Gloria’s justification of Proclamation 1959

Trillanes on Maguindanao martial law: ‘GMA can’t be trusted’

The primary issue at hand is not whether the declaration of Martial Law is the right policy to address the situation in Maguindanao. It is whether Mrs. Gloria Macapagal-Arroyo could be entrusted with such enormous power. Clearly, the answer is NO.

For the past nine years in office, GMA has not only abused all the powers vested in the presidency but also corrupted all the other institutions of government for the purpose of amassing more wealth and more power. Thus, entrusting her with even more power is a very dangerous proposition to even consider as it would likely be an opening that she is bound to take advantage of.

Moreover, based on the media reports, the AFP was already in control of the situation on the ground even prior to the Martial Law declaration.

In view of the above,

I hereby state my position to revoke Proclamation 1959 even as I exhort all my esteemed colleagues in the Senate to do the same and continue to guard against every possible insidious plot of GMA to perpetuate herself in power beyond the end of her term in 2010.

    The explanation is not convincing. Is this the kind of paper involving a delicate matter that serves as justification for the declaration of martial law?

    Where are the sworn statements of witnesses which will validate the claims of Malacanang. Where are the autopsy reports? Curiously, the sources of the arms and ammos recovered were not traced. Puro kwento na nga, mas exhaustive pa ang reports na produkto ng ibang investigative journalists.

    Bwiset!!! Kung mag aaply ka lang ng business permit sa maliit na sari sari store, karaming pinasusubmit at bawal ang kwento lang. kahit high school student kayang tapatan ang report na iyan.

    The Arroyo government evidences to justify “brewing rebellion” in Maguindanao province is based on fantasy and assumed armed uprising. There’s no independent report to confirm these sequence events. They even know the exact number of rebels and their armaments. This time they know how to count right. No dagdag-bawas scheme.

    Ms. Ellen, hindi yata nila mailagay sa report kung nasaan ang rebellion at invasion dahil WALA. Maski sila wala namang pruweba ang actual rebellion kaya nagkwento na lang ng events mula November 23. Baka nga nangopya pa sila sa mga new accounts sa mga dyaryo.

    Ang pinagtataka ko lang, nasaan si GMA? Puro Ermita ang nakikita kong nakapirma at sa TV puro spokespersons lang sa TV. Baka naman may announcement sa TV si GMA na hindi ko lang napapanood pa.

    Baka minumura na natin sa GMA, hindi naman nya alam na may martial law na sa Maguindanao.

    Sorry sa kadakdakdak ko dito. Sa Senate at Congress nga pala naka address yung report. Karamihan sa Senate at Congress tuta ni GMA kaya kahit gaanong kababaw ang explanation ang gawin ng Malacanang, oo oo lang ang mga hinayupak na yun. Mukhang masasama pa ang loob ng mga iyan at mapipilitan silang mag session sa Martes, maabala ang pamimili nila!

    the elements of invasion and rebellion are there in my view.

    Invasion -57 innocent people murdered in cold blood is an outright invasion to hold a territory. Not allowing any other candidates ( mangundadatu ) to challenge them thru legislative process such as an election is an invasion to take control of a territory and protect the interests of the invading entity ( ampatuan clan)

    rebellion is clearly explain from the pdf file. The are two elements of the crime- mens rea and actus reus.

    The facts strongly support the Mens rea ( mental state) . Example, the meeting and preparation of the crime . Actus Reus ( picture shows buried equipment and using PNP) is the actus reus or transferring the backhoe to the the grave prior to crime. The transfer is an act. Or ( Invasion ) For example. the act of preventing another clan to file candidacy by murdering the people.

    Mens rea and actus reus are justified … Therefore, if it involves armies against our law of the land, the elements of rebellion can be explained that Murder is the actus reus of rebellion. The hiding of the ammunitions and the lack of support to the investigations is a mental plan-mens rea of the crime Rebellion.

    Both Mens rea and actus reus cannot be divorced from each other for criminal charges. In my opinion, the ampatuans committed both rebellion and invasion.

    FYI. Invasion can also be interpreted as protecting once territory that does not belong to them legally but belongs to the Repubic of the Philippines.

    The elements of Rebellion-

    Mens REA: ( mental State) – the texting of death threat. Threat is also a good example of a mental state but it can also be interpreted as an act. The use of personnel to text local judges is an act. Actus reus of the crime.

    Due to the fear, the closing of some local offices is also a good example of the actus reus.

    The filing writ of Amparo can be interpreted as a state of mind that buying time may help plan ( thinking) for a local war- the mens rea of rebellion.

    The hiding of the ammunition in different places not allowed by law is an action ( the actus reus of the crime Rebellion. ).

