There are also analysis of documents presented in court.

Below is the manifestation of Sen. Antonio Trillanes IV last Jan. 30:

First, as regard the nature of impeachment, with all due respect to all those who have stated their different opinions, I have also researched extensively on the subject and I am convinced that it is a political process with a judicial character. It is where the public participates through their representatives in the formulation of a public policy to resolve a policy issue of whether the conviction or acquittal of Chief Justice Renato Corona is in the best interest of the country.

I agree that it is a class of its own; but in my own personal experience, it is akin to one of the most sacred traditions in the Philippine Military Academy which is the Honor Committee Trial. It is where a cadet who is accused of violating the tenets of the Honor Code is tried by a jury of eight members of the Honor Committee, and only a unanimous vote of guilty can convict an accuse. The only difference I can see with this impeachment trial is we don’t have brilliant lawyers like the ones performing before us, and it is the reason why we don’t have technicalities in our attempt to ferret out the truth. Again, then again, that is in a laboratory setting.
Secondly, as to the standard of proof, as a former soldier, Navy officer, I will not even venture into defining and distinguishing between what is proof beyond reasonable doubt and substantial evidence because that is well within the expertise of my more seasoned colleagues. But what I do know and what I will apply in this impeachment trial is the basic sense of justice that God has given by every human being born in this planet.

Lastly, as regards the issue raised by Senator Chiz Escudero as to whether the acts committed by the Chief Justice prior to his appointment in the Supreme Court should be covered in this trial, my position is yes. We should cover them all because I believe part of what we’re trying to find out in this trial is the moral fitness of the Chief Justice to remain in office. Being a justice of the Supreme Court is different from being an elected public official in the sense that elected officials are subjected to periodic election to renew their mandate. So you can have the worst possible moral record but once you are elected into public office, it is presumed that the public already accepted your past and probably they voted for you for other qualities. But the justices of the Supreme Court, whose principal mandate is to administer justice to every citizen of this republic, should possess the highest possible moral standards for public officials.

All the “wordings and principles of our Dear Senator Sonny Trillanes”, are the Best, that I have read-seen among the leaders-politicians in the country, today. Self-serving and greedy ( there wordings always have “reservations”, e.g..) leaders, never talked this kind of thought and principle or messages. All his comments are coming from his Heart or inner core of his Life. God Blessed the Philippines, we have him ( alive and active, not disabled from his 7-years incarceration ) and few in fingers count, who brings Hope to the future generations. My highest Salute and respect, he is truly becoming a true, honorable !..

    Thank you.

I prefer reading transcripts than listening to long-winded speeches. At least, puwede kang mag-scan, at puwede ring bumalik.

  3. At last someone after my own heart, bottomline, bottomline, bottomline.
Its a lot better than listening to Bong Revilla air his concerns about time being wasted in the impeachment trial, I believe he thinks its better to spend time on the Hayden Kho video scandals.

  4. Trillanes is not the most popular among his peers (well, maybe his mistahs pwede), and you always have this reservation when speaking something good about him especially when among his former upperclassmen, but I like his guts.
Its a sorry state of affairs when most regard him as “nagmamalinis” as if getting dirty is the norm already.
    Good luck to him.

“…what I do know and what I will apply in this impeachment trial is the basic sense of justice that God has given by every human being born in this planet.”

That’s all I wanted to hear/read from Sen. Sonny. Thank you, naiiba ka talaga,

  6. parasabayan parasabayan

Tama ka Jug, galit nga talaga yung mga upperclaassmen ni Sonny sa kanya lalo na yung mga circle of friends ni Gen Reyes, Gen Garcia,General Ligot and the like.

Sa akin, ok na ok si Sonny! We need new blood in the senate,di tulad ni Enrile, Joker, Angara and the like. We need YOUNG ones as well. In due time he will be honed to be a good leader!

Power and knowledge-wise you can not fight city hall. In the same vein, fight the public with power and knowledge and the public will skin and bury you alive.

  10. chi chi

Haha! This scenario between the young Perez and senior Cuevas is very merry. 🙂

Young lawyer stands ground in Corona trial

Private prosecutor Joseph Joemer Perez stood his ground before defense counsel Serafin Cuevas and Senate President Juan Ponce Enrile for an hour or so at the impeachment trial of Chief Justice Renato Corona.

