Ex-justice chief: Jalosjos case different from Trillanes’s

A former justice secretary on Tuesday said the government prosecutors should not have used as example the case of former Rep. Romeo Jalosjos in blocking Senator Antonio Trillanes IV’s request to fully perform his duties as an elected member of the Senate.

“Alam po ninyo iyong kaso ni Trillanes at iyong isang congressman ay mayroon pong pagkakaiba,” said Serafin Cuevas, also a former Supreme Court associate justice.

He said Jalosjos has been convicted of rape charges while Trillanes remains an accused and all the evidence against him have yet to be presented before the Makati City Regional Trial Court (RTC).

Since the trial for Trillanes’s rebellion case has not yet started, Cuevas said the senator still has the right to bail.

“According to the law, every person has the right to bail. It could have been cases where he is judged with a capital offense,” he said.

He said Trillanes should emphasize before the court that he is not yet convicted.

For the prosecution, Cuevas advised the government lawyers to present “strong [pieces of] evidence that show the guilt of the accused” instead of submitting a motion for denial of bail.

He said if the court is convinced by the evidence, it will automatically deny Trillanes’s requests.

In the comment submitted by the Department of Justice to the Makati RTC, State Prosecutor Juan Pedro Navera likened the case of Trillanes to that of Jalosjos, who is a convicted child rapist.

Navera said Jalosjos was jailed while still an active member of the House of Representatives. He cited a Supreme Court ruling in 2000 that denied Jalosjos’s petition to leave detention to perform his duties as a representative of his province. In the ruling, the high court said the House of Representatives can perform its duty even in the absence of Jalosjos.

The government lawyer added that Makati City RTC Judge Oscar Pimentel should deny Trillanes’s petition to put up a satellite or a legislative office inside the Philippine Marines headquarters in Fort Bonifacio, Taguig City because the place is a high security area.

In his motion, Trillanes asked Pimentel to allow him to attend Senate hearings. He also asked the court to allow him to put up an office inside his detention and hire a legislative staff.

Another request made by the new senator was to allow him to entertain the media in his detention cell every Tuesday and Friday when the Senate is not in session.

Meanwhile, Navera warned Trillanes against making public statements against the government. He said the new senator’s lashing at the government violates the court’s condition for his temporary release.

Trillanes took his oath Friday before his friend, barangay chairman Ruben Gatchalian, in Caloocan City.

After the ceremony, Trillanes accused Team Unity senatorial candidate Juan Miguel “Migz” Zubiri of benefiting from alleged cheating in the May mid-term elections and said that he did not want “a cheat” to join him in the Senate.

“I believe Congressman Zubiri knows deep in his heart that he benefited from cheating. If he is decent enough, he wouldn’t accept [victory in the Senate race] because that is not something you want your kids to emulate,” Trillanes said.

The new senator has also made strong statements against the administration, particularly President Arroyo, whom he labeled as an illegitimate leader.

He said he will work for Mrs. Arroyo’s removal from office during his term. He said the country will not be able to move forward if Mrs. Arroyo remains President of the republic.

Trillanes is among the junior military officers who led a cabal of enlisted personnel in the Oakwood Mutiny in 2003.

After taking over the Oakwood Premier Hotel in Makati City, Trillanes, who served as the group’s spokesman, repeatedly asked Mrs. Arroyo to step down.

    Most of us know this- kaya lang si Miriam, si Honasan, si Enrile, at iba pa ito ang dahilan kung bakit hindi puede si Sen. Trillanes sumali sa sessions. Como sila ay legislators and most of them are lawyers ipinipilit to justify the wrong decision and make it right. Ay ambot sa inyo- dugay na kamo sa Senate pag tonto pa guihapon ang ginahimo ninyo? Huwag naman laging left turn (may nangaliwa sa asawa, sa panindigan, etc) dapat seguro mag right turn na.

    The DOJ will throw all legal moves, selective justice and delaying tactics to block Senator Trillanes’ petition at Makati Regional Trial Court. I hope that Judge Pimentel will rule in favor of Sen. Trillanes based on merits not from Malacanang pressure and influence.

    I do agree on Miss Sahara,those silent majority of kawawas were mostly loud barker of poverty,low quality of life, but during last election,they are first one selling votes to admin. candidates,from Mayors ,Congressmen to Governors, how would you eradicate a bad system when this silent kawawas give a shielding armor to protect them.Imagine how many Administration tongressmen w/c the impeachment will fail because of the numbers.though it is your right whom to vote, but you don’t have the right to complaint about the quality of life thatwas given by the people whom you put to power.Now examine ourself.

