Arroyo should be nervous as search for truth continues

There’s a saying in Tagalog “umiikot ang puwit” which means jittery; feeling uneasy and nervous.

The decision of the Supreme Court allowing the House of Representatives to proceed with the impeachment proceeding against Ombudsman Merceditas Gutierrez should make not only Gutierrez nervous but her patrons, the former occupants of Malacañang.

The Supreme Court justices are supposed not to be influenced by public opinion but they would not be human not to be affected by the public outrage over the plea bargain agreement entered into by the Ombudsman with former military comptroller Maj. Gen. Carlos Garcia.

The congressional investigations on the Garcia plea bargain have opened a Pandora box of shocking anomalies in the military and have already claimed one life: former AFP chief Angelo Reyes.

Gloria Arroyo and her ilk must realize by now that, despite their efforts to put everything in place before she left Malacañang, everything is not going the way they have planned it. Who would ever imagine that former military budget officer George Rabusa would have a change of heart and spill the beans? They also did not imagine former state auditor Heidi Mendoza coming out relating her own horror story about the P200 million check intended for the Filipino peacekeepers.

CCM, a staunch opponent of the past administration of GMA and a civil society group espousing good governance, believes that with the burial of formal Chief Of Staff Angelo Reyes, the search for truth and the punishment for those who stole from the public coffers must now continue.

“While Philippine culture required us to respect the dead, which is the only explanation why CCM has not publicly issued a statement on the suicide of Gen Reyes, we believe that it is now high time for the Senate and the House to conclude its investigations with the end view of punishing and imprisoning those who may be proven to have stolen public funds”, said Betina Legarda, a CCM co—convenor during a mass to mark the death anniversary of CCM co-convenor Josefina Lichauco in Makati Monday.

“CCM has always espoused that there should be zero tolerance for corruption. We should now finally let the wheels of justice turn and punish those who stole. We should not let emotions come into the way since lest we forget, Gen Reyes himself was the one who decided to end his life”, said Marily Oroso, another co-convenor of CCM.

For his part, Prof. Harry Roque, another CCM co-convenor, defended Senator Sonny Trillanes: “Why should they single out Senator Trillanes’ line of questioning towards Gen. Reyes? This country has systemic corruption precisely because we choose to be meek and mild to those who should be thrown behind bars for stealing from the public coffers. Instead, we should commend Trillanes because he sent the message that we have long been wanting to say: No to corruption- whoever and no matter how powerful you are”.

CCM was the civil society group that spearheaded mass actions in Makati during the past dispensation, It was also the first group to march along Ayala to the office of the European Union in Ayala to demand the prosecution of GMA for widespread and systematic killings of activists and journalists in the country.

    How did the SC voted?

    The seven justices who voted to dismiss the Ombudsman’s petition were: Associate Justices Antonio Carpio, Conchita Carpio-Morales, Ma. Lourdes Sereno, Roberto Abad, Jose Catral Mendoza, Eduardo Nachura, and Martin Villarama Jr.

    The five justices who voted in favor of Gutierrez’s petition were: Chief Justice Renato Corona, Arturo Brion, Lucas Bersamin, Teresita Leonardo-De Castro, and Diosdado Peralta

    Associate Justices Mariano del Castillo and Jose Perez partially concurred with the majority and said the House panel could admit the complaint filed by Hontiveros and ban the second complaint filed by BAYAN.

    Associate Justice Presbitero Velasco inhibited himself from the proceedings because his son, Marinduque Rep. Lord Allan Velasco, belongs to the House justice committee.

With the AFP expose, the death of Angie, now the affidavit of Col Querubin linking her to Ampatuans and the 2004 election cheating operations, then this BIG SC decision on impeaching Maldita, dapat lang na nerbiyosin and reyna ng mga hoodlums. Meron pa dyan yung NBN-ZTE, yung fertilizer scam (nothing came out of this before but maybe now we can re-visit), swine scam, the supposed link of the fatso to the contractors. Gee, super dami ang kasalanan ng bansot!

    Sige na bilisan na natin na ibitay itong bansot na ito at ng kanyang asawang baboy at mga horsies. I can not wait!

    I was shocked and in disbelief to hear some people say that what General Reyes did was honorable. I do not know the meaning of honorable anymore.

