I believe Senator or President-elect(?) Aquino is mistaken. He’s being too literal and I believe he’s either trying to downgrade the charge or doesn’t understand the intricacies of coup d’état.
Aquino asks the question, how is coup d’état committed? It can be committed in many ways but the ultimate gauge of whether an act or an attempted act by a group is coup d’état or not is the INTENT.
For instance, say, my group and I go into action, i.e., launch the overthrow of the government or the republic with force and arms and we decide to start if off by stupidly blowing up the lavatories (toilettes) at the Glorietta Mall but with the clear intent of overthrowing the Republic and that is still coup d’état.
Another example, say, my group doesn’t have to be purely military-led — it could be led by Pope Benedict, launching a swift armed and forceful attack on Buckingham Palace with the clear intent of overthrowing Queen Elizabeth, depose her and to take over the throne of England, that still would be called a coup d’état.
Now, of course, intent is very difficult to prove but circumstancial evidences and declarations made by the group could help prove the case for the state.
Efren Abu and Cimatu could very well be called in to testify for either side to try to prove that there was intent to overthrow the state, i.e., by deposing the legal representative of the state or its head.
That’s where the battle lines should be drawn.
It is all very well for Aquino to try to be nice by saying “Walang hotel” sa definition ng coup d’état but please, either he shuts up na lang because he is beginning to appear stupid or pilosopo, not a good thing for the image of the incoming presidency to be perceived either way.

I don’t need to be a lawyer to determine whether the attempted act mounted from a hotel was an attempted coup d’état or not. The fact that the group staged their failed attempt at overthrowing Gloria in a hotel, something that I’ve always be classified as downright stupid and useless, does not negate the deed; it doesn’t alter the fact that there was serious attempt to bring down the head of the republic (now, of course, the best thing to do is to prove that Gloria was not the head of the republic and everything will be fine). Now, was that an attempted coup d’état? Yes, to me it was, it was swift, it had the element of force and the intent to depose, overthrow was present…
Fortunately for the boys, their motive was honourable and I believe we all agree that even if they committed coup d’état, attempted and failed or not, they were morally motivated to do so. (I personally am prepared to overlook their military blunder…)

If the intent was not to seize power, then you are right, it can’t be classified as a failed coup d’état despite the presence of all the other ingredients, plan, swift movement, arms, force, etc.
The state must be able to prove beyond reasonable doubt that the intent of the group was to seize power, overthrow the president… must be clear as daylight and if they could prove this and show proof that the other ingredients were present during the attempt, then the young officers group have a problem. But if the state cannot, then they must be set free.
As to whether they were prepared to die that day or not, like you, not too sure.
Downgrading the offence from treasonous coup d’état to mutiny is harsher I find… Why? Because the offence of mutiny is punishable by what? 20 years in prison? That’s even worse to my mind.
With coup d’état for a charge, the state will need need the ultimate proof: INTENT to seize power, overthrow state, etc. Of course if the state can prove intent, i.e., guilt, the punishment is more than harsh: death (anyway, in Pinas there’s no more capital punishment…, or is there for the military?)
But if the state cannot prove the intent, then the group must be set free on techinality — they must be turned over to military court instead for, say, the downscaling of charge to disobeying an order?
(Fundamentally, if there was no intent to seize power by force and arms, the adventure could be classified as mutiny…)

A crime requires two elements – the intent and the prohibited act. Criminal law is strictly construed (interpreted) as against the State. So if the act is not in the law, then there is no crime.
Now when the law makes an enumeration, it is presumed that the enumeration limits the things to those enumerated. There is valid reason in the case of the crime of coup, because not all attacks are directed against the State. If I attack a church or mosque, for instance, it is a hate crime, not a coup or rebellion, because churches and mosques are not seats of government.
So Noy is correct here. In fact, that, I believe is the basis of the defense of Trillanes, as mounted by his defense counsel. There were two elements of the act of coup missing. There was no attack on an enumerated building, and the intent was not to take the reins of government, but to seek changes in military administration.

The government can always file a motion to dismiss.
Private complainants of crimes do this as well, when they file what is called an affidavit of desistance, and then the defense counsel moves to dismiss on the basis of the affidavit of desistance.
When the government moves to dismiss, and it is granted, then that will be “with prejudice”, meaning, it cannot be filed again, on the basis of double jeopardy. Jeopardy already set in when they were arraigned, and trial commenced.

Actually, to be perfectly honest, at the beginning, right here in Ellen’s blog many years ago, I had surmised that based on the missing ingredients/elements, attack on airports, communications center, etc., I wrote that it couldn’t be coup d’état.
I then did further research on the matter — there were two replies/thoughts coming from UK military and US military (NATO legal dept), simply put: with all the other elements present, to prove attempted coup d’état, state or military court must prove that the intent to seize power was the overriding principle of the act.

I was asking that, i.e., if RP military still has it, because it doesn’t always follow that just because capital punishment has been abolished in civilian law, military also automatically abolishes capital punishment.
UK capital punishment was abolished for murder in the 60s but UK Articles of War did not do away with the death penalty automatically. It still existed in the UK military until some 10 years ago.

Funny enough, the original Articles of War (Royal Navy) which still rules the Navy still carries the death penalty but as to whether it would be applied even for the most heinous crime… I don’t know.
(The Articles were originally established in the 1650s, amended in 1749 (by an act of Parliament) and again in 1757. It is an amazing document to ponder, especially the number and degree of offenses which were punishable by death.)

Note the absence of two elements of the offense.
1. The building attacked (hotel) is not enumerated.
2. The purpose was not to seize or diminish state power, but to ask for reforms in the military.
The law was passed in reaction to Gringo’s serial coup attempts. Nothing in the acts of Trillanes’ group resembles Gringo’s naked attempt to grab power.

