Kahapon, nagdesisyun sila na maari daw mag-appoint si Gloria Arroyo ng kapalit ni Chief Justice Reynato Puno na magre-retiro sa Mayo 17.
Siyempre, sigurado yan i-appoint ni Arroyo ang kanyang paboritong Supreme Court justice na si Renato Corona. Kaya sigurado yan, kahit wala na sa Malacañang si Arroyo, protektado siya sa mga kaso niya.
Nandiyan si Merceditas Gutierrez na protektor ni Arroyo at ng kanyang pamilya sa Ombudsman. Ngayon nandyan si Corona ang magiging hepe ng Korte Suprema. Ayos ang sambayanang Pilipino.
Tandaan nyo itong siyam na mga pangalan ng Supreme Court justices na kasama sa pagbabastos ng demokrasya at ng taumbayan: Roberto Abad, Lucas Bersamin,Arturo Brion, Teresita De Castro,Mariano Del Castillo, Jose Mendoza, ,Diosdado Peralta, Jose Perez,at Martin Villarama Jr.
Isa lang ang may tapang na nagsabing hindi pwede, babae pa: Justice Conchita J Carpio-Morales.
Ang dalawa naman, naduwag hindi pa ra panahon para magdesisyon: Justices Presbitero Velasco at Antonio Eduardo Nachura.
Ang tatlo ay dumistansya. Naintindihan ko si Justices Antonio Carpio at si Renato Corona na nag-inhibit dahil silang dalawa ang nangunguna sa pinagpipilian. Ngunit si Puno, bakit siya mag-inhibit? Siya nga dapat ang mabigay ng liderato sa Supreme Court.
Kontrobersyal itong desisyun dahil nakalagay sa Constitution na ang president ay hindi na pwedeng mag-appoint dalawang buwan bago mag-eleksyun.
Ito ang sinabi ng Constitution: “Two months immediately before the next presidential elections and up to the end of his term, a President or Acting President shall not make appointments, except temporary appointments to executive positions when continued vacancies therein will prejudice public service or endanger public safety.”
Ang dalawang buwan or 60 na araw ay nagsimula na noong Marso 11. May dati ng desisyun ang Supreme Court na illegal ang “midnight appointment” na siya ang tawag sa mga appointments na ginagawa ng pangulo malapit na siyang aalis.
Pinagpipilit ito ni Gloria Arroyo kahit illegal dahil alam niyang sasampahan siya ng maraming kaso sa maraming karimen na ginawa niya sa sambayanang Pilipino. Unang-una doon ang pandaraya sa eleksyun ng 2004. Nandiyan ang fertilizer scam at NBN/ZTE.
Ang delikado dito sa desisyun ng Korte Suprema ay ang lalong pagkawala ng tiwala ng taumbayan sa kanila bilang pinakahuling takbuhan para makakuha ng hustisya.
Sira na ang Comelec. Sira na karamihan sa military. Sira na Kongreso. Sira na ang bureaucracy.
Ngayon sira na lalo ang Korte Suprema.
Saan na tatakbo ang taumbayan na naapi? Nakakabahala ang sagot sa tanong na ‘yan.
Titingala na lang tayo sa langit.
Yan ang ipinang-gagalaiti ko tungkol sa pag-iwas ng isang lider sa responsibilidad sa panahong dapat niyang ipastol ang mga alaga. Kung ipinagmatigasan sana ni Puno ay walang puwang upang maipilit ng mga aswang ang kanilang kagustuhan sa pagbaluktot hustisya.
Bakit ganon, kung sino pa ang inaasahan, siya pang naghuhugas ng kamay.

Akala ko ang mga sira sa pag iisip ay nasa MANDALUYONG. Ano itong nangyayari sa bansa natin ngayon. Ang mga sira ay nasa Supreme Court pa. Nakuha na ni Gloria ang matataas na puwesto na nag papatakbo sa bansa natin. Sino kaya ang aasahan natin. Sa mga tumatakbo sa mataas na puwesto ay puro dalawa kara ang mukha. Lahat sila ay may lihim na connection kay Gloria.
Ellen, kung sakali bang matuloy at may bagong presidente tayo at bagong Ombudsman or mawala ang mga bata ni Gloria sa Tongress ay may pag asa pa bang ma impeach ang ilalagay niyang gagong SJ.

Hindi ko gusto si Erap pero pinabilib nya ako noon na sinunod nya ang seniority rule sa pagpili kay Davide bilang Chief Justice kahit may ibang manok sina Zamora. Si GMA, binaliwala ang lahat ng batas at moralidad at tuluyang winasak ang integridad at kalayaan ng Judiciary.
Kung ganito ang Supreme Court, malabong maparusahan at mahadlangan ang plano ni GMA after June 30.
Matagal ng sira ang Korte Suprema dito sa atin, nag-umpisa ito nuong pinayagan nila si Gloria na maging legitimate President nuong EDSA 2. Ang basehan nila ay ang diary ni Ed Angara at ang pagbaba daw ni Erap sa pwesto ay isang constructive resignation.

What the JBC should do is ask NoyNoy to approve a list of nominees and then submit those Noynoy-approved names to GMA.