    Yes it is sad that he passed away no question about it,but it was his choice to end his own life. Is this honorable?Especially he is facing a corruption investigation?

    To me this is disgrace and cowardness,It is better for him to face his problem and try to clean his reputation,even catholic church should not given him a blessings, He did commit a mortal sin.

    For me honorable are Sen. Trillanes and Sen. Estrada. They both have the same experience, went to jail and the powers that be tried to destroy their reputation but they did not commit suicide. They dealt what they have to deal with.

    This is what we call honorable.May Gen. Reyes rest in peace and God forgive him.

    In the headline of Philippine Daily Inquirer last February 10, retired Philippine Navy chief Mateo Mayuga was quoted as saying that Angelo Reyes’ act of taking his life by shooting himself in the chest showed “extreme courage” and that it was an honorable thing to do.

    I am not a military man so most probably I do not understand what exactly are the ‘extreme act of courage’ and the ‘honorable thing’ in taking one’s life. In plain language that is suicide, and every act of suicide is wrong. I do not and cannot judge the state of mind of General Angelo Reyes when he committed suicide.

    In this, he renders personal account with his Creator. What I am referring to is the act itself of taking one’s life. Yes, we condole with the family, the loved ones and friends of General Reyes. I personally felt extreme sadness at his action and prayed for his soul. But sympathizing with him should not induce us to saying what he did was right. Let us not send a wrong message to the people, especially the young, that suicide is alright.

    No, it is all wrong! Whatever troubles we find in life, we should be brave enough to face them. We are not owners even of our lives. We are but stewards. Taking one’s life is an act of escapism. It does not even serve the country in this case. The country, especially the foot soldiers who are struggling it out on the ground, need to know how the military spends its moneys.

    I hope that this very unfortunate and sad end of General Angelo Reyes will not make the Senate, the House of Representatives, the Ombudsman and the Aquino Administration soften its commitment to root out corruption in our country.

    The corrupt people in government do not care at all at the grave sufferings they inflict on the nation and on the nameless people who are deprived of what is rightfully theirs. Let us not also be soft in the quest to right this wrong!

    Certain disturbing aspects of the military honors given to the late Sec. Reyes:

    1. A soldier who committed suicide is not given military honors. AFP spokesman said “he was no longer in active service..” Who made the decision to waive this gray area?

    2. A soldier’s widow gets 1/2 of the her late husband’s monthly pension; widow of a pensioner who killed self is not entitled to it. That means she gets nothing. If a pension can be denied under the circumtance, why not the military honors?

    3.As per our experience when our mistah John Francis Velasco died, G1, PA said that the deceased being a retiree, HPA would only provide a
    2-man detail for the vigil and the usual honors during burial. All others, expenses whatever, have to be shouldered by the family.

    4. According to newsreports, Reyes was buried in the dignitary section of LNMB and given 21-gun salute. If this was the case, the department (DOE) he last served should have handled all activities- not the AFP. And, the 21-gun salute? Was he the real head of state in the last decade?

    5. And so, the questions:
    -where did the AFP charge the expenses- which judging from the TV coverage would have easily cost millions of pesos, from vigil to interment? From PCDA (Provision for Command-Directed Activities) again?
    (Just thinking, could this “easy” access to funds have inspired the funds managers to develop a mindset that would led to the creation of so-called “culture of corruption”?)
    -If the decision for the spectacle was not covered by regulations, or worse, a violation, shouldn’t somebody reimburse the AFP?
    -or, another hearing-in-aid-of-legislation should be called to probe this unusual case of “pabaon”?

    In the UK, when soldier dies in service, his full pension goes to his widow. Same as when he retires and dies, full pension goes to widow. Have to come across yet of a case of a married soldier who committed suicide. Only one I’m aware of was an unmarried officer in the UK who committed suicide (after he was found out to be gay), pension died with him.

  27. One thing that’s really worrisome and that bothers me is all the talk that an 4-star officer committing suicide (just because he got verbally straightened by a junior officer) becomes a hero and that his act was noble.

    Is this the kind of moral values that these idiots trying to set?

    What kind of values are we trying to impart to the young, military cadets and non-cadets? That when you cannot face humiliation, you may turn around, shoot yourself and that act is noble?

    These officers, particularly the senior ones, have brains the size of a pea. They are not only morally corrupt, they are also screwing the values of the young, particularly those in the PMA.

