Update: DOJ bars Arroyo from travel
I remain firm in my stand that she should be made accountable for the crimes that she has done to the Filipino people, foremost of which is the stealing of the presidency in 2001 and in 2004.
Invoking the primacy of national interest over individual rights, Justice Secretary Leila de Lima Tuesday slammed the door on Arroyo’s plan to seek medical treatment abroad.
“My order is a denial of the request for an allow-departure order (ADO),” De Lima announced at a news briefing.

The damage caused by her destruction of democratic institutions just to keep her hold on power deeply affected the mindset of the public. It will take many years to rebuild those institutions which took several administrations to build.
But I’m for allowing her to travel abroad for medical treatment.
The Philippine Constitution guarantees the right of every Filipino citizen to travel. Sec. 6 of the Bill of Rights states: “The liberty of abode and of changing the same within the limits prescribed by law shall not be impaired except upon lawful order of the court. Neither shall the right to travel be impaired except in the interest of national security, public safety, or public health as may be provided by law.”
Lawyers of Arroyo is invoking that constitutional guarantee in their petition before the Supreme Court to junk the Arroyo couple’s inclusion in a watch list order by the Department of Justice (DOJ) in connection with electoral case filed them for their alleged role in the 2007 poll fraud.
It doesn’t matter that the Department of Health and an official of the Philippine Medical Association said that Gloria Arroyo’s problem with her spine can be treated her. The choice of doctor is personal to a patient. It’s not for the government to impose on the Arroyos the doctor who would treat them.
Of course, the issue of Arroyo’s travel abroad is not just a medical issue. It’s political. That’s why Justice Secretary Leila de Lima is taking time to decide. She must still be seeking instructions from Malacañang because ultimately, it would be the call of President Aquino.
Allowing a former president or spouse of a former president to travel abroad for medical treatment has its precedence. President Aquino’s father, the late Sen. Benigno Aquino, Jr. was allowed by his arch enemy, Ferdinand Marcos, to seek treatment for his heart ailment in the United States. Imelda Marcos, after her return to the Philippines in 1991, has been going in and out of the country despite her many cases (total of 901 in the beginning, now down to less than 10). Arroyo allowed former President Estrada to have his knee operation in Hongkong.
One of the concerns raised in Gloria Arroyo’s travel request is, she might not return and therefore, she could not be made accountable for the crimes that she is accused of.
It’s understandable that many do not put any value to Arroyo’s promise that she will return to face the charges. She promised not to run for the presidency in December 2002, in front of Jose Rizal’s monument, only to turn around after a few months.
But Arroyo’s lies should not harden us and do what she did to her opponents when she was in power.
She deprived many people of their liberties even to the extent of twisting the law just to keep them incarcerated. The case of Sen. Antonio Trillanes IV and the Magdalo officers is one example. Arroyo reneged on the agreement she had approved in Oakwood that only the core officers would charged in the military court, and ordered the filing of the unbailable charge of coup d’etat in a civilian court despite the fact that the Oakwood mutiny did not bear the elements of a coup.
The malicious intent was clear: to keep Trillanes and company in prison for life.
Arroyo tried to do the same thing to Sen. Panfilo Lacson- perverting justice to put him behind bars.
But alas, things have a way of correcting themselves. The situation has been reversed and she is in danger of becoming in the receiving end of injustice that she inflicted on her political enemies.
If allowed to travel, it’s possible Gloria Arroyo for once will be true to her promise and come back. Or maybe she won’t come back.
The burden is on her.
We should not allow Arroyo to rob us of our humanity.Let us not do unto Gloria what Gloria did unto us.

during her term, were there any medical bulletin issued regarding her state of health? weren’t her hospitalizations discreetly hidden from public attention and only her travels abroad they said yielded much investment the only much publicized and trumpeted news fed to the people? but were there really investments or the country was secretly sold piece by piece in the guise of loans most of which were done without proper bidding where they amassed unexplainable wealth?
please, stop fooling us this time!

