemen” they accused of “conduct unbecoming of a officer and gentlemen..

  20. Lalo na siguro kung isa ako doon sa makakapanood ng injustice na dinaranas ng mga matatapang at magigiting na sundalo. Truth is I know a lot many former policemen and soldiers now residing in the US of A. Hindi sila masaya, and I understand that a lot of them would like to be buried in the Philippines when they die. Napilitan lang silang umalis sa totoo lang for survival but their hearts remain in the Philippines.

    I had a brother, too, who returned to the Philippines and died there. Hindi rin na-adjust sa Tate katulad ko. Marami kasi siyang mga kaibigan sa Pilipinas, and he died contented. Hindi naman siya nakaranas ng gutom kasi maganda naman ang buhay niya. Nag-try ngang tumakbo pero talo kasi wala siyang backer at akala niya mananalo siya ng hindi maglalagay! I think iyon lang ang frustration niya sa buhay.

Even in the US now, I understand they’re studying the possibility of using handcuffs tied to some rope that can be tied around the waist of the suspect or accused in between transports to/from detention houses. It is more humane, I am told and sure guaranty of no escape.

A high school classmate (our class valedictorian) who is now a Good Shepherd nun, founded the Third World Movement Against the Exploitation of Women, and in her center in Proj. 4 and in Marikina, marami siyang tinutulungan na may sakit ng AIDS..a couple of years ago she gave a talk sa UN on “The Business (Prostitution), the Bought (yong mga women) and the Buyers (lalo na sa Europe) and I could not believe what I heard..and I could not believe that it is happening in the Phil..As a matter of fact ang mga bata bata ng mga girls..in their teens..malungkot…

    The youngest Japayuki we tried to save from some Yakuza way back when Aquino legitimized the trade in the guise of entertainers was 12 years old thinking like 23. Shocked ako when she said that “OK lang po.     I think the problem of the travesty is the proponderance of too many cooks and kibitzers. The court can no longer impose its legal will. Even constitutionality can not have its own stand on most matters. Trivial matters such as handcuffings are questioned.

    Iyan ang puro arte lang, wala namang ibubuga. Sa amin iyan papagalitan ng court ang mga inutil for brandishing their weapons in the courtroom. Bawal kasing umarteng walang pinag-iba sa mga kriminal tapos iyong mga wala namang armas na mga tina-trial ay siyang mga pormal at respetado.

    Palibhasa kasi mga inutusan ng isang kriminal working with her fellow wannabe criminals.

    DJB being from leftist origins but turned 180degrees rightist (with strong pro-American sentiments) has every reason to hate left-leaning and anti-government causes. The problem here is that he refuses to see the truth. He still views Sen. Trillanes. Gen. Lim et al as potential Pol Pots, as soldiers who were infected with the Maoist (Jomaist) influence in the ’60s, when the left infiltrated UP and even PMA, sending cadres to study there with the objective of making changes when in positions of power.
    Do we see any Pol Pot tendencies with Sen. Trillanes et al? They have never proposed ARMED STRUGGLE, in fact Sen. Trillanes was reported to have had a dialogue first with GMA before the first standoff, a very gentlemanly thing to do but nevertheless criticized by some as telegraphing his moves.
    Kung desente ka talaga, kausapin mo ng harap harapan ang kaaway mo, huwag mong tirahin habang nakatalikod, at kung may napag kasunduan kayo – sundin mo. Sad to say, hindi kaya ni GMA ito, siya at si Esperon ang mga totoong traydor – walang isang salita. Ito ba ang gusto nating mamuno sa bansa natin?

According to my source a classmate of both Esperon and Miranda, that Gen Esperon is not happy with anyone who will be in the way to his greed for power.     According to my classmate with the Phil Marines, Col Martir was appointed to BGen last Dec 23, 2006. There is a rule that an officer has to be confirmed within a year. So Col Martir’s case, he has to be re-appointed again.

    Just caught the court martial coverage by GMA. A Maj. Felicen (panel spokesman) was interviewed and he cited a Supreme Court memorandum saying that the accused must at all times be handcuffed within the court premises. Hahahahah. This is the same panel who, together with the prosecution has continuously asserted that they are not under the Supreme Court!
    FYI, the Supreme Court memoranda are not applicable to military tribunals because they are not regular courts under the administrative jurisdiction of the Supreme Court.

    Gone were the days when military officers were only restricted to quarters or to the camps while awaiting courts martial or even those charged in cilvilian courts were only returned to military custody and only restricted to the unit while awaiting trial. Those detained coup players in Cory’s term were only restricted to the camps, not brigged. And there were no handcuffs before the military courts. Everyone salutes each other in the course of the day according to ranks. They were still gentlemen in those days. However not even a decade earlier, things have drastically changed and becoming worst to this day. There is a perceived decay in the military, a great decline of respect for each other. The military arm has already blended with the political arm. For all we know, it has already overshadowed civilian rule.

    The court martial panel is made up of 7 members. 5 generals one colonel and one law member, Col Marian Aleido. Col Aleido used to be a nice lady lawyer who is fair and just but in this court martial proceedings she has turned into a witch. Many believe that she is under much pressure. Even if it is against the law, she would rule in favor of Gen Esperon’s orders.

    She once cried during the hearing when the defense lawyers challenged her for cause because she was biased and unlawful… meaning her legal advise to the other members of the panel were against the law. The others even want to file a disbarment case against her.

    On the contrary, Gen. Romeo Espino held the CSAFP position longer than anybody else. His term as spanned all of nine and a half years, from January 1972 until June 1981, when Fabian Ver took over the reins. Fabian Ver held the position from June 1981 until February 1986. I am not sure if Gen. Espino is related to Col. Espino, though.
