Aquino orders dropping of charges vs jailed health workers

President Aquino ordered the Department of Justice to withdraw the charges of illegal possession of firearms and explosives against 43 health workers arrested in Morong, Rizal, on suspicion of being members of the communist New People’s Army.

“The medical workers were arrested in the waning days of the Arroyo administration on the suspicion that they were aiding NPA insurgents. These are valid concerns. Nevertheless, we recognize that their right to due process was denied them,” President Aquino said in a brief televised speech on the occasion of International Human Rights Day.

“As a government that is committed to the rule of law and the rights of man, this cannot stand. Therefore, I have ordered the DOJ to withdraw the informations filed before the court,” Aquino added.

Aquino said he expected that his order, subject to court approval, would lead to the release of the 43 health workers.
Justice Secretary Leila De Lima, however, said that six of the detainees have outstanding warrants that aren’t related to the raid on the Morong resort where the 43 were arrested last February 6.

“Under existing rules we cannot free them if there are outstanding warrants of arrest against them in other cases,” De Lima said.

De Lima said the information on the six persons with other cases was provided by the Armed Forces. She said this was being verified by government prosecutors.

Memorandum on the withdrawal of cases vs ‘Morong 43’

MANILA, Philippines – The full text of the memorandum on the immediate withdrawal of informations against the “Morong 43,” issued by the Executive Secretary, addressed to Justice Secretary Leila de Lima.

MEMORANDUM FROM THE EXECUTIVE SECRETARY

TO : SECRETARY LEILA M. DE LIMA
Department of Justice (DOJ)

SUBJECT : IMMEDIATE WITHDRAWAL OF INFORMATIONS AGAINST THE “MORONG 43”

DATE : December 8, 2010

This refers to the forty three individuals arrested in Morong, Rizal on February 6, 2010, collectively known as the “Morong 43.” There is an urgent need to address their plight even solely on humanitarian grounds. Furthermore, it is consistent with the spirit of the season that the “Morong 43” be freed from detention and spend Christmas with their families. More importantly, questions raised on the legality of their arrest justify their release.

Pursuant thereto, and upon instructions of the President, you are hereby ordered to cause the withdrawal of the following Complaints against the aforesaid individuals, to wit:

1. Criminal Case No. 10-9079-M, People vs. Gary Liberal et al. pending before the Regional Trial Court of Rizal, Branch 78;
2. Criminal Case No. 10-9078-M, People vs. Reynaldo Macabenta; Municipal Trial Court, Morong, Rizal;
3. Criminal Case No. 10-9080-M, People vs. Del Ayo Avera, Municipal Trial Court, Morong, Rizal;
4. Criminal Case No. 10-9081-M, People vs. Romeo de la Cruz; Municipal Trial Court, Morong, Rizal,
5. Criminal Case Nos. 7082 , 7083 and 7084, People vs. Delayo Avera et al., for Violation of COMELEC Resolution No. 87134 in relation to Article 261 (Q) of the Election Code, Municipal Trial Court, Morong, Rizal, and
6. Criminal Case No. 7130, People vs. Delayo Avera for violation of PD 1866, Municipal Trial Court, Morong, Rizal.

    Good but why? Does it have something to do with the peace talk with NDF and Luis Jalandoni’s return to PH? More than NDF which is now political represented, the government should deal more with the Mindanao problem. Pero ayaw ko naman maging KJ sa usapan. What I’m afraid of is we cannot fight with ideology and truly come to peace with them. The government must not fall into trap and be victim of leverages and blackmail. Hindi demokrasya ang layunin ng mga Komunista.

    I’m not really anti-Communist. We need to respect a group of people’s beliefs and ideology. Many have sacrificed and died for their principle. The only problem is if they insist on overthrowing a government by force and violence. With their representatives now in Congress and government through these so called party-list groups as its front, what more do they want. Their existence particularly the NPA armed group has now become irrelevant.

    Let’s face it, many of these Communists or at least their sympathizers are often disguised as health care works, priests, missionaries and other professionals to spread their ideology. To say that all the 43 Morong suspects are clean and not Communists would be a lie.

