After being slammed by the OFW community (that means the estimated 2.3 million overseas Filipino workers plus their relatives at the average of six per OFW) for his order to impose tighter inspection of balikbayan boxes, a regional trial court Monday ordered him to stop his highly questionable act of cancelling the P650 million contract to modernize Customs operation that benefitted his company.
The day after President Aquino stopped Lina’s order for stricter control of balikbayan boxes, the Manila Regional Trial Court (RTC) Branch 47 released the order of Judge Paulino Gallegos for Lina also stopping his cancellation of the BOC contract with Omni Prime-Intrasoft JV.
The Court ordered Lina to proceed with the signing and not initiate any other procurement, sourcing, or negotiation to replace or upgrade the present customs systems that is the subject matter of the bid.
The case of OMI-Intrasoft JV and Lina’s E-Konek is related to the Philippine commitment as a member of the Association of Southeast Asian Nations or ASEAN which promotes free movement of people and goods among the 10-member countries.
Known as ASEAN Single Window (ASW), it is crucial to the free circulation of goods in the envisioned single market, single production base integrated economic community. It establishes a central database system that tracks in real time all customs procedures nationwide. It aims to be a fully electronic, paperless and human contact-free system of recording and monitoring customs transactions.
The integrated system is also seen as the long-sought after solution to rampant smuggling in the Philippines.
The deadline for implementing the upgrade is on December 2015.
The BOC had been working on the ASW for a long time. After a seven months of going through the process of bidding, the joint venture of Omniprime Marketing Incorporated and Intrasoft International was declared winner last April 13.
It is worthy to mention that E-Konek Pilipinas where Lina has 96.48 percent stake, participated in the bidding but lost.
Ten days later, on April 23, the contract was finalized and it was scheduled to be signed by the end of the same month.
However, on April 24, Commissioner John Sevilla resigned and Lina was immediately appointed.
Two weeks after he took over from Sevilla, Lina cancelled the BOC- OMI-Intrasoft JV contract telling the Department of Budget and Management that he needed to review all the projects in the pipeline entered by the Commissioner before he assumed office and also said that the project was not needed anymore.
With the cancellation of the BOC- OMI-Intrasoft JV, customs operations had to return to its previous system wherein the biggest of the three service providers is Lina’s E-Konek Pilipinas.
The service providers collect P50 for every Customs transaction. It is estimated that annual transaction in the BOC reaches an average of 4 million. With the modernization of customs operation, Lina’s E-Konek stands to lose its P200 million a year business.
Questions were raised when Lina was appointed as successor to Sevilla, whose resignation fueled speculations of the Liberal Party’s election-fund raising.
Conflict of interest was one issue against Lina,whose business is customs brokerage.
Aquino’s mantra of “Tuwid na Daan” didn’t apply to Lina.
It’s actually Lina’s second stint at the Bureau of Customs having held that position during the Arroyo administration. He is close to Finance Secretary Cesar Purisima and was one of the so-called Hyatt 10- ranking officials of the Arroyo administration who resigned in the wake of the Hello Garci scandal.
Roque has also filed graft and plunder charges against Lina and his associates at BOC with the Office of the Ombudsman.

Hindi rin dapat ikabahala kung ang mga OFW ay hindi man magpadala ng pera para sa kanilang pamilya dahil ang maaapektuhan diyan ay sila mismo na OFW, banta lang iyon. Hindi dapat ikatakot ang gusto na zero remittance. Dahil maling mali ang sinasabi na ang dollar remittance ng mga OFW ang bumubuhay sa ekonomiya ng bansa. Oo may mga dollar na dumarating sa bansa pero may mga dollar din na nalalabas sa ating bansa. Ang mga kompanya kapag bumibili sa ibang bansa ang bayad ay dollar hindi peso. Sa ganun ay may lumalabas din na dollar mula Pilipinas papunta country of importation. Maraming tao ang pumupunta ng USA bawat araw at may dala din na dollar kaya bakit sinasabi na ang dollar na mga padala ang bumubuhay sa ekonomiya. May dumadarating na dollar sa bansa bawat araw pero may lumalabas din na dollar bawat araw. Ang magandang salita ay kaya nabubuhay ang ekonomiya ng bansa ay dahil may mga exportation ang Pilipinas papunta sa ibang bansa na kung saan ang bayad ay dollar. Mode of payment sa BOC ay dollar lahat ng transaksyon.

