Maj. Gen. John Martir, whose two -star rank remains unconfirmed by the Commission on Appointments, finally showed up at last Friday’s court martial hearing of the mutiny case against 28 officers in connection with something that did not happen in February 2006.
This was the time when the people, including men in uniform, were restive about the revelations of massive cheating in the 2004 elections in favor of Gloria Arroyo using military and police officers and personnel.
It was the start of his cross examination which should have been last May 26 but Martir was a no-show giving the excuse that he was on a “confidential mission.”
It became evident during the cross examination of Atty. Sigfrid Fortun, counsel for Col. Ariel Querubin, that the court was protecting Martir in his case of AWOL (absence without leave) which is pending before the Ombudsman.
It’s another case of the “Old Boys Club.”
It was a delight to watch the highly competent Fortun lead Martir, who had testified against Querubin and other officers who participated in the 1989 coup d’etat against the Aquino government, up to the time he went to the United States because he was disgruntled that Querubin and his fellow 1989 “coup plotters “ were restored to military service without loss of rank. (The return to service of military officers who participated in the 1989 coup was a result of a peace process initiated by the Ramos administration.)
Trial Judge Advocate Serme Ayuyao knew that Fortun’s questioning would lead to Martir’s 477- day AWOL. He objected citing irrelevancy. Gilbert Gallos, counsel of Col. Orlando de Leon, said, “the TJA keeps on harping irrelevancy. If you are attacking credibility, you can ask anything.”
Fortun said “relevancy is not germane to cross if we are testing the credibility of the witness.”
Defense lawyers cited section B of Article 121 of the manual for court martial which states that “As one purpose of cross-examination is to test the crediblity of the witness, he may always be cross-examined as to matter bearing upon his crediblity, for instance, he may be interrogated as to his relationship to the parties and to the subject matter of the case, his interest, his motives, inclinations, and prejudices, his means of obtaining a correct and certain knowledge of the facts about which he testifies, the manner in which he has used those means, his powers of discernment, memory, and desription. Leading questions may be freely used on cross examination.”
At one point when Fortun asked if during his stay in the United States from February to April 1997 he took courses in HTML and Windows, Ayuyao objected invoking the witness’ right against self-incrimination.
Fortun said he will accept that if it’s Martir himself who will say that. Ayuyao approached Martir. Fortun objected saying under the rules of court counsel cannot coach, even approach, witness on the stand. “The witness has to decide on his own.”
The court called for a break. When it resumed, Martir said he will answer the question. He admitted it was not authorized by the military. He said he was on leave. When Fortun offered a record of Martir’s leave credits which showed that 477 days of his stay in the United States were not deducted, Ayuyao objected citing again relevancy.
The exchanges went back to testing credibility. Gallos said the documents will show that the witness has lied and has forged documents before. “If we destroy his credibility, we destroy his testimony.”
Fortun said his questions have impact on propriety, credibility and integrity of Martir who had executed a 29-page affidavit accusing the 28 officers of having committed mutiny punishable by life imprisonment.
He said upon the documents that he would be presenting to test the credibility of Martir “ rest the freedom of the accused.”
“ You want me to link that? It’s directly linked to the 29-page affidavit of this gentleman.” Fortun told the court.
In the end, the court sustained the objection of the TJA and Martir’s lies and forgeries didn’t go into the court records.
So much for search for truth as prayed for at the beginning of each hearing.

