Dacers say Lacson OK as witness vs Estrada

Lacson not interested; denies participation

The daughters of Salvador “Bubby” Dacer will accept Sen. Panfilo Lacson as a state witness if he provides information identifying the mastermind of the abduction and murder of the publicist and his driver in November 2000.

This was disclosed to the Philippine Daily Inquirer by Demetrio Custodio, the lawyer of Dacer’s daughters, who filed a murder complaint against Lacson after former Senior Supt. Cezar Mancao’s earlier testimony that he had heard the then Philippine National Police chief issue the order to kill Dacer.

“We are willing to accept any witness who will lead us to the killer. If it’s [Lacson], it would be okay,” Custodio said. “We are hoping that he can provide us usable information. The last time [he took the Senate floor], it wasn’t quite definite.”

But Lacson is not interested.


Told by the Inquirer on the phone that the Dacer daughters were open to the possibility of his becoming a witness for the prosecution, the senator said: “How can I qualify as a state witness \when I did not have any participation or involvement in the disappearance of Dacer and [Emmanuel] Corbito?

“A state witness is one who is not the most guilty among the accused, and whose testimony is relevant and material to the successful prosecution of the case. I am neither of the two.”

In a privilege speech on Monday, Lacson suggested that deposed President Joseph Estrada had something to do with the twin murders.

He is to deliver another privilege speech next week.

Only after mastermind

“If [Lacson] can pin down the real mastermind, then we can use him as witness,” Custodio told reporters at the Department of Justice, where the preliminary investigation of the senator is ongoing.

“We are not persecuting anyone. We are after the mastermind of the crime,” the lawyer said.

Carina Dacer and her three sisters have asked the court to be given more time to file an amended complaint that would include Estrada as a respondent.

They filed the motion after Mancao—testifying at a hearing on his wish to be discharged as an accused and made a state witness—told the panel of prosecutors that Estrada was one of those who might know something about the Dacer-Corbito murders.

The panel, chaired by Senior State Prosecutor Peter Ong, Friday approved the Dacers’ motion, saying it was the prerogative of the complainants to amend their information.

The amended complaint will be referred to Justice Secretary Agnes Devanadera and Chief State Prosecutor Jovencito Zuño, who will determine whether it should be heard in the preliminary investigation of Lacson or in a separate proceeding, according to Ong.

On the other hand, Mancao’s lawyer Ferdinand Topacio has stated that direct evidence from his client pointed only to Lacson’s involvement in the twin murders.

On Wednesday, Sen. Jinggoy Estrada cited Topacio’s statement as the purported reason behind Lacson’s accusations against his father, the ousted President.

“In my honest opinion, as a lawyer and based on the evidence so far adduced in court by my client, Cezar Mancao, the only direct evidence with respect to the mastermind in the Dacer-Corbito double murder case pertains to … Lacson,” Senator Estrada quoted Topacio as saying.

He said Lacson wanted to paint his father as a criminal capable of ordering someone killed.

New witness

A woman who claimed to have seen then PNP chief Lacson and Bubby Dacer arguing in Batangas days before the publicist was killed is the Dacer family’s next witness against the senator, according to Custodio.

The woman, Lymith Bagual, has submitted a statement narrating how she saw Lacson and Dacer having a heated exchange at a resort.

“It’s circumstantial evidence,” Custodio said, adding that the woman would be presented to the Department of Justice panel at the next hearing scheduled on Sept. 28.

Asked to comment, Lacson said: “The planned presentation of a supposed new witness to testify against me, as announced by Attorney Custodio, is their ploy to convince me to agree to their suggestion to turn state witness.”

He described the ploy as “too elementary, if not idiotic.”

“Anyway, they should rethink their position to present that false witness who, they say, claims to have seen me and Mr. Dacer arguing in a beach in Batangas one week before Dacer disappeared,” Lacson said.

He added: “First, I don’t remember having gone to a beach in Batangas in my entire life. I hate beaches. Second, and more incredibly, I would not have spent time in a beach with Mr. Dacer as we were hardly close to each other.”

