Arroyo appoints Corona as new chief justice

President Gloria Macapagal-Arroyo on Wednesday appointed Supreme Court Associate Justice Renato Corona as the incoming chief justice upon the retirement of Chief Justice Reynato Puno on May 17.

Corona was appointed associate justice by Arroyo on April 9, 2002. He graduated law from the Ateneo Law School in 1974. While studying, he also worked full time in the Office of the Executive Secretary. He ranked 25th in the 1974 Bar examination out of 1,965 candidates.

After law school, he studied Master of Business Administration at the Ateneo Professional Schools and in 1981, he was accepted to the Master of Laws program in Harvard Law School, where he focused on foreign investment policies and the regulation of corporate and financial institutions.

In 1992, he joined President Fidel Ramos as Assistant Executive Secretary for legal affairs. Two years later, he was promoted Deputy Executive Secretary and eventually became the Presidential Legal Counsel.

After Ramos, he was invited by then Vice President Arroyo to become her chief of staff and spokesman. When she assumed the presidency in 2001, he became the Presidential Chief of Staff, spokesman, and later as acting Executive Secretary.

He became a faculty of Ateneo Law school, teaching Commercial law, Taxation and Corporation law.

He was born on October 15, 1948 in Tanauan City, Batangas. He is married to former Cristina Roco and they have three children.

This is the first time that there is a “chief justice in waiting.” Before, presidents announce their choices for the chief justice post upon the retirement of the sitting chief justice.

The appointment of Puno’s replacement has been the most contested, with some saying that President Arroyo can no longer make the appointment due to the ban under Section 15 Article 7 of the 1987 Constitution which provides that only temporary appointments can be made within two months before the national elections.

But the Supreme Court in its March 17 ruling said that positions in the Supreme Court are exempted from the appointment ban.

Constitution expert Joaquin Bernas also said that there can be no appointment without a vacancy.

    “Her appointment of a Chief Justice in waiting is at the very least inappropriate. Chief Justice Puno’s term has not ended. There is no vacancy to be filled.

    “There is still time for Mrs. Arroyo to reconsider her decision. We hope she will choose not to add another burden on top of everything else she will be leaving behind. She should instead concentrate on ensuring a smooth transition.

    Akbayan Party-list, belonging to the staunch opposition against Gloria Macapagal Arroyo’s midnight appointment of the country’s top magistrate, called on Associate Justice Corona to “rise above personal loyalties and reject this appointment that is in brazen disregard of due process.”

    Taking advantage of the public’s focus on the canvassing of votes, Arroyo appointed Corona as the successor to Chief Justice Reynato Puno upon the latter’s retirement on May 17, 2010.

    His track record as an Associate Justice clearly identifies Corona as one of Arroyo’s operators in the Supreme Court, voting in favor of the vested interests of Arroyo and her allies in the cases that were brought to the Supreme Court.

    “Corona’s appointment is another instalment in her efforts to extend her political influence and power even beyond her presidency,” Akbayan Party-list Representative Walden Bello said.

    According to the Akbayan Representative, Arroyo is doing everything she can pre-empt prosecution and perpetuate her hold on power, especially that it is now likely the next administration will see to it that she pays for all the cases lodged against her.

    “Having the Supreme Court beholden to her will definitely give her an edge over the incoming president that is sure to make her accountable for all her transgressions against the Filipino people,” Bello pointed out.

    Bello appealed to the Corona’s sense of decency and refuse Mrs. Arroyo’s appointment.

    “Thus far, the elections have succeeded in providing Filipinos a chance at real reforms,” Bello said. “By accepting Mrs. Arroyo’s appointment, Associate Justice Corona would be sacrificing the interests of the Filipino people to protect the interest of his patron.”

    “If he has any sense of delikadesa, Associate Justice Corona must let the incoming president determine the next Supreme Court Chief Justice,” Bello concluded.

    Akbayan Representative Risa Hontiveros today called on Supreme Court Associate Justice Renato Corona to decline his appointment as Chief Justice by Gloria Macapagal-Arroyo. “It’s a time for hope and renewal and I’d like to give him the benefit of the doubt that he will uphold the best interest of the country by refusing the appointment,” she said.

    “I am hoping that he can rise above personal ambition and whatever loyalties he has to the President,” said Hontiveros. “Otherwise, he will only further compromise the integrity and credibility of the Supreme Court.”

    Noting the timing of the appointment, Rep. Hontiveros said, “This shows that Mrs. Arroyo has truly mastered the art of distraction. She chose to announce the appointment just when everyone is focused on the election results and with most of the people in a jubilant mood.”

    “Considering Justice Corona is only 61 years old, this could well mean another eight years of protection for Gloria Macapagal-Arroyo in the Supreme Court,” she added

    Before his appointment to the Supreme Court in 2002, Justice Corona served as Mrs. Arroyo’s spokesman, chief presidential legal counsel, acting executive secretary, and presidential chief of staff. Among the current members of the Supreme Court, he is identified as an administration ally having decided on cases favorably to Mrs. Arroyo.

