Review of the review: Verzosa, Puno, Moreno cleared

DILG decides on Lim; two newsmen chided

Malacanang has cleared three officials and downgraded the punishment recommended on a few others by the Incident Investigation and Review Committee (IIRC) in connection with the botched hostage rescue attempt last August 23.

This was revealed in documents obtained on the Palace legal team’s review of the IIRC report, which President Aquino was supposed to release yesterday. The legal team is composed of Executive Secretary Paquito Ochoa Jr. and chief presidential legal counsel Eduardo de Mesa.

Deputy presidential spokeswoman Abigail Valte said President Aquino did not release the Palace review team’s report because he is attending to preparations for his First 100 Days report.

“Considering that it’s a sensitive issue, we just want to be thorough and we want to make sure that all the bases that would support the recommendations are there,” she said.

Based on the obtained documents, the Palace cleared retired PNP chief Jesus Verzosa, Interior Undersecretary Rico Puno, and Manila Vice Mayor Francisco “Isko Moreno” Domagoso of any liability in the hostage crisis which left eight Hong Kong tourists and the hostage taker dead.

However, the Palace report recommended the filing of charges of reckless imprudence against Radio Mindanao Network anchors Michael Rogas, who interviewed hostage taker Rolando Mendoza, and Erwin Tulfo.

The Palace legal team said Puno, who was in charge of police matters, showed “lapse in judgment and poor performance” but no case should be filed against him.

“The President believes that Usec Puno should be held accountable for his judgment and performance as an official of the DILG and his continued tenure as a DILG official is subject to the President’s review,” said the legal team’s report.

The IIRC recommended administrative proceedings against Puno for gross negligence and for neglecting to ensure the implementation of President Aquino’s order to use the PNP Special Action Force in conducting the assault on the hijacked tourist bus.

The IIRC also recommended the conduct of preliminary investigation on Puno for “possible criminal liability” for offenses committed during his assumption of the position of head of the crisis management committee (CMC).

The report said Verzosa exhibited “lapses of judgment and poor performance” at the height of the hostage crisis but no case should be filed.

“As head of the PNP, it was incumbent upon Verzosa to identify and address the problems that were unfolding during the incident. His judgment and leadership in this regard could have been better exercised,” said the report’s action plan.

The IIRC recommended administrative proceedings against Verzosa for “less grave neglect of duty.” It also suggested that a preliminary investigation be conducted against Verzosa for possible criminal liability.

The Palace review said Domagoso’s/Moreno’s “judgment may have been questionable but no charges would be filed.”

The IIRC recommended administrative proceedings against Domagoso for failure to execute his duties as vice chair of the CMC and for dereliction of duty for abandoning the command post at the height of the hostage crisis, in violation of Sec. 60(c) of the Local Government Code.

The Palace review team recommended the filing of charges against SPO2 Gregorio Mendoza, for being an accomplice of his brother for serious illegal detention and serious neglect of duty under the Police Uniform Rules (PUR) of the National Police Commission (Napolcom).

It said Mendoza would be subject to preliminary investigation while Napolcom would determine whether he can be sanctioned under the PUR.

The Palace report, in recommending the filing of charges of reckless imprudence against Rogas and Tulfo, said: “While it cannot be denied that the media has an obligation to report the news, this comes with certain responsibilities. Their rights must be balanced with the primary objective of such police operations: to save lives. The conduct of their coverage should be consistent with this objective, and conduct that risks the lives of innocents cannot be tolerated.”

The IIRC did not recommend any charges against the two and merely suggested that their cases be referred to the Kapisanan ng mga Brodkaster sa Pilipinas or any appropriate media watchdog organizations for appropriate sanctions.

The Palace review team’s other findings:

Referral of Manila Police chief Supt. Rodolfo Magtibay’s case to the Napolcom for investigation and action for gross incompetence and serious neglect of duty under the PUR. This is lighter than the IIRC’s recommendation of administrative charges for serious irregularities and gross incompetence and a preliminary investigation for possible criminal liability.

Referral of National Capital Regional Command chief Director Leocadio Santiago Jr. to the Napolcom for investigation for “less grave neglect of duty.” The IIRC recommended administrative charges for less grave neglect of duty and investigation for possible criminal liability.

Referral to the interior department of Manila Mayor Alfredo Lim’s case for dereliction of duty and misconduct in violation of the Local Government Code of the Philippines. The IIRC recommended administrative and criminal proceedings against Lim.

Referral to the Napolcom of chief hostage negotiator Supt. Orlando Yebra’s case for “simple neglect of duty.” The IIRC recommended administrative charges for “gross incompetence.”

