‘Change not possible under GMA’ – Trillanes

From the office of Sen. Trillanes:

antonio-trillanesSenator Antonio Trillanes IV supported the public clamor for an election in 2010 by saying change under the Gloria Macapagal-Arroyo is ‘not possible.’

“Any illusions of change are simply not possible under the administration of GMA,” he said in a published annual report.

According to the same report, Trillanes was ranked sixth in the Senate for his 285 total bills on several advocacies as poverty alleviation, national defense and security, affordable and accessible health care and education, and environmental protection in only his second year in office.

He stressed good governance and civil service reforms as priorities by proposing heavier penalties against violations by contractors and subcontractors in public works projects and the public officials involved.

“We should fight against the alarming propensity of this administration to punish whistleblowers of anomalous transactions instead of the perpetrators, most of whom are part of government themselves,” Trillanes said.

He also addressed issues among the youth and women sectors with bills that would subject private schools to stricter government regulation against tuition hikes, and include PhilHealth coverage for diagnostic services for breast and cervical cancer.

This year Trillanes authored and coauthored seven bills and resolutions that were passed into law, including the Archipelagic Baselines Law (original bill included Scarborough Shoal within the baselines) and Salary Standardization Law 3.

Six of his bills have already been passed in the Senate, counting one that would fix the terms of the Armed Forces of the Philippines chief and major service commanders.

Admitting limitations as a legislator due to his imprisonment, Trillanes vowed to serve the country in other ways.

“I continue to be a voice of defiance against a regime that is reputed as the most corrupt in our nation’s history. This, I can honestly say, is my small contribution to our people’s incessant struggle for change,” he said.

  1. Don’t have to hear that from Trillanes to be convinced that change is impossible with Gloria at the helm.

Any person with a piece of brain knows that. Those who refuse the evidence need to have a boob, er brain transplant.

  2. Change under Gloria? Who says? The only change she wants is to change the Philippines into a monarchy so she can be queen! Nothing more—this the Filipinos should not allow to happen.

  3. Change Gloria and the rest shall follow.

  4. Gloria is not a Soliman/Solaiman,Kiram,Tupas or Baraguir kaya di siya pwede maging queen.

  5. Anyway, we are a Republic, hindi ba? At least, last time I heard, Pinas is REPUBLIC OF THE PHILIPPINES so walang reyna o hari.

  6. @Adebrux
I agree and Gloria has no claim to royalty, ilusyonada lang si Gloring.

yeap! expect no change from this administration. if there is, it’s to perpetuate power.

here in America, we just celebrated July 4th with kwitis flying all over the place, sayang yong kwitis na pinalipad sa north korea sana tinarget yong ano… ahh… si kwan… ahh! basta! yun na yun!

  9. @reynz

  11. Allot of these ills we are experiencing are started by spanish and americans….

Kung di sinakop ng kastila at amerikano ang pilipinas ally tayo ngayon ng iran at pakistan…so much for regrets

  12. presidente ng iran, not iraq, yung picture mo.

  13. sorry i mistyped ms.ellen, iran pala di iraq..

A lot of these ills we are experiencing are started by spanish and americans….

Kung di sinakop ng kastila at amerikano ang pilipinas ally tayo ngayon ng iran at pakistan…so much for regrets.

No thanks to traitors and wannabe foreigners….

  15. ..No thanks to traitors and wannabe foreigners, like Gloria and her minions.

I’ve been trying to compare Gloria and Bush and here’s what came up:

    1. They are both son and daughter of former Presidents.

    2. Both won the election in a controversial way.

    3. Both are liars. Si Gloria isang tambak na kasinungalingan. For Bush, at least one lie that almost cost his presidency: He denied ever arrested for drunk driving when asked by a reporter long before the campaign. Then a few days before the election, a copy of his record came out showing he was arrested for DUI at the age of 30.

    4. Both are very unpopular and much hated.

    May idadagdag pa ba kayo?

  17. @dodong

  18. Wala tayong magagawa. Hindi na natin maibabalik ang kasaysayan. Most countries were colonized by others at one time or another. On the other hand, would the Philippines be better if we remain as Muslim country?

  19. @Dodong
kaya ko naman sinabi so much for regrets.

  20. I believe na mas tahimik ang pilipinas kung di dumating ang espanyol at ang mga americans but it is okay ngayon kasi pwede natin hubarin ang mga negative na kaugalian na natutunan natin sa kanila at ibalik ang mga nawala sa atin.

Gusto ng mga balik islam na dumami ang muslim uli sa pinas but the rajah solaiman movement wants to do it faster and in an extremist way!

mabuhay ka sen. trillanes, i have been checking and reviewing his legislative achievements, most of national importance ay may kapakinabangan sa ating bansa…medyo kakabilib sa isang neophyte senator, di sayang ang boto ng masang pilipino.

  22. Mon Sagullo Mon Sagullo

    What a relief!

I held my trap and withheld banging my keyboard when BGen. Danny Lim announced his intention to go after a seat in the Senate, because for awhile there, I thought he changed his mind that “election is the least desired (acceptable) mode of change.” Or something to that effect.

Even with half plus one of the Senate, ergo, forming the majority happens to be men and women with the integrity of the genuine reformists like Sen. Trillanes and BGen. Danny Lim, there is no way this scenario can have an immediate and lasting impact on transforming our people into responsible, hardworking and honest law-abiding citizens.