    “Justice Corona is not without the option to decline the appointment and wait for the incoming administration to name the Chief Justice – and that would be the decent and constitutional thing to do,” added Hontiveros.

After almost Ten Years in Power, she lost all her bearings and she will be surprise how will it be to be just another Congresswoman and nobody will give too much attention to Her after give or take a few months, unless she still got the Billions to feed the Birds.

    Gusto kasi ni Gloria na magkaroon ng utang na loob sa kanya ang Cheap Justiis para nga naman pag-sampa ng mga kaso sa kanya ay medyo may impluwensiya siya. Remember that majority pa rin ng SC justices ay mga bataan niya. There is power in numbers.

    Hindi kailangan ni Noy na sumumpa sa harap ng Cheap Justice or Chief Justifier. Puwede siyang manumpa sa isang associate justice, RTC judge, or even a notary public.Sinabi lang sa Saligang Batas na dapat manumpa, pero hindi binanggit kung sino ang pagsusumpaan.

    Article VII, Section 5. Before they enter on the execution of their office, the President, the Vice-President, or the Acting President shall take the following oath or affirmation:

    Kung may naglilingkod pa sa mga inappoint ng Nanay niya, whether Court of Appeals or RTC, I recommend na doon siya manumpa.

    Because of this, PBA president and former Ombudsman Simeon Marcelo urged Corona to reject the appointment, especially since he, Corona, is “tainted” by his close association with President Gloria Macapagal-Arroyo.

    “There’s culpable violation of Constitution in accepting the appointment because the SC ruling is not yet final. I will consult with board of PBA on this issue but personally I think an impeachment case should be filed,” Marcelo said, adding that he himself would support the impeachment.

    My reading is different. A decision has already been rendered. Until the Court reverses itself, the decision enjoys the presumption of validity. It is the movants (who filed the motion) who have the burden of getting a reversal.

    Until reversed, the decision stands. So walang culpable violation diyan.

    Note that the Supreme Court ordered the submission of the JBC list. That indicated a green light from the Court to submit the list, and impliedly, for the President to appoint.

    Hindi ako agree, sa decision, but there is no way you can reverse, considering that there is only one dissenting opinion.

    Yung impeachment, problema din, because there will be no basis. Kung hindi sana nagkaroon ng Davide case, then it could be said that the Senate alone decides the boundaries of impeachment. Yan ang rule sa America, kung saan kinopya natin ang impeachment concept. There is no judicial review of the impeachment process, because it is a political, not legal process. But the Senate, headed by Drilon, yielded to the Supreme Court.

    Corona should not accept his appointment. Binoto ng tao si Noynoy dahilan sa pangakong revamp ng Judiciary para maayos ito. Kung tatanggapin ni Corona ang posisyon, para na rin tinanggihan ang mga pinoy ukol sa pagbabago at isa pa, di magandang tingnan ito para sa kanya. Dapat makita ng mga pinoy ito at ni corona mismo!     Hindi ba pwedeng kasuhan sa IBP ng disbarment case si Corona? Isama na rin yung lahat na bumoto na pwedeng mag appoint si GMA ng CJ.

    Read today’s Inquirer opinion by Belinda Olivarez-Cunanan:

    “In the first place, where does one question the constitutionality of the chief justice’s appointment if not before the same Court which, by a vote of 9-1, recognized the President’s power to appoint the chief justice. There’s also the political angle. The automation process proceeded with relatively fewer glitches than people feared, winning the confidence of the Filipino people and praises from around the world. Most losers have conceded like statesmen and citizens have welcomed Noynoy’s victory. To go after the new chief justice just because The Firm didn’t get its candidate appointed will put the nation at cross-purposes again.

    Besides, the political situation could heat up because of the very tight race between vice-presidential candidates Jejomar Binay and Mar Roxas. Who knows what imponderables could happen? It’s still better to have an appointed chief justice at the Court’s helm.”

    Sorry to most bloggers kung iba ako ng opinyon sa inyo but I agree with Ms. Cunanan’s comments na for all intents and purposes, there is a legal basis to appoint a new CJ. No less than Atty. Estelito Mendoza who requested the SC to appoint a new CJ must be recognized. Yung mga nagsasabi na bawal o hindi pwede, sinasabi nila to para pauupuin si Justice Antonio Carpio once Noynoy was elected. But come to think of it, di kaya naman magkaroon naman ng utang na loob kay Noynoy ang bagong CJ kung sya ang mag-appoint dito. In other words, people who are against the appointment say so because they want somebody na maupo dyan na tatanaw ng utang na loob sa kanila. Di naman tama yun.

    As an example, yung Hacienda Luisita issue. do you think a Noynoy-appointed CJ will finally lift the TRO sa Hacienda Luisita para madistribute na finally sa mga farmer-beneficiaries?

