Justice Secretary Leila de Lima Thursday ruled out friendly fire in the killing of eight Hong Kong tourists but recommended charges against 10 officials, police and media people in the bungled hostage rescue last month.
De Lima did not identify those accountable for the Aug. 23 fiasco or the charges to be leveled against them in the report, which she said was “95 percent” complete. The fact-finding committee will submit its report to President Benigno Aquino III on Friday.
De Lima described the report as “very exhaustive, fact-intensive, and incisive.”
Asked during a news conference how far in government the five-member committee was pinning accountability, she replied, “High enough.” But she stressed that the panel was not a quasi-judicial body and could only make recommendations.
“We have (had) discussions on specific accountabilities of specific officers and (other) personalities … We expect the President to act on the basis of our recommendation.”
De Lima said that the panel had determined that the hostage-taker, dismissed Senior Insp. Rolando Mendoza, killed the tourists before he himself was gunned down during the police assault before an international TV audience that triggered widespread ridicule of the Aquino administration’s bungling.
She said that the conclusion was based on eyewitness accounts of three Hong Kong tourists who survived the carnage toward the close of the 11-hour standoff in front of Quirino Grandstand at Rizal Park.
De Lima said the survivors corroborated the testimony of Alberto Lubang, 33, the driver of the hijacked tourist bus, who said he saw in his rear-view mirror how Mendoza sprayed gunfire at close range at the hapless tourists.
“We will include that in the report. Based on the survivors’ accounts, they were really killed by the hostage-taker,” De Lima said.
Lubang used a nail file to unlock his handcuff and escaped by jumping through a window as gunfire erupted around him at nightfall under a heavy rain.
Glaring errors
Autopsies carried out by Hong Kong police also supported testimony by witnesses that those killed were shot by Mendoza, De Lima said.
During the nationally televised public hearings, the panel was told of glaring errors by those who handled the hostage crisis.
These included key officials leaving the scene at the critical moment to go to a Chinese restaurant, passing up chances to take down the gunman, and not involving the best trained security unit in the rescue.
Members of the panel had also accused Radio Mo Nationwide of hogging the telephone line to the hostage-taker before the shooting started.
Testimony during five days of marathon hearings revealed that Mendoza started firing after his demand for reinstatement and dismissal of extortion and robbery charges against him were denied; that he was further enraged when he saw on the TV receiver in the bus the arrest of his brother, also a policeman who was accused of being his conspirator.
SPO2 Gregorio Mendoza, the hostage-taker’s brother, went to the park ostensibly to help but was ordered handcuffed by Manila Mayor Alfredo Lim, a former police chief reputed to be the local version of the San Francisco cop in the “Dirty Harry” movies.
Lim was the head of the crisis management committee, which also included Undersecretary Rico E. Puno of the Department of the Interior and Local Government (DILG) and Philippine National Police Director General Jesus Verzosa, who retired this week.
“More or less 10 will be recommended (to face charges),” said De Lima, some of them from the media, the Philippine National Police and public officials.
Even a ranking official of the Office of the Ombudsman would also be subject of an “appropriate recommendation,” De Lima said.
The panel’s vice chair, Local Government Secretary Jesse Robredo, has been criticized for not inhibiting himself in the inquiry as the PNP is under DILG supervision.
Out of the loop
Robredo has claimed that he was “out of the loop” during the crisis and said that Mr. Aquino had designated Puno as PNP overseer. Puno, a gun enthusiast and shooting buddy of the President, testified he had no experience in hostage situations.
The report will later be submitted by a high-level government delegation to the Chinese government and Hong Kong authorities who have also mounted a parallel investigation of the bloodbath that sparked outrage in China and Hong Kong.
Asked what she thought the administration could do to repair its image abroad, De Lima replied: “The government has to really show resolve in terms of going after those that we will recommend [to be held accountable].”
“The powers of the committee are merely recommendatory,” she added.
“We were never clothed with quasi-judicial authority. Our main mandate is to find out exactly what happened … and make appropriate recommendations based on the evaluation of the actions, non-action, the missteps, the lapses, the negligence, the incompetence, etc.”
Extortion attempt
De Lima said that one “interesting discussion” concerned Deputy Ombudsman Emilio Gonzalez.
The Office of the Ombudsman was included in the panel’s report after police negotiators testified that Mendoza angrily accused someone on the phone of trying to extort P150,000 from him, seemingly in exchange for a review of his case.
Through Manila Vice Mayor Isko Moreno, Mendoza was able to talk to Gonzalez and Ombudsman Merceditas Gutierrez on the phone during the negotiations.
“We are not going to profess complete knowledge or we don’t have the answers to all the questions [but] definitely, [the panel has the answers] to most of the questions especially to the key and vital ones,” De Lima said. With a report from Associated Press

