Rewarding Diokno

Freed of accountability
Is President Aquino serious about giving his good friend, just-resigned head of the Bureau of Corrections Ernesto Diokno, another position in government?

What’s the basis for such an appointment? It could not be competence because he has proven as BuCor chief to be clueless about his job.

He said his understanding of his job was just policy-making and he refused to take command responsibility for the violation of his subordinate for allowing former Batangas Governor Antonio Leviste, in prison for the 2007 killing of his business associate Rafael de las Alas, to go out of the jail accompanied by fellow inmates.

Diokno also considered the practice of prisoners living out a “small matter.”

Aquino praised Diokno for his ‘delicadeza’. But Diokno resigned, almost two weeks after the Leviste caper was exposed, because despite the fact that the Department of Justice, in deference to his friendship with the President, treaded gingerly in the investigation of his role in prison scandal, it still recommended administrative charges against him. He was cleared of any criminal lapses.

Is that ‘delicadeza’?

I need to review my understanding of ‘delicadeza.’

    It’s unbelievable to be a director of government agency NOT to know that a Director is the equivalent of chief executive officer (CEO) in the private sector. As director of private or government agency you direct, you don’t make policies. To direct is a command function, making policies is a staff function like those working in policy and planning offices. Policies had already been made for directors. Anybody can get from Civil Service Commission a statement of functions, duties and responsibilities of a bureau director. NO policy making there. Only policy interpretation and execution. Office policies are really nothing but office rules and regulations. You can call white color black, it will still be white. Directors can not by any means exculpate themselves from command responsibility. What is funny and really laughable is that the Department of Justice and Congress (and some in the critical media) have no clues at all.

    It is downright impossible to have become a police general or military general NOT to know the sequential concepts of law, policy, programs, projects, activities, tasks, motion, rules and regulations. Directors do not, repeat do not make policies, they interpret policies into rules and regulations and execute them. Higher offices formulates policies for them. Who makes policies of eating out or living out for prisoners. Policies should have been made at higher than the director’s level. Directors translate policies established from above into action. I am repetitive to be understood.

P Noy knows but he needs a little insensitivity to bungling friends; the people know P Noy knows that their ignorance is nothing but dishonest pretense. So P Noy gets whacks in the surveys because of his inappropriate response.

    MMDA people should know that unlike regulations, rules allow no exception or exemptions. Examples of rules: NO SMOKING. NO LEFT TURN. Sabi ng Lola ko dahil lang sa kunting halaga kailan pa tayo magiging tapat sa ating tungkulin.

Dahil sa namatay lang ang nanay niyang si Cory, ano’t inihalal kaagad ang kanyang anak na noong una pa man ay walang kakuwenta kuwenta. Ano ba an naging kontribusyon ni Cory sa Pilipinas? Di na ba natanto ng mga botanteng Pilipino ang mga kalaswaan ni Kris Aquino.

    This Mitos Villareal is a hypocrite(her name rings a bell). Though she tried very hard to conceal the venom in her diatribes, the ‘abnoy’ tag gave her away. In the process, she unmasked her utter disdain for people with disabilities, not necessarily Aquino. She can always criticize but to call Aquino a ‘retard’ is a low blow. I wonder if she is also in possession of a ‘verified’ psychiatric report.

    “Correcting the Bureau of Corrections”

    The President has authorized the Department of Justice to release to the public, the fact-finding panel’s report on the Bureau of Corrections.

    The tasks before the Department of Justice and other concerned agencies are clear. The President himself has expressed concern about congestion in our prisons and drugs being introduced into the lives of inmates. These factors combine to promote corruption and disorder and saps, in turn, discipline and justice as rules may be unclear or arbitrarily applied to inmates.

    Our correctional system cannot function if it is inhumane, if it is underfunded, and if its rules aren’t further codified and applied in a fair and strict manner. We would like to see more of a focus on education and rehabilitation, in partnership with individual citizens and organizations who have quietly, and without fanfare, engaged in education and training efforts for inmates, rather than the spectacular cases of favoritism and exemptions from the rules that have shocked the public.