Slowly but surely

Lacson said other recent revelations in the Dacer-Corbito double murder case were “slowly but surely unmasking administration attempts to use the case to persecute” him.

He voiced hope that the DoJ would “wake up and realize” that the preliminary investigation it was pursuing against him was “irrelevant.”

“I now believe the saying ‘the truth shall set us free.’ It is becoming clear the efforts to link me to the case stemmed from Malacañang, through then Presidential Security Group (PSG) chief Romeo Prestoza,” he said.

On Thursday, Mancao testified that Prestoza, then a colonel heading the PSG, had made him an offer in exchange for making fabricated statements against Lacson.

Mancao said that in September 2007 when he was still in the United States, a man claiming to be Prestoza phoned him and offered him money, relocation in Singapore, and education support for his children, all in exchange for false statements against Lacson.

He said he refused the offers.

‘Sleep soundly, sir’

Lacson said he received a text message from Mancao in January 2008 narrating Prestoza’s offer.

He said Mancao even told him: “Sleep soundly, sir.”

Also earlier this week, former Senior Supt. Glenn Dumlao said in an interview with ABS-CBN that ousted President Estrada was behind the twin murders.

Said Lacson: “This administration is using all foul and underhanded tactics to silence me for exposing its sins. But they failed to stop me then, and they will not stop me now. I will continue to investigate the sins that [the First Family] has committed against the nation.”

No knowledge

In Malacañang, Undersecretary Lorelei Fajardo Friday disclaimed knowledge of Mancao’s claim that he was made an offer by the PSG chief in 2007 to issue false statements against Lacson.

“We have no knowledge about it,” Fajardo, a spokesperson of Ms Arroyo, curtly said at a briefing. She referred reporters to now Major General Prestoza. With a report from TJ Burgonio

    We just talked about the untimate “beneficiaries” from this case in the previous loop.

    Wala namang ibang ‘intresado’ sa kanilang dalawa ni Erap kundi ang mga nasa likod mismo ng script.

    If they truly believe that both of them have nothing to do with the twin murder case, why couldn’t Erap and Ping set aside their respective prides for a while and focus their efforts on unmasking the mastermind/s?

    Mahirap talaga na magkakurutan ang dalawang macho.

    I read again the privilege speech of Lacson, I couldn’t find the section where Lacson mentioned this.

    Oh yeah? E di ipakita niya. Still, what he did exposing Erap is in fact nothing but saving his hide that is much welcome by these very people he vows “to investigate” and what’s next?

    Kawawang nilalang! Baka ilabas na nila si Dacer, buhay man o patay!

    Ni hindi nga nakita ang bangkay ni Dacer para sabihing patay na nga ang tao especially noong mga beteranong tagatinda ng mga bangkay sa morgue para doon sa mga dayuhan for instance na nagpapanggap na patay para makakuha ng insurance. Tapos aamin, hindi pal, tapos magtuturo na sila sa isa’t isa o kung sino pang pagbibintangan nila? Ganoon ba? Aba gago nga!

Pero papaanong makaka-imbestiga kung ganyan ang mga klase ng mga pulis ngayon sa Pilipinas gaya nina Mancao, et al, at ginagamit pang pangungurakot.

  7. So many are afraid of putting Lacson in power. Only he has the guts and political will to implement a “no take” policy from jueting. So this makes him dangerous to his upper classmen, lower classmen, non pmayers, politicians and businessmen, even policemen who have made a living out of protecting, tolerating gambling, drugs, and extortion to make money. Erap was very good with greasing peoples’ hands just like Gloria, the difference was (for him) he did not steal this money from the government like Gloria and others but from “jueting” only and therefore is justifiable. Now the administration is supporting the Pinedas (jueting lords) openly against Panlilio.

    If we’re really serious about cleaning up, give Lacson the power he needs, and we’ll see heads roll, the first gentleman’s as a start, and even Erap’s later. What could he do about Erap earlier? When we Filipinos have a warped sense of loyalty, to support someone we owe money, position, favors, to right or wrong? Doing the right thing means even subjecting your wife, sons, relatives , fathers to blind justice…what more with bosses?
    Dacer was not a good person to begin with also, find out how he makes his living…administration after administration…

  8. Dacer may not be a good person, but I don’t think he deserved to be murdered, especially not by Erap who would be suspect No. 1 with witnesses saying that he was last seen in Malacanang. Kahit bobong kriminal, hindi gagawin ang ganyang kagaguhan.