I’m pretty sure they didn’t employ a psychologist to analyze what caused the “killer frame of mind” of Rolando (Mendoza).
I think they didn’t stitch the taped RMN interview with the video footages and survivors’ accounts.
It’s not only that the RMN guy “hogged the telephone line” but also captured and shaped the mind of Rolando into becoming a killer. All things were negotiable to Rolando, inherently not a killer, even up to the “last 2 minutes.” It’s DO THIS OR ELSE…
(1) the pullout of the snipers
(2) the withdrawal of support
– both to remove threat to his life, and
(3) stop the arrest of Gregorio
– to remove threat to his family
If only he was talking to the police then and they can easily grant the instant requests, perhaps Rolando was pacified for another round of negotiations.
Too bad Michael wasn’t a genie to grant the 3 instant requests/commands. Too bad Rolando trusted Michael. Too bad Michael let Rolando down.

De Lima has to put weight on the Chinese witnesses’ testimonies. This will be the only way the Hongkong people will be able to respect the Filipinos anew. Whitewashing the de Lima report will not help the case.

The root cause of why Captain Mendoza resorted to hostage taking was the long delay of his pending case with the Ombudsman. It is more believable that it did not move because of lack of grease. Napuno ang salop in Kapitan. That Gonzales guy from the office of the Ombudsman has a lot more to answer than those officers onsite .
Good to hear that media is also one of the respondents. I hope not only one but two persons to be charged. These media people had gone too far in this incident. I hope they follow our protocol if there’s any in the future.

In today’s modern world, newsgathering by gaining access through mobile phone can always be done. Interviewing a perpetrator (e.g., a hostage taker) can be made unlawful inasmuch as the general public is already barred from getting information because of the ongoing criminal act.
Of course, it’s a different story if the perpetrator requested for an interview with a particular journalist and authorities acceded to the request. Just like what happened with Susan Enriquez (though the reporter revealed that it was not really an interview and that it was not aired live).
In crisis negotiation a negotiator may promise the perpetrator certain things in an attempt to successfully mediate surrender the government is under no obligation to enforce the promise(s). Such action is void as against public policy. (State vs. Sands, 1985).

The Aug23 (read: Uhg! 23) Incident really captured the ineptness, incompetence, or clumsiness (or plain stupidity?) of our government in their failure to secure everyone and to save precious human lives in times of crisis.
But there is another powerful sector of society that shares the responsibility in bringing about global shame to us Filipinos. This is media…specifically, the Broadcast Media.
Michelle Ward Ghetti laid down the two general areas of conflict that particularly caused media coverage during publicity-seeking crimes to become the hotbed of controversy.

It appears the TV broadcasters and the RMN people had not learned from past lessons and so were guilty in complicating things and possibly helped Rolando Mendoza to pull the trigger of his M16.
However, it also appears that the most the media will get is probably censure (or a “slap on the wrist”) or Grave Offense sanction for the two meddling radio broadcasters [unless there really is “a law against interference to police actions” – contrary to Nene’s (Pimentel) trumpeting words that no ethical code or law was violated by the two clowns Rogas and Tulfo, backed-up by the stout ringmaster Maderazo!].
Sadly, the all-too-powerful media that even our senators are in fear of could probably be “scot-free” again to go on their merry-way of being a “watchdog” of government…all for the sake of public service…and, of course, NOT for the ratings as some insinuated!
Anyway, Ghetti also explained in her paper the Media’s Reasoning why they continue to cover (with eagerness and zest! I believe) publicity-seeking crimes such as the Aug23 Incident.

Two things THE SELF-REGULATING media (i.e., not the whole media but members of the Broadcast Media) was wrong about the handling of the Aug23 Incident. These are:
(1) The dissemination of information (esp. the live TV coverage) was too detailed as to reveal police strategies, activities, hidden personnel, etc. This could highly influence the mind of a viewing perpetrator. Of course, it’s the network bosses’ job to filter their news coverage…whether to air the footages live or not! For example, GMA-7 had shots of the bus (as background) and a sniper (as foreground); and video of the arrest of the gunman’s brother.
(2) Media interference with law enforcement is present. Direct contact with the perpetrator through mobile phone was made by a radio broadcaster.