    I’m not a lawyer but I did study criminal law , contract and tort Law. Hopefully I will get back to law school and maybe able to explain what the hell is going on…

    But remember… the motive of the Martial law can also be interpreted as the mens rea of a future crime that we don’t know yet. But this mean it’s not only Gloria’s state of mind because according to our Constitution, Congress can intervene her state of mind. But what have they done? nag shopping nga sila..

    2. That the purpose of the uprising or movement is either –

    The MILF rose publicly and took up arms against the government (1st element). Their purpose was to remove from the allegiance to the government, the areas they hold (element 2a).

    Goyang aided and abetted in the removal of allegiance to the government of the Philippines, the area held by the MILF, when she excluded the area from the coverage of her martial law.

    So Goyang is guilty of rebellion.

    Goyang aided thru Exeutive 546 for the purpose of using armed men against insurgents.It is constitutionally written. Murdering innocent people did not fall to Goyang’s Order nor allowed by the Constitution. The hiding of the ammunitions in scattered places, using provincial funds to purchase excessive ammunitions is not written in our Constitution. Therefore, it was illegal which constitute the mental state and the act of the crime.

    All happened within close proximity to where the presiding governor lives of which he has a direct duty to govern.

    If it’s a fact that Goyang made him who he is now , it will still not excuse him from disclosing Goyang crimes from public at that time cheating happened. It was his direct duty to report while it was brewing.

    Time and Proximity of the event are also elements of the crime. Anong ginawa ni Ampatuan noong cheating? He conspire against his own people for his own benefit.

Our courts don’t accept self serving definitions of felonies since it is the law that defines and provides for their punishment – the revised penal code and special penal laws! Everyone should think of Ampatuan and warlord-ism, maguindanao mass-murder, Reproductive Health, Superferry14 terrorism, Princess Stars ferry sinking … but when election day May2010 comes, the foremost issues (in my opinion) are jobs-jobs-jobs and improved education for Pinas youth (more schools, more teachers, better supplies). As Canada Ehhh in #15 says, lubog pa rin sa kahirapan ang mamayang Pilipino. Pinas needs jobs (and not jobs in Abu dhabi nor Singapore nor Toronto nor Hongkong)… Pinas needs jobs in Pinas.

  26. May duda akong hindi magkakaroon ng quorum sa congress to debate on the proclamation of martial law. Pero halimbawang magkaroon, may indikasyon na majority in the senate will thumb it down pero dun sa mga taga Bastusang Pambansa, ang maingay lang at tahasang kumukontra ay ang mga militant congressmen. Ang ganyang scenario ang dapat abangan lalo na yung mga running for reelection, yung mga dating PALAKA na tumalon na sa ibang bakuran. Alamin natin kung saan sila papanig. Kapag aprub sa kanila ang pagpapairal ng martial law, totoo ang suspetsa na pakawala lang sila, mga trojan horses at kakampi pa rin ni GMA. At kung muling mahalal, expect them to be back to the arms of GMA dahil kailangan sila sa pagsusulong ng cha-cha. Sila ang tunay na mga Paru-paro Buking.

    Next to the US, Pinas has more military exchanges with Aussie than with any other Western nation.

    The Aussies also have paid local assets in Pinas, reporting to them and being paid a monthly stipend. One of the paid “private” assets is a retired commodore. Another one is a civvie…

    Without the Martial Law, the risk that the Ampatuans with 800 armed soldiers can easily mobilized and may divide into smaller groups and multiply if the area is not secured. Who knows , they might join the muslim extremists.. lalong magka leche leche.

    I am in favor of martial law but one thing I don’t like is the penalty of the offenses. For Political crime such as rebellion, it can only impose one single penalty of reclusion perpetua ( life imprisonment) as opposed to murder with life imprisonment x 57 ( victims died.) Even if the house intervene to stop Martial law, the charges of rebellion might have been filed.

    In my understanding of life imprisonment for the powerful is a HOUSE with an amenities type prison . That’s not really prison plus the pardon. Just remember Jalosjos, Estrada and Teehankee.

    If we have to assume Gloria guilty of her crimes, she might also get the same benefits. Maybe a mansion , with champagne and maids to do her laundry? Not to mention becky belo to give her botox treatment.

    what should be our demand? are we going to tolerate this kind of penalty?

    Too much sound and fury has already been aired against the proclamation, but Gloria will never listen. She’s only interested in her own interpretation of the law and at the end of the day, that’s the only thing that counts.

    It’s a typical gloria thing, doesn’t care for anything but herself. Just brace and prepare to the prospect of no elections come May 2010 and Gloria’s reign till kingdom come.

    That’s the agenda behind the proclamation of martial law. Nothing else.

