I will hold my applause until I see the results of the Aquino administration’s efforts to investigate the pork barrel scam which was triggered by the discovery of a Janet Napoles operations involving initially five opposition senators and has now spilled into the current administration’s territory.

President Aquino and the Senate leadership have shown that they are listening to passions online and on the ground by accommodating the call for a probe into the misuse of the multi-billion Priority Development Assistance Fund, commonly referred to as pork barrel.

After dismissing the Napoles-triggered pork barrel expose estimated to reach as high as P10 billion as not as massive as the P728 million fertilizer scam during the time of Gloria Arroyo, Aquino yesterday said he is open to the suggestion of Senate Majority Leader Alan Peter Cayetano to tap former Sen. Panfilo Lacson as special independent investigator who will look into the alleged irregularities in the use of pork barrel funds by some senators.

Last Wednesday Cayetano said ““Lacson is the best person to conduct the investigation because of his impeccable record against corruption and his unwavering stand against the pork barrel.” Lacson did not avail of his PDAF allocation during his term as senator.

Cayetano also said that Lacson’s background as a police officer would be an advantage because “he knows how to build up cases, he knows how to case people, he knows how to sense lying during question and answer of witnesses, so these are some qualities we need that will make the investigation more credible.”

Cayetano’s colleagues are divided on Lacson’s involvement in the Senate probe. Lacson’s nemesis, Sen. Miriam Santiago, expectedly opposed it. Even the head of the Senate Blue Ribbon Committee Senator Teofisto Guingona III was not amenable to Cayetano’s suggestion.

“We recognize the integrity and professionalism of Senator (Panfilo) Lacson. However, we believe that the Senate Blue Ribbon is capable of determining the truth. I don’t think there’s a need at all,” Guingona said.

Guingona also said that senators mentioned in the COA report will not be grilled by the committee.

Actually, even Lacson, knowing the political and legal realities, is not enthusiastic about it even as he was polite to Cayetano’s suggestion.

In a statement, Lacson said: “First, I thank the Senate Majority Leader for putting his trust and confidence in my ability to assist the senate in a very sensitive issue hounding several of its members. Second, a resolution needs to be adopted or concurred in by at least a majority of the senate to formally create the same. Third, and most important is how the proposed body will be defined in regard to its mandate, scope, powers and functions. “

He reminded everybody that in 2003, at the 12th Congress he delivered a privilege speech advocating the abolition of the pork barrel which he described as ‘a very corrupt and corrupting system in our political institutions.”

“ Had the 12th congress reacted positively to my privilege speech 10 years ago, the Senate could have been saved from the wrath and hatred of the citizenry,” Lacson said.

Lacson said he has to consult with the President since he said he “has yet to hear a formal confirmation of an earlier announced creation of an anti-corruption body to be headed by me which will necessarily deal with a similar or related issue at hand. “

Actually, if you examine the President’s statement on the proposed role of Lacson in the pork barrel scam, he is not enthusiastic about it.

He said there is already the Inter-Agency Anti-Graft and Corruption Council . The Ombudsman, the DOJ and COA are currently probing on the misuse of pork barrel.

The probe, however , is limited to the COA report released recently which covered PDAF released from 2007 to 2009. COA’s investigation does not cover PDAF releases under the Aquino administration.

Lacson has submitted a draft Executive Order for an office that would investigate graft cases under the Executive branch of the government. It did not cover graft cases in the two other branches of government – legislative and judiciary- for obvious constitutional limitations.

To create an all-encompassing anti-graft body, it has to be a new law that would require an act of Congress. They would have to make sure that the proposed new anti-graft body does not duplicate the functions of the Ombudsman.

Will members of Congress pass a law creating an independent body that would have powers to investigate them? Do pigs fly?

    A Senate Blue Ribbon committee investigation on the alleged P10 billion pork barrel scam will not center on lawmakers linked to the scam but on the Commission on Audit report on alleged fund misuse.

    In an interview, Sen TG Guingona said fellow senators such as Juan Ponce Enrile, Jinggoy Estrada and Ramon “Bong” Revilla Jr. who have been linked to the scam will not be questioned.

    “They will attend as senators. They will not be questioned. I’m sure if they have something to say, they will say it,” he said….

    Just what are the Objectives of the Senate probe into the Pork Barrel scams? Legislative measures? Criminal Probe? The way the Mess is being investigated, the chances of it being resolved is getting nowhere. There is only one way to approach this issue..since the allegation of diversion of Pork is a Criminal offense, then it is a matter for Criminal investigation and we all know that the Police agencies are the only bodies mandated to investigate criminal acts..not the Senate, the HOR and not the executive.

    And if there is a need to have an Inquiry, call for a Blameless inquiry unrelated to the Criminal probe whose only objective is to gather the facts to arrive to the Truth to be able to promulgate measures to prevent the Pork from turning the politicians into Pigs.

    Now if the Senate investigation is still allowed to go on, it will be utilized to WHITEWASH The Scams the same with all the other Senate investigations in the past…believe me, it is never done, not even for Legislative measure or Aid of legislation in many other working democracy as the Senate or Congress is political, biased and prejudiced. It can never be impartial (just watch Senator Santiago and her “friends” trying to outdo one another to prove who has the smaller brains) independent and Credible. I’d rather suggest an independent Judicial Inquiry headed by a very Credible Justice or judge with a clearly defined mandate and power and given all the funds to conduct the fair and independent and Blameless Inquiry, not prejudicing the Police criminal investigation which by the way should also be impartial, independent and credible.