Even some of the winners admit there were frauds. As the investigations go on, there are more questions than answers about the recent election.
Let’s not go far. Case in point is Erap Estrada. How did he lose in Rizal and Laguna the latter of which his nephew ER Ejercito won by landslide as Governor? Those two have been Erap’s bailiwicks for many years. Worse, Erap placed third in San Juan where his son JV won as Congressman and mother Guia Gomez won as Mayor.
To find out if indeed there was massive cheating and fraud last election, we need to seek INC’s help by asking them to share with us the number of their members’ votes that were counted. Since they voted as a bloc, the areas or barangays where many members live could serve as evidence. In one recent TV interview, QC Rep. Mat Defensor said a candidate who he helped complained about getting only 9 votes in one Barangay majority of the residents of whom were INC members. The candidate verified this with the members and they told him all of them voted for him since he was endorsed by INC.
By the way, losing QC mayoral candidate Mike Defensor also complained about poll fraud. For protecting and defending GMA in 2004 election “Hello Garci”, Mike should be the last to complain.
There is a more substantial reason why the government should file a motion to dismiss. Coup is a political crime. That crime was forgiven by the sovereign people by their direct act, when they voted for Trillanes. The desire to anoint a representative and the desire to punish are contradictory; so one must prevail. Now the election of Trillanes is a direct act of the sovereign, while the enactment of the Revised Penal Code is the act of representatives of the people. A prosecution on the basis of the Revised Penal Code, as well as a judgment based on the Revised Penal Code is an enforcement of the act of representatives of the people. Between the principal (sovereign) and the agent (Congress), obviously the agent must yield.
Unfortunately, in the case before the Supreme Court, asking for bail, Carpio-Morales penned the decision denying bail. Nobody dissented, not even the liberal-posturing Reynato Puno. He was for obeying the voice of the people in the case of JDV’s cha-cha, lampooned by Carpio as a fraud. Yet he did not abide by the voice of the people when they forgave Trillanes and voted him into office. Carpio-Morales is also the ponente of the Francisco case, which got Davide off the hook, and allowed the “impeach-me” tactics that inoculated the Glue.
No, I am not a fan. She is not in the same league as JBL Reyes, Alejo Labrador, and CJ Cesar Bengzon. Among the recent crop, I like reading Justice Carolina Grino-Aquino, and Justice Vicente V. Mendoza.

Your brother is right. It’s 99.9% easier to cheat in an automated election than in manual. It’s not only easier, faster but more efficient and much easier too to get away with it without a trace if the operator is efficient. The dagdag-bawas operation is a piece of cake done in minutes compared to the manual which you have to sweat it out for weeks to arrive at a figure.
I just didn’t want to come in first about this thing but my son who is a software engineer/programmer at Microsoft told me about it even before the election. He said that whoever holds the key, whatever that is, or have access and connections with the commission or operators and has a lot of money will win the election. Of course he is talking about the well-documented and well-known cheating operations in every Philippine election. He ended by saying: “you can trust the machines but not the operators; whatever the input is the output either thru hacking or pre-programed and loaded pcos.
The operators made a very big blunder in their operation. They did not consider the bailwick of Erap that is San Juan and they put him in third place. In a hundred times that he will run for any local or national office, San Juan will never go to anybody but Erap. Erap is San Juan and San Juan is Erap.

On #29: I have always doubted election results in the past. The cries of losing candidates seemed all too plausible with the process of manual counting. As the results of the automated election were being made public as the counts were transmitted, I began to have hope. I imagined candidates who no longer used their time planning to rig the election and buy votes but instead focus on the program. I imagined sitting officials having care with their work, since they must win by the will of the people and not in any other way. Perhaps this is why I have been resisting the cries of foul in this election. As a business entity, Smartmatic would do better if they prove that they can handle such a project. With all the expertise they have shown, they have shown that they are not a fly-by-night company. As such, they would want to have a good reputation to be able to clinch other big contracts. The whole world was watching and congratulated the Philippines in this election. Smartmatic would surely lose ground in their business if they were proven to have been involved in election fraud. In the case of Erap, I would like to believe that even if the people love him for what he did for San Juan, they recognize that he has been found guilty of the crimes he was accused. If this is true, then we may be moving away from the patronage politics of the past. In any case, PPCRV was present during the audit. As an independent body, they have also declared that there has been no fraud. But it would benefit the country greatly, if the tests were also done for the contested areas, shown live on nationwide TV. The truth will unite the country. Complaint and whine are two different things. Complaint when face with irregularities committed is a means of calling attention that some things need to be straighten; and whine without any reason at all except to make a scene means you are insane.
Others don’t want to hear complaints and instead want them to be silent and join the no- talk-no-complaint club, maybe for the sake of unity and peace. But attaining peace and unity by sweeping reports of tainted election under the rug is not an option, or else we will be back where we came from before the election. This is not a matter of who won or lost, but it is about cleaning and making right what’s wrong with Philippine elections.
And that’s what makes democracy healthy. We are not in a communist country. We have freedom to talk and complain about how the government conducts its business. Being silent and just sulk in a corner inspite of piling reports of irregularities mean coddling and abetting the perpetrators of crime. Being silent and just minding your own business, for me is worse than a rebel who knows how to fight for their rights and beliefs. By being silent in the face of fraud being committed does not in anyway contributing something good but encouraging more of the same in the future knowing that they can easily get away with it.
Maybe silence is bliss when it’s all about “peace”, when people just go on with their lives without care on how they are being subjected or cheated by the powers that be.
Yes indeed, silence is bliss when people forget to talk and complain, just like the subjects of North Korea.
