PNP team admits breaking into Batasan building

A police officer and his “boys” have come forward saying they stole original election returns (ERs) then kept at the Batasang Pambansa building and replaced these with fake ones to make sure Gloria Macapagal-Arroyo would still emerge the winner of the 2004 presidential election in the event of a recount.
Senior Supt. Rafael Santiago, now assigned at the Philippine National Police Directorate for Operations in Camp Crame, presented to the Inquirer envelopes bearing the seal of the Commission on Elections (Comelec) and containing what he said were original ERs from various areas in Mindanao.
Prior to his appointment in Camp Crame, Santiago was relieved as police director of Zambales province.
At a meeting on Tuesday evening attended by Justice Secretary Leila de Lima and Inquirer editors and reporters, Santiago described their coming out as “providential.”
“After I was relieved as Zambales police director, I realized now is the time to come out and tell the truth. I expect there would be mudslinging [against] me, I would be accused of sour graping, and there would be threats because we are going against a powerful man. But I am ready to face it and tell what we know,” he said.
Acting on orders
Santiago said the documents presented to De Lima were among the original ERs stuffed in more than 100 Marlboro cigarette boxes taken by his team from the Batasan main building.
He said he and his boys acted on the orders of then PNP Director General and now Zambales Gov. Hermogenes Ebdane Jr., which were coursed through the then Special Action Force (SAF) director, Chief Supt. Marcelino Franco.
Santiago also implicated Roque Bello, a former Comelec supervisor, his son El Bello, and 10 other men who purportedly took part in producing the fake ERs.
He tagged as an accomplice Chief Insp. Ferdinand Ortega, then chief of the SAF unit in charge of security at the Batasan complex.
According to Santiago, the operation was prompted by the election protest filed by Susan Roces, widow of the late actor Fernando Poe Jr., who was Arroyo’s closest opponent in the 2004 election.
At the time of the operation, Santiago headed the Intelligence Division of the National Capital Region (NCR) command of the SAF unit based in Camp Bagong Diwa in Taguig City.
Santiago said he and his boys had mustered the courage to go public after hearing De Lima and Sen. Francis Escudero call on those who had knowledge of past election fraud to come out.
Speaking on behalf of the other policemen involved in the operation, PO2 Rudy Gahar said: “We are tired of being used and ridiculed by our colleagues for what we have done, and we also believe that now is the right time to come out because according to Justice Secretary De Lima, we could be admitted as state witnesses.
“We also want the truth to come out.”
Highly confidential
Santiago said he planned and implemented the “special operation” which was based on orders issued by Franco and originating from Ebdane, and carried out between January and February 2005.
“It was the first week of January 2005 when I was called to Franco’s office and ordered to choose my most trusted men for a highly confidential operation in the Batasan Pambansa building based on instructions from PNP chief Ebdane at that time,” he told the Inquirer.
He identified the men he later selected aside from Gahar, Senior Inspectors Raffy Lero (now assigned at the NCR’s Northern Police District), Samson Kimmayong (now posted in Central Mindanao) and Warly Bitog; Insp. Ramon Garcia (retired); Special Police Officers 2 Rommel Pahang (retired) and Paterno Gamba; Police Officers 2 Alan Layugan, Rodel Tabangin and Trifon Laxamana; and PO1 Norman Duco.
“The objective of the operation was to get the original ERs and replace them with manufactured ones prepared by El Bello and his people to ensure that the ERs reflect the same number of votes indicated in the certificates of canvass that greatly favored Arroyo,” Santiago said.
But this piece of information was not disclosed to his men before the operation.
“They found out [that the operation was all] about switching ERs when it was already ongoing,” he said.
Meeting in coffee shop
Santiago said he met with Ebdane, Franco and El Bello at a coffee shop on Commonwealth Avenue in Quezon City in the same week he was ordered by Franco to form his team for the operation.
He said the meeting was held “to discuss the project and familiarize ourselves with the personalities involved.”
Santiago said the operation was scheduled to be carried out on Jan. 23 and 29 and Feb. 5 and 27, 2005, starting at around 11 p.m. up to around 2:30 a.m. the next day.
To ensure that no one else would be at the Batasan main building when his team moved in, a bogus bomb threat was announced, he said.