The changes we all aspire for cannot bloom in the current socio-religious-economic-political atmosphere. Exactly why I fully agree with Danny Lim’s assessment – the only path to our nation’s salvation is through a “generational change.”

Even with GMArroyo out of the picture, ganoon pa din. Changing a president does not make dishonest and dishonourable men and women overnight or 3 years later, to honest and honourable men and women.

Top to bottom. From the well-heeled to the struggling “masa,” kailangang may mga modelo at higit sa lahat, nagpapasunod, ng mga pagbabago na ating minimithi.

Apropos to Michael Jackson’s endearing song – “Man in the Mirror” – we direly need the environment that encourages people to have deep and penetrating self-reflection, and effect the very changes they expect from their leaders.

Of course, if the “reformists” can tone down the nationalist thrust of their agenda for the Filipino people, there is a slight chance the super-puppeteers behind Philippine society may allow this generational change to come to fore.

It is not the honesty, integrity and austerity that frightens the “powers that be” – it is the rise of genuine nationalist leaders who have the “arrogance” (sarcasm intended) to believe our national patrimony must always serve the need of the MAJORITY of the Filipinos, and not just the same-dogs-different- coiffeur-genuine-or-fake-breasts-wearing leaders with changing PMA class as praetorian to ensure a few middle class get to taste “the good life” so they will have enough creature comfort to distaste helping and enlightening the poor majority.

“Change not possible under GMA.” True. Yet for as long Barack Obama and what he represents can cast doubt and condemn the election in Iran, yet more than tolerate a proven cheat that is GMArroyo (Garci? Raise your hand!), change is not possible under anyone…

  23. I wrote after Judge Pilapil denied his request: It was wrong for Senator Trillans to ask for special privileges. Nobody deserves any, much less a rebel. The people elected him Senator, therefore, he should be allowed to serves as such, unimpaired.

We were aware of his acts when we voted for him. Yet, we voted for him. Or because of it. 11 million voters, in effect, absolved him of any crime, particularly one that is political in nature. Can the Military Tribunal defy this overwhelming mandate? Of course it can. And it did. Why not? What is it in power for? Or, would the fake Commanderin-Chief permit anything else?

He did not insist on his mandate. And lost a golden opportunity to lead.

  24. Sorry. Nakalimutan kong ilagay ang clincher. SAYANG.

  25. Taxj, hindi sayang si Trillianes. Inspite of his incarceration he has passed more bills than the other 18 senators di ba? Eh ano ang ginagawa nung 18 senatongs? Yes, they can freeely go in and out of the Senate but for what? Just to collect the “pork” at magpapogi points lang. Sila ang sayang!

  26. Boobuwit will not effect change, change of her silly con lang!

So what? kung dumanak ng dugo at nakikipaglaban.

If I were them, hindi ako magpapakamatay sa mga Pilipinong bulag, pipi, bingi at tanga pa! Rizal, Aguinaldo and all our heroes died for our country but look what we are doing to this country? We have leaders who do not care for the citizenry but looks at an elected office as a form of investment. Tongpats lang ang alam! Bayaran ang boto at pag umupo eh lutong lugaw and gana.

I still appreciate the efforts of Trillianes, Gen Lim, Col Querubin kesa naman sa mga bulag, pipi, bingi at tangang kababayan natin. Nothing is real with the boobuwit!

Ikaw ba yun Cocoy?

  31. PSB
I spent years in active duty in US Military. One of the things I recall as part of the indoctrination process was the emphasis that – while in uniform – I was not to express any political opinion. It was a mantra reply we memorized: “I cannot express my political opinion because it might be misinterpreted as the official opinion of the United States”

Separation of the military sphere from the political sphere is one of the foundation pillars of modern Western government. One need merely consider the numerous military coups and military cadre run countries around the world (or look back at Nazi Germany and Imperial Japan) to grasp the dangers of allowing the military to get involved in politics.

  32. Liwayway-Gawgaw Liwayway-Gawgaw

  33. The tradition has been that soldiers shed politics and political affiliations when they put on their uniform. When they take it off, soldiers are free to pick and support the political party that appeals most to them, with no pressure from the Defense Department. The importance of this tradition can’t be overstated.

  34. Cocoy, that is in the US. Nasa Pilipinas ito. In the Philippines di ba ginamit ni boobuwit si Angie Reyes to install herself? So, nasaan ang sinasabi mong mantra? It simply does not work in the Philippines at all! Even the separation of the church from the State does not work in the Philippines too. Thanks to him we are in a mess!

  35. Besides, there are so many cases in the US too where the soldiesr can voice out their disgust. They can protest too. That is their constitutional right!

  36. Mon Mon

“Separation of the military sphere from the political sphere is one of the foundation pillars of modern Western government. One need merely consider the numerous military coups and military cadre run countries around the world (or look back at Nazi Germany and Imperial Japan) to grasp the dangers of allowing the military to get involved in politics.” – Cocoy

And I agree 125% on this doctrine. I supported what Trillanes and Lim did, on the premise or my assumption that theirs is not “a mere military takeover,” but a genuine revolutionary government; for this is the only path I can fathom that has the potential to turn our country around.

A bloody revolution is the least palatable option. As the younger folks and friends of Danny Lim asserted in ’89, when “mere civilians” asked them why they stood down (there is far more story in the much vaunted flyover by a couple of US fighter jets at that time), “we don’t know when the cycle of bloodshed will stop once we unleash it…”

They were of course referring to their fellow soldiers who stood their grounds on what they believe was the right thing to do (then).