Let the wheel of justice roll….
To allow or not to allow gloria to travel is really up to the authorities to decide.
They say (pro-gloria) it is inhumane not to allow gloria to seek medical treatment abroad. But there are question that needs to be answered. it’s like a Damocles sword on top of your head or damn if you do and damn if you don’t.
De Lima already made known of her intent not to allow gloria to leave because according to her “there were some “discrepancies” between the medical abstract the Arroyo camp sent to justify her ADO request and the letter-affidavit they earlier submitted.’ De Lima even added “I cannot avoid being concerned that these countries have no existing extradition treaties with us,” she expressed concern over the Arroyo camp statement that she will have to seek treatment abroad “indefinitely.”
“This is something we cannot afford to take… that they will dictate the duration of her absence,” De Lima said.
“Indefinitely”, hmm… let me see, how can you seek medical treatment indefinitely? unless he or she is hiding under the cloak of “medical needs”. That is really fishy.
It also mentioned that gloria’s request for ADO includes a number of entourage. My question is why a number of entourage?is she sending them to different countries to take care of their finances. In the case of lagay-man, este lagman, if he is willing to file an affidavit that he will go to jail if gloria does not return, that’s fine with me. bautista-horn, just take the name and she will hit you with the horn, is she a doctor?it seems that she is more knowledgeable than the doctors who knows best how to treat the sickness. the PMA already said that there are medical practitioner in the country for the kind of gloria’s sickness, yet “nagpapacute sya”. and of course, the NPC, i don’t know with this group, these NPC’s are idiot’s they are a very classic sample of balimbing or chameleon, whoever is in power they will shed skin to a new color just to adopt.
And with Noy-Ab’s administration, if something happens to gloria’s health, baka mamaya magtututro na kasi kasalanan ni ganito at kasalanan ni ganyan. gobyerno turo-ng-turo

In her 41-page suit, the former chief executive asked the high tribunal, to declare as unconstitutional Department Circular No. 41 which gives the DoJ the power to issue watchlist orders (WLOs) and hold departure order (HDOs).

I propose Congress enacts a law that imposes the same penalty on a local doctor in cahoots with criminals that provides a suspect an invulnerable shield against the search for justice.
For multiple offenses, the cumulative minimum punishment of the cases filed or about to be filed for a suspect proven to be feigning illness shall be equivalent and the same as that applied to the doctor/s and the hospital that maliciously confirms the false medical status as true.
We cannot allow unverified claims of illness to shortcut our dispensation of justice, more so accept false or aggravated and exaggerated declarations of co-conspirators from the medical profession to stand in the way of our legal processes.
Compassion can only work on a case-to-case basis.
Humanitarianism is only for humans.
The reason that “The Golden Rule” is applicable to man is to forewarn anybody of the consequences of his/her actions. Supposedly, there should be no argument or defense for it.
It is the same as the law of physics: Every action is accompanied by a reaction of equal magnitude but opposite direction.
Allowing a person to travel abroad for medical treatment is definitely correct, if that is the real and ultimate reason for travel. There are, however, so many “unknowns” in the equation. In management, you have to eliminate the “risks” or contain them if they cannot be entirely eliminated.

That’s very humane and Christian like.
Right to travel is guaranteed in the constitution, and to follow that provision, the evil couple should be allowed to go. But still Noynoy has the last words in this case. In the meantime however, as always the case, keep his nose clean by letting Delima do the dirty job of deciding the fate of Gloria. He has a very bad habit of evading a decision-making as long and as much as possible just as what he did to the Luneta massacre investigation and the Marcos case by appointing Binay. Ultimately the final decision will come from him if Delima’s decision is not in line with what he has in mind. If Delima is smart and learned her lessons enough she should do a-Binay, throw back the case to the lap of Noynoy and for him to decide.
November was the month highlighted by Noynoy to file cases against the Arroyos, but it looks like it will not happen. They even said that they will spend Christmas in jail, but it appears now that it’s just a pipe dream, that there are still no cases filed against them. It’s becoming clear by the day that the Arroyos will not go to jail as scheduled and may not even go to jail for the rest of their lives. How can you send them to jail if there are no cases filed against them? Thanks to the “generosity” of Noynoy and his government. There actions speak for themselves and are obviously pro-Gloria, na parang mas gusto na nilang lumayas dahil wala silang kaso at hindi nila kayang ipakulong ito. Kundi ba naman parang hindi nila alam ang kanilang ginagawa, parang mga pagong kung kumilos, puro daldal, puro slogans and no actions, and if ever they act or do something, mas madalas palpak pa.