Ellen,
How old is Querubin?
Next time Martir attends the court hearing, shoot him in the head !
Fuckin predictable. Yet unbelievable. The AFP today is nothing but swine manure. If pigs can fly Camp Aguinaldo will be a very busy airport.
Baka naman sasabihin pa ring “let the people start, and the soldiers will be there to protect them.”
My bullshit detector shows full scale deflection. They can’t even protect themselves. Haaay.
No need to test Martir’s credibility. We know that already. It’s time we test OUR soldiers’ credibility.
Ellen,
Is there no appeals court to protest railroaded court martial proceedings such as this?
Is the court of the angry masses the only option left for justice under this corrupted dispensation?
Tribune:
“Favored PMAers, Gloria conniving for power grab”. What will OUR soldiers do?
And this is what Brawner calls as the AFP being apolitical and professional.
And the other stupid general (I forgot his name) calling the AFP as a lot smarter than 5 years ago (is he saying that Senators Biazon and Lacson are dumbos ?).
Somehow, I could not earnestly reconcile what these two morons are blabbering about. Must be something they concocted after watching too much stupidities and absurdities from MALA-TIYANAK PALACE. Oh well, did we really expect a lot from two blundering IDIOTS (isama na rin natin si MARTIR)? Sa panahong ito ni GOYO, este gloria pala, having “stars” on an officer’s collar is as cheap as dalawa-singko. Libre kalendaryo pa iyan.
Ellen,
What is the full name of Martir, is it Jonathan Martir?
One of its kind, you know, hahaha!
sorry( marter)martir,(promo)promossiyon,thnks
Kim,
Isa ring tanga at sipsip.
Nakakahiya sya!Kredibilidad?sinong me sabing meron sya nun?.Kapal nya!
yes Anna, it’s Jonathan. He has a younger brother, Victor, also in the military.
AdeBrux,
His name is Jonathan Carr Martir.
Guess who started this scenarios?FVR remember Victor CORPUS a deserter from PMA,stole weapons and joined ENEMIES OF THE STATE(NPA),reinstated to the service, promoted and w/star retired,an excon KIDNAPPER reinstated promotted while behind the slammer, retired star and sitting on juicy position, now another “Deserter” while being AWOL got promoted.WOW this scenarios are good indication for encouraging our future OFFICERS of authorities military or civilian,to commit a grave offense to the republic as long they knew somebody in the higher up.Desertion a punishablr no less than 20 yrs+ of STOCKADE&unhonorable discharge. But in SWINIES ADMIN. PROMOTIONS,COMMENDATIONS AND APPOINTMENT OF JUICY POST.
Martir’s homecoming to the AFP after being AWOL for 477 days is hard to understand because it defied logic that instead of being dismissed from the service he is even being promoted.
It really pays to be a first-rate rat and a grandmaster of the art of lying, and ass-licking. Knowing the soft spots and weaknesses of the power holders and how to take advantage of the opportunity it presents, was best exemplified by Martir. These qualifications are his tickets that win the hearts and trust of his masters that’s why he is being well-taken care of.
Ayuyao has no business sitting as a trial judge. His bias is very obvious and disgusting. He should not be playing as a mythological god who can rule and do whatever he pleases to favor the other side. This is about finding out the truth and he should be helping by being fair. This is a serious matter and the lives and the future of these officers and their families are at stake and he should not be playing with them.
Florry, Serme Ayuyao is trial judge advocate, the court martial’s equivalent of a prosecution lawyer.
Anna, Col. Querubin is 53 years old. Born March 28, 1956.
Thanks Ellen.
What do you expect sa mga eto na galing sa isang kahig isang tuka na pamilya madaling malulon sa graft and corruption under the influence of this fake president. No offense to our brave and honorable military men who are serving their country with dignity.
“The singles: Capt Dante Langkit and Lt Belinda Ferrer.”
Bagay sila. Parehong may dignidad at paninindigang hindi natitinag kahit anong paninikil ng administrasyon at pamunuang robot.

habib, confidential mission,on another country is SPYING,unless the mission with the approval diplomatically of both gov’t,the host country & country sender of agent. This case should be a DEEPER INVESTIGATION than AWOL,if this RAT telling the truth.Phil. gov’t voilating an international law regarding of nation security. Then if he is lying, using a gov’t an excuse to commit crimes another grave offense, what if he get caught by the hosting country
I think what Gen. Gaudencio Pangilinan really mean when he said, “military troops are now “smarter” than before and that the organization is professional than ever”, is that…
…the military troops are now sMartir than before…
According to Martir, he was on a confidential mission on May 26, 2009 that is why he was not able to attend the Court martial hearing.
But he was seen jogging inside the Marine Camp in Fort Bonifacio on May 26, 2009.
Martir is the J-6, Assistant Chief of Staff for Communications and Electronics, so what is so confidential about his position? Except that he is the older brother of J-2 (Intelligence), Commodore Victor Emmanuel Carr Martir AFP, member of PMA Class 1978. He can easily get a Mission Order from his younger brother.
Pangilinan and Martir are best friends.
Martir admitted during the court martial hearing that he called Boygee Pangilinan, after Col Querubin visited him on Feb 23, 2006. Martir did not follow the Chain of Command. Martir is a Marine but he called an Army Officer who is not in his chain of command.
Pangilinan was in the Marine Camp during the Marine Stand off but he was told to leave the camp and was escorted outside.
Martir should have informed the Commandant of the Philippine Marines or the FOIC instead of Pangilinan.