The question is – do we really expect those 200+ congressmen, the governors, the mayors & the chief of police to mend their ways, voluntarily, without the “palpable threat” that not only it does not pay to commit crimes in this country, to do so can imperil their abhorrent lifestyle and their very lives?

So, balik sa premise ni Cocoy – yes, the military must not get involved in politics. Caveat, the military must protect the people and the State, not GMArroyo and her cabals.

  37. Trillianes left the military when he ran for the senate. I am pretty sure Gen Lim and Col Querubin will leave the military when they run for any government office. This again is a double standard. It seems that all politicians can run for any office without leaving their curent positions. Nandiyan na ako na ang military should not be involved in politics while they are in uniform. But if no one lese seem to care for the country, would it not be a challenge to these uniformed men to defend their countrymen?

  38. PSB

Some officers in Philippine Armed Forces were being trained in Military Academy here in the United States. So, there’s no difference if they are in the Philippines or any outside world. They should acted as a true soldier. Why they don’t protest in the first place when they were assigned and to be used to cheat the election results. They obey that order and why latter complained.

  39. Isn’t it true too that in the military you follow first before you object? Otherwise ma-cocourt martial ka if you disobey orders.

  40. Cocoy, Asspweron, Ebdame, Habacon and the other generals were used in the election rigging operations. Who among these vultures would have protested? Tell me. It was the junior officers who protested. These officers told Gen Lim et al how the rigging operations were conducted. Thanks to Mayuga who whitewashed his report clearing all these generals who were involved. Look at what happened thereafter. Asspweron will be the side kick of the boobuwit until she is in power. Ebdame is taking over Puno’s posts after a prior juicy position. Mayuga is now an ambassador. All of these vultures sold their souls to boobuwit. Obvious na obvious ba?

  41. PSB

Any order from your commanding officer is legit as long as it is lawful.Yes, you can refuse to follow order if you think is unlawful like the case of U.S. Army 1st Lt. Ehren Watada.he refused orders to Iraq on the grounds that the war was illegal and immoral. He faced court martial. In court Martial doesn’t mean he is guilty or innocence.

  42. The perpetuators were not those who complained. It was the junior officers who complained after they were used in the rigging of the elections.

  43. Question. Why the junior officers follow the order? They can if they refused and the cheating won’t carried on because they were on the front line.

  44. taga-ilog taga-ilog

Cocoy….

  45. It was a big operation Cocoy. Remember “Yung dagdag” tape? Not all these junior officers are like Gen Lim, Col Querubin et al. Most of them may have followed orders but had remorse thereafter.

  46. Sayang talaga si Trillanes. He was in a position to say, ALL OR NOTHING. Instead, he chose to be a hybrid. Honasan saved his own skin. He didn’t, but he too joined the mainstream albeit handcuffed – the easier path. The bills he authored, though constructive perhaps, only served to preserve the status quo. Live and let live. Very much unlike Honasan, but a softee just the same. Anyway, we deserve him. He is what we are.

  47. Taxy, but look at Honasan now? Hawak sa bayag ni boobuwit! It is better for Trillianes to be in jail but he can voice out what he wants rather than join the mainstream na “kapon” naman!

  48. Taga-ilog,

Hindi mo ako dapat kaawaan.I don’t need your pity.Logic lang ang pinag-uusapan dito.

  51. It is the US Military who have been executing the American invasion of our Filipino nation from 1899 up to today.

It is the US Military who have been conducting the killing of us Filipinos and the raping of the Filipina women among us from 1899 up to today.

It is the backing of the US Military that the Americans where able to effect: change of our perception of our national identity; change of our military education institution from the original Academia Militar organized by our national hero and the greatest Filipino military leader of his time, Gen Antonio Luna, to that of the American organized Constabulary Academy later to Philippine Military Academy; change of our original Malolos Constitution to that of somthing framed under circumstances of a corrupted development aftermath of US invasion; change of our balance of control of our economy from that of Filipino control to that of Chinese and American control; change of development of pool of political leaders from one of organically and nationalistically moulded to one of having been infected by the Heredity Injuring Virus which resulted to an Alienated Identity and Defense Syndrome; change which resulted to the replication of these corruption of our national genetic code from one generation to the next; change which resulted in the infection of our present pool of leaders which includes GMA.

Should the US Military then be the model of the Filipino soldier among us?

Gayundin sina Col QUERUBIN at Capt LANGKIT at iba pang Tanay Boys.

  53. Thanks Jose Miguel for pointing out what our soldiers should NOT emulate.

“Trillanes was ranked sixth in the Senate for his 285 total bills on several advocacies as poverty alleviation, national defense and security, affordable and accessible health care and education, and environmental protection in only his second year in office.”

Nakakulong pa siya! And for me, all the bills he authored are just bonus.

  65. At least, si Senator Trillanes, gumagawa ng mga bills na naiintindihan niya mismo di gaya ni Jaworski noon na karamihan sa mga ipinapasok na bill, ipinapasok lang sa kaniya, and so with a lot many of them, nagdudunung-dunungan at nagmamagaling sa Senado, pero palpak naman. Kaya dasal naming mga supporter niya, “May his tribe increase!”

  68. All the languages in the philippine language group used to be a single language in the past about the when the roman empire started.

  71. regarding the igorots and lakandula bloodline, the ibaloi trace their ancestry from Urduja/Deboxah that means ibaloi and pangalatok used to be the same tribe, ang angkan ni Lakandula at ang mga Soliman ay descended din kay Urduja, that means ninuno ni Romy Capulong si Urduja.