Observers noted it was the first time in the first eight days of the trial that a prosecutor was not “eaten alive” by the defense. www. newsinfo.inquirer.net/137059/young-lawyer-stands-ground-in-corona-trial

Precisely my take on the pure legalities/technicalities of this particular case. This impeachment trial is People of the Philippines vs. Corona. What good would it bring to the people if the case was won due to technicalities, e di balik din sa dating hopelessness si Mang Juan.

I agree fully that we should not set aside the evidences but let’s also not forget the practical appreciation of the merits of the case against Corona, and the “basic sense of justice..”

What is just is beyond brilliancy in defending a case using only legality/technicality, it is beyond quotation.

  15. humus humus

thanks Mam Ellen for the clarification; will comply.

  16. We can go back to the past topics, mababasa natin na marami po sa bloggers dito sa Ellenville ay nagco-comment din sa blog ni Raissa Robles.

  17. Korek si Sen. Trillanes sa kanyang pagsasabi na ang mga mahistrado sa Supreme Court “should possess the highest possible moral standards for public officials”. At dito, Corona failed by accepting his appointment as Chief Justice at the time na alam niyang it’s still covered by election ban.

  18. saxnviolins saxnviolins

Ngayon magagamit ang RA 1379 ukol sa unexplained wealth, and the presumption that if the SALN and ITR do not match, the property is forfeited to the State.

    Hataw. Get the money.

And if you win in the Philippine courts, pati ang naka-park sa labas ay kuha niyo.

    Gising.

  19. saxnviolins saxnviolins

If the Philippine courts declare the money as forfeited to the State, then even if the bank deposits abroad are in the name of Jose Pidal, the foreign banks hold it in trust for the real owner, the Republic of the Philippines.

Now then.

  21. chijap chijap

I like the approach. Strike where the money is. (mala TDK)

Pero, do you think Mike will deposit his “savings” to Iggy alone? Wouldn’t the amount be in his name instead?

  22. Rudolfo Rudolfo

Pidal’s Wealth, is the “real fishing expedition-adventure” that the government of the Philippine should have to focus further. The CJ-Corona is only worth ” small millions “, and a penny compared to Mike and the late Iggy’s billions of dollars. Though, the two houses said, they had been wasting time because of the Impeachment, at least, if they get the “laundered ” money ( just like the Marcoses ), more money will be send back to the country to be spent on multiple problems of the government, schools-health, employment, e.g…The main essence of either cases ( Pidal’s and CJ-Corona ), are “money” and Prestige or honor in their services to the nation, but, did not make good as public servants because of greed and corruptions…If the ill-gotten wealth of the brother-Arroyo be collected, it is plus to the Economy, while, the CJ-Corona, is a plus in the “Cleaning-Cleansing” the “worms” in the Supreme Court..

  23. They must neutralize Corona first as he can put a plug in any attempts to go after the Pidals if he’s still in power. Hmmmm, now we know why he won’t relinquish it, there’s so much at stake here. Maybe we’re just seeing the tip of the iceberg?
The government must be able to hit several targets at once, swiftly, and accurately. No need to sacrifice anything, there’s got to be other people to do the job, bakit lahat ba ng magagaling nasa impeachment na?
Hire sax here, if I were in their shoes hindi ako manghihinayang kahit 20-30million pa ang budget niya. Hehehe.

No matter how glaring the evidences are that Corona was not truthful in SALN etc…some of the senators: Arroyo and Angara think that these concealment can be remedied and that they are minor offences. The Villar block (Marcos and Cayetanos) seem to be doing the same-defending Corona’s actions. Medyo si Pimentel lang at Recto ang medyo hindi nababasa coz they are always just asking for facts and volunteering information as well.

Representing UP Diliman, he emerged as champion in 1998. Three years earlier, Joemer and classmate Paulo David Javier, representing San Jose Academy of Navotas won in the high school division.

Joemer was the Valedictorian of UP Law Class 2004. He placed 8th in the bar exams.”

Kayang-kaya ni Ping ang kaso ng billions of pesos bank accounts of Jose Pidal brothers. Mas mahirap kalaban itong Gloria-Corona dahil mismatch ang defense at prosecutors, hehehe!

I believe Lacson has all the evidences/paper trails, e itong prosecutors medyo nangangapa pa sa papeles.