    By ordering their release, it would be more fair for Pnoy to order the release of the Magdalo soldiers and rebels instead of granting them amnesty since these soldiers were fighting for the country and what was right; not ideology the Communists want. Granting amnesty is forgiving for their crime many of these soldiers do not believe they committed. And if they accept the amnesty, it’s tantamount to admitting guilt. On the other hand, if it’s a release order, then it shows the government has made a mistake in detaining them. Therefore, Mr. President, release these soldiers now. You would be admired from both sides, the left and the right.

    According to the news, there are 5 out of the 43 who were heavily interrogated. So not all of these health workers are with the NPA.

    Kaya tayo may mga NPA, Abbu, MILF and etc, dahil na rin sa kahirapan ng mga tao sa rural areas. Improve their lives and they will be law abiding citizens. Where do you find these groups of peaople? Sa mga hirap na lugar. What is alarming is that these groups are recruiting the young kids. I came across a group like them in Rizal. It was a good thing I was briefed prior. The leader usually tells you that “it is my b-day today” or something to that effect. This is a solicitation to give them money. Then if you do not give them money, they will harm you. It was a good thing that our car was just a few meters away and I was immediately led out of the area. On the way down there were teenagers who wore all black. I was told that these kids belonged to the group I earlier met.

    I agree with Marz. Although Pnoy is trying to be compassionate over the holidays, he also has to be careful letting go of the Morong 43. In the case of the Magdalo, the Marine Stand off and the Manila Pen, there was one common denominator, the soldiers were against the CHEAT midget and her corrupt dogs. With the so-called NPAs, Abbus and the like now, they kidnap, force businesses to give money to them and do the killings of ordinary people as well. Although there were men in uniform like Palparan who was branded as the liquidator, there may be more on the NPA, Abbus, MILF, MNLF who do more harm than good.

    Pnoy gave in to NDF and foreign countries’ pressure. Or maybe he’s also paying back the Left for their support in 1986 Revolt ousting Marcos. Never had the Left been so openly active in politics and government until his mother Cory became President. Kaya puwedeng may kaunting dugong Kaliwa din ang pamilya nina Noynoy. Di ba si Ninoy pinagbintangan Komunista noon? At matanong ko nga, mga Moro ba ang 13 health workers? Bakit Morong 43 and tawag sa kanila?

    I personally believe that the Magdalo soldiers deserve more to be released than the Morong 43. For one thing, Morong 43 were detained for only 10 months while the Magdalos have been suffering in cell for many years.

    That’s true. NPA recruits kids to commit violence. It’s common in other countries. Kids can easily be brainwashed. Kids are very aggressive and willing to shoot and kill. In Mexico, drug syndicates hire kids as hit men. Even though I’m in favor of having peace talks with these Communists, let’s not forget about the crimes they committed all these years. Ang hirap kasi marami sa mga human rights groups front din ng Kaliwa. If the NPA or rebels are abused and killed by the military, they cry foul. But if it’s the soldiers who are killed, we don’t hear anything from them. Fair?

    Pasensya na ha. Pero mali ang pagkatumbok mo. Yung sa Magdalo, 7 taon na yun nililitis sa korte. Di na puede iwithdraw ng prosecution ang kaso kaya nga amnesty na kasama pati ang sa Marine stand off and Manila Pen. Di naman puede utusan ni Aquino na pawalan sila ng korte. Unlike dito sa Morong 43 na ilang buwan pa lang ang lumipas at ni wala pang presentation of evidence siguro sa korte kaya puede pang iwithdraw ng DOJ ang charges.