  73. Regarding the origin of filipinos it looks like na yung theory ni Jocano ang malapit sa katotohanan based on the new studies regarding our languages and history,we should know the truth about our origins and the history para matuto tayo sa mga mistakes ng mga ninuno natin at para di tayo maabuse ng mga taong kagaya ni Gloring na walang inisip kung di magnakaw ng pera ng mga taxpayers.

Igan Chi…excempted ako diyan ha, i’m still and do believe sa kakayahang ng kgg. Sen.Trillanes. He is a young breed leader kaya give him change to prove na di tayo nagkamaling suportahan siya.

  76. chi chi

    Balweg,

I always know your love for the fighting Trillanes.

  77. Balweg Balweg

We rebelled against Gloria by voting for Trillanes, her arch-enemy. Who is he anyway prior to the Oakwood incident? With his victory, the rebel in us succeeded. After taking his oath of office, he should have picked up where we left off, but he didn’t. Do I blame him for that? No. Who could have seen that legal/political angle? His lawyers certainly didn’t.

Why would I? His heart is still in the right place, and that is all that counts. I say the same thing of the Tanay boys… men, I should say.

  79. Mumbaki,

Malaking bagay ang napili mong kara. Nagkaroon tuloy ng international flavor and color ang Edenville.

  80. PSB

As a Soldier in the US Military, I would have obeyed any of the orders given to me by my commanders or the people appointed over me; I took an oath saying I would. I would just have to hope that those orders were legal ones.

If I were in a situation where I was ordered to clearly break an article of the Geneva Convention, like shoot a disarmed prisoner, then I would not obey that order; unless the situation warranted it.

In another words I would not obey any order given to me by a person appointed over me unless I really knew directly and personally that the order would be illegal. It would have to be a case where what I was ordered to do was illegal, at that time and place, and I knew (with the knowledge available to me) that it was illegal.

Soldiers have to obey the orders of their superiors. They really don’t have any other choice. If the coup succeeds then they would be wrong to have not obeyed the order. If the coup fails, then they will still be wrong if they disobey their orders. If they obey their orders and those orders were unlawful then they would still be wrong for disobeying the orders of their superiors.

In the case of I would be ask to be used in illegal election cheating I would have not followed my orders. A soldier is not supposed to be involved in politics. They can have their opinions, if they keep them to themselves and they can vote, but they are forbidden pretty much any other political activity. This isn’t my opinion it is military law.

  81. Taxj, thanks for the clarification.

Let us preserve them for bigger endeavors. We need them to put the criminals away. That is the Big Picture!

  82. Vonjovi,

There are so many ways to do good for your country. Not only being a politicians or a soldiers, I cannot speak for everyone who are in the military, but I can speak for myself and know the people I work with. I, along with everyone else on my team, left a profitable job and volunteered to perform this mission in the Philippines at significant personal expense before. Yes, we do receive additional incentives while deployed in a combat zone but it is a small pittance compared to the great sacrifices that we endure. On occasions the military offers additional bonus for people to stay in and I would be stupid to turn down anything offered for something I would do anyways. Now, let me itemize all the bonuses I have received over the last 20 years of service. Above my regular pay and allowances, I have received: a t-shirt, a pen, laminated honorable discharge and a barbeque utensil set.

Some call me a mercenary just because I receive a – less than honest – wage. Can I apologize now for needing some money to live on? If I had alternative means to support my family, I would still be still a soldier even without pay if necessary because the job must be done! I have walked on foreign soil and have seen the price paid by those who do not stand up against despots and I will not lay that burden on my children.

You should be grateful for the sacrifice that I, and every other service member, willingly offer. Showing disdain for us only cheapens the liberties that you enjoy. Liberties you would not have without us.

Our disussion on the cheating operations will end in a stale mate coz your point of view is emanates from the US military dontrine and mine is from a point of view of the Filipinos who got robbed of their suffrage. Hindi tayo magkakasundo. But I am ok with that. I still respect your opinions.

Boobuwit, when she ousted Erap followed my line of reasoning but now that she has hinged herself comfortably on the stolen throne, she is now following the US doctine-that the military should not meddle in politics. What a hypocrite!

  84. Cocoy, you forgot to mention that if you are a US military retiree, you have a handsome pension, enough to simply do volunteer work and still be comfortable. Our Filipino soldiers do not have that luxury. I come from a family with a few PMAers. Some of them already retirees and still do not have a house they can call their own because they were not corrupt. They can not even send their kids to higher education without asking for help from other relatives who can help them. The Philippine military, other than the corrupt officials, do not really produce a nest egg for retirees. It is very sad but true.

Sen Trillianes has young children. He has to put food on the table for them. Just like him, those in incarceration also have kids to put through school. If they decide to go into an endeavor that they think they can continue to pursue to serve their country and continue to have compensation, so be it. In the military they could not go out of their box without being court martialed. So, if they pursue a political carreer, so be it!

Rose kong talaga mong mahal ang Pinas bakit mo iniwan in the first place. Without them there were no progress made in Pinas. I don’t know if we were better to be under the Japanese regime. They have code of honor, they can not be compared to the Filipino Military who serves under Pandak. I’m sure if it was reversed the U.S. military will have a coup d’etat against a dictator president. True, they don’t get involved in politics but I’m sure they will be the first one to act if we get over runned by a Muslim President.

