I, SUZETTE S. NICOLAS, of legal age. Filipino, a resident of Zamboanga City, after being duly sworn in accordance with law, hereby depose and state:

1. I am a Bachelor of Science graduate, major in Management Accounting, of the Ateneo de Davao University. Soon after my graduation, I took up nursing in 2004 at the Ateneo de Zamboanga City and at the same time assisted in managing our family owned canteen located inside the military base of the Southern Command. My mother was a civilian supervisor of the Philippine Navy for 25 years while my deceased father was a Philippine Navy Officer.

2. Since our canteen also catered to American servicemen who stayed at the military base every time their vessels docked in Zamboanga City, my family came to know many American servicemen who would go to our canteen to eat and buy souvenir items. We treated them as family and we would go out of our way to talk to them, play cards and on many occasions, my mother would even cook special meals for them. They would even entrust their ATM cards to us to withdraw money for them from the bank. My former boyfriend, Brian Goodrich, is also an American serviceman.

3. After working in Swift Foods Inc. since January 22, 2007, I decided to quit my job as a Credit Accountant to pursue my studies in the United States through the help of my family, relatives and close friends. I know that they supported me so that I could finally move on after my tragic experience in 2005 in Subic, Zambales which led to the trial and conviction for rape of Daniel J. Smith.

4. Deep inside, however, I know that I may never be able to move on for as long as I continue to search for answer to so many questions that have lingered in my mind regarding the incident in Subic more than three years ago. Daniel Smith was convicted of rape because the court accepted my version that he took advantage of my intoxication in raping me inside a van that took us to the seawall located at the SBMA Alaba Pier at around 11:30 in the evening of November 1, 2005.

5. Daniel Smith’s witnesses said that while we were at the Neptune Club, I sat on Daniel Smith’s lap and that we kissed each other passionately. I remember that before I met Daniel Smith at the Neptune Club, all I ate was a slice of pizza at the Grand Leisure Hotel. After the pizza, everything else was alcoholic drinks from vodka sprite, B52, Singaporean sling, B53, long island ice tea to bullfrog all of which I drank bottoms up. I do not recall Daniel Smith having ordered any alcoholic drink for me. My drinks were all paid for by Chris Mills who invited me to go to the Neptune Club.

6. I had no opportunity to deny in court that I kissed Daniel Smith but with the amount of alcoholic mixed drinks I took, my low tolerance level of alcohol and with only a slice of pizza all night, it dawned upon me that I may have possibly lost my inhibitions, became so intimate with Daniel Smith and did more than just dancing and talking with him like everyone else on the dance floor. Looking back, I would not have agreed to talk with Daniel Smith and dance with him no less than three times if I did not enjoy his company or was at least attracted to him since I met him for the very first time on the dance floor of Neptune Club.

7. When I danced with Daniel Smith for the third time, my companion, Chris Mills has already left Neptune Club since he had to catch their curfew time at the military base. The lighting was sufficient for people to recognize each other and other marines were with their Filipino partners drinking, dancing and enjoying each other’s company and kissing and hugging among partners was a common scene.

8. With the events at the Neptune Club in mind, I keep on asking myself, if Daniel Smith wanted to rape me, why would he carry me out of the Neptune Club using the main entrance in full view of the security guard and the other sources? Why would the van park right in front of Neptune Club? Why would Daniel Smith and his companions bring me to the seawall of Alaba Pier and casually leave this area that was well lighted and with many people roaming around? If they believed that I was raped, would they have not dumped me instead in a dimly lit area along the highway going to Alaba Pier to avoid detection?

9. I told the court that Daniel Smith kissed my lips and neck and held my breast inside the van. Recalling my testimony, I ask myself now how could I have remembered this if witnesses told the court that I passed out and looked unconscious when I was brought to the van by Daniel Smith. How could I have resisted his advances given this condition? Daniel Smith and I were alone on the third row of the van which had limited space and I do not recall anyone inside the van who held my hand or any part of my body. What I can recall is that there was very loud music and shouting inside the van.

