ABS-CBN online reported Thursday that Gloria Arroyo’s son, Mikey, who shocked the Filipino people with his claim that he represents the tricycle drivers and the security guards in the House of Representatives, was “shocked” upon hearing of the P73.85 million suit filed by the Bureau of Internal Revenue against him and his wife, Angela.
The news report, quoting BIR Commissioner Kim Henares, said the Arroyos were charged with attempting to evade taxes and failing to file income tax returns.

Mikey Arroyo’s statement
Henares said Arroyo did not file ITRs for the years 2005, 2008 and 2009, while his wife had no tax returns from 2003 to 2009.
She also said the spouses failed to pay taxes even as the lawmaker declared in his Statement of Assets, Liabilities and Net Worth (SALN) millions of pesos worth of real and other properties acquired from 2004 to 2009. One of those properties was his $1.32 million beachfront house on Park Boulevard, Foster City in the San Francisco Bay Area in California which was exposed by VERA Files in 2009.
Mikey’s lawyer, Ruy Rondain, said the BIR move violated his client’s right to due process because he had until April 15 to respond to the BIR’s notice.
I could not imagine reporting a government action like this one year ago. Times have really changed.

Several counts of tax evasion charges were filed by the Bureau of Internal Revenue on Thursday against former President Arroyo’s son and Ang Galing Pinoy party list Rep. Juan Miguel “Mikey” Arroyo and his wife Maria Angela Montenegro.
The BIR said the Arroyos did not declare their true incomes for the years 2003 to 2009, totaling P73.85-million, despite their acquisition of numerous properties here and abroad.
BIR commissioner Kim Henares said the Arroyos attempted to evade the payment of their tax liabilities in violation of the National Internal Revenue Code.
The BIR said that being a government official, Mikey’s only source of income is his salary.
For taxable year 2004, the couple reported a net income of P2.4 million; P1.7 million in 2006; P376,000 in 2007; and no income and no ITR filed for the years, 2005, 2008 and 2009.
Angela, although she registered as a taxpayer only in 2004 and obtained a taxpayer’s identification number (TIN) for a one-time transaction, has not filed an ITR.
“Remember, if you report that you have an asset, you have a net worth, you should be able to say where it comes from. Where it comes from, normally, there is a tax consequence. If somebody donated it to you, there should be a donor’s tax. If you inherited it, you should have an estate tax. If you bought it, you should have income from which to buy this property. They claimed they have all these assets but no income tax return has ever been reported by Angela, so that is the basis for the tax evasion case against her. The important thing to look at is, when government officials do their SALN, they have to state where it came from and all of these should be stated as acquisitions,” Henares said.
“This is based on the SALN they submitted, as we go along this can still grow because there is an allegation that there are assets that were not included. The BIR works based on evidence and documents, and this is what we found out. Even with those documents (showing) that there is already evasion, if more assets will be recovered, then this assessment will keep on growing,” she added.
Henares said the Arroyos’ act of non-filing shows their intention not to pay taxes. Their substantial underdeclaration of income (more than 30 percent) in the years 2004, 2006 and 2007 is considered prima facie evidence of fraudulent return.
Presidential spokesman Edwin Lacierda and Presidential Communications Development and Strategic Planning Office Secretary Ramon Carandang were quick to deny that politics was involved in the filing of charges against Arroyo, as well as against Local Water Utilities Administration chairman Prospero Pichay, an Arroyo ally who was charged the other day with malversation and graft for allegedly misusing government funds to buy an ailing thrift bank.
Lacierda and Carandang said the charges were based on evidence and the case build up took time which is why the cases were only filed only recently.
“Nagkataon lang siguro na nai-file kahapon (Wednesday) iyong kay former Congressman Pichay – base po ito sa mga ebidensyang nakalap ng Department of Finance – pinag-aralan po ito nang masusi at saka na lang ipi-nile iyung kaso. Ito rin po ang nangyari kay Congressman Arroyo. Nag-usap po kami kanina ni Kim Henares at iyon po ang sinabi niya sa akin na knowing and gathering are two different things. So they really had to gather the evidences first,” Lacierda said.
He said Malacañang had nothing to do with the filing of the cases since the filing agencies – the DOF and the BIR – were only doing their mandate in “clearing landmines” and going after tax evaders.
Henares herself stressed that Arroyo is not being singled out for being a critic of the present administration. “If the argument is we are singling out anyone and not based on evidence, shouldn’t we have filed the case long ago? But the fact is, we don’t do that. We file cases because of evidence. It’s not because of any personality,” she said.
Lacierda said the different department secretaries had been reviewing the transactions, deals and contracts that had been entered into by their predecessors and it just so happened that some of the cases are just being filed now.
He said the Department of Public Works and Highways and the Bureau of Customs, for instance, had unraveled “landmines” and irregularities in their agencies and filed appropriate charges. He added that the investigations of the different departments proceeded after the Supreme Court declared the Truth Commission as unconstitutional.
“We’re still waiting for the final decision on the Truth Commission, but in the meantime, we are not abandoning our quest for good governance. We continue to investigate the landmines,” Lacierda said.
If found guilty of violating Section 254 of the Internal Revenue Code, Henares said the Arroyos may be penalized for each count with P30,000 to P100,000 and a jail term of two to four years; for violation of Section of 255, a fine of not less than P10,000 and imprisonment of one to 10 years. – With Jocelyn Montemayor

Hindi payat. Napatungan na yan ng 50% surcharge, 20% interest per annum at siyempre, yung basic unpaid tax.
For example, yung pinakamalaking item sa BIR computation, yung 2004, P21.7M ang dapat binayaran, P10.85M yung 50% surcharge at P26.1M yung interest for 6 years. Ang total na sinisingil ng BIR for 2004 alone is P58.6M

The Statements that Put Mikey in Trouble
Come on, Mikey. Less than two years after failing to explain his SALN (Statement of Assets and Liabilities) on national television, Ang Galing Party-list representative Mikey Arroyo is in trouble with the law again, this time with his wife Angela.
Mikey allegedly failed to file his Internal Tax Revenue for the year 2005, 2008, and 2009, while Angela has failed to do hers from 2003 to 2009. Dude of course denies the allegations pitting him and his wife. “Our lawyer will just answer this,” he mentioned during an interview on dzBB yesterday, 7 April 2011.
See, a statement such as this is the quintessential code for guilty. At least the voting public thinks so. Not to say that Mikey Arroyo is guilty this time around – the man’s got enough balls to sue BIR back – but when you settle for that kind of explanation, chances are you’re in the wrong.

In September 2009, I filed an anonymous tip with the FBI regarding Mikey Arroyo. This morning, I underwent a background chedk and met in person with an FBI agent and handed over 20 pages of documentary evidence, much of it from Ellen and Vera files about Mikey’s crimes in the US which include: money laundering, mortgage fraud, mail and wire fraud, violations of Sec. 312 of the USA Patriot Act and Bank Secrecy Act, as well as the DOJ’s Anti-kleptocracy initiative. Mikey used a fraudulent mortgage to launder over $1 million dollars, exploiting a loophole that the Financial Crimes Enforcement Network has since closed. I also identified the CPA I believe helped him with this, based on his prior work in the US for “Big Mike”. The agent was forwarding it to the White Collar Crimes Division to look at. Hopefully they will look for other properties that corrupt officials have acquired in the US with proceeds from corrupt activities.

They can best work on Mikey’s case together.