  97. Dandaw, the truth is chow mein na tayong lahat. Ang mga tunay na Filipino ay maliliit at maiitim (daw-coz I have not seen one so far). I am very sure that I have some Spanish blood in me too (just a little coz I am still kayumanggi and hindi masyadong matangos na ilong-hindi naman pango!). One thing we have is lahat tayo ay natuturingang mga Filipino. Lahat tayo ay iisa ang diwa-para umunlad ang ating bansa-except a few rotten ones who are drunk with power and stolen money!

  98. What “special privilege” are you referring to Taxj? That he be allowed to attend senate sessions? Is that a “special privilege?”

That’s a right that he was invoking having been elected by more than 11 million Filipinos (walang daya yan ha) but that was denied. It’s the court that termed it “special privilege.”

“Who’s behind bombings?” screams the Inquirer headline, considering the murky probable cause. I share the suspicion and brings to mind Operation August Moon. Unfortunately, the ’78 sweep posted by Ellen was deleted, making my curious mind curiouser and curiouser.

  103. Rose, I know how it feels to long for one’s own home.

You can always make-up for what you answered when asked, “If America declares war with the Filipinos, whose side will you be?” There is still time to make up while we are still breathing. You need not even worry having to undergo the agony of having to make a decision when that declaration comes. That declaration will not come because they have already been continuing their invasion they started in 1899. They continue to familiarize themselves with our terrain which reduces our defense capability. Our terrain is one of our tactical assets for as long as our aggressors are not familiar with it. They continue to have military base in Zamboanga City where we Filipinos cannot enter without their consent. This is inside our own territory. They continue on killing our brother Filipinos in Central Luzon in the 1960s. They continue on raping our sister Filipinas today in the 2000s. We Filipinos are helpless because they control our defense in particular and our government in general. This includes the GMA puppet government.

This is a development as a result of their having replaced our organic systems after 500,000 to 900,000 of us Filipinos died as a result of our resistance to their invasion. They replaced them with Filipino labelled but corrupted systems designed to transform us into generations upon generations of worshipping dependents on the Americans.

Hopefully you can respond to our situation like the Israelites who were scattered all over the world for 2000 years because they were driven away in history. But because a group of Jews preserved their identity from the time they were organized as a nation way back in biblical era. They disseminated this Jewish history to all the Jews all over the world. Finally in the 1940s, they organized to recover their land however disputed it may be. They pulled their talents to come home and rebuild their nation.

We here in our islands remain foreign to our nation. We are alienated from our identity. Filipino Soldiers among us defend the foreign invaders and attack brother Filipinos. Our political leaders despise us Filipinos and steal our assets and hand them over to the foreign invaders.
We have remain dependent on the Americans for our defense. But who are we defending?

Yes Rose, not only you, but all of us Filipinos have not come to our own home yet. You can help us find our way back home!

Ano ang gagawin niya doon? Magaral ng belly dance?

  107. May I remind you that the topic here is Trillanes. Let’s try to rein in our tendency to wander away from the posted topic.

  108. Al Al

There are those who criticize Trillanes for failing in his attempts to oust Arroyo.

If he won, would they have also criticized him. I’m sure they would have applauded him.

And those who say they are against Gloria but blamed Trillanes for bungling attempts to oust Arroyo, what have you done to get rid of this corrupt administration?

  109. Rose Rose

Ellen: you are following the trials of SEn. Trillanes and the Tanay group…ano ang status ngayon? Half of the year is gone and soon mag election na..what takes the Military Court so long to close the case..matatapos na ang adm. ni putot..

  110. The court was right in denying him permission to attend sessions. It was a special privilege that the court cannot grant. Why did he not, instead, question the legality of his incarcertion?

  111. There’s a hearing tomorrow (July 8 )of those the mutiny charge against 28 officers in connection with the Feb. 2006 non-event.

I won’t be able to cover it because I’m going home to Antique for a brief vacation.

The case of coup d’etat case against Trillanes et al (Magdalo) group at the Makati Regional Trial Court is still ongoing.

  112. Taxj, we differ in our idea of “special privilege”. But that’s okay. We are entitled to our own opinion.

I lost track anymore of the details of the case, whether he questioned the legality of his incarceration. Maybe he did, I’m not sure anymore because I’m covering several military cases at the same time. I have to check with the lawyer later.

What I know is that as military officers, they accept punishment commensurate to whatever offense committed. They are questioning the charge of coup detat.

  113. Whatever the legal strategy Trillanes and the Magdalo’s legal team, it does not diminish the cause that they fought for which is Gloria Arroyo’s abuse of her powers.

Since 2003, that abuse has grown worse. The worst of it is the 2004 election massive cheating.

With her crime, Gloria Arroyo loses the moral and legal authority to demand obedience to the law.

    *******************************

Same thing you yourself probably haven’t…..NOTHING.

But make no mistake, through this blog, we intend to make our voices heard. This may not be enough but it is all we’ve got to fight for. We intend to make the most out of it, that I can assure you.

  115. Ellen, the Tanay Boys will miss you at their hearing tomorrow. You have consistently covered the hearings. You are the only link to what is going on with them. The newspapers already stopped covering the hearings. I wonder why? But you are still there for them.

But you deserve to take a break. Have a good time!

  116. Al Al

Regarding Abki’s comment: Same thing you yourself probably haven’t…..NOTHING.

    Please speak for yourself Abki.

But this is a contest of who did what in the past. What is important is what we are doing now. And I’m glad to know that in our own ways, we contribute to the objective of having a government that cares for the Filipino people.