10. If the travel from Neptune Club took only several minutes and with the driver of the van trying to beat the curfew time of his passengers, how could I have instantly regained my consciousness and talked to the people upon reaching the seawall of Alaba Pier? When people gathered around me at the seawall, everyone seemed to have drawn the conclusion that I was raped except for one who called me a bitch.

11. Based on the account of SBMA police, I was very hesitant to board the mobile police car that brought me to the headquarters for investigation. I was so confused and the first thing that entered my mind was how would my mother and boyfriend react if they learn that I was last seen with Daniel Smith and that a condom was seen on my pants after Daniel Smith left the van? I was scared of losing not only my American boyfriend but the chance of living in the United States. In fact, I did not immediately tell my boyfriend that I was raped by Daniel Smith. All I said was that something bad happened to me.

12. I expect many sectors to question my motives in executing this statement more than three years after the incident. However, as I practically grew up interacting with American servicemen in Zamboanga City who treated me and my family very well, and thinking over and over again how I may have conducted myself at the Neptune Club, I can’t help but entertain doubts on whether the sequence of events in Subic last November of 2005 really occurred the way the court found them to have happened.

13. My conscience continues to bother me realizing that I may have in fact been so friendly and intimate with Daniel Smith at the Neptune Club that he was led to believe that I was amenable to having sex or that we simply just got carried away. I would rather risk public outrage than do nothing to help the court in ensuring that justice is served.

After two years of agonizing litigation, it took President Obama just one phone call to the Evil Bitch to close this rape case. Yet, Malacanang bragged about Obama’s call as if it was a big deal. The call was to order the Bitch to end the Smith case once and for all as well as stop the review of the VFA.

    In a country where affidavits are submitted, faked, altered, or whatever, it’s easy to believe that witnesses recant without the slightest hesitation.

    Word of honour? My word is my bond? Many Filipinos don’t know the meaning of these words. That’s why the Philippines remain in a mess.

    I think you’re referring to perjury charges. But then, I’m sure they have already made an arrangement and signed a contract that no further claims, civil or criminal, shall be initiated by any party. It’s up to the RP government to pursue this perjury charge but I seriously doubt it.

    There are reports that if you want to legalize your stay in the US, you could work as a CIA informer. That explains why there were some Filipino fugitives now comfortably residing in the US and free to travel to RP to gather information for Uncle Sam.

    Can you blame her? Let’s not kid ourselves. A lot of our kababayans will gladly be in her situation, sad to say, maiahon lang ang kanilang mahal sa buhay sa kahirapan. It’s a jungle out there, it’s true, but in the end she made a bad situation into something that, perhaps, may better her loved ones lives.

    Coming to the US is everyone’s dream. Kahit na sabihin pa na palubog na ang US, there is still that concept na it is still the country of milk and honey and an economic freedom for everyone not found anywhere else.

    I just do not know who the man is who would take Nicole seriously knowing what she has done to herself, Smith and the legal system. Her lawyer was duped, to say the least. I just hope that whoever this guy is who is her “hero” and who is willing to forget her past and settle down with her is for real!

    We may disagree, but Nicole’s life is hers to live.

    A case is not just about crossing blades and besting the other lawyer. Nor is it only about “high principles” – sovereignty, Constitutionality of treaties, etc. It is about people, their lives, and the damage that one says the other caused. Can we undo the damage? If not, can we at least mitigate it, and help the aggrieved pick up the pieces of a shattered life?

    And which of them do we make whole? Some people here believe that Smith destroyed Nicole’s life; others believe that it is Nicole who has wronged Smith with the accusation.

    The cause-oriented champions see these people as footstools to step on, to hold higher the banners of their causes; Ursua, her feminism, and maybe the need to exact retribution from the arrogant foreign chauvinist; the nationalists, the need to prove that the administration has betrayed the people in the continued observance of the VFA. Lost in the passion of causes championed is the true empathy for the suffering parties. For whomever you believe as being aggrieved, they are, in fact, suffering – they have lost their privacy, their anonymity, and are being gawked upon like fish in a fish bowl.

    So Nicole has chosen to accept the offer of a settlement – emigration to the US, perhaps even a green card on some assumed name. That will certainly better her life, and that of her family. If she fought to the end, what would she achieve? Smith may be convicted for life. But would that undo the damage to her? A new identity may not, but it would certainly prevent further pain.