  28. And certainly, there is no way the UK Armed Forces or the French Armed Forces would give an officer a 21-gun salute, particularly when the person killed self or was killed while accused of massive corruption, particularly when there’s a first hand witness.

    The French or the UK military would probably say, “What on earth for? Damn waste of military rations!”

    Oh, and according to a UK 4-star navy officer, there’s no way, they would call a fellow who killed self accused of massive corruption a hero. (Only in the Philippines do they do that sort of thing.)

    It only shows, those in the circle of corrupt governance don’t really care but themselves. They thought and act as if they are the only ones who has the right and that they can do whatever they want at the expense of many. Kahiyahiya!

    I do not put too much value of what the Supreme Court did with regards to letting Congress proceed with the impeachment of mercy the thief protector. First, karapatan ng kongresso ito na pinakailaman nila and ikalawa they acted a little too late, harm is done! Masarap kasi umupo sa mga upuan nila. In addition, they seems to want to look credible? After all those corruption issues before and after. What can one expect? Looks like they just wanted to soften the blow. Kahit naman sila protektor din ng mga mali at abuso ng mga BFF nila sa gobyerno kapag nakakalingat ang mga mamamayan!

    I don’t find time honorable! Maybe later kung talagang magpapakatotoo sila.

  31. Incidentally, Ellen, LtGeneral Limot, er Ligot, and his wife Mrs Limot, are die-hard Reyes sidekicks and I’ve just learned that they will not/are determined not to squeal or talk or point out the widow Reyes as part of the loot gang.

    Officer (classmate of Reyes) who said that says that if Senate is expecting the Limots to reveal anything, they are mistaken. The only way for those two to crack at all is to make sure that Rabusa has iron-clad evidence, and even then, it is unlikely that they would implicate Reyes or his widow.

    Officer further added that there’s every chance that those two Limots would take their secret to the grave unless iron-clad evidence is presented against them.

    Yes, the government, civil society groups, the media will have to work hard to uncover the evidence to the anomalies that they did to the detriment of the Filipino people.

    Who would ever imagine Rabusa experiencing an epiphany and revealing what he had done? Reyes,Garcia and Arroyos never expected that. But it happened.

    Sen. Miriam Defensor-Santiago says impeaching Merceditas would not be easy.

    A fourth of the entire House is needed to vote in favor of the complaint. And then at the Senate, a two-thirds vote would be required to unseat her.

    Miriam says “If we cannot muster these votes, sometimes, [an impeachment] is just a waste of the country’s resources that could otherwise be spent on economic and policy matters.”

    It’s a valid observation. That’s why the focus of the vigil should now again be on the Congressmen and the Senators.

  42. Did you see on TV the PAF choppers that showered rose petals on the burial spot? I think they did that twice or thrice, I didn’t count.

    When they bury a scoundrel they have available helicopters to show off, not to mention aviation gas. But when it is time to airlift wounded soldiers in the battlefield, they are nowhere to be found. Even if these aircrafts were available, they usually don’t have gas. Maybe they sell those to the most corrupt vegetable in the world, Pichay, and other private plane owners, whose hangars are just next to the Air Force camp at giveaway prices.

    Shouldn’t that be charged to the family, too?

    I was bothered by my youngest son (9 y.o.) as we were watching on ANC the long eulogies that night. He asked “Why do they always say ‘honorable’?”, “What is the meaning of ‘dignity’?” I just answered, “Those are big words, it’s difficult to explain”.

    Both of my sons are politically-aware kids none of their cousins or aunts/uncles would dare debate current events with them. This is one of the rare times I would not answer such questions because the definitions, as with the logic of it all, escapes me.

    Every one of the fallen heroes we had in Afgahnistan were repatriated home and each of them passed thru the Highway of Heroes (a portion of Highway 401-the Macdonald-Cartier Highway) which brings their bodies from Air Base Trenton to the Coroners Office Downtown and to where thousands of us will line up the overpasses to Salute each of them as they pass by…and there were few who for some reason took their own lives..they were discreetly shipped home to their families and their privacy is always respected…the only reason why it is the media because they are soldiers..private citizens taking their own lives (and there are many mostly by firearms, statistic shows 3000 plus a year) is always private…not even whispered in funerals..