This forgiving attitude is one of the weaknesses of our culture that is why foreigners and countrymen step down on our faces thinking they were higher than the nation’s body of law. The law exists but we cannot implement them. This is why other countries call our country lawless.
May the Arroyo’s go to jail. May all his cronies from top to bottom be incarcerated. Let our nation show the world there is justice in our system. Hopefully the rest of the country will follow.

While it’s true that they banned her from travel abroad, they were just too naïve as stupids are not to consider that they will be challenged in court and without any basis for the ban their case is as good as dead. Now if they really are serious in preventing her, they have to act fast and quick, provide a basis for the ban, otherwise it would seemed that since the beginning, their inaction is deliberate to set Gloria free from all accountabilities, and all the dramas going on are just a show to entertain the people.
The way I see it, if Noynoy and company remain idle, do nothing but all talk and talk, the SC will uphold the constitution and let Gloria go. If Noynoy and his government are really serious in not allowing Gloria, but let go by the court, what will they do about it?

let the former Pangulong Gloria Macapagal Arroyo rot in jail if found guilty of her alleged crimes. but to deny her of travel abroad to seek for what she may think as a credible treatment for her illness is just being unchristian. the fear she will not come back anymore to face her cases and accussers as the reason for denying her the freedom to go is to me a little bit shallow. gloria arroyo though se maybe perceived as a liar is not the type to abandon her homeland and hide somewhere slse to save her skin. Let her go and once she is well and fit to go to the court then prosecute her till found guilty if really the evidences are strong enough to convict her.

We are not doing “an eye for an eye” here. We simply gave GMA a dose of her own medicine.
Keep in mind we are not killing her. Nor are we putting her in jail. In fact the current government offered a win-win situation, we bring the doctors in. Her camp obviously want one thing: to leave the country.
(Side comment: buti pa si Erap, he was offered to leave, he said he will stay to face his charges, maski may karamdaman din sya)
We are not treating GMA the same she treated the nation, we did not cheat her of any of her rights. And that includes her right to leave. And since it was her government that said the DOJ has that right, then its well within the constitution to use it against her, again until the Supreme Court says otherwise.
Ang ironic lang, it was her government who made it legal, and now she’s complaining its illegal? Think about it. Why should we fall for her definitions?

I’m not sure if it was intentional or not, maybe we don’t take much time to seriously analyze Noynoy’s moves, but I have to give credit to the guy who thought out the plan to offer to bring in the doctors from five countries who will do the check up. Surely Gloria would reject it, they can’t name any names just yet. BECAUSE THERE IS NONE.
Contrary to most reactions, I find it clever: Gloria has no doctors as of yet, let alone be able to convince some famous doctor abroad who would abide by the GMA playbook and not look stupid being made top VIP due to a national issue and for a non life-threatening illness.

My point is about the rule of law, and not about Gloria. And to be frank, I don’t really give a damn about what will happen to Gloria whether she becomes paralyzed or dies. She deserves it anyway.
If we allow the present administration to use the circular 41 as basis to stop Gloria et. al. to leave the country, it would become a bad precedent. It would become the basis not only for PNoy but for future presidents to use this to suppress the freedom to travel of whoever they perceived as their political enemies.
There are other ways to stop them from leaving the country legally, and one of them is to immediately file a criminal case against the Pidal couple. The problem with the DOJ is that she seemed to be dilly dallying with the cases and talks too much without really exerting enough effort to file the cases.
What I’m afraid of is that the petition of the Pidals will be ruled favorably by the SC since the DOJ order is illegal.

This is a weekend and any business, including mobilizing immigration agents to prevent the family’s departure will only be possible on Monday.
