Senate seeks custody of Trillanes

The Senate has passed a resolution urging the Makati Regional Trial Court to allow them to take custody of detained Sen. Antonio Trillanes IV so he can attend sessions and perform his functions as a senator.

At least 16 senators have signed Senate Resolution No. 84 that was formally adopted Tuesday night by the upper chamber, calling for the transfer of the custody of Senator Trillanes to the Senate, so he can attend and participate in the sessions and other official functions of the Senate.

Those who signed the resolution were Senate President Juan Ponce Enrile and Senators Vicente Sotto III, Alan Peter Cayetano, Pia Cayetano, Franklin Drilon, Jinggoy Estrada, Francis “Chiz” Escudero, Teofisto Guingona III, Gregorio Honasan, Ferdinand “Bongbong” Marcos, Loren Legarda, Sergio Osmena III, Francis “Kiko” Pangilinan, Ralph Recto, Ramong “Bong” Revilla Jr., and Juan Miguel Zubiri.

Five senators – Drilon, Escudero, Recto, Honasan, Pangilinan and Zubiri – signed the resolution but with qualifying statements “with due respect to the court proceedings.”

Sen. Joker Arroyo asked for its recall yesterday because, he said, this would intervene in court proceedings.

Sen. Juan Ponce Enrile said it is still up to the court to decide.

“We’re just appealing… we’re part of the same government… we do not decide how the case will be resolved… we’re not saying they should do this. It’s not like that… we’re just appealing to them, so that we can work,” Enrile said.
Senator Trillanes, who clinched a Senate seat in the 2007 election with 11,189, 671 votes, thanked his Senate colleagues and welcomed the resolution, saying “it will pave the way for the correction of a long-standing travesty of justice and uphold the mandate of the Filipino people.”

Senator Trillanes, the first senator to be elected into office while in detention, continues to struggle to serve his mandate even under severe constraints. During the 14th Congress, he filed a total of 347 bills and resolutions, 19 of which were enacted into law. A little over a month after the start of the 15th Congress, he has thus far filed 270 bills.

While under incarceration, Senator Trillanes also completed his Master in Public Administration (MPA) degree from the University of the Philippines to improve his legislative skills and broaden his knowledge of public administration to better serve the people.

Senator Trillanes has been under detention since 2003 in connection with the Oakwood mutiny in Makati City which was staged to dramatize their demand for the resignation of then President Gloria Macapagal-Arroyo, now a congresswoman representing her district in Pampanga.

Judge Oscar Pimentel of the Makati RTC Branch 148 has denied the detained senator’s motion for a five-hour furlough so he can attend the opening of the Senate session on July 26, 2010, citing a ruling with finality of the Supreme Court in 2008 that upheld the decision of Pimentel disallowing Trillanes to participate in the Senate sessions and other legislative functions.

The Senate resolution said that despite the fact the Senator Trillanes was under detention pending the resolution of the coup d’ etat charge before the Makati court, there was a “clear and unmistakable mandate of the electorate for him to serve as one of their elected representatives at the Senate.”

A similar resolution had been adopted by the Senate in 2007 urging the courts to allow Senator Trillanes to discharge his legislative duties.

It also cited the five official decisions adopted by the Inter-Parliamentary Union (IPU), an organization composed of 155 lawmakers from different countries, urging the Philippine government to release Trillanes or allow him to attend Senate sessions to “enable him exercise his mandate in a meaningful way.”

The resolution also pointed out that the “offenses with which Senator Trillanes is charged are political offenses. Thus, he is properly classified as a political prisoner under the International Laws.”

“[W]e urge the Judiciary, through the Regional Trial Court of Makati-Branch 148, to rectify the apparent injustice by allowing the temporary transfer of the custody of… Senator Trillanes from the Philippine National Police (PNP) Custodial Center to the Senate, particularly the Office of the Senate Sergeant-at-Arms (OSSA), while the Senate is in session,” the senators said in the resolution.

    This is going to be tough. Judge Oscar Pimentel doesn’t even know why he jailed Pareng Sonny Trillanes to begin with. Remember in an earlier thread ? He said that he be given a year for him to find the correct spelling for “coup de etat”,———-or something to that effect. So kung palalabasin niya si Sonny, magmunmukha siyang TANGA !!

    Yoong pagiging TANGA ni Judge Pimentel eh nangibabaw sa mas malaking dahilan na palabasin si Sonny na merong mandate to serve his term as a senator of the republic. SUSMARYOSEP !!

  2. Ano’ng ipinuputok ng butse ni Joker? Bigyan nga yan ng mag-asawang sampal sa punong-tenga para makalog ng konti ang utak. Kulang lang sa pansin ang huklubang ito.

    Hindi pa rin niya matanggap na siya ang isa sa mga pangunahing dahilan kaya nag-coup sila Gringo noon na nauwi sa pagkasibak niya bilang Exec. Sec. ni Cory. Samantalang yung mga nag-coup nag-pushup lang.

    Basta Arroyo talagang walang kwenta.

    …in the meantime, we let not so serious criminals get away like Ecleo, etc…

  9. …and Trillanes has the potential to theaten the age old tradition os silence or be silenced in the military…of corruption permeating even the highest levels, collusions with politicians, shady businessmen, and real enemies of the state, etc….
    I really believe he poses no threat to the country, the people and the government (at least this one)…in Gloria’s time this clamor for his release would be labeled as DESTABILIZATION – how ironic that now its non other than the president who brought it up and these legal luminaries are pummeling him for it…

Marami daw kasi sa bicol ang “crab mentality”, kaya, mulat-mula pa noon, walang naging presidente. Sila-sila, nag-kakagatan ng malalaking agat. Ano pang kinakahol nitong si Joker, tapos ng power nila, aapat-tatlo na lang yata kayo ( Angara, Lapid, Joker ).

    Maliwanag na political prisoner si Sen. Trillanes. Ano pa ang hinihintay ni Judge Pimentel? Ito naman si ulyaning Joker humirit pa. Akala niya nasa Malacanang ang amo niya.