I think this is the pivotal rationale of the Lacson’s “bowing to realities”.
How would a general be sent on a CONFIDENTIAL MISSION like what Augustus Cavanes says?
It is a great foolishness of any commander to send a flag officer (star-ranked) on a COVERT mission which can be assigned to a lower ranked officer or an enlistedman. Besides, where in the universe has the Philippines got a diplomatic agreement where it can field intelligence operators for SPYING or collecting information?
So much with these LIES!
Thanks, Ellen for the info.
Re Jonathan Carr Martir — I see! It’s become clear to me.
Ellen, I don’t know him personally but I do know that a certain Jonathan Martir is very close to and has worked very closely for “intel services” of the AFP and govt at the highest levels. I’m afraid that if this is the same Jonathan Martir (and he should be; how many Jonathan Martirs can there be?), from what I learned, not a few folks from the military owe him a few favours.
If Querubin doesn’t run for public office, he will be retirable only in 3 years which means that in the traditional scheme of military affairs, he could have made it to two-star rank like Miranda. (I doubt he would have made it to FOIC or CSAFP.)
Si Brigadier General Gaudencio Pangilinan, PMA ’78?
Nakow! Huwag ninyong gaganyanin ‘yan. Matapang ‘yan.
Mali! PMA ’79 na pala ‘yan.
Row 4!
BGen Gaudencio “Boygee” Samin Pangilinan is a former PMA 78 but turned-back to PMA 79.
Boygee is a master of militics, a great manipulator.
As Kaibigang Spy once said:
“He’s corrupt, traitor, and opportunist.
He is hated in the Army and unpopular in the intel community.
He can impress politicians and acquaintances with his eloquence but once you know him, he’s nothing but garbage.”
Liwayway,
“It is a great foolishness of any commander to send a flag officer (star-ranked) on a COVERT mission”
Anong kasinunaglingan na naman ang sinasabi? They sent a flag officer on a COVERT mission? Paano magiging covert mission yan e kilala kilala na yan? If they want to lie, they should at least try a goood lie.
Hihihih! OK ako jan sa suggestion na yan! Tawagin sila Ka Roger para tumulong itakas.
Liwayway,
Ang best friend ni Boygee ay from Class 78, from the Air Force, who is now serving Gloria in Malacanang, ass, boot and everything. Last time I heard this best friend was deputy cdr PSG.
I heard that CGPAF Rabena of PMA Class 1978 (siya ba ang best friend ni Boygee?) will be the next CSAFP maybe in November or December this year. Bangit will remain as CGPA because he is so controversial and they need him as head in PA. Anyway, Bangit is retirable in July 2011 pa, so he can still be CSAFP after Rabena.
According to AFP Spokesman LCol Brawner, any soldier who will be seen joining the rallies on Wednesday will be discharged from the service… tinatakot na nila yung mga sundalo.
Eh bakit si Gen Angelo Reyes CSAFP, LtGen Villanueva CGPA and LtGen Defensor CGPAF who went to EDSA in 2001 – they were not discharged. They were promoted and eventually became the AFP Chief of Staff pa…
Eh bakit si Gen Angelo Reyes CSAFP, LtGen Villanueva CGPA and LtGen Defensor CGPAF who went to EDSA in 2001 – they were not discharged. They were promoted and eventually became the AFP Chief of Staff pa…
Jose..to the Victors go the spoils of war..the same as in “real” war, the only war criminals to face the court of International Justice was the Losing Side.
LtCol Brawner’s principle is galaxy away from his late uncle, BGen Felix Brawner. He (LtCol) is allowing himself to be the mouthpiece of the puppet military leadership in trumpeting lies coming out of the asses of the malakanyang psychopaths.
Liwayway: re Capt- Langkit and Lt.
ang tungkol naman kay BG Pangilinan..I will take your word for it…matapang nga siya..dahil sa kangyang katapangan he
removed his private conscience for the sake of his president even though peke and not duly elected. It does take courage for a military officer, a general at that to do that..instead of To Protect the People, and To Protect the Nation..and I am hope I am wrong but it seems that what you are now saying To Protect Gloria and To Hell with the People and the Nation! It takes indeed a deep sense of distorted courage…May you and your president..join your god..in hell..

Since this is gloria, the commander-in-thief we are talking about, it was really foolish and she was great at it. Nothing like a consistent idiot.
There was a glitch with my entry of June 8, 2009 11:48PM
Ignore it.

According to Martir, he was on a confidential mission on May 26, 2009 that is why he was not able to attend the Court martial hearing.
Martir’s mission was so confidential, he himself didn’t know about it.

Martir’s confidential mission – memorize the transcript.
once the Tanay Boys will be released and found not guilty..will they be given their well deserved ranks retroactively? Kung mawala na si putot (it is just a matter of time..malapit na) and since there were no charges to find them guilty..they should be compensated and promoted..Ang sabi nga kanina sa Gospel Readings..on the Beatitude..”Blessed are those who hunger for truth and justice they will be satisfied.” kaunting tiis na lang at on June 12 we will celebrate our independence from Gloria
Macapagal Arroyo’s tyranny..a.k.a. Greedy Magnanakaw Ako!
She does not deserve such insults.
Bakit hindi niyo ba alam na nag suffer din siya in silence noong mga more than 400 days na nang ibang bansa siya? She did this in order to acquire knowledge on computers so she can transfer such skills to this unit she so love especially the handsome men in this unit, able to transform the handsome marines into tough and agile conducting counter terrorism in the hot jungles of the cyberworld.
We refuse to be compassionate. We refuse to understand how Joana must have suffered missing the warm tough hands of the marines in the Philippines. Now that she has come back to transfer her skills to her beloved unit, we mock at her?
Ingratos!
I am sorry for my having overlooked at the proper rank and designation of the General. It should have been written: MGEN JOANA MARTIR, WAC.
jose miguel,
But we did not mean that much, eh. To be cruel to her, to be exact.
KARMA remember Gen.
tinatawag nila akong bakla ? At higit sa lahat,
bakit ako napapatingin sa mga guwapo ?
DOCTOR: Ganoon ba ? Eh kailan mo pa naramdaman ang kaka-
bang pakiramdam na ito ?
MARTIR: Noong ako po ay DALAGA pa.
The Fortun Law Office may be a good office but it still all comes down to the right price. My sister-in-law’s husband who shot and killed her is still out roaming freely and no decision yet to convict him. The criminal’s family hired the services of Atty. Fortun.
