The language of the Corona impeachment is, of necessity, legal. The senators who sit in judgment will do their best to couch their opinions in legalese. Media commentators will try to catch up. But everyone knows that, in the end, it’s all about power and politics.

Law and the judicial system just happen to be the battlefield in this instance. The Corona impeachment is the single most important exercise of presidential power by President Aquino in the year and a half he has spent in office thus far.

The Corona impeachment is about Gloria Macapagal-Arroyo (GMA). But only in that GMA has been the symbolic lynchpin of opposition to the reforms that the Aquino administration is currently undertaking. The trigger for impeachment was the Corona Supreme Court’s attempt to facilitate GMA’s escape from the clutches of the law. While there is still another case in the Supreme Court which could be used to spring GMA from prison, more likely she will remain there for some time. The battlefield has now shifted to Corona.

Corona’s designated role in GMA’s playbook was to use the Supreme Court to prevent her from going to prison. He has failed to do that. What’s at stake now is no longer whether GMA can be made accountable for her crimes. Corona is still being given a lot of importance by the Aquino administration because he, in turn, has become the lynchpin to reforming the Supreme Court. His well publicized clashes with PNoy, and the opportunity to shape the Court’s decisions as Chief Justice, have made Corona the de facto “last hope” of those who oppose administration reforms.

One of the more important lines of Corona’s defense is that the decisions for which he is being impeached are collegial, and that, therefore, what’s under threat is not just Corona but the Supreme Court itself. There are those who insist that Corona is not the whole Court. I don’t agree. What’s being challenged is not just Corona but the “Corona Court.”

Since, short of a coup, you can’t remove other problematic justices, you remove the head. It’s not a question of how many justices PNoy appoints; the more important step is to secure ourt leadership that does not behave as if it were part of the opposition.

Opponents of Corona’s impeachment say that PNoy is undermining the independence of the Court. In fact, the goal is to restore the independence of the Court. Because it does not have the resources to implement its decisions, the Supreme Court has to have the kind of authority that gets its decisions obeyed as a matter of course. This requires that it be above the partisan fray.

The Corona Court has behaved as though it is still being retained by GMA and the opposition. The Aquino administration does not require a subservient Supreme Court. All it needs is a Court that assures its independence by interpreting the law without partisan bias.

Was it inevitable that organized lawyers — most importantly, the Integrated Bar of the Philippines (IBP) — should take the side of the Corona Court? To be generous, because some of my friends agree with the IBP, one can assume that they really believe the Corona impeachment threatens the integrity of the Supreme Court. But that integrity is an assumed ideal.

The reality, which any lawyer who knows his “areglaw” should know, is that the current court is not exactly stocked with giants of integrity, or even simple competence. One doesn’t have to believe widespread rumors of bought decisions; one simply has to look at public decisions which violate the court’s own procedures.

I could be cynical and say that lawyers prefer the current court because it’s easiest to deal with the familiar, to practice law where decisions are the result of money or political pressure. But if I were a lawyer, God forbid, I might be interested in having some degree of regularity established through an arbiter a Supreme Court to interpret the law fairly and competently.

Corona defenders might then say this court is not significantly different from past courts, so why punish it? Because, one way or another, the Aquino administration will move on judicial reform. The Corona impeachment is a necessary first step.

Corona, like GMA, is a victim of circumstances. Any other president would have left well enough alone, relaxed behind ‘business as usual’ vis-à-vis a recalcitrant Supreme Court. But after giving the Corona Court a year, PNoy understands that, without removing Corona, the Court would remain a court of last resort for reactionaries. Any person or organization resisting reform but facing defeat in other arenas could always look forward to being defended by the Corona Court. Indeed, perhaps Roman Catholic defenders of Corona are loath to lose a final weapon against the Reproductive Health bill.

Is the Senate going to convict Corona? One should never predict a Senate with so many ‘characters’, even if one is thankfully leaving us soon for international pastures. But the Senate is also full of people with many economic interests and vulnerabilities. Neither would I place any bets on Corona riding out exposé of expensive Makati penthouses, corruption charges against his wife, even rumors of sexual harassment cases. Resignation or conviction, either way, Corona will go.

    Assuming the Not guilty wins, what options does Aquino have?

    I forward look for Corona to get booted out. Booting people out of public office especially those who deserve it, is a stern reminder to people who wanted to be in power that power comes with a reason: to serve the Filipino people, and not himself or his friends.

    Since matigas ang ulo, sige let’s get this show and i really really look forward Corona go down in shame. Pero what if mr. CJ wins? What then?

  2. Anyone else with a mordicum of decency will resign if placed in the same situation as corona, pinipilit pa rin niya sarili niya sa mga tao, ang kapal talaga.