    Lacson as a Senator should have the freedom to expose these anomalies and do something about them. Nobody is stopping him if he really has valid and concrete evidences. And I doubt that if he is really clean, those perjurers the creeps in the Senate and Congress themselves present to refute his statements and make his claims not worth pursuing can really succeed. But so far, nothing has come up with his exposes.

    Ironically, those creeps he vows to topple down have become more powerful and abusive, for which reason he has become a suspect, even dubbed “a trojan horse of the Opposition.” Ang pangit sa totoo lang ng naging image niya!

  12. Not me, Perl. I am not even emotionally involved, at least, I’m trying not too, for in the first place, ano naman ang mahihita kong ipagtanggol si Erap o maging si Lacson? Nada! Ang concern ko lang ay ang mga kapalpakang pinaggagawa ng mga ito na di nakakabuti sa image ng Pilipinas na kahit gusto mo sanang ipagmalaki, hindi mo magawa. And of course, concern ako na magkaroon ng katarungan iyong mga talagang naaapi, kahit na iyong di naman dapat na pinatay no matter how bad he was gaya ni Dacer.

    Sabi ko nga, na-meet ko iyong mamang iyan. Hindi bastos ang dating no matter what others say/said about him, and we talked mostly about spiritual things. As a matter of fact, binigyan niya ako ng libro na sabi niya nakatulong sa kaniya in his own soul-searching. Sabi ko nga sa kaniya bibigyan ko siya ng subscription sa isang magazine published by our church, the Ensign, pero nakalimutan ko.

    Kahapon nga kausap ko iyong mga kaibigan ko sa Philippine Embassy. Sila mismo sabi nila di na sila makapagtaas ng nuo sa mga kabalbalang nangyayari sa bansa di gaya noong araw.

Matagal ko nang kilatis ang kalibre niya, and never na binago ko ang opinion ko sa kaniya, pero wala akong magagawa doon sa mga tagahanga niyang dyinodyos siya. Fair is fair dapat. As for Lacson, dismayado ako sa kaniya dahil wala naman siyang tinapos sa mga sinasabi niyang ginagawa niya.   15. Di komo tinawag ako ni Balweg na friend, kasama niya ako sa movement niya. No way! I may be a Marcos Loyalist dahil pinsan ng nanay ko si Marcos, but I am not an Erap fan. Wala akong napanood na pelikula niya maliban doon sa ni-recommend ni Ellen before na ni-ban ni Kulimbat.

  16. Hindi ako madalas pumunta ng Pilipinas, but I keep abreast with news back there. Mas marami pa nga akong alam in fact dahil doon sa mga tina-translate kong mga video clips galing sa Pilipinas na ang napapanood lang ng mga TV viewers sa totoo lang ay katiting at edited pa. Iyong mga napapanood ko, kung baga “live broadcast” no cut, no edit. At di naman mahirap malaman kung nag-improve na nga ang kondisyon doon o hindi.

    Titignan lang namin ang kondisyon ng mga pilipino sa Japan, alam na namin ang kahirapan dinaranas nila at ng mga kamag-anak nila sa bansa nila. Kahit mangmang alam iyan.     It’s not that they (me included) are afraid of Lacson’s guts and political will per se, but I for one have read about his past during his stint as Col. Lacson then of the notorious MISG during the martial law years. LIke I’ve mentioned in another thread, I have a friend whose brother was tortured to death by the MISG back then and I know the guy to be innocent of a crime that he supposedly committed. Granting that if the guy is guilty as they claimed back then, it’s still not right to torture and kill someone. Imagine someone who is capable of doing such… and then electing him as president??? Yikes!!!
    At the very least, he should’ve denounced the MISG and tell what he knows about the atrocities that the group has committed.
    By the way, it didn’t stop there… remember Kuratong Baleleng????