Ortega, being in charge of Batasan security, was tasked to make sure that Santiago’s team as well as El Bello’s civilian group would have unhampered access to the lobby where the boxes were kept in an area enclosed by screen dividers.
Santiago said that on each of the four nights they worked, “not less than 20 Marlboro cigarette boxes were transported, first filled with manufactured forms collected from a house in Brookside Subdivision in Cainta, Rizal province, and then with the original ERs taken from inside the complex.”
Assigned tasks
Santiago said 15 men were tapped for the operation and divided into four groups.
One group was assigned to guard the perimeter of the building to prevent anyone from getting near the area while Bello’s men were inside “opening ballot boxes, taking out the original [ERs] and replacing them with fakes.”
A second group ensured that all lights and closed circuit TV cameras were turned off during the operation. This group under Garcia also included some of El Bello’s men who took positions in the dark corridors of the building.
Santiago said Garcia had a camera in his bag and recorded the switching of the ERs: “It was Garcia who took the video of Bello’s men while they were in the restricted area, for insurance.”
The third group, composed of a van driver and a number of security escorts, was in charge of transport.
The fourth group was made up of Santiago’s team.
Santiago said two vans with SAF markings were used in the operation “to avoid being flagged down or inspected at checkpoints.”
He reiterated that his men had no knowledge of the nature of the operation: “My only instruction [to them] was to secure and transport the boxes. They did not know at first what were inside the boxes.”
First night
Gahar recounted that at around 9 p.m. of Jan. 23, 2005, the first night of the operation, he received an order to go to Ortega’s office.
On getting there, he said, he saw Franco, El Bello, Ortega, Lero, Kimmayong, Garcia and some members of the PNP’s explosive and ordnance disposal (EOD) unit.
He said his team was told to go to Bello’s house in Brookside “to load some important boxes [in the van] and bring these to the Batasan complex.”
Gahar said a civilian accompanied them to Bello’s house: “There was no talking, no [mention of] names. [The civilian] just spoke to Duco, our driver.”
This was how Gahar recounted the turn of events:
The team members went to Brookside in a three-vehicle convoy composed of a closed SAF van, a Nissan Frontier pickup, and a private car owned by Pahang.
They stopped in front of a house from which emerged five men carrying 20 Marlboro cigarette boxes that were loaded into the van.
They proceeded to the Batasan complex.
Gahar noticed that while they were in transit, the civilian kept turning his head to look at them, apparently to check if they were looking into the boxes.
At the Batasan complex, Gahar, Duco and Layugan were ordered to stay in the van to guard the boxes.
Another five civilians together with Garcia, Santiago, Ortega and some EOD members then entered the building.
In less than an hour, the boxes were brought back to the van and the team returned to Brookside where the first set of five civilians took the 20 boxes and brought them inside the house.
From Brookside, the team went back to base at Camp Bagong Diwa.
Curiosity
This sequence was repeated on Jan. 29, 2005, Gahar said.
But by the third night, Feb. 5, the team members had become curious about the contents of the boxes.
“It was so hot inside the van. There was no ventilation because all the windows and doors must be closed at all times. We were instructed to avoid being seen while in transit so as not to arouse suspicion,” Gahar said.
“But we got more and more curious about our cargo,” he said.
At one point, Gahar said, they noticed that one of the boxes had been left open.
He recalled: “I reached inside and took out some envelopes that we could use to fan ourselves. We were shocked to see that they were [envelopes] for original ERs.
“We later took some of the envelopes we brought from Cainta and compared these [with those taken from the Batasan].
“The manufactured forms looked clean, while the originals were a bit crumpled. The marks on the fake appeared to include [prints] from the smallest finger, while the original bore only the thumb print.
“More than 100 boxes of original ERs were taken out of the Batasan complex. Most of them were from Mindanao.”
P10K ‘bonus’
Gahar said he and his team were able to pilfer more than 50 original ERs from the boxes that were turned over to Santiago for safekeeping.
There was to have been a fifth operation, Gahar said, but it was aborted because members of the team had to respond to an attempted jailbreak by Abu Sayyaf terror suspects at Camp Bagong Diwa on March 14.
In the end, the team members received P10,000 each from Garcia.
“This is our bonus. Just keep your mouths shut,” Gahar quoted Garcia as telling them.