Is CJ Puno expecting any political appointment from the Administration and why he did not object to the Majority decision at all? Sometimes to be on the safe side is repaid back. But to give up your principles for that matter would not be becoming of the Chief Justice who had distinguished himself all his Tenure in the high court. Hope he has some good reason for not voicing at all.
But what is the Law that is in question here against the Provision of Section 15 Article VII of the Charter? Did the SC made a ruling on the Provision itself? (that would be funny, though)
Even a student lawyer would know that you can not make a ruling without a case. And the Charter preclude the congress to pass any law that will violate the above provision that will allow the sitting President to conduct “midnight appointment” except as noted in the provision, Temporary Positions in the Executive if the situation demands…a very Clear and concise and beyond any interpretation…
But it is becoming a custom, tradition to violate just about everything nowadays, from an oath of office, even executing an affidavits, breaking all kinds of laws, from traffic laws, to municipal by-laws, and worst getting away from them all. And the BIGGEST of them all the violation of the fundamental Law of the Land and with very convincing “justifications”…this decision will come back to haunt all concern, mark this word.
Vic, the official line of Puno (why he inhibited) is that he is an ex-officio member of the Judicial and Bar Council, which is a respondent in the case.
But that is just a secondary job/responsibility. His primary job is that of a magistrate. He should have exercised his leadership, if he strongly believes that the decision endangers democracy.
The scuttlebutt is that he is dislikes Carpio.

Ang mga judges ay nagbotohan kaya dapat na igalang ng mga judges na hindi sangayon sa desisyon ang nanalong desisiyon at wag na silang pumutak ng pumutak na ikakasira ng buong SC. When the judges join the process they should accept the result with finality.
Let see another scenario: Halimbawang nanalo ang hindi pwede, bakante ngayon ang Chief at halimbawang si noynoy ang nanalo sa eleksyon. Kanino ngayon manunumpa si Noynoy e walang chief? at papano makakaappoint si noy e hindi pa siya nakakapanumpa?

Kung May 17 magre-retire si Puno, meron pang hanggang July 16 para mag-appoint ng kapalit. May ambiguity ba diyan? “from occurrence” ang sabi, hindi “before occurrence”.
Meron pa bang dapat na mag-interpret dito e malinaw na may prohibition as to time at as to the arm of gov’t involved. Hindi naman executive ang Supreme Court.
Yung mga gustong magpagago, kayo na lang.
dahil wala ng tiwala ang pinoy kay gma kaya lahat ng mali ay sa kanya ang bagsak. hindi rin naman ako magtataka kung may kamay ni arroyo ang pangyayaring ito tulad ng hello garci.
Isa pa, hindi pa naman justiciable ang kaso dahil:
1. Hindi pa naman retired si CJ Puno.
2. Wala pang isina-submit na listahan ang JBC kay Putot.
3. Wala pang ina-appoint na CJ si Putot.
Tutal babuyan na rin lang ang laban, patulugin na lang ng JBC ang listahan kanggang mag-expire si Putot sa June 30.

-Secretary of Justice (Agra)
-representative of both houses of Congress (Escudero and Defensor)
-a representative of the Integrated Bar of the Phils. (Atty Castro)
-a professor of law (UST’s Dean Dimayuga)
-a retired Member of the Supreme Court (ex-CJ Hermosisima)
-a representative of the private sector (Justice Lagman)
Why might businessmen be interested in an issue that seems to be an inconsequential question of law? Businessmen like Lucio Tan, Danding Cojuangco, et.al. After all, like the Tribune and Ninez Oliveras opine, it is only one vote.
Business cases normally do not pose novel questions of law, so hardly are they decided en banc. They are decided by divisions.
Now if Renato Corona were the CJ, then he will have the power to assign cases to divisions. Tie this in with that administrative complaint about Renato Corona being for sale.
So if Corona were CJ, the second division will be headed by the second most senior, Carpio. The third division will be headed by the third most senior, Carpio-Morales. So that takes care of the potential dissenting votes. The rest of the justices are from the puppet Sandiganbayan, and that brood of vipers called the Court of Appeals.
So Corona gets the business cases, and he gets a division of compliant members.
Aah the wonders of a seemingly technical issue of law.
Sax, how do you count the 60-day ban? Does it start on March 10 or March 11 (as Ellen says)? I’m asking because Raissa Robles says the ban started on March 10 – the day Ibrado retired & also the day Bangit was appointed.

Raissa was probably counting calendar months, so you go back two months from May 10 (election day), April 10, March 10. There are, however, 31 days of March. Ellen was counting sixty days, not two calendar months.
The Constitution says two months, not sixty days. Article 13 of the Civil Code, however, states that

would suggest a permanent professionalized vetting body, composing of members from different professions and civic bodies, and clear guidelines of who can qualify for the positions. And the Best is to represent the Regions as to their Residence and place of Practice and of ethnic origins.
Let us say there are 15 Justices, each should be apportioned to the country’s different regions say, 4 from Mindanao, 5 from visayas (to be proportioned to the provinces in alternates, the same in every Region) and the Rest maybe assigned to the Luzon region. So when Justice Puno resigns, candidates for his replacement will come from his region.

Now READ this, Section 15, Article VII as amended…the sitting President is now not precluded to go ahead with the Midnight Serenade and other than the Temporary Positions in the Executive Branch, when vacancies may put the national security in peril can now Appoint Her Favourite Pet to Chief Justice within the Prohibition Period. (this amendment is subject to amendment by the incoming President, and the SC will oblige)
Maybe, the 14 little Indian justices were very desperate in keeping gloria beyond her ninakaw na term.