Referral to the Napolcom for investigation of Chief Insp. Santiago Pascual III, Manila SWAT team leader, for “gross incompetence.” The Palace review team’s recommendation is the same as IIRC’s.

Referral to the House of Representatives of the case of Ombudsman Ma. Merceditas Gutierrez for appropriate action, whether she committed an offense that is a ground for impeachment, as recommended by the IIRC.

Referral to the Ombudsman for appropriate action of the case of Deputy Ombudsman Emilio Gonzales III for gross neglect of duty and/or inefficiency. The IIRC had recommended that the Office of the President investigate Gonzales.

Referral to the KBP of the case of the station manager of Radio Mindanao Network-DZXL for appropriate sanctions. The Palace said dialogues have started with media groups to draw up guidelines for coverage of similar incidents. The IIRC also recommended that the issue be referred to the KBP or appropriate watchdog organization.

On the cases of ABC5, ABS-CBN and GMA7, the Palace legal team recommended that media adopt specific regulations on coverage of hostage-taking and other critical incidents. The IIRC also referred the issue to the KBP or other media watchdogs.

    Why the need for review? Look at the recommendations of the IIRC. Anak ng pating! Puro couched in general terms! Paanong di mo irereview? Parang shotgun! Parang sinabi na, “Eto yung rekomendasyon namin. Bahala na kayo sa specific charges.” Kaya tama lang na ireview. Pag nagfile ka naman ng kaso na di angkop sa evidence on hand, sasabihin niluto para di tumalab yung kaso. O baka yun lang naman talaga ang hangarin? Basta mag file lang ng kaso? Para masabi lang na may ginawang action? Pag nadismiss sa korte, niluto na naman? hehehe. . . 😛

    Yeah, popularity is relative depending on the present issue at hand. Compared to the information available to the President, we can’t fault him. Already, my former comrades in arms in the PSG are verifying reports of destabilization efforts by forces who want to oust Aquino. Sorry for them. Just like in Cory’s time, they will fail. And just like in Cory’s time, I assure you Gazmin is not fond of acoustic warfare. There will be no long trials for would be mutineers. TAPS will be immediately played in their final resting place. 😛

Hundreds of millions ba naman ang ibinayad sa Inc and nagiingay din ang Iglesia Katoliko. It is the bad bad habit of Filipinos for decades that caused all these inefficiencies and corrupt ways. Instead of having the money to equipt our force, ninanakaw lang. Instead of punishing the jueteng beneficiaries, eh may promotion pa to Cabinet positions. WOW, only in the Philippines talaga!     Pnoy is doing the right in keeping his cabinets intact for now. Letting go of anyone of them makes him a panicky type of president…and some here will not hesitate to sharply criticize him, what else is new. The hostage situation was a blurr; this huweteng payola to those in authority is nothing new either.

    Million or billion pesos in illegal contracts/thievery in government is a more valid reason to sack anyone in his inner circles. Until then, just be a spectator; or if you’re the type to gripe just for the sake of griping…..knock yourself out.

    I’ve never begrudged Martir for his promotions and now having a cushy position in government. Most in here knew who John Martir is; I’ve never heard him bash anyone, and he just keeps smiling…and if that was his secret to his windfall, why would he complain. He’s a lucky person that’s all.

    Noynoy finally found another issue to showcase a decisive leadership, decisively against the recommendations of the IIRC, a committee he himself created to look at the events of Aug. 23. His fans must be very happy, I suppose, after all these times his only decisive moment was when he banned wang wang. To them, the minor leaguer is elevated and now belongs to the big league.

    The decision however was not based on sound mind, judgement, and from the heart. It’s based on his instinct to protect and defend friends and supporters who somehow contributed so much in his campaign or holding “something mysterious” against him. The decisiveness was due to that “mysterious something” or his loyalty to them, thus ignoring the glaring and exposed ineptness and incompetence in their appointed and assigned jobs.

    This is not a case of anti or pro Noynoy. This is a case of finding and doing what is right and correcting what went wrong. Taunting and insulting people who criticize him is not only childish but idiotic and foolish. Criticizing is one of the pillars of a healthy democracy. People who can’t accept criticism has no right living under a democratic government, might as well migrate to somewhere else run by tyrants and dictators where the privileges of the strong are rights and the rights of the weak are privileges.

    Ang matuwid na daan ni Noynoy ay hindi matutupad kung walang mga pumupuna. So to the proNoynoy, keep an open mind, learn how to tolerate and accept criticism against the boss; that will be good for everybody’s health, for democracy and for our beloved country.