2 SAF cops recount grilling, bribe offers

Two members of the core group of an elite police team who were involved in the alleged switching of election returns (ERs) at the Batasang Pambansa building in 2005 claimed to have been subjected to “harsh questioning” by their superiors in the Special Action Force (SAF) and later offered bribes and monetary rewards by personalities identified with the administration of then President Gloria Macapagal-Arroyo.
“The Batasan operation became an open secret in the SAF, and because of this we were subjected to ridicule and harsh interrogation by other officers of the unit. For this reason we wanted to leave and requested a transfer,” said PO2 Rudy Gahar and PO1 Norman Duco.
They said they also met with Sen. Loren Legarda, the running mate of actor Fernando Poe Jr. in the 2004 presidential election, and who, at the time of the meeting, was petitioning for a recount.
Gahar and Duco named their “interrogator” as Senior Supt. Rommel Marbil, now a member of President Aquino’s Presidential Security Group.
“Colonel Marbil interrogated us on what we knew about the operation and pressed us to give the names of those who were involved,” they said.
By then, Senior Supt. Rafael Santiago, the leader of the purported ER-switching operation, and eight members of the core group had been transferred to the Northern Police District (NPD) of which Chief Supt. Marcelino Franco was the then director.
It was Franco who allegedly ordered Santiago and his men to carry out the operation in four weekends in January-February 2005.
Under surveillance
Gahar and Duco said their colleagues in the SAF became aloof and kept a distance from them.
“We were treated like we had the plague, and we always felt we were under surveillance. We received calls and text messages from people we did not know, asking for a meeting,” they said.
The policemen said they made known their desire to leave the SAF to Insp. Ramon Garcia, who supposedly took part in the Batasan operation and who remained in the unit.
Gahar said that in 2008, he and Duco were introduced by Garcia to Joel Pinawen, a close friend of Garcia’s who has been variously described as “glib” and “an influence-peddler.”
“Pinawen told us he could help us get a transfer order and could provide us P20,000 a month if he will be posted in a juicy position using our information as leverage,” Gahar said.
He and Duco said the personalities they subsequently met with were all selected by Pinawen, who became their patron.
“We met with both sides,” Gahar said, naming Senator Legarda and lawyer Harry Roque from the opposition, and Presidential Anti-Smuggling Group (PASG) Chair Antonio “Bebot” Villar, then Maj. Gen. Jovito Palparan and Chief Supt. Mariano Ele from the administration.
Meeting confirmed
Contacted by the Inquirer, Legarda confirmed having had a meeting with Pinawen and Duco. She also said the meeting was about evidence on the switching of ERs at the Batasang Pambansa building.
“I confirm that I met with Pinawen and the policemen, but I declined their offer. They were selling video footage to show evidence of cheating,” Legarda said, adding:
“I refused to buy the evidence of the cheating. I don’t want to taint my electoral fight by bought evidence. I told them that if they have evidence of cheating, they should bring it to the Supreme Court.”
Gahar also said that while he and Duco had no face-to-face meeting with then Surigao Rep. Prospero Pichay, the latter made an offer to them through Pinawen.
“Pichay supposedly promised us a vehicle and a house and lot,” Duco said.
After their release from the SAF, the two policemen briefly worked for the PASG and reported to Villar’s office in Malacañang.
Gahar said Villar asked him and Duco several times “to narrate our story,” and “treated us like royalty, [so much so] that we became the envy of other PASG operatives.”
He said they left the PASG because of an incident involving Pinawen and other operatives of the unit.
Arrogance
After their stint at the PASG, Gahar and Duco worked as Pinawen’s personal body guards.