Lina has 70 brokerage firms in his name. Anyone who imports knows that in order to cut cost on duty tariffs, excise taxes, etc., you provide your broker with “expediter’s expense account” which is actually for fixers’ grease. Instead of paying hundreds of thousands for a “clean paper” transaction, you just pay your broker five thousand per container (lately an additional P25,000 per container for the DOF Task Force) in order to pass through the gates and guarantee safe passage from the Task Force inspectors who operate in the streets of MMla.
If your cargo includes raw materials for re-export or contain highly-taxable goods like liquor, you are diverted to a Customs Bonded Warehouse where Customs collect the appropriate bonds should you later fail to re-export and sell those materials here instead. In the case of locally-produced liquor, bonds cover taxes due once the aging process is completed after 3, 5, 10, or 12 yrs., depending on your liquor. Again, Lina owns the biggest CBWs like Ufreight and Skyfreight, just right across or even inside the airport compound, I’m not sure about his CBWs in the piers, though.
Airfreight 2100 is also a major forwarder which Lina owns. Few years ago, they were partners with FedEx as Air21 until the joint venture turned sour and split ways.
And many other big companies. That, aside from the long suspicion and open secret that he is the jueteng lord in Laguna that’s why PCSO’s Lotto was banned from entering the province until his brother. ex-senator Joey Lina, transferred his governorship to Ningning Lazaro (presently accused of plunder) whom many say are the Linas’ dummy.

It’s not really difficult to catch technical smugglers. First, the broker submits an IED (Import Entry Declaration, hindi Improvised Explosive Device, sayang) complete with all the details of the incoming shipment. While the ships are sailing they have an ample window of opportunity to segregate which shipments can be flagged, for example several containers of garlic from Taiwan which cost much less than freight and the duties and taxes to be collected. This should be flagged.
Upon arrival, check the net weight. the container vans have typical weight so, identifying the net weight would be easy. These devices can be incorporated into the gantry cranes that move the containers from ship to port. It is stupid to find net weight variance of one ton acceptable which is about the weight of a sportscar.
If it passes the weight test, then it goes into the xray machine, verifying the contents.
Then the K-9 dogs do their job, sniffing for drugs, gunpowder, chemicals, the likes. If it passes then shipment is cleared.
They have at least 2 weeks, for Asian origin shipments, to identify from the IED which ones are suspect and which ones do not need further inspection, proceed to the dogs and xray and they’re done. For those incoming from US and the west, they have at least 1 full month to prepare.
They can have a separate area for ASW items to expedite the process using OMI’s software. Of course Lina will object to that scheme because it will make the process more transparent, depriving him of the opportunity to earn “tubos” and “padulas” money for his pocket and for the LP war fund.

Kung ayaw ng mga OFW na buksan ang mga balikbayan boxes eh di huwag silang magpadala ng balikbayan boxes. Milyon milyon ang nawawalang pera dahil sa mga palusot na dinadaaan sa balikbayan boxes. Walang masama talaga kung bubuksan ang mga balikbayan boxes kasi para maiwasan ang smuggling.
Ang mga Pilipino ay mahilig din sa mantiner kung sa waray o bisaya. Kung sa tagalog ay mahilig pa na gamitin ang ginamit na. Minsan may mga passenger vessel na binili sa ibang bansa na ginamit na ng ilang taon at dito sa Pilipinas ginagamit pa. Kasi mahal ang halaga ng bagong passenger vessel. Para makaiwas sa malaking gasto ay bibili ng second hand. Ganun din sa panty at bra. Basta palagay ko kaya tutol ang mga OFW na buksan ang balikbayan boxes ay nahihiya sila na baka ang pinadala nilang bra at panty na ginamit na ay makita ng nag inspeksyon. Sa customs noon ay may mga shipment na 10 percent examination lang sa container. Kung halimbawa ay 10 container galing ibang bansa na import ng kompanya ay isang container lang ang buksan ng taga BOC at pag magkatugma sa bill of lading ay okey na. Ito ang di maganda, kung may illegal shipment sa 10 container ay kontakin ang taga BOC na iyan ang buksan na container o ituro kung anong container ang buksan dahil walang illegal doon at siyempre involve ang pera at alam na iyon ng taga BOC na may illegal. Sa ganun na paraan kahit pa mahuli ng nakatataas na posisyon na may illegal ay may dahilan ang nag eksamin kasi ginawa niya ang tungkol na 10 percent examination, at isa lang ang binuksan. Sa ngayon 100 percent examination na kasi para walang lusot pero may nakakalusot pa rin. Sa balikbayan boxes na walang pagbusisi masyado ay doon inaabuso ng mga mahilig mag import ng mahal ang halaga at para di makabayad ng tamang buwis.
Sa utos ni Pnoy na huwag na lang buksan ang mga balikbayan boxes ay siya mismo ang sumuway sa tuwid na daan na pinagmamalaki niya. Tama talaga na buksan ang mga balikbayan boxes. Siguro yung nagpalusot ng daan-daan libong toneladang bigas na laging nasasabat nila Kiko Pangilinan na nailabas na sa Pier at nasa warehouse na ng dealers sa balikbayan box din nilagay no? Walanghiya kasi yang mga OFWs sa Vietnam at Thailand. Ganun din yung mga OFWs sa Taiwan at India, bawang, sibuyas naman raket nila.
Isa pa, yung mga smuggled na frozen chicken at beef na mabibili sa mga supermarket sa murang presyo, akalain mong nagpasadya pa ng maliliit na freezer na kasya lang sa loob balikbayan box para maipuslit yung mga karne? Ilang libong mini-freezers kaya ang ginastusan nitong mga bigtime OFWs sa US at Australia? Malala na talaga itong mga OFWs na ito.
Di totoong mahirap ang buhay ng mga OFWs sa Middle East. Aba e kundi ba naman e, makakaipon ba sila ng 25 container vans na nakapangalan sa iisang consignee lang na puno ng “used” clothes na pang-Ukay ukay (naka-balikbayan box din ba?) na halos hindi pa nagagamit binebenta na ng mura sa ukay-ukay. Ilandaang pantalon ba ang binibili nila kada buwan? Jacket? Blouse? Bra at Panty?
Ang pinakamayaman na OFWs yung mga nasa Japan, biruin mo napakalaki ng mga balikbayan box nila, nagkakasya mga aparador, golf clubs, LED TV, mga boots, tsinelas, pati plato at sirang mga SEGA, Playstation, mga geisha dolls, manga/hentai comics, hanggang mga used trucks, vans, tractors, kotse, naipapadala sa Pinas at binebenta sa mga Japan surplus stores. Yung mga kotse at truck, ino-auction sa Bulacan, Subic, Cebu, CDO. Hindi ba napakabigtime smugglers yang mga OFWS na yan?
Pambihira, demonyo talaga yang mga OFWs, sa sobrang galing magpalusot, kahit xray scanner at K-9 sniffers di ma-detect ng mga taga-Customs. Tapos sasabihin ninyo corrupt ang Bureau of Customs.

