Estrada joins call for Trillanes’ temporary release

Former president Joseph Estrada joined calls for the temporary release of Trillanes, saying that his continued detention is a waste of taxpayer’s money.

Statement of Sen. Antonio Trillanes IV:

I am very grateful for the public pronouncements of Pres. Aquino as regards our case. It was truly a display of magnanimity on his part. Still, for now, it will be the court who will decide whether or not I would be able to serve our country once again.

“He is receiving his salary as senator yet unable to render his services in this capacity. By not allowing him to participate in Senate sessions, the courts are rendering Senator Trillanes’ office inutile and indirectly wasting taxpayers’ money,” he said.

Estrada said it should not be too difficult to allow Trillanes a few hours of provisional liberty to participate in the Senate sessions, particularly on July 26.

“He can be brought to the Senate to attend session for a few hours and then brought back to where he is being detained. Why the big fuss?” Estrada said.

President Aquino, in an ambush interview yesterday after a mass oath-taking in Malacañang, said he was neither interfering nor trying to influence the judiciary when he ordered the review of the case. He said he would respect whatever the court’s decision will be.
He said he just wants to make sure that requirements under the law were complied with when Trillanes and his co-accused were charged.

He encouraged his former colleagues at the Senate to revisit the Revised Penal Code pertaining to the coup d’état charge and determine if an injustice was committed.

“As I have said often enough, it seems that the fiscal, in evaluating the charge, should not have let the case prosper. The elements necessary that would constitute a crime were not existing in Oakwood. It is not just Senator Trillanes, there are others. If we do not object to what we perceive as an injustice, then we are party to it,” he said.

Aquino was referring to the Revised Penal Code which defines a coup d’état, a “swift violent attack on military installations, police installations, telecoms facilities.”

He said a hotel like Oakwood is not in the list of targets.

“So hindi klaro kung in-attack nila o takeover or what have you. But bottom line, it is not in the enumeration. Fatal flaw in the preparation of the case as far as I’m concerned. Again, that’s my personal opinion,” he said.

He stressed the review had nothing to do with Trillanes’ petition for bail and his request to be allowed to attend the Senate sessions.

He said they are leaving the request to the court.

He said he is not asking for the exoneration of Trillanes or other officers like Capt. Nicanor Faeldon who, he said, is in a “similar situation and has just surrendered himself to the authorities.”

Faeldon was also a leader of the Oakwood mutiny. He escaped at the height of the standoff at the Manila Peninsula. He surrendered on July 6.

De Lima said she has started the review on Trillanes’ case but the executive department through the Department of Justice will leave it all up to the courts.

The DOJ under the Arroyo administration recommended the filing of charges against some 30 officers, including Trillanes and Faeldon, for the Oakwood incident.

Both the prosecution and defense have rested their cases, and have been ordered by the Makati trial court to submit their memoranda.

“I understand that the case will soon be deemed submitted for the court’s decision, upon the filing of the required memoranda by both the prosecution and the defense. At this stage, the options for the prosecution and the defense may be limited,” De Lima said.

    Dapat lang…palayain si Sen. Trillanes and other Magdalo soldiers, ngayon…dapat ikulong ang lahat ng tunay na hudas at nanghudas NOT ONCE, but TWICE sa ating Saligang Batas?

    Nakakainit talaga ng kukote…ikulong ang EDSA DOS military officers na nagkanlong kay gloria plus ang Hello Garci Generals?

    Most of those concerned General problems are now retired…ikulong silang lahat! Ngayon pa na retirado na sila at malapit nang magsipanaw sa mundong ibabaw ang ilan sa kanila.

    Bakit di yan ang litisin at turuan ng leksyon ng mangatuto…walang pinagkatandaan, puro sila pahirap sa bayan?

Trillanes tuwing pupunta sa Senado. Pwede ring gumawa ng iron cage na may tatak For Official Use Only na pagsisidlan kay Sen. Trilanes. Tapos ibalik nila sa kulungan after the session.

    Dito sa question ng senate presidency na sinasabing siyang dahilan kung bakit siya padadaluhin sa senate opening session, I don’t think Sen. Trillanes will vote for Kiko Pangilinan.

    Whoever Hudas not want Sen Trillanes to perform his duties as an elected senator is rendering injustice not only to those who voted for him but the whole nation.

    Former President Erap was right in calling for his periodic temporary liberty if only to join senate sessions since Sen Trillanes is also receiving all what is due to an elected lawmaker in the Upper House and it is only fitting that he be allowed to join every senate meeting.

    Those who oppose and profess legal intelligence are just sadist selfish people who feel joy over the sufferings of others. They are not human. They belong to an animal specie of lowest form.

    Yes. Walang detonating chords yung mga C4 explosives na ipinalibot ng mga members ng SWAG ng Navy doon sa Oakwood. They did that because they didn’t want to have an accident. C4 explosives are very powerful. Kung meron mang detonating chords yung iba, they made sure na di naka connect sa detonating switch. Pang gulat lang actually yun.

    Dapat kang magpasalamat at natapos na rin ata ang kalbaryo ng mga JAGUAR dahil maiiproklama na rin sa wakas ang kanilang idolo bilang representante, si Mikey Arroyo. Biro nyo kung wala si Mikey, sinong tutulong at magtatanggol sa kanilang kapakanan? Malaki na ang kanyang sakripisyo kaya karampatan lang na makaupo na siya. Lalo pa ngayon at ang ermat niya ay isa na ring kongresista, lalong magiging matibay ang pag-asa ng mga marginalized sector.

    Bale 5 na silang Arroyo sa Kongreso kaya makaka-asa ang sambayanang Pilipino sa kanilang makatotohanang servicio publico. Kulang kasi yung 9 na taon sa Malakanyang.

    Hindi pa ito yung post related to the bluff on the explosives. But this is related to the observation of the President, that the charge should have been for a lesser offense, not coup. It is also related to my earlier post that coup was charged to deny Trillanes bail.

    This is from Justice Vicente V. Mendoza, in the case of Office of the Provincial Prosecutor of Zamboanga v Court of Appeals (G.R. No. 125796, December 27, 2000)

    If then, a public prosecutor deliberately ignores or suppresses evidence in his hands which palpably indicates the chargeable offense and files an information charging a more serious one, he departs from the precinct of discretion and treads on the forbidden field or arbitrary action.

    If prosecutory discretion is twisted to charge a person of an unbailable offense and, therefore, keeps him under detention when the truly chargeable offense is a bailable one, the prosecutor transgresses upon the human rights of the accused.

    Trillanes will be using more taxpayer’s money when he is transported to attend senate hearings. I think he should first prove to me what he can do before I pay for his ride or webcam sessions with the senate. I am disappointed that I hardly ever hear from him. What does he do all day? It feels like nothing. It’s too bad he’s in jail but he did something wrong and people elected him anyway. It’s his turn to prove he deserves his salary while incarcerated.