    Pangalawa, please revisit Edsa 86. The communists did not support People Power revolution. Remember na boycott nga sila sa snap election. Kaya nga galit sila kay Cory dahil naging irrelevant yung Left at that critical juncture in Philippine history at isinet-up yung Mendiola ‘massacre’ one year later para isisi kay Cory. 🙂

I think all Pnoy as Commander-in-Chief has to do is to order the AFP to withdraw its complaint and charges. Kapag umatras na ang nagdemanda, siyempre puwedeng ma-absuelto ang mga Magdalo. Pero ewan ko lang. Hindi kasi ako abogado. I took three months of law at FEU in the evening while operating a small business but quit due to time pressure. Mga 80s pa iyon. Sana isang abogado na rin ako ngayon.

    As for the leftist groups joining the 1986 Edsa, baka bata ka pa noon. Sa alias mong Henry90, hula ko mga 1990 ka nagtapos o Batch 90 ng PMA. That means I’m older than you. Nandoon ako sa Edsa.     Why do you care if they are communists or not? Our katipunan who fought Spain disguised themselves as ordinary people. They are Filipino revolutionaries who have beliefs as well as the NPA, only our belief is different than them. Even the personalities of our past presidency, they disguised themselves as public servants supposedly who look for the good of the many but look at what they did. Numero unong abusado.

    Our laws are clear when it comes to human right and due process with no distinction kung sino ka man. It we want our government to be look as fair and just government, We should expect them to promote human rights and due process…respect it and live by it. Para ano pa ang gobyerno kung sila naman ang nang aabuso?

Akala ko ba ay dinedeny nila na NPA sila? Bakit di nila idemand na pabilisin din ang paglilitis ng Maguinadanao massacre kung talagang interesado sila sa human rights? Bakit nakatutok lang ang Bayan at other front organizations sa Morong 43? Narinig ba natin ang ganito ring kasidhi na panawagan nila para bigyang hustisya ang mga pinatay ng mga Ampatuan? As I said and I’m saying it again…Communists want to push their Godless ideology using violence to overthrow any government. I say ANY because they don’t care who the leader or what administration is. Basta gusto nila Communism ang pamamalakad. Wala naman akong sinabi na ang human rights violation ay galing sa isang grupo lang. It happens to any group and any person.     I’m not disagreeing with your point but wanted to just high light one thing…it goes both ways tit for tat for both the military and NPA. In many cases, maraming inosenteng civilian ang apektado o napapatay. Dahil sa di matapos tapos na isyung ito taong bayan parin ang apektado. Pano ang hustisya para sa mga civilian apektado? That why for me with urgency, the more our government behave the way they should be the more we will have no problem sa mga isyong katulad ng morong 43 at mga ambush cases na ini share mo. Maybe a simple point of view but what is there to do to bring them to the folds of law?

    This is a common thing sa atin lalo na sa mga probinsiya. Revolutionary tax para sa mga rebelde, tax sa gobyerno, lagay sa mayor, at iba pa. It happen to my uncle nuon nagbukas sa ng quarry business sa probinsiya namin. At the end of day, di nag tagal ang negosyo at nawalan ng trabaho ang ilang driver at mga tauhan nito. just to let you know.

    I was in college long time ago pinag report ako ng instructor ko sa humanities about democracy and communism. After my report, one of the foreign student made a comment with regards to my report. Bias daw to favor the a Democratic System and everyone was taken by surprise. So my instructor reacted by asking many what do they think about democratic system or communism. Which one is better? many of my klasmeyts replied to favor the Democratic System. Majority ang boto. Then when its my turn to answer ang sabi ko it all fall down to who govern and how just they govern..focus pa nga yung presidente or yung premier. After the we completed the course karamihan sa pabor sa isang system binigyan niya ng 5.0 (bagsak) at ako naman 1.5 (pasa) 🙂

    Marz, pardz, looks like there is a disconnect between de Lima and the PNoy here. PNoy says, release the 43 while de Lima says, not so fast because 6 our of the 43 have oustanding warrants! Are de lima and Ochoa talking at all? Are they not suppose to be consulting each other before giving PNoy something to read/annnounce to the public? (I am asking you because we have been “talking” at the “assoc” thread). My Pointless Sisters point will follow. (Hint: speechwriter). ;8))

    I know where you’re coming from but I don’t know where you’re going? (tama ba?). Ang isang systema ng gobyerno ay depende kung bagay sa bansang iyon. May advantages and disadvantages. May pros and cons. Democracy with too much freedom is sometimes bad for the people. Communism is bad for those who want to move up materially but good for those who prefer equal distribution of wealth. Iyon nga lang, medyo walang Diyos ang Komunista or they have Godless ideology. Marami ang kontra sa Martial Law, halimbawa lang. Pero nakakabuti kung minsan ang kamay na bakal para maging matino at disiplina ang mga tao. In fact, the early years of Marcos Martial Law were good for the people.