    Ok, let’s not use the case of Jalosjos for comparison because Trillanes indeed is not “convicted”, maybe in time, but not yet. But it’s simple logic, the charge he’s being accused of is “non-bailable”, so definitely he can not post bail. This is so similar to the plunder case of “ERAP”, also non-bailable. Ask this, where was ERAP when his trial is being heard? Is he out?? Was he allowed to post bail?? NO!!! All the prosecutors have to do is to show good evidence that what Trillanes and his group did was indeed a “mutiny” and that he is directly involved. If they can back this up with strong evidence, then its done. He can’t go out. Simple. Now you ask, 11 million voted for him to serve in senate, but dont forget that 80 million has to be protected.

Mayor Lim promised to give back the lost right of the people to rally wherever they want and even at the gates of Malacanan. He will clean up the place of tetanus ridden barb wires and congestive 40 footer vans. MMDA clear the sidewalks, the mayor cleans his streets. And he issues tickets to any illegally parked military vehicles, tanks and firetrucks. No need to rally on weekdays. Weekends will do. No need of permits. No threats, please. But bring resumes should some turn tails from their posts in the palace

    The DoJ chief kuno is seriously and physically handicapped. He’s currently on dialysis and needs loads of money. Perhaps, Jalosjos gave him some of the money that this convict Jalosjos has managed to stash away before his incarceration.

    In any case (and this IS NOT RUMOUR), Gonzales has been selling DoJ opinion for a high price. Ever wonder why Tony Leviste’s case was elevated to murder (from homicide) 48 hours after the forensic findings showed that Leviste’s case was homicide (not premeditated)? Well, Gunggong gonzales needed money, lots of money for his frigging dialysis.

    I understand as a paralegal that murder and homicide are the same thing. Non-premeditated murder is “manslaughter” although over in Japan murder is murder and they are not categorized as homicide or manslaughter as they do in the US and the Philippines.

    Over here it is “murder” when the victim dies, or “attempted murder” when the victim survives.

    I have a case in fact presently where I am helping a lawyer assigned to a case of a Filipino woman who stabbed her husband twice at the back. Good thing that the wounds were not deep enough for the husband to lose blood and die.

    We are now presently trying to have the case reduced to just physical injury so the woman can get a suspended sentence for if this case is indicted as a case of attempted murder, she can get a prison term of no shorter than 3 years, enough time in fact for the husband to totally lose interest in saving their marriage, and for her to be deported after serving her jail term. Good thing that they do not have children yet.

    Funny how Koko used the word “enlightened” as he gave up on the Electoral Board to be fair and non-participant. I hope he used it sarcastically to show the desperate state of the nation today.

    “Enlightened” nga naman siya for the blatant crimes being committed by these political appointees in all Philippine agencies, especially those charged with dismissing or having crooks like the unano prosecuted for crimes committed against the Filipinos and even foreigners who are contributing aids for Philippine development like us, taxpayers in Japan.

    7 out of 10, yes, you have this number now after all the cheating allegations and plotical noise. People got sick and tired of hearing this everyday. Mahirap man aminin, pero maraming pinoy ang madaling maniwala sa nilalabas sa media. So I see this number increase because of media reports which of course dominantly negative.

So around 40% or equivalent to 12 million less na yung “1 million” highly contested votes na contribution daw ni Garci. She would still have won by a close margin, even Biazon admitted that, less those 1 million.

    But remember, in presidential race, you only have to chose 1 from 5 condidates, whereas for sentorial race you choose 12 from 37. To see the equivalent rate, i’ll call it “acceptance”, for GMA = (12M)*(5/1) = 60, Trillanes however, = (11.2M)*(37/12) = 34.5 only. The higher the number, the greater chance of winning.

    Meaning, the acceptance rate of Arroyo in 2004 election was 60, while Trillanes only 34.5

A noble crusade fit the definition, whereas, compared to his peers they poured tons of monies, humongous TV and tabloid advertisement, campaigning under the scourging heat of the sun, shaking hands with lot of people but, deep inside they have a bottle of rubbing alcohol, now, they are busy making an appointment with beauty expert doctors to restored their feminine and masculine looks with an extra shots of Botox.Trillanes is languishing in jail since day one and he might be lucky if he has an appointment with his dentist and have a pills of vioxx to suppress his pain.

    I don’t accept the 12 million figure you are citing as Gloria’s vote in the 2004 election. She cheated.

    She did not win the elction.For that matter, she was never elected by the Filipino people to the presidency. In 2001, she grabbed power. In 2004, she cheated.

    By cheating, she committed a crime. She should not be in Malacanang. She should be in jail.

  26. As one who has worked for the Japanese police, for me, a criminal is a criminal. Gloria M. Arroyo cheated in the last election, and cheating is a crime under Philippine law. Accordingly, she is a criminal. If she is not proven as one, it is because police there under a military has not done their homework because the head of the AFP and the PNP are her own political appointees.