Arroyo’s “GMA cares” is bullshit. She cares only for herself and her ilk.

I mean, This is NOT a contest of who did what in the past.

  121. We should stop underestimating ourselves kaya natin ito kaya natin paalisin si Gloria…..

  122. Abki,

I have to disagree very strongly with your comment.

First and foremost: there is never a justification for the military of any country interfering in internal politics. The military of a democracy is under the command of the country’s executive branch.

The executive of a democracy receives its power from the people in elections. The ground rules for this process are laid out in the constitution and in laws, and as we know, there are often disputes about these rules.Legal and political disputes cannot be settled by the military.

Whether we like or dislike President Susong Dalaga, the fact is that she received a majority of that country’s votes,if she cheated her way,Filipinos nothing to blame but, themselves because they let it happened. I may not be a fan of Nunalisa, but there can categorically be no justification ever for an intervention of the military in a country’s government. If someone calls for that, they want to impose the will of a minority on the majority, and they are saying they are willing to see blood flow so their will can be imposed.

Regardless of what you think, military coups are indicative that the military will always direct the outcome of politics and their interests may not always coincide with the people.

Meanwhile, should we not be talking about the constitutional implications of this episode, discussing what can be done to make democracy work better and more effectively? Perhaps we have been so conditioned by soap opera farces and media frenzies that we are willing to focus our attention.

  123. Cocoy, kaso mo the boobuwit was never elected! She overthrew an elected President the first time. She liked the presidency too much that she had to cheat to keep herself in power the second time. If we will not stop her, she will have a third attempt at the presidency and this time it will be for life! I do not think the people care if at this time we follow a constitution that was never followed by the boobuwit herself anyway.

Excuse me, those who hate this boobuwit are not in the MINORITY! Majority of the people hate this fake president! The only thing is, most of them look up to the military to do the ousting of the illegal president for them. They prefer to be the RAH,RAH citizens! How pathetic!

  124. PSB,

So far I know the Constitution was not yet been amended. So,there’s no third term for susong dalaga.

  125. Those majority numbers who hate Nunalisa are deceiving unless, they come out and be counted.A hundred thousand warm bodies at Con-Ass rally is not even 1 % of the Philippine population.Where’s the voice of the people for that? Villarde can gather his fanatic flocks 10-20 times more than that.

  126. Cocoy, although I respect your opinion on the separation of the military and politics (which is ideal), I want you to be aware that most of the third world countries who emerged to be much better than us politically had to go through the growing pains of several coups before they got to their better government.

Do we have to wait until the boobuwit changes the constitution before the people move? Wouldn’t that be too late then?

  127. PSB

Well, so be it.If we let the constitution be ratified. It’s time for the Filipino people to think about it.

  128. CHANGES,not possible under GMA,maybe? the only time there would be changes is,if probably when SUN rises from the south and set on the northern hemiphere, which more posaible to occur than changes under GMA.The “ANSWERS” are defending from the people who read this.

  129. Yan na nga ang problema natin Cocoy. Where are the majority? God helps only those who help themselves. He will not help the fence sitters!

  130. We should stop underestimating ourselves kaya natin ito kaya natin paalisin si Gloria..

Most of our problems even in the past including the spanish and american colonizations are caused by underestimating ourselves dapat isipin natin na kaya natin ito dapat ipakita natin sa mga nangaapi sa atin na tayo ay matapang at di magpapaapi.

  131. Ellen: “I lost track anymore of the details of the case, whether he questioned the legality of his incarceration. Maybe he did, I’m not sure anymore because I’m covering several military cases at the same time. I have to check with the lawyer later.”

Thank you for giving my question the importance it deserves. But I think you should know by now whether the question was raised. I think it is something for the SC to decide, not the Military Tribunal.

Ellen: “Whatever the legal strategy Trillanes and the Magdalo’s legal team, it does not diminish the cause that they fought for which is Gloria Arroyo’s abuse of her powers.”

I think it’s not about diminishing the cause, which is a given factor. It is about enhancing one’s chances of success. I assess the situation as a team member, not as a fault-finder. Or, so I believe.

In the tape General Lim says the military claims only the moral high ground, and does not seek power.

“We call on Mrs. Arroyo to accept gracefully the formation of a new government. As soldiers we do not seek political powers for ourselves,” he continued. “We shall not allow anyone to use political power to commit crimes against our people or to pursue their own personal agenda at the expense of the national interest.”

Tape daw yan ng abs-cbn. This shows that there was no attempt to wrest power or authority; so no mutiny.

I was reading the answer of Sen. Trillanes to his accuser. Ah! the power of the PEN. I don’t believe a word Ramon Tulfo said. I believe Sen. Trillanes. He is speaking from the heart. I know those Newspaper people. “Mukhang Pera”. I pity this woman and those people that are dancing to her tune.

  141. Cocoy – July 7, 2009 3:37 pm

The turmoil in Honduras following the ouster of its leader by the military boosts your thesis: no to milirary intervention. What we need is “talking about the constitutional implications of this episode, discussing what can be done to make democracy work better and more effectively.”

Lest I be accused of a flip-flop. There are many reasons why I voted and campaigned for Trillanes. Approval of what he did at Oakwood is not one of them. Foremost is to get Gloria out of her comfort zone, and perhaps make her take some time for some serious reflection.