    Kung manalo man si CJ-Corona, siguro di din sya magtatagal, dahil sa mga sumusunod:

    1.Magiging makapal ang mukha niya, bilang CJ, at may bahid na ng pagduda ang karamihan, sa bawat desisyon-partisipasyon na gagawin ng SC..
    2.Bawat pag-aari niya,kung anuman ?..laging may alin-langan ang buong madla..
    3.Sa pagbalik niya sa pwesto, may ” Bitak o lamat “na ang kanyang credibility, at bawas na bawas na ang respito sa kanya.
    4.Magiging hindi na effective ang kanyang katungkulan bilang isang CJ..dahil sa duda na “pinabalik siya ng kanyang mga kasangang Senadores “, na “same feather flocks together”, principle.,
    5. I believe because of reflections and self-analysis, and conscience, di na din sya tatagal..dahil, marami pang “demonstrations, ang mga susunod na kabanata, against him and the Senators who shielded him “, lalo lamang gugulo at mag-aalab ang galit ng mga taong, uhaw na sa PAGBABGO ng bansa, at marami pa ang magiging mga biktima sa mga karahasang darating, between the PNPs and the youth-student demonstration ( lagi ng ganito ang nangyayari, paulit-ulit na kaguluhan )..Dapat silipin ng mabuti ang angulong ito ng mga huradong Senador..2nd phase of chaos !..my analysis..

    jug, plis lang. huwag mong kalilimutang ang kulturang pamanang ‘yang ay pinalaganap ng PINAKAGARAPAL na pamilyang nang-agaw noon ng malakanyang at halos na ituring na mala-kanila ang sentro ng kapangyarihan. hindi lang parang naging virus ang iniwan ng mga magnanakaw na ‘yan kundi salot na naging peste sa bayan!

    MANILA, Philippines – While the members of the prosecution team for the impeachment trial of Chief Justice Renato Corona have been throwing around the sordid details of his alleged ill-gotten wealth, such evidence may end up not amounting to much, at least for one senator.

    Senator Antonio Trillanes IV said that the evidence presented during the trial of Corona would not be that much of a basis for his final decision but rather what an acquittal or conviction would mean for the country and what the people would think about it.

    “My verdict should not be based solely on evidence as it now becomes a matter of public policy, and the over-arching policy issue in this whole impeachment episode is whether the conviction or acquittal of Chief Justice Renato Corona would be good for our country,” he said.

    “To resolve this, I intend to use political acceptability as the sole criterion to evaluate the projected outcomes of either policy alternative of conviction or acquittal,” he added.

    That’s my senator! Way to go, Senator Sonny!

    The Senator from Bicol, Senator Sonny Trillanes 1V is one of the progressive leaders of the country, allied with Gen Danny Lim ( Magdalo group ).
    These two if given more chances to serve the nation will make a big difference from the “trapos ” who had been spoiling the Philippines for a very long time. We are happy, we can still see Hope for a change in the governance of the country. Many in the House of Senate are really ” Jokers “, mostly not serious in their services, except the “Pork Barrels ” and multiple extra privileges or immunity. We need Senators, who really are, public servants, not public grandstand !…

    Ang gusto ko kay Sen. Sonny, ang kanyang pribadong (personal) position ay yun din ang kanyang publikong position, walang kieme-kieme. Kung ano ang nasa isip, yun din sigurado ang nasa puso at syang sasabihin.

    With a -14 approval rating of Corona, anong ebidensya ang hahanapin pa? Talaga itong ating ibang senador, pa-cheesy epek pa!

    Trillanes is with the Magdalo group. Lim is not with Magdalo.

UNLIKE what you encounter in the Inquirer’ or PhilStar’s commentators Where once in many whiles you encounter the fragrance of Payatas and then

    Senator Trillanes had just put to public shame and made
    laughing stock of all vocal Trapos in the Senate. No
    amount of reasoning can put back their masks of clowns
    shouting for strong and sufficient evidence and posturings
    about the pseudo fairness of the Senate.

    a clean, with public confidence and trust, competent court to render justice NEED NO posturings and noises to make the
    public believe them. Shallow streams makes the strongest
    noise. Silent waters run deep. Trillanes speaks out to
    silence them.

The next election, their positions will be over, if they kept being self-serve and self-influence with a wrong side of ideology. Enough is Enough and the Senator ( roots from Albay-Libon-Polangue )is blowing like an eruption of a ” Mayon Volcano”..I think peoples from that place are more patriotic (to excuse some who really loves money-$$$PhpPhp). Who they are: A legal Staff of Pres. Pnoy; DOJ;DILG;DENR: ( the Mison Brothers ), Vinzons, 15-Martyrs in Naga City, and many more…Lagman’s root is from Pampanga, Arroyo is maybe from Ilo-Ilo-Negros…just an analysis for a greater HOPE of Change in the governance of the country…I mean, give a chance to a Bicolano, to lead the Nation. This is the Hope of Bicolanos, for a very long time, already !..( I apologize if I mean for “something” to some bloggers that can not get my food for thoughts. What matter is, what the Senator, Sony trillanes had just said, related to “Trust in his Office, for the people, and decency in the House of Senate “..GOD BLESS The Philippines and the People !..