    Can we blame her for her choice? Must we insist on our “ideals”? Or can we muster the charity to allow her a shot at a new life, and some peace of mind? Perhaps, from the bitter fruit of this experience, and the flesh of a new beginning, both Nicole and Smith, separately, can make ampalaya con carne with their lives. I pray neither will squander this opportunity.

    But we must now confront the devil who forever lurks in the details. The case is on appeal. Can you introduce evidence on appeal? Mukhang hindi.

    Kailangang planchahin Raul. Looks like you have another pressing engagement.

    By the way, have you tossed the coin to determine if there is probable cause against the Alabang Boys?

    Be Cool! stop blaming the VFA.You need to be more reasonable.Daniel Smith is wrongly accused. I think Nicole just want to get all the publicity from the media.She just wants to get her own share of fame. She’s another hypocrite who wants to get an American husband so that she can come here in the US. When things did not work out she just accused the poor fellow of raping her. Nicole is wicked.There are many gaps between the testimonies,first, why are the filipinos complaining about the verdict’s decision when the philippines always seems like a dog’s tail to america. we rely on them, in fact some think that they too want to have sex with an american,they say they hate americans but they want to go to america.

    Nicole first denied that she was raped but took her word back after that,it really means that nicole is lying and Daniel Smith is innocent.The 40 year sentence is wrongly done.

    I Believe that Daniel Smith is just another victim of the Dirty Politics of the Philippines. Although most ordinary Filipinos are hospitable and good hearted, almost all the public officials in the different Philippines government agencies are crooked and corrupted. From the top officials to the low rank civil servants, a large majority of them are dishonest, corrupt and irresponsible. Daniel Smith just happened to be at the wrong place at the wrong time. He’s caught in between the extreme femninist and right wing groups and the government who only know how to play politics. The woman “nicole” has made many inconsistent statements. She is not to be trusted. I pray that there is still some good people who will give Daniel Smith freedom as he should be allowed to come home here in the US. He does not belong to the Philippines. The US Government should do its best to get him back home here.

    I believe that Nicole’s rape case has been settled in all angles. Trust Gloria, she already covered all the bases right after Barack gave her the ‘urgent’ call.

    From Nicole’s affidavit, it seems that she has cleared Smith of rape, pinalabas niya that the sex was consensual due to both of them being intoxicated…nalalabuan daw siya, etc.

    As to the legal consequence because the Supreme Court had already spoken, trust Gloria again. Pinas courts, including the SC, are hers.

    Daniel Smith will come home soon. Uncle Sam, no matter who the president is, takes care of his people.

    Nicole’s case is winner takes all! Them all are winners except those who truly supported and believed in Nicole and her fight. Naiwan sila sa pansitan!

    Who knows, baka pakasalan ni Smith si Nicole sa Amerika, and they will live happily everafter, hehehe!!!

    I’m more surprised and upset with the Smith rape case than this Dacer murder case. The rape victim is now already in the US and terminated the services of her lawyer who took care of her for two years. Why the US of all the countries? Because it was the arrangement between the Evil Bitch and Washington perhaps in exchange for the return of Mancao and Dumlao. This Nicole is now saying she was not raped and that she was so drunk at that time to remember. She also said she liked Smith and had good sex with him. To those guys in the US, I want you to hunt down this Nicole and rape her again. Just buy her a few drinks and you get it.

    True, affidavit was made and signed under oath. But, the court would still require the the person to confirm it. Good if it was prepared by a legitimate notary public. What if it was a naughty or notorious public?

    If the Nicole case is settled, then the Salonga case before the Supreme Court becomes moot and academic. There is nothing to decide (whether or not the provisions are skewed against the Philippines, re custody of prisoners), because there is no prisoner.

    The Supreme Court will not decide a hypothetical question. Walang Smith na dapat ikulong, walang kaso ukol sa custody provisions.

    Tama ka Chi, pero maraming tao ang gagamit o gumagamit ng iba para marating ang lahat ng pangarap. Sana na lang maging maayos ang maging buhay nya. Pag dasal na lang natin sya at lahat ng mga naging biktima.