On the part of Trillanes, I just wanted to give him a better venue for his grievances and desired reforms, which he soon apparently forgot as he shifted to other concerns, though not less commendable ones. I wanted him in the Senate, not on the streets nor in jail.

I disagree with Senator Trillanes. Change is possible under Gloria as long as we are willing to make some changes in ourselves.

  142. saxnviolins – July 8, 2009 10:26 am

Power grab is power grab, regardless of whether you do it for yourself or for others. The phrase “we do not seek political powers for ourselves” is not a saving grace.

  143. taxj,if you talk of power grabs, the personification of that is Gloria Arroyo.

Any attempt to oust her is just to correct a wrong that she imposed on the Filipino people.

  144. Letter of Atty.Reynaldo Robles to Tulfo:

    07 July 2009

    MR. JORGE V. ARUTA

    Opinion Editor

    Philippine Daily Inquirer

Chino Roces Avenue corner Yague & Mascardo Sts.

    Makati City

    Dear Mr. Aruta:

Please allow me to respond point-by-point to the personal attacks of Mr. Ramon Tulfo against Sen. Antonio F. Trillanes IV in his column “On Target” (PDI, July 7, 2009).

    1. Many cars. – Contrary to the claim of Mr. Tulfo, Sen. Trillanes never owned any luxury vehicles when he was in the military. Sen. Trillanes’s only vehicle when he was with the Navy was a second-hand ’96 Nissan Terrano, which he sold in 2007 to finance his campaign. The fact is that in 2003, the CIDG filed an ill-gotten wealth case relating to Trillanes’s alleged vehicles but the case was dismissed because the documents the CIDG submitted in support of its allegation were found to be spurious; they showed that the vehicles were supposedly registered under Trillanes’s name in the year 1900! This could be confirmed from the records of the Office of the Ombudsman.

    2. House in an exclusive village. – Sen. Trillanes does not own a house in an exclusive village in Antipolo, Rizal, as alleged by Mr. Tulfo. He never did. His parents-in-law own a house at the Town and Country Homes, a middle class subdivision in Antipolo. In fact, Trillanes did not own a house at all when he was still with the Navy and even up to now. He and his family used to live at his wife’s quarters at the PMA in Baguio City. When in Metro Manila, he stays either at his parent’s house in Caloocan or with his in-laws. It was only last May that Sen. Trillanes acquired a 300 sqm lot in the same subdivision in Antipolo through the PAG-IBIG’s Home Financing II Program for which he will be paying for 25 years. You can verify these claims from the Register of Deeds of Rizal and from PAG-IBIG.

    3. Tiff with a Dutchman and his Filipino wife. – The couple referred to, Anastacia Santarin and Adrian De Jager, have been locked in a dispute with a certain Estelita Pabalan over a vacant lot (there was no house) in Novaliches since 1999. Said property was leased by Mr. Trillanes—who did not know of the dispute—as parking lot for his mother’s rent-a-van business in early 2003. Sometime in March 2003, Santarin and De Jager forced their way into the premises, shoved the caretaker out, and refused to leave. When Trillanes was informed of the incident, he went to talk to Ms. Santarin. He never met Mr. De Jager. Due to the couple’s refusal to leave, Trillanes reported the matter to the Barangay Chairman in the area. That was the extent of his participation in this matter.

A few days later, Pabalan and the caretaker reported the matter to the police. When they came to investigate, the policemen were attacked by De Jager with a knife. The policemen arrested De Jager and charged him in court with attempted homicide. He was incarcerated because of this and not because of anything that Trillanes did. In fact, Sen. Trillanes had no involvement whatsoever in either the land dispute case or in De Jager’s criminal case. Court records will bear this out.

After the Oakwood incident, this couple tried to cut a deal with the government by offering themselves as witnesses against Mr. Trillanes in exchange for a favorable ruling in the land dispute. Fortunately, the police and/or prosecutors found their claim to be dubious and incredible. The couple later filed a case against Trillanes before the Ombudsman but the case was dismissed for lack of merit.

    4. Abusive behavior. – Mr. Tulfo claims that Sen. Trillanes was abusive when he was a mere Navy lieutenant and concludes “much more so now that you’re already a senator”. Likewise, Mr. Tulfo also wrote: “[W]hen you were in jail at the Intelligence Service of the Armed Forces of the Philippines (Isafp), you were a problem-detainee as you always quarreled with your jailers.”

Apart from Mr. Tulfo and the De Jager couple with their bogus and recycled claims, however, we are not aware of anyone who claims to have been victimized by Mr. Trillanes’ abuses.

The next time Mr. Tulfo writes an article, we are hoping that he would at least take the time to check his sources, verify his facts and get the side of the affected party, just like how a good journalist is supposed to. Otherwise, his articles do not deserve to be published in a respected newspaper like the Philippine Daily Inquirer.

In the interest of fairness, we are hoping that you will publish this response in full.

    Very truly yours,

    REYNALDO B. ROBLES

    Legal Counsel of

Sen. Antonio “Sonny” F. Trillanes IV

  145. Bobong, please dont capitalize your comments. Hindi maganda basahin.

  146. saxnviolins saxnviolins

    Power grab ba taxj?

Withdraw (al of support) and grab are antonyms.

Ang “hugot” at “sakmal” ay mag-kakontra.

  147. Regardless of what many say was Gen. Miranda’s participation in the 2006 planned withdrawal of support, whether he was on the side of the rebels or not, his dilly-dallying and permitting the senior Marine officers to make a vote in the HQ were the acts that dealt a severe blow to the planned march of Lim and Querubin etal. That move enabled Esperon to push his weight at that critical moment.

