Defense: Palace offered P100-M per senator to skirt TRO

Palace says claims are ‘unsubstantiated,’ a ‘desperate gimmick’

The defense on Sunday alleged that Malacanang offered P100 million for senators to skirt around the Supreme Court-issued temporary restraining order on the subpoena issued on Chief Justice Renato Corona’s alleged dollar accounts.

Citing a “very reliable” source, defense lawyer Dennis Manalo said Executive Secretary Paquito Ochoa Jr. has been contacting senator-judges not to honor the halt order.

Another lawyer, Jose “Judd” Roy III, alleged the money will be sourced from government savings to be used for “soft projects.” The funds will supposedly be released this week.

In a prepared statement read by Manalo, the defense said: “Yesterday, we received very reliable information that Executive Secretary [Ochoa], acting in behalf of President Aquino, was personally contacting and phoning senator-judges to pursuade or pressure them to defy TRO issued by SC in favor of PSBank.”

He said they condemn in the strongest terms the actions of President Benigno Aquino III to “undermine the constitutional process that he himself initiated.”

He added that Corona “in good faith” participated in the process, but now “it’s apparent that the President is bent on convicting CJ Corona at all cost.”

Attack on the judiciary, economy

The defense did not reveal their source, noting only that he is very reliable.

But they stressed they would not risk their reputations as lawyers by coming out on a Sunday to issue a statement on news that has no bearing.

They also called on lawyers “to be more vigilant and stand up for the independence of the judiciary and the integrity of our constitutional processes.”

What is happening now is an attack on the entire judiciary, the defense added.

They also called on the public to “guard against efforts to undermine the constitution and rule of law…We must…secure the independence of the judiciary. Otherwise, the oppressed would find no refuge from abuses and rights cannot triumph over injustice.”

Defense lawyer Ramon Esguerra also added that if the senator-judges decide on Monday not to respect the TRO, “the backlash will not only be on the Chief Justice, but on the banking industry and the entire economy.”

The defense did not say what it will do with the information it received. They said, however, that what Aquino did, if true, is already “a culpable violation of the Constitution.”

Palace says defense allegation a ‘squid tactic’

Executive Secretary Ochoa called the accusations of the defense as “unsubstantiated” and a “desperate gimmick.”

In a statement issued to the media, Ochoa said: “As a member of the Bar, I respect the right of the lawyers of the Chief Justice to protect the interests of their client, within the bounds of the law. However, citing rumors to prove baseless accusations to support their cause goes against the principles of decent and ethical lawyering.”

He said: “It is a desperate gimmick that does not belong in the proceedings of any court of law, especially an impeachment trial.”

He said the Senate, sitting as an impeachment court, is capable of making decisions to provide Corona a fair trial.

Presidential spokesperson Edwin Lacierda urged Corona’s camp to “stop running and stop hiding” and inflicting on the public “idle talk.”

“Their conspiracy theories concerning the Executive Secretary [Ochoa] is a diversionary tactic to distract attention from the evidence coming to light in the impeachment trial,” he said.

He said the defense chooses to use “squid tactics” in order to deviate from the real issues.

“The Senate has been conducting the impeachment trial in full light of day; the prosecution and defense have been given every opportunity to have themselves heard,” he said. “We can only surmise that the defense has run out of ways to conceal the culpability of its client, and has engineered this move as a last-ditch effort to confuse the proceedings and prevent a resolution.”

“The only danger in the disclosure of the Chief Justice’s assets is the Chief Justice’s defense: the integrity of the banking system, our system of laws, the cause of justice and good governance are not endangered by the proceedings of the impeachment court,” he added.

Pull-out imminent?

The senator-judges will hold a caucus on Monday morning to discuss whether or not to follow the halt order issued by the Supreme Court last Thursday.

The High Court, in a vote of 8-5, issued on Thursday a TRO on the subpoena issued by the impeachment court on the alleged dollar accounts of Corona in PSBank.

Esguerra added: “We respect the trial…but we came in already scathed and wounded…Sugatan na ang Chief Justice, lopsided na ang sitwasyon, di kami makapag-motion for reconsideration, we can’t object to the questions of the senators.”

He said, however, that they still hope that “the senator-judges will see reason and implement the Constitution.”