    Agree ako sa iyo, Dean tungkol sa “goal” ni Nicole. In fact, I was one of those pinays who did not fully support her claims of rape by Smith. Meron kasi ako na hunch na ginamit lang niya ang insidente to pursue her long term goal. Nagulangan niya ang mga Gabriellas.

With a weak resistance, Americans continued raping our institutions one of the earliest of which was our military. Then they proceeded with the governance, economy, the education and our communication. We were infected by a Heritage Injuring Virus. The identity we inherited from our fathers and which defined our relationship among us Filipinos was injured. This corrupted every system of the life of our nation. This corruption replicated from the defense system, spread to the other systems until it spread to our culture and finally into our national psyche. This replicated from one generation to the next.

    The symptoms are: a whole new generation of dependent people drawing life from and willing to give all of their most treasured assets to the trespasser; and an autoimmune defense system which now recognize as the enemy, the self (us, Filipinos) trying to resist the foreign invaders and their collaborators who is now recognize as the superior or super ego. We are now in the stage of Alienated Identity and Defense Syndrome. Our defense system has been corrupted.

    Nicole is just a cell of our body as Filipinos which was corrupted by that Heritage injuring Virus transmitted by the Americans thru the continued rape of our institutions. With the corruption of our national system by this virus, the identity of each one of us with our nation has been as a consequence, corrupted. How then, could we have love for one another.     Yuko, in the late 70s and mid 80s when I used to travel to Japan, I was a size 4 and very young. Whenever I checked into a hotel, the staff would look at me from head to foot and I felt so belittled but I was lucky that somehow, I found half Filipinos amongst the hotel personnel. Some of them spoke very good English so I had clear communications with them. After a few minutes of scrutiny, I was treated very well. Actually, the front desk personnel even helped me with mapping my itinerary everyday. They would write the addresses in Japanese and I just gave the directions to the taxi driver. It helped a lot!

    Everyone is lambasting and even ridiculing Nicole for what she did. From blogs, radio phone-in calls, text jokes, etc… No one has nice words to say about her after she recanted. But you know what? There’s something that we have to thank her for. And that is the issue of the VFA. It brought to the open the issues that we have to tackle with regards to VFA; What’s beneficial to us being the host country? What happens to US soldiers who commits a crime or violated our laws, etc.. Should we renegotiate or just scrap the whole thing altogether? For me, it’s a wake up call. Who will know that one day a “real” rape will or will not happen? And if it does (God forbid). How will we face again the situation? How will our gov’t as well as the media and ordinary folks like us protect the victim?   188. Ah, the Philippine Statehood Movement! It was founded by Nueva Ecija Congressman Rufino Antonio in the early seventies who claimed that at its peak they had six million members. He donated a huge sum to the movement’s fund and got the support of another congressman, Bartolome Cabangbang who happens to live in our street, about seven houses away.

    They started the movement because the $2Billion America has earmarked for the country’s rebuilding after WWII just made it into the politicians’ pockets, their cronies and their relatives. At one point, even US visas were bidded out to the Chinese by Congress the group figured Statehood was the only answer, the cure-all elixir for all our ills.

    They claimed we could use American administrators to instill discipline and order among the ruling class and their interests, demonstrate to us the workings of a true democracy, defeat a growing Maoist underground movement, and setup Manila as the American HQ for trade and commerce in the region, to compete with Japan who had rebuilt their war-demolished economy into the most robust one in the Pacific.

    Nationalists lambasted the movement, journalists like Chino Roces, Teodoro Valencia, Isagani Yambot (of today’s PDI) Teodoro Locsin and it looked like Pinoys were, for once, united against what they considered the treasonous surrender of independence.

    Despite the huge initial following, the movement didn’t fly as it was at this time that Marcos was convening the Con-con to pave way for his perpetual rule and the events were eclipsed by Martial Law which promoted fierce nationalism.

    I never saw what Cong. Antonio looked like, he faded into the sunset but I can never forget our old neighbor Cong. Cabangbang who flew the American Flag in front of his apartment and took the cudgels for the movement after Antonio gave up.