    Lacson owes it to the people, especially the victims of the MISG to explain what he knows about the it’s wrong doings. I’m not saying he personally is involved in the tortures and killings, but since he is part of the group and yet still kept quite about it all these years makes a lot of us distrust him.

Kung tutuusin nman talga… wala nman tayong mahihita, either ipagtanggol natin o sirain sila… pero we are concern pinoy citizens (except for paid bloggers).. we feel na meron tayong responsibility.. kahit sa ganito lang paraan…nagsasayang tayo ng oras para ipagtaggol ang pinaniniwalaan natin… o maglabas ng sama ng loob dahil sa problema ng bansa natin…
    I respect all bloggers here, magagaling… madami akong natutunan…kahit mka-erap ka man.

    I am not really anti-erap.. pero obviously, i am not pro-erap… minsan nman humahanga ako sa kanya.. pero madalas hindi… depende kasi sa issue eh. As for Ping, I believe in him… his action.. his words… consistent! Pero hindi ako bulag,.. about dacer-corbito case, hindi ko sya inaabswelto… pero salamat na din sa paliwanag ni sax sa previous thread… atleast may pagasa na both erap and ping… pwde maabswelto.

    Sang expose ka ba bitin? Senador si Ping Lacson, hindi Presidente. Hindi naman nya hawak ang NBI, ISAFP, PNP para magutos na mangalap ng mga susunod na ibedensya. Hindi naman impossible na maubusan sya ng resources… lalo pat hindi nman tumatanggap ng prok barrel si Ping. Yung mga expose nya, malaking bagay na yun kung iisipin natin… at dapat sundan na lang ng ombudsman at ahensya ng gobyerno.. ang problema, hawak ito ni gloria arroyo…

    Sen. Ping Lacson is doing a great job!

    we all know that there is only so much a person can do regarding the exposition of crime in the philippines. if we werent so frothing-in-the-mouth rabid in condemning lacson for his expose, we will probably find the calmness required to appreciate that the guy’s doing all he can without either compromising himself and looking like a fool. we want him to do all the work, not realizing that he has done all he can. the nature of the controversy is that, if he resolves it himself, it would suggest his own involvement. he will look like a fool. then he will be crucified.

    first we must look at the limited powers of the senate seat. it has no investigatory manpower save that on committees where it can subpoena witnesses in aid of legislation. we must admit that cannot compare to the police and prosecutorial power in the hands of those that hold malacanang.

    it would have been prudent (in fact, for some other senators of lesser mettle, it would have been expected) for him to just lie low, take his pork, and not make waves. that he chooses instead, at great risk to his own personal safety and political well-being, to reveal anomalies should merit some praise at the least. the more he speaks the more enemies he makes because that is the nature of our politics. and yet he persists.

    that some of his exposes have not been concluded or incomplete, is still way way more than other people in his situation have done. but you see, the power of his senate seat is limited. it should be enough that he has told us of the ills in our own governance. regardless of his other presumed agenda, that he has actually told us, the filipino people, of these crimes (incomplete though they may be) should merit some appreciation as well. the rest of the country, should have found a way to use that information to aid itself. but no, from those who have sacrificed a substantial part of themselves, we even have the temerity to demand that they save us as well. redemption should have been up to us. that we failed, is not on him.

    i know his reputation and have heard of the shadowy world he lives in, but he has willingly faced the darkness knowing that the response would be equal parts praise and condemnation. we have grown accustomed to suspicion that we fail to see what could have been good for us.

    finally, that he is out to save his own ass is all but natural. that he did it at this time is also expected as he must have felt he was being railroaded to a place where his safety and freedom is at stake. his integrity, however, will remain intact, regardless of who he points his finger to, IF his version of events sound reasonable to a clear mind. there is no truth for the public here. only versions of events from people to whom agendas and interests can so easily be attributed.

    that he has diverted attention from the snake pit in malacanang is not of his own doing. if he had not, the mancao affidavit (which, as legal standard go, is far from being the gold standard of truth) would just run him straight to jail. this man has risked his reputation too often. IF he has a reasonable tale to tell, i dont think we should deny him the chance to save himself.

    as for the present powers that be, if we the filipino people choose to ignore their sins because we have decided that this dacer situation deserves more of our attention, then that is our own fault too. no one ever made a rule that we should deal with only one controversy at a time.

    please read my post# 2 above. As i mentioned on other threads, si erap ang unang nagturo o nagdiin kay Lacson sa dacer-corbito case. What did you expect na gagawin ni Lacson? Manahimik?