    In the first place, what logic is there to compare Gloria in 2004 votes to Trillanes votes in 2007? Gloria, an old hand in politics who used Macapagal instead of Arroyo, campaigned with all the might of the administration with the foul odor of the fertilizer as sprinkled by Jocjoc Bolante capped by Hello Garci! In one hand, we know how the first timer, 35 years old, imprisoned Trillanes campaigned in 2007. Trillanes even now is not even qualified to run as president, babalik pa sa 2004? He will be disqualified on the question of age as Gloria sought but embarrased by the Supreme Court for the disqualification of FPJ on the question of citizenship.

    Gloria’s votes were tainted with fraud and that 12 million votes she got in 2004 was never accepted by the people. This midterm elections was a sort of referendum with an unwritten question: Do you believe Gloria cheated in the 2004 elections? The answer is a resounding Yes! It was the sentiment of those who voted for the nationally elected senatorial candidates by dumping the Gloria annointed candidates. Kahit anong formula ang iprisinta, it will never change the perception on Gloria’s legitimacy. Except of course to those who choose to look the other way. Some people really are unbelebedol!

  31. Yup, away with these formulas for cheating, etc. and fake figures. They don’t change the fact that Gloria M. Arroyo cheated in 2004, and she is not in jail yet, because she and her husband, and their cahoots had made sure that they have their own people in the agencies that have the duties and responsibilities to put them in jail. That does not make them innocent of their crimes as a matter of fact.

    It is in fact a matter of time and determination of the very patient and tolerant Filipinos to wait for another 20 years perhaps to have this crook removed the way they have removed (no thanks to Uncle Sam) Marcos from Malacanang straight to Hawaii, not Paoay!

    Bakit hindi natin i-compare si Trillanes kay Major General Carlos Garcia who was convicted of corruption by the millions and in the millions. What did Garcia get? Just 2 years imprisonment and hard labor daw, whatever that means to them.

I say, he has a different breeding, mas magaling—the real thoroughbred kung kabayong pangkarera— di tulad ng mga kunyari anak mayaman daw pero hindi nila alam kung ang yaman ay nanggaling sa mabuting paraan lalo na noong matapos ang WWII na maraming mga pilipino ang naging switik at mapagsamantala ng kapwa nila pilipino!

    I visited the other forums I am in but neglected since I joined this blog. Boy, ang daming murang inaabot sina Cayetano, Escudero, et al doon. Next time they run for office, pihado ko sira na ang mga pag-asa nila unless mandaya na rin sila, that is kung may pandaya pa si pygmy.

Kaya pala nakakapagtaka na pumayag silang ma-declare without insisting that Trillanes and Koko Pimentel be declared, too, when Namfrel stopped its counting because there were no more votes to count considering that the votes in Maguindanao were fake and missing at that time! Samantalang ang grupo nina Trillanes ipinaglaban si Alan particularly when he was likewise not sure to be included in the Magic 12. Mahirap ang nakiki-compromise kasi. For sure may mga secret deals silang ginawa para makapasok siya samantalang all that he had to do was insist that he could not possibly lose because he was GO!

    Kayong mga babalimbing, hindi kayo patatawarin ng tao. Nakita na ninyo ang nangyari sa mga kandidato ni Gloria? Ganyan din ang mangyayari sa inyo. Hindi kayo patatawarin ng tao. Yan ang tandaan ninyo.

But let the others reveal their feelings, too. For those who are Pikons may take Propranolol, its effective. But understanding is better, or forgiveness. Remember, the emotional thoughts expressed are not necessarily that of the blogger but of the media maybe where he picked it up that was not clear enough.

And that is after the Senate president is in place and the different committees fiiled up and its composition known. We will know their true colors from thereon.

    On the other hand, Trillanes and his Magdalo friends’ case is unique. It should be treated with care. Justifiable in fact considering who they were fighting against with especially when there was actually no rule of law!!!

    I find this revelation on Cayetano and Escudero a blessing in disguise. This early, alam na natin kung ano sila.

Naniguro iyong pygmy na infiltrated ang GO para matalo man sila sa team unano meron pa rin siyang tao sa Senado. Lagot kung ang dalawang ito will join the others in pushing for a Chacha and abolish the Senate. Patay na! Panalo na si Queen Pygmy who will declare herself as queen.

    Itong batikos sa dalawa ay batikos laban sa pygmy. No doubt about that. Dapat lang malaman ni Escudero at Cayetano that they don’t call the shot. They should learn to listen to the people now.

    At least, I know now likewise that Legarda has more sense that I personally thought she had, and was willing to give her the benefit of the doubt.

  48. I believe Legarda won her slot She may not exactly be a paragon of virtue but she won her slot in the senate without having to steal. I may not like bits of her persona (privately that is) but no one can begrudge her for her election victory.