Asked if they will pull out from the trial if the Senate insists on the subpoena, defense lawyer Paolo Quicho only said: “Kami pong mga abogado ay handing lumaban, manindigan…Sama-sama po namin itong haharapin. Marangal naming haharapin ang persecution na ito.”

In the meantime, the defense is asking stakeholders to wait for their turn in ducking the accusations against Corona.

Malacanang has also called on Corona to just open his bank accounts to end the speculation.

But Manalo said: “There is a process. Sila dapat muna ang magpatunay. Bakit kailangan ng shortcut?”

    May show of force (kuno) sa rally sa Supreme Court na karamihan ay myembro ng INC.

    Ngayon naman, binibribe ng Malacanang ang mga senators-judges.

    Asahan marami na namang nakapula bukas at magrarally sa P. Faura.

    Sa tingin ba nila masway ang karamihan na gustong malinis SC ng Presidente kung idederekta ang mga paninira kay Pnoy?

    Agree with Tongue, that was a stupid move the defense did. True or not they should’ve just shut up if they can’t prove it or can’t reveal their source. Pag ikaw ay isang isnasakdal, di mo pwedeng inisin, insultohin o buwisitin ang hukom na hahatol sa kaso mo. Baka mapabilis ang pag convict kay Corona dahil sa blunder na ito.

  10. The best thing to do is ask the defense to explain and call Tatad to the witness stand. At least they would not be able to claim they were not given due process as they always claim. Madali gumawa ng kwento, mahirap patunayan ‘to.

    (1) The defense “proclaimed” this so that when the Senate ignores the TRO tomorrow, the defense will walk out and make the issue all about P100M.

    (2) The defense’s reliable source is a “small gentleman.”

    I don’t like Ochoa, but the defense only makes its move less credible. Why should Ochoa or Malacanang do such a thing when they see that Corona is now about to fall down to the pit? The burden of proof now is on Corona’s camp to prove why he holds multimillions but reported only a fraction.

    It’s a desperate move from someone who is already cornered but still doesn’t want to throw in the white towel.

    Why all the fuss and the debate and the fear of a constitutional crisis? STOP the Impeachment even without receiving the TRO. The Impeachment Court can at once COME to judgment: Declare CJ Corona based on the sufficient evidence submitted as UNFIT for the high office of the Chief Justice. FIRE CORONA. Who and what can stop the Impeachment Court from doing that? The MISRULE of law by bad lawyers in the Philippines?

    The defense will walk out and lose their promised fees and pending cases? Push them to do it and good riddance. It won’t take five minutes for the Impeachment Court to convene and FIRE Corona. Impeachment completed. The DoJ and the Ombudsman can take it away from there.

The reason Corona finds himself in the straits he’s in is precisely because he has banished those things by accepting a midnight appointment and by voting in cases involving his patron, never mind unwaveringly in her favor. The Supreme Court does the same. The culture of impunity merely means that the law has become so powerless it allows people to get away with murder. This is worse: It means the law has become so powerful it routinely commits murder itself.

    Three, Corona has repeatedly said he has nothing to hide. Serafin Cuevas has repeatedly said he has nothing to hide. His supporters, real or hakot, have repeatedly said he has nothing to hide. So why is he hiding his dollars?”

    Ang middle name pala ni Corona ay “Coronado”. Sobrang delusion yan, me korona na, kinoronahan pa!

    Flailing around in deep water. That’s what the Corona camp is doing. It is so desperate and panicky that it has lost its ability to swim.

    Their latest antic last Sunday, the now-infamous P100 Million presscon, was so shot full of holes it could deservedly earn the nickname The P100 Million Chismis. Or start a joke “Senator, may 100 ka dito.” Pero cheap. Abalos was big time..“Romy, may 200 ka dito.”

    The Corona is planning something desperately big and stupid. It is now obvious they plan to stop the impeachment trial altogether.. because the ragtag squad of prosecutors are actually fumbling their way to success.

    Bloodied and bruised from all the ribbing from the public and Cuevas and from the impatient sneering and lecturing from Senator-Judges, they are still on their feet and unbowed.

    Armed with slingshots to Cuevas’ machineguns, they have succeeded to do battle against the might of the Goliaths of the court . They are uncovering and presenting documents that are piling up as evidence against the highest ranking lawyer of the land.