    Actually one of the proofs in those studies by Jose Villa Panganiban, Loarca,etc which I posted are the remontado agtas who speak a language similar to kapampangan,Gloria and Danding want to put a dam in their ancestral domain in Tanay,Rizal to displace them,the project by Gloria and Danding is Laiban Dam.
    I really believe na kagaya lang si Lacson ni Aguinaldo na traydor,nagtraydor rin si Ramon Revilla.
    Nasusuka talaga ako sa situation ng politika sa pinas.

    I think both sides whether Erap or Gloria are both fools pareho lang silang walang kwenta,I think the only Okay candidates for me would be either Jamby or Ninoy….

On the other hand, maybe, the reason why I feel that way, Perl, is because over in Japan, wala pang ganyan mga kaso na hindi natapos na walang nagbibigti o tumatalon sa mataas na building. In short, masyado siguro talagang mataas ang expectation ko dahil walang napapalpak dito even if it takes time. Kahit papaano, may nangyayari! Sa Pilipinas, bago pa tumakbo si Pandak at talagang naging powerful, na-expose na ang mga kalokohan at kabulastugan, hanggang ngayon nakaupo pa rin. Tapos kunyari nagtatapang-tapangan iyong manok ninyo, pero hanggang dakdak lang. At saka, pansin ko wala namang gustong sumama sa pinagdadakdak niya dahil wala rin yatang cooperation ang lintik. Tanong ko nga kay Senator Pimentel, bakit hindi niya i-follow up iyong expose ni Lacson, pero sabi naman niya kulang daw sa ebidensiya!

    The woman, Lymith Bagual, has submitted a statement narrating how she saw Lacson and Dacer having a heated exchange at a resort.

    “It’s circumstantial evidence,” Custodio said, adding that the woman would be presented to the Department of Justice panel at the next hearing scheduled on Sept.

    So the script continues. Apparently, the the theory is that a mountain of circumstantial evidence will suffice to prove guilt. Wrong again.

    Remember that the hierarchy is physical evidence (including documentary), testimonial, and lastly, cricumstantial.

    Circumstantial evidence will suffice to convict, in the absence of physical evidence. For example, if a stowaway boy in the ship sees the crew tying up Captain Bligh, and forcing him to walk the plank; but at the last minute, the boy averts his eyes. If Captain Bligh can not be found later, then the circumstantial evidence will suffice to convict the crew of Captain Bligh’s murder.

    But if Captain Bligh’s body turns up on the shore, with arrow wounds, then the physical evidence will trump the circumstantial evidence; because it proves that the Captain was killed by the natives. The crew will be acquitted of murder (mutiny is another thing of course).

    Physical evidence will also trump testimonial evidence, including a confession. For instance, a woman is raped, and the father of the assailant confesses, to take the heat off his Ivy League attending son. The DNA of the sperm, however, proves negative for the father, and matches the son. In this case, the physical evidence will trump the confession. Son goes to jail, not the father.

    You can invent a mountain of circumstantial evidence: that Lacson held a grudge on Dacer; that Dacer stole money from Lacson, that Dacer made a pass at Lacson’s wife, etc. etc. But no matter how much motive Lacson may be proven to have had, the physical evidence shows that no murder occurred in the area where Lacson’s men held Dacer.

    You can even make Dumlao or Mancao confess that they did the deed, on orders of Lacson. But without the physical evidence, that confession is worthless. That is the ruling of the Supreme Court in the case of Allado, cited in the earlier thread. Umbal confessed, stating that he did the deed upon orders of Attorney Diosdado Allado (yes the guy is a lawyer, god-given ally pa ang pangalan) and the other lawyer.

    The Supreme Court, essentially said: Tanga walang namatay, so what are you confessing to? You cannot completely pulverize a body with just gasoline and car tires, even if, as you say, you did it for eight hours, from 10 pm to 6 am.