  8. Dapat, taumbayan ang magtatanong sa mga mambabatas, at walang bawal-bawal. No hold barred open forum. Gumawa lang sila ng forum para makapagpalusot yung mga sumabit na lawmakers. Sa social networks wala silang kalaban-laban tapos kung alin pa yung imbestigasyon doon sila gagawa ng kung anong palusot? Hindi pa matatanong. E di puro blanket denial lang lahat yan. Bakit pa bibigyan ng pagkakataon?

    Kung gusto nila, isang independent Fact-Finding Commission sa pamumuno ng isang isang ex-Justice ng Supreme Court, si Reynato Puno halimbawa, katulong ang private auditors, private volunteer lawyers, technical staff, yung whistleblowers pati na mga bagong volunteer witnesses, para once and for all mawakasan na yang punot dulo ng korapsyon at gumawa ng matinong sistema kung saan taumbayan ang magsasabi kung sangayon sila o hindi sa pamamagitan ng referendum.

    Nandito na rin lang tayo, gawin na natin ito ng tama at maayos na hindi naman masasakripisyo ang serbisyo ng gobyerno. Gagastos man tayo rito, may saysay na expense naman.

    Pagkatapos nito, ewan ko lang kung meron pang mag-aaksaya ng milyun-milyon gastos sa kampanya kung wala nang mananakaw na pondo.

    Pihado, simula Martes, mahigit kalahati ng mga congressman at senador, absent!

    Okay na din ang approach ng blue ribbon committee kasi if it scrutinizes the COA report darating at darating din yan doon sa mga senador na sangkot kay Napoles. Kung maayos at kung gugustuhin ng blue ribbon, ang questioning nila ng resource persons from COA, DBM, implementing agencies, and NGOs will lead to explaining what happened to the PDAF that went to certain senators. Siempre yung tatamaan mapipilitan mag explain. Pag nag explain pwede ng tanungin ng diretsahan.

    You have to take into consideration na mahirap naman na frontal assault ang gagawin ng isang senador sa kapwa niyang senador kasi they are stuck with each other until 2016 at the earliest and they do have to get each other’s votes for their respective bills. Sa madaling salita, practical considerations relating to getting legislation passed prevents a senator from burning all his bridges.

    Kaya kailangan medyo padaplis ang dating ng probe at kunwari sinusundan lang ang ebidensiya basta lang talagang susundan ang ebidensiya at hindi mawawalan ng bayag ang blue ribbon kung papunta na ang ebidensiya sa mga matitigas na colleagues nila.

    During the Justice Gommery inquiry on the Sponsorship Corruption Scandal in Quebec (note. that was the First Big one, the current one is even Bigger) his commission Subpoena former PM Jean Chretien and the Sitting PM Paul Martin..Jean Chretien went to Court to contest the subpoena, but lost and has to testify before the Inquiry under Oath..although it was a Blameless Inquiry as all Judicial and Coroner’s Inquiries are, it was an unprecedented move on the part of the commission to summon both the sitting and the former PMs.

    And I do not support this Senate investigation in any form…it is a waste of money, time and effort and it has a negative effect on the objectives of what the inquiry is all about.

    isa rin naman talagang wala sa hulog ay ‘yang si brenda na ang panukala noong una ay UNTI UNTING i-abolish ang pork barrel hanggang 2015 KUNG KAILAN matatapos ang kanyang termino sa senado. ibig sabihin – may kulay salapi ang kanyang pagiging isang mambabatas.

    True, there is much sensitivity and conflict on both choices for Lacson and the senate blue ribbon committee since both have their own predicaments in regards to corruption cases of their peers. Existing laws may not be sufficient and effective to counter the deep rooted ills in pork since was used in the Philippines back in 1922.

    So what kind of enabling law then is needed? It must be that kind of law that is strong in the rule of law itself rather than the rule of the rich that we have in our Philippine justice system. I am pointing towards the adoption of the proposed grand jury/trial jury system mirrored from U.S. jury system. In effect we are fully availing what is mandated by Article 2, Section 1 of our Constitution, that the sovereign power of the state is vested upon the people and all authorities emanates from them. Jurors shall act under the supervision, protection and instruction of the presiding judge of the case and verdict shall be based on facts. I would not hesitate recommending its adoption in our Philippine justice system as former forensic auditor, admitted in the High Court of the U.S. Territory of American Samoa as expert witness in court in criminal and civil cases in the venue of Jury trials.

    Our ordinary Filipino people cannot be treated anymore as mere second class Filipino Citizens in view of their supreme power duly granted by our Constitution, their power to investigate, indict(the grand jury) and give verdict (the trial jury) selected among the 98 million Filipinos, while at the same time, there are 98 million Filipinos as the eyes and ears of crimes in the Philippines. According to the author of the proposed Jury laws, “The Jury System means rule of law, rule of the people, and prevent the rule by corrupt political dynasties . It is also the means to unite the Filipino people just like the way Americans who came from all other countries of the world….”No less than the former U.S. President Thomas Jefferson said, and I quote, “I consider the jury trial as the only anchor yet imagine by man, by which a government can be held to the principles of its constitution.” –Thomas Jefferson to Thomas Paine, 1789.