If Lacson would like to resuscitate the Jose Pidal bank account case, he can do so… pick up from where he left and with his evidences he can request for a freeze of the account until the case is solved.

Puno-Dr. Jose P. Rizal”…my food for thought..

  33. Phil Cruz Phil Cruz

Prosecutor Barzaga should have replied to Enrile “Yes, it is a high crime.” and let Enrile and the senators wrestle with their conscience on that issue.

But really, the prosecutors have to do a better job of presenting the gravity, the seriousness, the magnitude of the crimes of Corona.

They must thread it well, wrap it together in a beautuful crystal clear package in order to counter these leading remarks of the senators that follow the line of the defense.

  34. Phil Cruz Phil Cruz

Joker will definitely not vote for ousting Corona. Same with Miriam. She was the one who broached the idea of censure only as a penalty. She suggested this on her first day of shrieking in court.

This could be the way out the Coronarroyo-enamored senators are looking for. Guilty but only of small crimes and therefore censure lang?

  35. Phil Cruz Phil Cruz

If that is their plan, the bottomline result is Corona stays put in the SC…. To protect his boss and the rest of their mob who are or may be brought before his court.

Happy plundering days again for these few… Forever and ever. While the rest of us will continue to get mired in poverty and deep sh_t… Forever and ever, amen.

  36. Rudolfo Rudolfo

Sana nga sinabi ni Prosecutor Barzaga, “There is a Crime”..

Some in the prosecution may seems to be holding back considering the influence of the olds. You are now taking the cudgels for the people, show what you have and present the case crystal clear. If you want to be a part of a reformed governance in our country now is the time to show that you are with the people!

  38. Phil Cruz Phil Cruz

What a sad day it is when an opinion maker like Mareng Winnie Monsod headlines her piece “Defense Wins Round 1.”

Any person of common sense would see that even though the prosecutors were fumbling all over, their presentation showed that Corona is dishonest and cannot be trusted.

Winnie is a very very technical person. Such persons cannot live in this world unless they are surrounded by street signs, traffic lights, painted road lanes, etc. In short, she is a technical mouse.. a city mouse. Which is in contrast to the non-technical country mouse who uses plain common sense to survive and overcome the natural obstacles in her path.

So, Winnie, a technical city mouse, says the defense wins Round 1 (Article 3). If I may rewrite her column title today.. your honors, please..

TECHNICALITIES WINS ROUND 1..(according to Winnie’s technical mind).

  39. Phil Cruz Phil Cruz

Sorry, the last line should read:

    “TECHNICALITIES WINS ROUND 1”

But I don’t agree the defense did win that round.

I am not a lawyer but it is plain and simple.
Corona is the mandated person to review the SALN in the judiciary being the Chief Justice so the PROSECUTORS shall emphasize the following facts.

1- His SALN is deemed correct and final as filed since it was his duty to review it annually and since he did not correct it so it assumed as correct ( For year 2010) and not entitled to the correction as CUEVAS is saying.

2- When he Start as Chief Justice He has all the reasons, time and opportunity to correct it
before the impeachment. being the person mandated to review the SALN for the Judiciary.

3- He cannot Claim that it is a lapse of memory or not being an accountant because he wrote Supreme court decisions regarding this matter especially the Marcos ill-gotten wealth.

4- His Professional exposure prior to the Supreme court is in TAXATION to he has ZERO tolerance in committing error in the preparation of his SALN.

HE INTENTIONALLY PREPARE HIS SALN WITH THE FOLLOWING PREMISE.
    – He thinks that his SALN will not be a subject of impeachment and will not be revealed.
    – He think that being with the Supreme Court he is above the Law worst HE IS THE LAW.
-by not including his wife in his SALN and or not prodding his wife to file her SALN speaks of the couples integrity and righteousness WHAT A SHAME. THEY SHAMED THE WHOLE JUDICIARY WITH ZERO DELIKADEZA
    – It is a family of Tax Evaders. imagine a whole family not filing correct income tax return thru out this years.
REALLY SHAMELESS , HIS WIFE’S UNCLE WAS REALLY SPEAKING OF THE TRUTH OF THE MAN HE ACCUSED CORRECTLY . AFTER MORE THAN A DECADE AND PASSED AWAY, HE WAS PROVEN RIGHT.