    Another point is yung dikit na laban nila Binay at Roxas sa pagka-VP. May mga pwedeng mangyari na baka kailanganin ang CJ to settle the issue especially if either Binay or Roxas lose sa pagiging VP. Kaya dun sa mga against sa appointment ni Corona, hope ymaging objective tayo na mas mabuting mayroong CJ kesa wala. kung May 17 mag-reretire si Puno, there is still 1 1/2 month bago makaupo si Noynoy. Matagal pa yun at maraming pwedeng mangyari na baka kailanganin ang CJ. Thanks guys.

    We can take out all the legal and political considerations in the appointment made by GMA as it boils down to one and only thing, i.e. propriety.

    A Chief Justice vote is just one vote in the decision. He is not the sole arbiter in any case assigned to the Court, whether sitting en banc or a division. He alone cannot decided whether to lift the TRO or to resolve any issue in the VP votes.

    Kasi nga galing tayo kay GMA ng 9 taon na kung saan lahat ng appointments ni GMA ay may kapalit or for political consideration, hindi natin pwedeng agad agad iattribute ang ganitong style kay Aquino, na hindi pa nga na poproclaim.

    Yang The Firm na yan, sinabi na rin ni Corona yan laban kay Marcelo, ngayon iyan na rin ang linya ni Cunanan. Mabuti nga hindi sinabi ni CUnanan na ang information ay galing kay Mr. X na mataas ang pwesto sa gobyerno na nakasama nya sa dinner sa London sa isang party para kay Mrs. Y na siya namang kaibigan ni Ms. A na ngayon ay kasalukuyang nakaupo as Secretary of Department of LMNOP na sya namang nakasama ni Cunanan bilang sponsor sa kasal ng mga mayayamang lahi sa Province of QRS.

    sa isang banda… maganda din yang pinalabas na pagtutol ni Marcelo sa pag appoint ni Gloria sa chief justice para magkaron ng pagasa ang mga mamamayan na kalampagin si Corona para makapagisip at huwag tanggapin ang appointment… mukhang ang pagreject na lang talga mismo ni Corona ang natitirang paraan pra maiwasan ang pagdududa ng mga mamamayan sa Supreme Court at magtiwalang lubusan muli sa kanila…

    Naway magsakripisyo si Corona para sa bayan sa pamamagitan ng hindi pagtanggap sa posisyon bilang CJ…

    Well kung ganyan ang argument, Noynoy might as well fire all GMA-appointed justices including Corona and have a new clean slate. I think Drilon and the other legal experts at LP should give Noynoy a good legal advise on this. Yung talagang tamang advise at within the Constitution. It’s not good na magkamali si Noynoy sa isyung ito.

    Pareng Phil, sa palagay ko hindi naman yung appointment per se ang pinupuna kungdi yung issue na dapat bang mag appoint ng Chief Justice sa period na pinagbabawal ng Saligang Batas at batas.

    Kung si Puno ay nagretire nung January 12, 2010, wala namang aalma kung mag appoint si GMA ng bagong CJ bago mag March 12. Impunity, ika nga.

    I think nasagot na dito na hindi mandatory na ang CJ ang mag administer ng oath ng presidente

    The Cheap Justice, when in the majority, may choose to write the ponencia (opinion in the US). In fact, in the book “The Brethren” (non-fiction by Bob Woodward, not fiction of John Grisham), it is told that Burger used to change votes when the liberals won, so that he could assign the opinion writing to himself, and water down any liberal decision. He did not want the ultras, Hugo Black, William Douglas, or William Brennan to write the opinion, and declare sweeping liberal doctrine.

    The Cheap Justice is also the ex-oficio Chair of the JBC, and can wield a lot of clout in the appointment of justices and judges as well as the Ombusman and Deputies. That is one vote for appointees of Noy. The anti- Noys need all the votes they can get, because they lost the DOJ vote. Noy will certainly replace Agra. The private sector appointee will also be Noy’s, as well as the retired justice, and the rep of the academe.

    The private sector rep serves for one year, so an appointment may be made soon. The retired justice serves for two years, so baka patapos na rin.

Tinitira natin si Gloria na di marunong sumunod sa batas, heto nanaman tayo. The SC has already ruled na pwede ngang mag appoint si Gloria ng bagong CJ ngayong eleksyon so thats it. Ngayon kung sa palagay natin eh mali ang desisyon, eh di mag petisyon ulit ang mga kumokontra and hopefully the SC will reverse it’s decision. In the meantime, sundin natin batas.

    Nadisappoint ako kay CJ Puno. Hindi sya sumali sa deliberation ng kaso tapos heto nagbibigay na ng opinion tungkol sa pag appoint ni GMA kay Corona. Wala man lang syang nakitang mali sa appointment ni Corona as Chief Justice in Waiting bago pa man din sya magretire.

    Nag iwas pusoy si CJ Puno na hindi yata naayon sa lagi nyang pinagmamalaking moral courage at gatekeeper ng transparency. All this time, in favor pala sya sa pag appoint ni GMA during the constitutional ban. Mahiya naman sya kay Justice Morales na nagpakita ng balls laban sa isyu.