Their followers are now divided among themselves.

  148. Re: saxnviolins – July 9, 2009 7:41 am

I reacted only to your opinion on the portion you quoted from an allege abs-cbn tape. There’s nothing in there about withdrawal of support, just a very polite and gracious request from one of her officers for her “to accept gracefully the formation of a new government.”

To be more precise, maybe Ellen should have added, “Beloved and respected evil bitch, Gen. Lim is not out on a power grab. He just wants to correct a wrong that you imposed on the Filipino people. So, please don’t be angry at him.”

Extraneous matters blurred my point which is: The document per se is damaging. It is not what you say it is.

  149. saxnviolins saxnviolins

    taxj:

You apparently only read my post, not the article linked to.

Lim has denied involvement in any coup plot, but on Monday, local television channel ABS-CBN aired a video of General Lim, announcing he was withdrawing support from President Arroyo, and calling her rule unconstitutional and illegal.

    Mutiny may be:

properly be defined as consisting in an unlawful opposition or resistance to, or defiance of superior military authority, with a deliberate purpose to usurp, subvert, or override the same, or to eject with authority from office Winthrop’s Military Precedents, page 575.

That is why I distinguished withdraw from grab; because mutiny requires a power grab. Also,

Mutiny imports collective insubordination and necessarily includes some combination of two or more persons in resisting lawful military authority. Sedition implies the raising of commotion or disturbance against the State; it is a revolt against legitimate authority and differs from mutiny in that it implies a resistance to lawful civil powerA Manual for Courts Martial, US Army, 1928 (updated to 1943 page 157).

Since the support was withdrawn from the President (the office, not the implantee), then, if at all, it is a civil offense (sedition) not a military one. I have earlier posted that civil offenses are properly tried in civil courts, not courts martial.

So two elements are missing, for a proper charge of mutiny – (1) attempt to grab power, and (2) resistance directed at a military officer. In fact, there was no resistance, because when there was an order to go back to the barracks, the officers and men complied.

    Finally,

There can be no actual mutiny or sedition until there has been an overt act of insubordination joined in by two or more persons. Therefore no person can be found guilty of beginning or joining in a mutiny unless an overt act of mutiny is proved (Manual for Courts Martial, page 158).

What was the covert act? Discussing the withdrawal?

What order was being disobeyed, that will qualify as an overt act of insubordination? And whose order was being disobeyed? None was alleged – so there is even a basis to dismiss for failure to state an offense. The motion may be filed at any time, even on appeal.

I earlier posted that the Commander-in-Chief is not a military officer. The President is a civilian. That office is made commander-in-chief, to comply with the Constitutional provision that civilian authority is above the military. Were the President a military officer, then there will be no civilian above the military.

I agree, that the video is damaging – to the prosecution.

  150. Sax: “You apparently only read my post, not the article linked to.”

Please remember that you made the assertion based solely on what you pasted, not from the whole tape itself. So, I took it from there. You know, of course, why I used the qualifying phrase: per se or by itself. A video is one thing, using it is another.

Anyway, thanks for the info. Now we know better. If the Tanay boys lose their case it wouldn’t be for lack of valid arguments.

  151. Sax, if the court martial (because of the pressure from above) find the Tanay Boys guilty, will they be able to elevate their case to the Supreme Court? The court martial hearings were full of postponements. Could these postponements be a material fact in their right to a speedy trial? It is very obvious that the military want these men incarcerated so that the boobuwit can continue with her reign of terror.

  152. Sax, if the court martial (because of the pressure from above) find the Tanay Boys guilty, will they be able to elevate their case to the Supreme Court?–Parasabayan.

I don’t think so!Military Appeals hears appeals of military court-martial.When a person who is in the military commits a crime they can be tried and punished by the military courts.

  153. Bakit under Court Martial si Senator Trillanes?

I think he is a quality person. Mabuhay Ka Sonny.

Every person has good and bad qualities.

Same same pa rin, kurakutan kaliwa at kanan. Now we have a more corrupt leader than Marcos. I personally think that the old man was good and had the heart for the people kaya nga lang noong may sakit na siya, si Imelda at ang mga henerales (we even have a worse general cronies now in the likes of asspweron, ebdame, reyes and the like) nila kasama na ang mga kapatid ni Imelda at ang mga cronies nila ang nagpayaman ng husto. Each regime have its own downfall but I never saw one regime where corruption was and is being done openly than now!

  157. Besides, I do not believe that one should receive money and assets rightfully belonging to the Filipino people. May karma yan!

  158. dandaw dandaw

Toto-o iyong sinabi mo Parasabayan. Now he is the Ambassador of Pandak to the Middle East.

  159. Sonny may be too much for the US. He has a mind of his own. The US will not annoint him for sure. Unless we can cut the umbilical cord between the US and the Philippines. Let us cross the bridge when we come to it.

  160. Sonny for President? Why not? How do I get to help with the platform?

  161. Liwayway-Gawgaw Liwayway-Gawgaw

    psb,

Unless Sonny will start compromising on his principles, it will be an uphill battle for him to reach the top. This is just simply the reality!

  164. dandaw dandaw

Hindi pa rin naka uwi si Zelyada (sp.) See the parallelism in the Philippine situation? Anong nagyari sa trial nina Trillanes? I think Trillanes will not compromise his principles. He seems a very principled individual and has common sense the way he writes those bills.