    I repeat, I don’t like Puno. I would rather PNoy sack him for being a ‘bobo’. Incompetent is far more tame. As to the jueteng payola, Cruz’s evidence is ‘laway’ only. SnV won’t give it a second look. Ever wondered why nothing happened to those jueteng exposes before? If Cruz is so certain about their involvement, why can’t he file the case directly with the Ombudsman? Because he doesn’t have the evidence, save for the say-so of his assets in the field?

    I’m not privy to the kind of information the President has in retaining the services of Puno. But I will venture to speculate. Puno is the eyes and ears of Pnoy in the PNP. The guy has an extensive network within the organization dating back so many years. I would suggest though that he be banished from the limelight and just do his job incognito. At saka, por dios por santo, huwag nang payagan magpa interview yan. Bopol eh. Nagpapaendorse lang sincerely. Di ba Jug? 😛

    Only the powerful and rich think there is democracy in the motherland; ask the poorest of the poor or those constantly marginalized and you will find out (seems you are unaware) the democratic process does not pertain to them. If you are nothing in the motherland; you are prone to salvaging just for being unruly or for simply trying to defend yourself from erring pulis-patolas or those in authority.
    Please don’t turn a blind eye on this premise. It’s a reality.

    Criticize all you want; so long as it’s truly warranted, not just toothless accusations. Once again, it’s a very young administration…so just sit still. I’m a pessimist but as of now…there is still gold at the end of rainbow.

    true. i never liked the guy at the start, i’m pretty sure minamalas yan kay presidente but sorry na lang he’s not the type who wants to humiliate somebody in public…i don’t know why some people here like to do that? some kind of deep seated inferiority complex or something?
    but he seems to have the trust and confidence of the president and he knows the guy much much better than we do – as we generally rely on “he said, she said” i believe his info is more reliable than ours kung baga first hand information hindi “tsismis.”

    In an interview with the Inquirer on Monday night, the President said he had not had a chance to talk with Puno but that he had lectured him on how he should have handled the allegations.

    Mr. Aquino also said Puno was so trustworthy there were not too many people like him.

    “Rico played a very big role in getting my security, he looked for friendly forces to help us in both the senatorial and presidential elections. He had formed many relationships over the years and he’s the one really trusted here,” the President said.

    The President said Puno trained the members of his mother’s Presidential Security Group in Malacañang.

    DOJ Sec. de Lima already “buffered” the eventual modification of their recommendations on the anniversary of Martial Law.

    When asked what if the IIRC’s recommendations will be changed, she said she’ll comment once the review of the IIRC report will be publicly announced.

DOJ sec de Lima is a professional, she knows where her authority extends and where it ends…by the looks, she is not governed by emotions alone…if she crumbles this early in the game, wala palang tibay na maaasahan sa kanya, Noynoy needs people like her in the long term…and we need people like her…

  38. In his heart, PNoy knows Puno is blameless. Noynoy placed him at the DILG as his eyes and ears, Puno himself admitted that. His official function is but a formality for his position as undersec. Pnoy was in reality the one calling the shots for the other half of the DILG. During the crisis, Puno was probably just as confused as to what he was going to do because officially he was not supposed to be the one there but Robredo. And Robredo was confused as to what he was going to do because he was under verbal instruction to be hands off the PNP. Get the picture?

    Now, recall that PNoy was telling media that he issued specific instructions to Puno and others particularly on the use of SAF for the attack. That’s just the President telling his version of the story. Did he really? In the report you find no confirmation. It’s a gap no one wants to see. If Puno is cross-examined later and asked “what instructions did you get from the President?” Aha, you have a big problem!

    in contrast, the ampatuan massace is almost forgotten, and there’s no attempt at investigating complicit government figures? how about the glaring afp markings on the ammo boxes, where did the weapons come from? afghanistan? why is there more effort being exerted to criticize the current administration when the people involve (mawalang galang lang) are the most arrogant in the world (try shopping in hk now and take a long time to decide and you’ll know what i mean) than 50+ or so fellow filipinos and there are media personnel involved also.

    Mababaw” as in superficial. PCOO, which Coloma heads, has a very broad scope. Bureaus and agencies under it are: Bureau of Broadcast Services, Bureau of Communication Services, Philippine Information Agency, and Radio Television Malacañang.

    One may call it a “propaganda” machine but it’s really an essential part of any administration. Let’s see if the huge budget will pass muster at Congress if enacted.

    For now, I suggest you compare the said Coloma budget to previous ones…