    There are 121,000 (more or less) officers and troops in the AFP… but only a fraction of that, and I mean a small fraction of that population, will be willing to rebel against the military hierarchy.

    So, even if for the sake of argument, they don’t like what they are hearing, difficult for a fraction of the military to revolt on their own. They need help!

One thing that everyone must be aware of is that Gloria is doing ALL the right things a de facto dictator needs to do to stay in power, to get herself firmly entrenched in a position where it will be difficult to get at her and more importantly, to avoid retribution when things go wrong her way … by getting officers and troops who will be loyal to her and most specifically, officers and troops who are ready “to shoot” for her The latter is key to her survival. (And by gum, she’s got them!)

    She’s the complete anti-thesis of Aung san suu kyi who doesn’t want to have anything to do with generals.

    We need martial law in Maguindanao like we need a hole in the head. It is not just unnecessary, it is pernicious. At the very least, it rewards the guilty. It gives GMA tremendous powers to do whatever she wants to do there, including bury the truth, which may not prove entirely figurative, about her role as Dr. Frankenstein in the creation of the Ampatuans. It reposes the cure in the hands of the source of the disease, it puts the solution in the hands of the originator of the problem. The very brazenness of the Ampatuans is a testament to GMA’s complicity with them. Writ large over their mutinous rage is the threat that if we go down, you go down with us. Martial law gives GMA the power to sew up the place, to blanket it in secrecy so that nothing escapes from it, not a cry, not a peep, not a dying breath.     Yup GIBO can win. Gloria remains the controller of the budget. House as “check and balance” is wishful thinking. The chicken has already been cooked in the kitchen. The people don’t have to eat but Mang Juan and Pedro will be bought and they may not understand the consequences.

    It doesn’t matter if Gloria will be convicted of her crime. She has the millions and she will enjoy the luxurious prison. 🙂

    Did they mean military offensive? That will require going near a government military installation, not some hicktown barangay. Pardon my dirty mind, but what offensive position can you take in a hicktown?

    Naka-dirty finger ba? Kaya offensive? Akma bang dumudyugdyug ng babae? Or were they defecating in public?

    Kung papalapit sa government building, I can take that as a military offensive.

    In effect, while martial law could be a “useful” tool in lawless Maguindanao, its implementation cannot be entrusted to Gloria.

    In any case, I do believe that Gloria is testing the waters in preparation for election 2010. She is preparing a kind of mindset for the population, i.e., if ever there’s “uncontrollable” violence and lawlessness in select areas in RP (especially in provinces that can yield high voting returns), she will whip up some gobbledygook of a reason, eg., purporting prevention of failed election, and impose martial law.

    Problem is when that happens, military can switch ballot boxes to award those boxes to whoever she wants to win (and presumably, it will be Teodoro).

    With a J-3 (operations, people, operations!!!), who is firmly entrenched in her corner, and who’s probably already sworn allegiance to Teodoro, things will be exciting.

    (Check out who the major service operations chiefs are — as well as the 2s, i.e., A2, G2, N2 and all sub-major service/divisional 3s and 2s, and find out if they are close to current J-3… to ensure that ops go as smoothly as planned as much as possible — that’s how it’s done…)

Remember that Gloria is doing all the right tactical things to get herself firmly entrenched in power — not necessarily to be president for life; she knows that sort of ambition will be next to impossible to achieve in Pinas today (America won’t go for that nonsense) but she must have another purpose, ambition, etc in life (politically that is) — gotta discover what that is.

    Problem is there’s bugger all one can do about it today. Because she’s always one step ahead, clearly doing things within the extreme limit of the law… and the biggest problem is you have an ineffectual Congress, a confused judiciary and a divided opposition, and most importantly, she’s got military officers down the line who are prepared TO SHOOT for her!

    I’d watch Teodoro… his “popularity” just might unbelievably “surge” close to election time.

    Baka naman may kilala kayo sa GMA 7 na pwedeng huwag isensationalize ang mga arms recovery operation sa Maguindanao. Don’t get me wrong, I am for the independence of media and its role in giving the people truthful information. during this dangerous time, circumspection should be observed specially when dealing with unverified facts.

    It was the segment in the 24 oras reported by Jun Veneracion and it was shown that recovery operations were undertaken in the middle of a field within the ranch of Ampatuan Sr. Suddenly, gunshots were heard. It was not verified who where those behind the firing of guns and it was speculated by Mr. Veneracion that probably they were supporters of the Ampatuans.

    I am of the opinion that there is no actual rebellion in Maguindanao but this kind of reporting gives some semblance to the existence of an actual rebellion in the area.