    Pards, matagal na kinokontra ni De Lima si Pnoy. Alter ego siya ng Presidente kaya kung lagi ganyan na kontra siya dapat mag-resign na siya. It’s good to have an independent mind and speak your mind but not in this case when she’s a member of the President’s cabinet team.

    Olan # 39 ..it believe it is also designed for the people looking at your resume to instantly know how you performed in your undergraduate programs…see for example the passing grade is 2.5 that will be times to credits of the total programs to get the minimum credits…now if you have an average grades of 4.5 times the credits, then it will show in the bottom line a larger Credit..just one look.

    But anyways, President Aquino here is just showing his mistrust to the other branch of government by exercising his executive prerogative in requesting (ordering) the Dept. of Justice to withdraw the charges since the pattern of decision of the courts is always predictable no matter how his legal team approaches the case…it is some kind of Tit for Tat and we’ll see who’ll be standing last.

    Hindi kinokontra ni de lima ang president on this issue. She is just informing the public that the other 6 detainees still have separate cases. Pnoy’s order for the withdrawal of the case against the 43 is only for this particular case. Yung six cases are separate and independent which are not affected by Pnoy’s order for the withdrawal of the information against the 43. That’s the rule.
    If an accused is charged for robbery and another separate case for rape and the court dismisses the robbery case, the rape case shall continue.

    Ang inilagay ni De Lima sa “balag ng alanganin”, si Ochoa. Para niyang sinabi sa buong mundo, “Engot itong si Ochoa, merong ibang warrant of arrest yung anim pero gusto niyang palayain.” But it should have not reached that point. At the time Ochoa was drafting the memo, he should already be coordinating with De Lima who in turn, could’ve informed him it wasn’t possible for the six other arrestees. A Memorandum merely formalizes the pre-agreed tenor and text.

    There’s obviously a storm brewing between the two honchos.

    First, you don’t put in a memo “For your immediate and strict compliance” unless it’s for some new rule that is meant to correct some procedural or control system flaw in an office that has caused some real problems that it should be immediately implemented. “Strict” implies finality and does not grant the memo recipient any elbow room to maneuver.

    For this kind of communication, the proper words would have been “For your implementation and guidance” which is emotionally neutral but just as definite.

    Direction is clearly lacking and worse, he has no clear roadmap on fulfilling his promise of eradicating corruption. It would be nice if Gloria is jailed, but this miracle wouldn’t initiate a sort of domino effect that would stop other public “servants” from being corrupted for selfish ends.

    What we want is a systematic and proactive solution to a systemic problem. Prevention is more effective and less expensive than the cure. The cost of prosecution would add on top of the value that has been stolen.

    That is why I would see FOI to be on top of Aquino’s agenda. If that happens, I would believe his sincerity and Gloria in jail would be icing on the cake.

    Nowhere in my discourse did I say that. Part of the hazards of the profession yan. You win some. You lose some, ika nga. Pero at the end of the day, ang tanong ko: Are we appreciative of what our soldiers our doing to protect democracy or not? The same democracy that the Old People’s Army is exploiting to the hilt? There’s something wrong with an ideology that only engages the armed elements of the state in a futile war of attrition. One that they can never win. For all the bright minds that they have within their ranks, are they so blind not to see that the real enemy is not the high school graduate in camouflage uniform holding a M16 but rather, the glib-talking and well-heeled politicos who continue to enslave the vast majority of their constituents leaving them in the quagmire of poverty?