    The judge is wasting time (or in the pockets of somebody). All these pieces of evidence are worthless.

    If, as Sax here says, there’s no physical evidence that Dacer was killed (or that they haven’t found any), and if the judge/judges (granted he/she/they are not in ze pokett of some powerful and sinister people) rules/rule in that direction, seems to me that it — such ruling — will benefit Estrada as he could make it his rallying cry, e.g, “Ayan inaapi nila ako! Napatunayan na walang katotohanan ang mga akusasyon sa akin, dahil takot sila na mabalik ako sa Malacanang! Takot sila sa masa! .

    This prospect should give all Estrada die-hards great hope and should make them happy.

    Why can’t they see the powers that be in the judiciary see the simplicity of the law with regard to Dacer’s case — just as Sax here outlined it.

    Those folks probably need remedial course in this section of the law, don’t you think? Sax would be an excellent lecturer… I like his Bligh example here (not only because I’m a sailor but also because Bligh’s feat of seamanship was phenomenal) and I’m sure the judge/judges can only but agree with Sax.

    And then TAPOS!

    Yes. Sen. Lacson have exposed a lot, with barely a conclusion. That is, as far as we, who are not embroiled into the ins and outs of Philippine politics.

    Yet, it seems we are spewing bile on Sen. Lacson spewing his version of truth, but we are more forgiving of “Senators” who do nothing but sit in that chamber in their fine suits and gowns, doing what?

    I do not know Sen. Lacson, but if we will just focus on what he did or presume to have done before, then we are asking for the moon to elect somebody who is “lily white.” In Philippine politics, is this a sane aspiration?

    I am one of those who even took the time to express to Lito Banayo that his ward’s expose are getting tiresome for non-conclusions.

    Pero tama yung ibang nag post dito – hindi trabaho ng Senate ang magpakaluong ng kriminal. If we will send to jail all those in “power” for the “slightest” illegal acts they have committed, do we expect anyone to be left untouched?

    We do not even know the middle, much more the end part of this unfolding “drama,” yet we are blazing with our guns.

    Yet, Cory (may she rest in peace) was a presiding president of a “revolutionary” government, yet, all those power did not afford her to “publicly” put to jail who really are the people behind her husband’s murder.

    In short, I believe we are not naive to believe that “all truths” are there for us to unravel, just because we wish it so.

    As I see it, let us cool our heels, and just “enjoy the show” as it unravels some more. Who knows? We may be in for a surprise as to how all these will conclude?

    By the way – I was more riled up with Obama’s handing out a seal of legitimacy to GMA than Sen. Lacson’s exposes failing to send one big fish behind bars.

    I don’t think it is Erap ang nag-diin kay Lacson. It is MANCAO na nakarinig ng usapan ni Lacson at Ray Aquino. Yung pagsabi ni Erap ay patungkol sa affidavit ni Mancao. Na ikinagalit ni Lacson.

But this should not the basis to conclude that no crime of murder were committed against dacer and corbito by erap or lacson as their living bodies are also not produced. That this whole exercise is scripted may also be acceptable but up to what extent, we do not know. It is therefore wrong to conclude that erap or lacson are clean. Espikulasyon lahat yan.
    Ang problema ay sinasakyan ito ng iba. Inilihis ang usapan para makalusot ang kanilang idolo.
    I am for lacson pero kung nagkasala siya, why should I defend him?

    The goal of the ‘scriptwriters’ is not really to find the ‘murderers’ or the ‘brain’ behind it but to demonize one’s person and deprive him to be president!

    (Example from Macshock:i’m not usually too sensitive, and i’ve agreed with some of the guy’s comments in other posts, but the maligning and suggestive stereotypes have become a little too intolerable. its become a bit irresponsible and i hope something can be done to diminish it.

    i will continue to read your blog and the comments in it, but being subjected to such wanton bigotry does make it a lot less enjoyable.)

    I think you should listen to their comments and examine yourself. I share their sentiments.

    I have been deleting offensive lines in your comments even after i have called your attention and told you to stop being a bigot.