“But we left because he became arrogant when we were with him, and we realized he was using us for his personal interest,” Gahar said. “It was at that point that we decided to contact our former CO (commanding officer, Santiago) and asked to be taken in.”
Gahar said their requests were granted, and they reported to Santiago at the NPD headquarters.
Santiago was detailed at the NPD until late in 2008, and then assigned as director for intelligence of the National Capital Region Police Office (NCRPO) under Chief Supt. Leopoldo Bataoil for a few months.
He was relieved when the new NCRPO head was assigned.
In January 2010, Santiago was pulled out of his “floating status” and assigned as police director of Zambales province, where Hermogenes Ebdane Jr., a former director general of the Philippine National Police, among other posts, ran and won as governor.
Santiago said that based on the order, he was relieved on July 7 but that he found out about it only on July 18.
“I was having a command conference when I received a call from the regional office saying that I had been relieved. No explanation was provided.” Santiago said.
He said he asked Ebdane about his sacking by text message, and that the latter replied with “a short and vague message.”
No comment
Santiago told the Inquirer that the order to switch ERs in 2005 was issued by then PNP Director General Ebdane through then SAF chief Franco.
Repeated attempts on Thursday by the Inquirer Northern Luzon to contact Governor Ebdane were futile. No staffer of Ebdane wanted to talk to the Inquirer, except to say that the governor was not around.
But in an interview in 2008 with then Public Works Secretary Ebdane in one of his visits to Valenzuela City to inspect the repair of the Tullahan Bridge, he denied having ordered Franco and Santiago to mount the ER-switching operation in 2005.
“No, it’s not true. Pinagtagpi-tagping kwento lang yan (It’s just a made-up story),” Ebdane told the Inquirer.
Franco also denied involvement in the ER-switching operation in in a phone interview in April 2008. By then he had retired from the service
“I do not know anything about it and I do not think about it, he told the Inquirer.
Asked to explain his statement, he said: “I do not think about it because I did not do it.”
As the SAF chief, Franco was among those mentioned in reports as having supported the failed mutiny on Feb. 23, 2007.
While the other officers involved, including then Brig. Gen. Danny Lim, were arrested, Franco was not taken in custody and was able to retire from the service in the same year with all his benefits intact.
Father and son
Santiago had also implicated Roque Bello, a former election supervisor, and the latter’s son, El Bello, in the switching of ERs.
Bello agreed also in 2008 to be interviewed by phone, and vehemently denied that Ebdane had tapped his and his son’s services in the 2005 operation.
“No one approached us,” Bello said, adding with a laugh that they could not be so influential as to be thus approached “when we could not even make myself win when I ran for mayor in the 2007 elections.”
Bello said his son represented and helped him in all election-related cases that he handled after he retired from the Commission on Elections in 1986.
“He is my administrative officer and he talks to clients and makes the follow-up in all the election cases I handled after I retired,” the father said.
“How can we do that (be involved in ER-switching at Batasang Pambansa) when the place is being guarded by the military?” he said.
In a brief interview with reporters at the Comelec main office in Manila on Thursday, Bello again denied Santiago’s claim that the fake ERs were manufactured at his residence in Cainta, Rizal province.
“I don’t know anything about it. You want to verify it? If you go to the front of my house, you’d already see what’s inside. If I will do something bad, will I do it there? I don’t think so,” he said.
Bello said he and his son El were “ready to face any investigation” into Santiago’s allegations of cheating. With a report from Jerome Aning