  71. It’s the first time I heard Heidi Mendoza’s complete testimony. Wow!

    She confirms what the guy from Air Force (Capt. Pogoy, was it?) had been telling this blog (and now in YouTube) all along, that the P120M cost of repairs for the C130 was doubled. Heidi says the funding came from a JUSMAG grant.

    The supplier was Lockheed-Martin which subcontracted the job to a local company in Clark, Asian Aerospace, who in turn, as Pogoy claims, was given Phil. Air Force technicians by PAF officers to undertake the rehab. What’s worse, they cannibalized parts from other C130 planes to transfer to that one being repaired. Puhunang-laway si Asian Aerospace! Another P120M was subsequently released from the Nat’l budget for the same amount. Wow uli!

    P240M paid for a P120M job done for free by the PAF, with free parts to boot.

    In other words, the contract was with Lockheed Martin.

    If Lockheed Martin was prime contractor, then they billed the AFP for services and in turn, paid off sub-contractor.

    Lockheed Martin will be duty bound to declare in the United States the costings of the contract which will naturally include details how much they paid sub-contractor and FOR WHAT or quantity of services, etc, etc., etc. (This is SOP).

    It is through the sub-contractor’s billing Lockheed Martin phase of the deal that money for bribes changes hands. Lockheed Martin will require sub-contractor to submit progress report and other kinds of reports.

    These reports normally determine the amount of payment that will be made to sub-contractor.

    Now, here comes the critical or crucial part — this is how Lockheed circumvents the RICO Law, a method which many defence companies copied or immitated to turn around anti-bribery or anti-graft laws in their home country: even a report that’s been photocopied from God knows where or which manual or literary invention from somewhere often containing technical gibberish of all sorts virtually saying nothing,but nothing at all, will enable Lockheed Martin to release payments that contains the bribe money or graft money.

    I’ve seen progress reports that were complete shit because they were not only unreal or that detailed works that did not exist or were never effected but the reports were the basis for prime contractor to now release millions of dollars in payment. Of course, Lockheed Martin knew that and in fact, being the first ones to do this sort of practice in the defence industry field, would suggest this methodology to their local agents as the only way to pass off the extremely high cost of the deal.

    It’s easy to cost refurbisment works on an aircraft and given that the RICO Law will punish a company that overcharges clients, the only way for Lockheed to win a contract is to pay the bribe money the clients want and one way to do it without it looking illegal in the US is by way of fake progress reports.

    That’s how these defence companies course the graft money to the guys who signed the deal!

Now, Tony Carpio — yes, the Supreme Court justice, knew how things were done ever since FVR’s time (remember he was legal adviser ot FVR and by virtue of that position, NO contract would be approved by FVR without his OK) and at one point, just before he was appointed by Gloria, denounced Lockheed Martin. But guess what? After his article in the Inquirer virulently critical of Lockheed Martin, the whole issue went pfff. The deal went through!

    And we all know what happened!! 😉

  84. Anna, I’ve seen how some foreign main contractors avoid scrutiny from their regulators. I can cite the “Cost-plus” contract wherein the foreign company merely supervises the rehab job (if at all) paying the local rep/agent (or sub-contractor) a fixed percentage over and above what the actual expenses that were incurred based on progress reports AND invoices of purchases. On paper, a “cost plus 5%” deal, for example, will not attract much attention since 5% mark-up is an acceptable cost, much more if supported by documents and proofs of purchases.

    What makes it scandalous is when parts not even bought but “cannibalized” from existing units are accompanied by Sales Invoices. Zero cost equals 100% profit!

    Now, if you add the free labor cost provided by the PAF technicians, then even the price of labor becomes 100% profit, too.

    When rehab contracts call for, say, labor and materials, provision of tools and equipment, supervision/testing/commissioning, supply of consumables, rentals and other coincidental expenses, the bulk of the cost come from “labor and materials”, the rest are just used to further milk the client and pass on any and all expenses. But if the former two are at no cost, justifying documents are usually fake/falsified.

    This system frees the foreign counterpart from any liability from its government, because the included five percent profit is regular and fair.

    The corruption of course takes place in the local counterpart’s country, usually the country whose regulators are either too stupid, too lax or are in cahoots with the syndicate/s.

    In this specific case, the rehab job was paid twice!