    They could not have done this if the Impeachment Court were not as liberal, of course. If the impeachment court had stuck strictly to judicial and court procedures, I don’t think we would have an impeachment proceeding still going on today. It would have been already over run by people power by this time. Or perhaps the Executive branch could already have stepped in to break any impasse that could have developed.

    The Corona camp is striving mightily to trip the Senator-Judges, to taint their characters, to paint them as biased, to get them to lose their tempers and make foolish errors and decisions… so that Corona will have reason to walk out, or call for a mistrial.. all to stop the impeachment.

    For what? The bottomline is.. so he can stay in office and continue to protect Gloria, Mike and the mob?

    As I said. Big and stupid.

    The witness was asked to look into the originals at her bank so that it could be determined if the prosecution’s documents were fake.

    But the manner and behavior of the bank manager of PSB was weird. She kept on wanting to consult her lawyer, two lawyers at that, both named Puno.. even when asked the simplest of questions.

    Something fishy with this lady..and something smells at her bank’s main office. All the bank records of Corona seem to have been spirited away from the lady’s branch and kept in the central office.

    My thoughts exactly. Parang pilit plinaplantsa yung evidence against Corona. The TRO I think was meant to buy him some time to cover all loose ends. Remember their mantra: “We will prove it at the right time”. When that time comes, naayos na at sasabihin nila, “See, malinis lahat”. Yun pala nasanitize na. These people play dirty. I’m afraid the 13-10 decision would give him enough time to ‘fix’ everything.

    Wag tayong masyadong paaapekto sa mga kasalukuyang nangyayari. Para sa akin ito ay bahagi ng learning curve kung saan malaki ang ating matututunan pag dating na sa tunay na laban.

    Several Senator-Judges rose to condemn the defense lawyers for their P100M Presscon Chismis. I was expecting they would spit fire and brimstone for this insult and disrespect to them.

    I was disappointed. Kulang ang level of indignation. Where was Enrile’s impatient growls and Miriam’s shrieking?

    I guess such level of ire and disrespect is reserved only for the ragtag army of prosecutors. Kawawa talaga ‘tong mga prosecutors.

    In the midst of the Senator-Judges’ explanation of their votes on the SC TRO, Enrile gave a short one sentence cryptic assurance. After Senator Trillanes explained his vote, Enrile assured:

    Alright, alright..so the Senate has decided to respect the SC’s TRO on them. If the Senators’ plan is to temporarily take one step backwards now so they can take two steps forward later, I can agree with that.

    They are banking on arguing their case before the SC? That makes them subservient to the SC. But ok. They say that the defense has already assured the dollar accounts will be opened “in due time”. But the defense lawyers are saying that is what their client Corona says. uh oh..

    So the question is, do the Senators trust Corona? After saying he wants to stop the impeachment? After calling them names? After he has practically accused the senators of bribe taking?

    Anyway, so okay give the senators the benefit of the doubt. Am willing to wait for theirs and Corona’s “in due time”.

    But taking a page from Miriam’s cruel lecture to Congressman Tupas yesterday “What is the Senate’s standard for this over-used term “in due time”?

    The prosecution’s ragtag boys have been more respectful of the Senator-Judges than the defense lawyers have been. And yet they are being treated with ridicule, shown impatient snarls and growls and general disrespect by some Senators-Judges.

    The Corona camp has slapped them a TRO and called them names. Cuevas has been raising his voice with obvious regularity. but no berating, no snide remarks for them.

    They just a gentle slap on the wrist. The prosecution gets slaps on the nape.

    Yesterday Enrile lost his cool. He said he hated to say it but the prosecution was committing a “fatal error” for its apparent failure to gather evidence against Chief Justice Renato Corona.

    What?! That is the most damaging statement yet to the prosecution side. More damaging than any ever uttered by the defense lawyers of Corona. The defense will pounce on this and use this statement to the hilt.

    Enrile as presiding officer-judge has done Corona a great favor.

    Brenda will sell everyone and take side to whom she wants so long she feels she belongs. She forgot during those days na inabandon sya and now she is back on her old self. We shouldn’t try to understand her anymore its a waste of time. She is suppose to represent us in this case but bias is so obvious its sickening. With all her knowledge about the law she forget one thing why we have the law in the first place! what a waste.