Pangilinan, who sat on the National Board of Canvassers in 2004 as then Majority Leader in the Senate, said that the public is closer now more than ever to the truth behind the controversies of the 2004 elections.
“Our role in the canvassing committee in 2004 mandated us to decide on the basis of the evidence available, the rules and the law. All the evidence now surfacing seven years later was not available then. In 2004 we did not know about ‘hello garci’, but when we learned about the taped conversations in 2005, out of principle, we did not hesitate to condemn the acts of PGMA then and called for her immediate resignation. In keeping with this principled position, we refused a slot in the admin ticket in 2007 and opted to run as an independent.”
Pangilinan hopes that the joint inquiry would educate the voters better and make them become more vigilant during elections. “Voting is a fundamental right of every citizen and a crucial aspect of a democratic process. It is considered sacred, and any violation against it should be met with severe and appropriate sanction.”

It was available then. All you had to do was open it, but you merely NOTED it.

Now back to the topic. Here is the brilliant dilemma for Brilliantes and De Lima.
An election offense prescribes (the right to prosecute expires) in five years. Since this happened in 2005, the right to prosecute has already lapsed.
Brillantes opines that the counting of the expiry period commences “upon discovery”. But when was it discovered? Certainly not this year, because the PNP met with Loren Legarda and Harry Roque in 2005.
There is also the other opinion of Brillantes, that the period commences only when the immunity from suit ends. But that only covers the Glue. It does not cover the Pig and Ebdane – they had no immunity from suit. So counting commenced in 2005, so they can no longer be prosecuted on the basis of election offenses.
Your mission then, should you decide to accept it, is to look for a suitable offense in the Revised Penal Code, or other penal law.

There’s nothing new in these revelations. It’s all over the news before, even discussed in this blog. The reason why investigations did not prosper and justice was not carried out, almost all those crying for the head of Gloria now, shall I say were all her own brand of KKKs before, Drilon and Mr. Noted included who sat for Gloria in the canvassing.
Mr. Noted and Drilon were not that naïve, or mga bobo or mga tanga to believe that Gloria has a chance and won the election fair and square against the FPJ unless they were really are. Drilon even advised Gloria to move Malacanang to Iloilo. Wow, that’s what I call the ultimate “ass-licker.”

Masyado talagang sakim sa politika. Hindi nakuntento na naging Pangulo dahil sa pagpapatalsik kay Erap. Naniguro na makakaupo uli dahil ang kalaban na si FPJ ay malakas na kandidato. Ewan ko lang kung bakit may mga tao na sakim sa posisyon o pera. Gayong ang posisyon o pera na nahawakan o nakamit ay hindi naman madadala sa kanilang kamatayan. Sa nangyayari sa ngayon baka hindi na sila nakakatulog ng mahimbing. Nagsisilabasan na ang mga kabulukan na ginawa nila o ng administrasyon nila. Nakakasawa na ngang magbasa ng diaryo kasi puro na lang sila ang laman. Kapag hindi nakayanan ay tiyak magbabaril sa sarili.
Panalo naman talaga si FPJ kaso ang mga kaalyado sa panahon ni GMA hindi pinagpatuloy ang mga imbestigasyon tungkol sa dayaan kasi sila din na mga kaalyado ay mga sakim din. Tapos ngayon na iba na ang presidente ay doon naman sila didikit sa bagong pangulo. Ang ibang mga politiko talaga kapit tuko. Kung sino ang maimpluwensya ay doon sila. Masyado ng nakakahiya ang bansang pilipinas. Puro na lang masamang balita ang laman lalo na pagdating sa politika.

Hindi sapat ang pag sorry. Dapat noon ginawa ang pag amin na pag switch sa balota ng buhay pa si FPJ. Ano pa ang mapapala na inamin na. Wala naman. Hindi na magiging pangulo si FPJ dahil wala na.

I support charitable organizations I perceived as honest, and directly help other people, including our neighbors. I don’t see the point why help should be coursed thru a church, particularly our Catholic Church. I don’t think an all-powerful, compassionate Creator needs any help in his works on earth anyway. Looking at the situation of our country and the world today, I can only ask how all the accumulated wealth of the Catholic Church and other religious churches has helped our country in particular, and to the world in general.