It is whether Mrs. Gloria Macapagal-Arroyo could be entrusted with such enormous power.” seems to point to a belief that martial law in Maguindanao (and by extension, wherever lawlessness is rampant) is an option he himself would not back out of… 🙂

  75. Whether justified or not, martial law is in place in Maguindanao where there many firearms, loose or government issued. We would like to hear or read that the military is not only after the Ampatuans but should also go after the Mangudadatus who were and still goody-goody with the administration. No doubt the Mangudadatus are also armed like the Ampatuans as covered by the EO promulgated by GMA supposedly to help the government go against the MILF.

When all is said and done, martial law was declared over Maguindanao because the local Maguindanao government (from governor all the way down to the courts to the baranggay captains) had been corrupted. Quickly arresting the Ampatuans and their goons or being able to quickly enter the Ampatuan farms to dig up the buried weapons was not possible given slow-justice, especially slow-justice corrupted by warlordism of that province.

    Reminder — federalism can not work in Pilipinas for at least twenty more years.

    Yes, that’s we’re expecting for the admin to do, disarm Mangudadatus and other groups even if they are their political allies. Kahit papaano, may na-accomplish at pwedeng ikatuwa ng kahit mga anti-martial law.

    To GMA and also GIBO, it is during their watch that the Ampatuans thrive and able to amassed wealth and firearms which some of our soldiers don’t have. Gibo cannot particularly feign ignorance on what’s going on there when he was DND Secretary. Sandamakmak ang intelligence funds ng AFP & DND, not to mention the Office of the President. As Gibo campaigns for the presidency, he should be asked why those firearms coming from the AFP arsenal were found with the Ampatuans. Given this scenario, what could we expect from Gibo as president?

    If we presume the suspicion of many, that the true reason for the imposition of martial law was to silence the Ampatuans, and recover the election materials in the hands of the Ampatuans, that has already been accomplished. The Ampatuans are in prison, and their aces have been taken (as reported by the Tribune). Their silence is assured.

    The short-term goal has been accomplished.

    If there is a long-term goal, it would be to have martial law in place when elections are held.

    So the strategist of Goyang may think, why don’t we lift martial law now? We can re-impose it later, sixty days before elections, when everybody would be busy campaigning. So we twit the oppositors by rendering both the Supreme Court case moot, and the Congressional deliberations as well. Then our people need not have to face the difficult situation of trying to win reelection with the handicap of an electorate displeased by the affirmation of martial law.

    Ano naisahan na naman tayo?

    Marcos had a smiling martial law. This woman has a snickering martial law.

    Ibrado can prevent this by having her arrested for culpable violation of the Constitution. I still dream of a Philippine military which protects the Constitution like the Turkish military does.

    Singson has as much armed goons and weapons as the Ampatuans. Singson was involved in many killings including the auditor Chan and the family members of Rafanan who’s now running for Governor. Take note of Singson’s silence on the massacre. Isa pa naman siyang Adviser on National Security. Kaibigang matalik niya ang mga Ampatuan.
    Hindi lang mga armas meroon si Singson; he also has a private zoo and his favorite pets are tigers. Ganyan kabagsik ang warlord, gambling lord at criminal lord ng Ilocos Sur.

    I doubt if the military actually arrested the Ampatuans or are protecting them. The high powered weapons found outside and inside of their residences were long known to the authorities. It was Gloria who gave the Ampatuans the permission to organized civilian militia to counter the MILF. Why are they now surprised to find such a huge number of weapons? If the Ampatuans are accused of massacre or rebellion, they must be detained in ordinary jails like other ordinary citizens. But no…they are placed in comfortable facilities. This early, Malacanang is warning that the trouble might spill over Metro Manila. It would be easy for GMA to claim that the supporters of Ampatuans are in Metro Manila and another “rebellion” reason would be used to declare Martial Law in Manila. Are we seeing No Election which many feared before?

  93. to saxnviolins at #82: I disagree you saying that “an electorate displeased by the affirmation of martial law”. Just think back to last week. A common message among the people commenting on this EllenT’s blogsite is this — why is GMA taking so long to respond to the mass-killings?

    That disgust and anger is shared by all Filipinos. And Filipinos are so overtaken with anger at the Ampatuans and the mass-killings that they are in favor of the martial law. Reason why Filipinos like it — the rapid arrest of the Ampatuans and the rapid raids into Ampatuan private property to confiscate the weapons. If the PNP were to wait for arrest-warrants, then walang mangyayari because of the Ampatuan relatives and clansmen in the Maguindanao courts and the various baranggays.

    Senators Legarda and Enrile understand the weaknesses of the arguments for martial law (one does not call martial law because newsmen had been murdered; one does not call martial law because of political murders). The members of Congress understand what their baranggays want.