    I recall that when Maj. General Victor Corpus, now Malacañang Civil Relations Chief in charge of the Palace “war room”, came to see me in my home in 1976, just before he went in to “surrender” to one of his Philippine Military Academy classmates (he was ordered “arrested” instead and slapped into military prison), Corpus revealed that it had been Joma Sison who had ordered the Plaza Miranda bombing in 1970 – not the Marcos government.

    Mind you, Corpus had fought alongside Joma as an NPA Commander for almost six years, following his raid on the PMA armory in Baguio in 1970, when he (1st Lt. Corpus) defected to the Communist rebels, bringing PMA Browning automatic rifles, machineguns, and other weapons with him. Corpus told me he was heartsick and disillusioned with the movement, and the “executions” ordered of high-ranking and loyal NPAs by their own leadership, including Joma himself.

    When I met Corpus (before his “political prostitute” statement against a lady Senator) at the National Defense College of the Philippines “Roundtable Discussion”, last January 27, I asked Vic – in the presence of Commodore Carlos L. Agustin, AFP (retired), President of the Defense College; Vice Chief of Staff Gen. Rodolfo Diaz, Commodore Mariano S. Sontillanosa, AFP (ret.); Rear Admiral Ariston V. de los Reyes, Deputy Chief of Staff of the Armed Forces, and dozens of officers and Defense College participants, whether he stood by his charge that Joma Sison had dispatched the cadre who attacked the Liberal Party’s miting de avance with hand-grenade.

    General Corpus replied: “I do.”

    Corpus – mind you, still an NPA Commander at the time – had asserted that Joma believed an attack on the opposition rally – which resulted in some killed including our Manila Times cameraman, and others like Senator Jovito Salonga, Speaker Ramon Mitra Jr., Senator Sergio Osmeña Jr., Manila Mayoral candidate (subsequently Mayor) Ramon D. Bagatsing, grievously wounded, indeed, some like Jovy maimed for life and near to death – would be blamed on then President Ferdinand Marcos and the Government. Hence, Corpus disclosed, that bold attack. Fortunately, one of the grenades thrown that night proved a dud and failed to explode, otherwise the carnage would have been inestimable.

    True enough, Marcos was blamed. And even then Senator Ninoy Aquino who hadn’t arrived at the Plaza Miranda entablado because he was attending a party as ninong (godfather) in the Jai Alai “Keg Room” on Taft Avenue.

    After Corpus “came in from the cold”, a heroic movie had been made about him – which, by the way, I tho-roughly enjoyed – starring “Daboy”, Rudy Fernandez.

  72. Marcos was not dumb to have ordered the bombing of Plaza Miranda — he knew that the blame would have been put on him and so Corpuz’ revelation that it was Joma who ordered it is very very credible.

    Incidentally, Joma Sison’s children were sent to China sponsored by then Red China authorities following his incarceration by Marcos. In fact, his children grew up in China and only left China when they followed him to Utrecht in The Netherlands.

    Joma’s armed rebellion against the Philippine govt in place was not only inspired by Mao and overall by Red China but was also funded by the Red Chinese.

I came across an article one or two weeks ago by, was it Bobby Tiglao?, reviewing a new book written by one who came from the high ranks of the communist movement, who has since then gone back to teaching. Too bad, can’t find the link and forgot the author’s name. The book’s title starts ” Secrets of…”

    Among some intriguing parts of the story, according to the article, was the part claiming Joma was into an extramarital affair that bore him a daughter.

    Further, the book alleges that yeah the Plaza Miranda bombing was Jomas handiwork and that Ninoy Aquino was forewarned of it by a call from Kumander Pusa…

    Intrigero? Maybe.

Joma is a brilliant person, great intellect with a fantastic gift of the gab; there’s nothing wrong with the man as a person, he likes to sing and dance just like any ordinary Pinoy Joe, but I certainly don’t like his ideology and am one that he cannot convince that his ideology is for the good of the Pinoy nation (and he knows it.)