    Does that mean, the President didn’t find this shocking and alarming and begrudges the press for reporting it?

    On the lighter side minsan kahit kunti tila kulang ang mga salita sa ating wikang pambansa. Salitang napakalapit sa katotohanan. Sa ibang bansa, pag nagkamali ang isang tao: to acknowledge the truth, the less educated will say I am sorry I blew it. The miseducated who can accept the truth with remorse will say: I fucked up, man! I am fucked.

    This gutter language of a culture reminds the high and mighty in the society to be careful because a few of them are no better than the low life they care for. As long as our language prefers the plastic and hypocrisy and respect and shuns the stinking language of truth, we will always be like sheeps with bowed heads meek to our shepherds who yells: you f..k.ng sinners go forth and sin some more.

    On a more serious side of the highly educated, these probably innocent attempts at contortion, distortion and discombobulation of the word policy can be made clearer than mud if we use a country’s democratic governance as paradigm.

    The balance of power paradigm manifested in three equal branches of the government are the Legislative, the Executive, and the Judiciary. They, analytically can come in that order because the paradigm calls for laws/policies to be enacted (by the legislature) so the Executive can have something to execute, and (only?) if there are questions and need for clarification and resolution, the judiciary can come in to interpret and resolve the law/policies imbroglio. That could be the governance paradigm.

    There is paradigm shift in the parliamentary form when law and policy making is sort of combined with law execution and policy implementation in the executive office of the Prime Minister. There is governance paradigm fucked up if because of greed or corruption, the three branches can happily intrude and make hay into each other’s jurisdiction. Papano kaya sasabihin sa Tagalog yan? But did anybody saw it, the big picture? That the legislative, and the judiciary are not supposed to execute policies, in their own turf they can make a living; in the middle the executive branch may come out the most powerful. But if it is all confused and anything goes, the governance paradigm is fucked.

    Sori Ellen, gusto ko ipakita lang na meron mas mataas na baitang sa katwirang hindi puedeng baluktutin tungkol sa kalakaran (policy, written or unwritten) sa mga oficina ng gobierno.

    Let’s Move On with a clear conscience.

    In the ultimate and final analysis I commiserate with the resigned director who very likely in all his life had strive for a life that’s balanced as a good Christian. Had he failed in such morally hostile environment he would not have climbed the clouds where it is cold and the oxygen thinner. When our time comes, Before St. Peter’s sala, there’s hell (down there) to pay, only if there’s a hell of mistake done to others. And that makes P Noy a scared pit bull, he (perhaps like his Mom) doesn’t want to injudiciously or indiscriminately bite trespassers, because innocent others might hemorrhage. Whether it’s good or bad for the country, only time probably can tell.

    However, We can not and won’t be moving on UNLESS, we make the culprits in the penitentiary join their wards behind bars.

    Agree with you, Chi. Ano ba ito, revolving-door policy na naman ? This is reminiscent of that diminutive fart, Gloria. Really, wala na ba tayong mga MAS magagaling na pagpipilian ? I hope Noy would not make this mistake (among the countless mistakes he has done so far). Oo nga’t lahat tayo nagkakamali. But please, PNoy, do not abuse this “provelege” (of commiting one mistake after another).

    Ang kanyan ama na si Ninoy kahit na binigyan ng pagkakataon ng self exile kapalit ng kalayaan sa kulungan, dahilan sa Delikadesa ay naninindigan siya taliwas sa pananaw ng nasa kapangyarihan noon, ay pinili pa ang mabilanggo at mahatulan ng firing squad.

    Sana magkaroon ng discernment si Pnoy na dahilan sa mga taong naniwala sa prinsipyo at paninindigan ng kanyang mga magulang kung kaya siya naluklok bilang Pangulo ng bansa.

    Sana makita niya ang tunay na kahulugan ng tuwid na landas na ating tatahakin sa panahon ng kanyang panunungkulan.
