Bad news for AFP chief of staff Gen. Delfin Bangit.

Because Congress adjourned on Friday without him getting the nod of the Commission on Appointments, Bangit is deemed bypassed and thus he has to vacate his position and be replaced by his vice chief of staff, Lt. Gen.Rodrigo Maclang, according to Senate President Juan Ponce Enrile.

Enrile said President Macapagal-Arroyo can no longer re-appoint Bangit because of the ban on appointments that is effective until her term ends on June 30.

“There is a vice chief of staff. He can run the organization,’’ Enrile said, adding the No. 2 man in the Armed Forces should automatically replace Bangit. He said, however, that he believed Bangit could still carry his four-star rank until he retires next year.

“My understanding of the Constitution [is] once you are appointed ad interim, the appointment is complete in every respect and of course you will hold the position throughout the duration of your term if confirmed. But if your ad interim appointment lapses, you are entitled to all the benefits of the office to which you have been appointed ad interim,’’ said Enrile, who chairs the Commission on Appointments.

Enrile said Maclang will hold the position of chief of staff until the new President appoints a new military chief.

“The funny part is you will have a military officer who will still be in the active service with four-star rank but is not sitting as chief of staff,’’ he said.

He said the National Defense Act calls for only one four-star general.

“So you will have a chief of staff who is a three-star general and you will have a four-star general who is floating,’’ Enrile said.

Bangit was appointed AFP chief of staff on March 9 or a day before the ban on appointments took effect. He was unable to undergo scrutiny by the CA because Congress was on a break due to the election campaign.

Manicurist of Arroyo begs off from ‘midnight appointment’

President Gloria Macapagal-Arroyo’s manicurist has begged off from her “midnight appointment” to the Board of Pag-IBIG Fund after it stirred a furor, Malacañang said Thursday.

Press Undersecretary Rogelio Peyuan confirmed that Anita Carpon rejected her controversial presidential appointment, and this has been “automatically withdrawn.”

“What I know is that she has begged off from her appointment because of the criticisms that came her way,” the deputy presidential spokesperson said in an interview. “That’s automatically withdrawn.

Peyuan, however, said he wasn’t aware of the fate of gardener Armando Macapagal, whom Ms Arroyo appointed as deputy of the Luneta Park Administration.

“I’m not aware of the status of the gardener,” he said.

The appointments of Carpon and Macapagal were among a flurry of appointments that Ms Arroyo made a day ahead of the March 10 ban on appointments and that stirred a lot of controversy.

She also revamped the boards of the National Museum and the National Historical Institute.

    Mabuti pa si Carpon may delicadeza..si Pangit ay talagang wala..mabuti nga na by pass ang appointment niya..seguro mapahiya na siya ngayon..that is kung may hiya!

    May delikadesa naman si goyang, akala n’yo lang wala.

    Lahat ng ginagawa niya ay nahihiya siyang masabing hindi makapal ang kanyang mukha.

    Kapag nagnanakaw siya, nahihiya siya ng konti lang. Dapat big time. Para nga naman sulit.

  7. Bangit is fully aware of the sentiment of the incoming president and commander in chief about him. He can stick to the status quo and not submit his resignation when the new commander-in-chief is sworn in if he really wants to.

    If he does that, he will be creating a military precedent, tantamount to arm wrestling with the commander in chief. This is definitely not the right thing to do. It is definitely Bangit’s call — he may choose to embarass new president or do the honourable thing. Which will it be?

    The polemic or current controversy could have easily been avoided had the successor of Ibrado deemed fit to announce that he would tender his resignation when the new cdr-in-chief is sworned in just like what the current police chief had done.