Ang tao ay nagtratrabaho para magkapera. Ang mga empleyado sa BOC ay tao lang na nangangailangan din ng pera. Sakali may makita na illegal sa shipment ay tapalan ng pera ang kaliwang mata. Sabihin ng impleyado “may nakikita pa ako”, at muli tapalan ng pera sa kanang mata naman at tanungin “O, ano may nakikita ka pa? Pag sinabi ng empleyado “oo may nakikita pa ako” ay muli tapalan din ng pera para wala na talagang makita.
Ang BOC ay hindi dapat sisihin sa mga illegal shipment sa bansa. Ang dapat sisihin ay ang BOC country of origin. Kung binubusisi lang ng maayos ang mga shipment doon sa bansa na pinanggalingan ng shipment ay hindi iyon makakarating sa ating bansa na ganun.

Tama na naman si arvin! Dapat ibalik yung pre-shipment inspection. Ginawa yan nung panahon ni Ramos. Hindi tatanggapin ng Local Bank ang papeles mula sa correspondent bank sa abroad. Mas magastos pero mas malaki kita ng gobyerno. Malinaw yang nakalagay sa mga Letters of Credit. Société Générale de Surveillance (SGS) ang most trusted sa ganyang negosyo kaya kinontrata sila ng PH gov’t para magconduct ng inspections.
Nag-boom ang industries ng Pinas nung panahon ni FVR kasi di makalusot yung mga Chekwa na sanay sa smuggling kaya wala silang advantage noong FVR regime. Umakyat exports ng electronics, vehicle parts, pati na pagpasok ng mga consumer electronics manufacturers at automotive factories.
Nabura lahat nung umupo si Erap at bumalik na yung P5,000 per container charge at yung “per kilo” valuation at nakansela yung SGS contract. Dinudukot yung IED sa Customs at pinapalitan ng description para mapunta sa mababang Tarrif rate. Namayagpag uli mga negosyong Chekwa. Panahon ni Gloria, mas lumala pa. Napunta sa iilang negosyante ang pagkopo ng importation ng commodities, bigas, coal, petroleum, etc. Yun pala si Taba lahat ng may pakana.
Kung tutuusin, nung panahon ni Makoy (palakpak na naman si arvin) 3 bagay lang bawal sa Pier: droga, baril, at tela. Mahigpit sila sa tatlong yan. Wala ring bayad ang Balikbayan Box, one to sawa basta hindi garapal yung OFW o yung nagpapanggap na OFW. Ngayon may limit na P10,000 at may patong kung electronics, jewelry at kung clothes, hindi dapat lalampas ng 3 yarda kumpara sa raw textile kundi may tax na. Ang limit ay one box a month lang per OFW at di dapat lumampas sa P10,000 value total.
Kabobohan, panggigipit lang talaga. Ano pa maiiwan sa P10,000 e yung freight pa lang $80 -$100 na (kung galing US) e di kalahati na ng P10,000 ang nawala. Baka yung Balikbayan box ng Forex o LBC na 24″x24″36″ ni hindi mangalahati at kakalog-kalog yung mga tigalawang lata ng Spam, Hereford Corned Beef, Libby’s Vienna Sausage, galon ng Skippy’s Peanut Butter, at malaking bote ng Nutella. Samahan mo ng ilang assorted na chocolates, P5,000 na siguro yun.