    He was quite confident Filipinos would certainly choose to be American citizens that in the elections which the opposition boycotted, Cabangbang was Don Quixote de la Mancha who contested the presidency versus Macoy, it was a boring, lopsided slaughter, of course.

    That marked the end of the Movement. Cabangbang later died in the 90s poor and alone, very few people attended his wake in the dilapidated apartment. All the middle and upper class-dominated statehood sympathizers never cared about their leaders. Movements, like this statehood one, were doomed to fail because it never had a genuine soul. It was all about American dollars and US visas.

    That was in the 70s. I’m awed many people still have not changed at all. Tsk tsk tsk.

Danny Lim, et al are living proof that the AFP has not YET deteriorated to being irredeemable.

    Sabihin na nating may 2,000 mga Filipinas na nag “pu-puta” sa Japan. Ergo, yung mga dalawang libong iyon lang ang masasabi nating nag “pu-puta.” Ergo, hindi lahat ng Hapones ay Yakuza.

    In short, to be just and kind to the innocent, it is perhaps better to condemn the person/s who deserve it, and just leave the nationality aside in respect for the rest of the people who deserve nothing less.

    With just a leader with strong, morally upright and a nationalistic political, economic, mass communication, educational and military base, we can turn this tide of misfortune. At the start of development of their present nationhood, France, Finland, Japan, Israel and Vietnam had a leadership group with a strong base who engaged their nation in a DELIBERATE program based on nationalistic development concepts. It is still natural since the program was organic to them, not foreign as in our case.

    Which brings home the point that “we have been programmed to stay this way” by the Americans to achieve their vision of an America secured in its economic base and physical existence. To achieve this, America programmed us Filipinos to think subconsciously that a security for a benevolent master is security for it’s slaves, which by nature, benevolent master is the definition of America, and slave is the definition of Filipinos.

    Proofs that subconscious mind works wonders are: the way people with access to political power including GMA have been prostituting our resources at the service of Americans and the Chinese and many of us Filipinos accept it as for the good of our national security which more importantly means individual security.

    But the mere fact that many of us Filipinos are becoming aware of this will turn our subconscious mind to act as a team to resist this continous corruption of our national character.

    Then we, will be able to turn the tide!

We all know that the Justice System of this country is the most corrupt. 2 years of waiting for Justice? who can be a reasonable woman to wait for things to happen. This case is a drag. I will not blame Nicole for moving on. The Justice system in this country cannot represent the people. It will instead free guilty foreigner from jail and send the rest of the people in hell.

    people must understand that this RAPE case is an offense AGAINST the PEOPLE OF THIS COUNTRY, not against Nicole.

    The case is “People of the Philippines versus Smith. ” Nicole is the victim and the witness. eh sino bang maghintay sa kakawitness kung wala naman palang magawa ang korte kundi appeal daw. si nicole pa ang na rape , siya pa ang mali.

    May intermission pa nga yung Nicole-Smith version; Jalosjos naman. Plus yung anticipated concert ni Mancao.

    The main event of course that happens behind all these smokescreens is the ongoing China-US dancing a violent tango with Malacanang in the middle.

Danny Lim – sa 2010, even *if* indeed we get hold a relatively clean election, this cannot be the solution to our collective sufferings. Only a revolutionary change can usher in a new dawn.     Suzette needs to change and improve her life in the US. Agree with some commenters she be given a chance to become productive whereever she is. Her recantation of a serious rape case diminished her credibility and for her to be seen embracing the never ending nightlife in bars especially close to any military bases. This certainly will be a recipe for disaster. That’s the bad part, but I do wish her the best. We should all do.

FYI, The barangay chairman of Bgy. 99 threatened Sim Delantar to stop pimping the child or he would tell the sisters in St. Mary’s that their student was being forced into prostitution. Not wanting to lose his bigtime client Jalosjos, Delantar instead moved his operations to another barangay.

  234. My comment about Jalosjos seems incomplete. What I’m trying to say is the 11-year old prostitute isn’t even complaining she was raped. All the while, what she knew she was being paid handsomely for sex. The pimp’s greed led to his blackmailing of Jalosjos, but media took up the girl’s cause and noisily campaigned for the congressman’s and the pimp’s conviction.

    In Nicole’s case the victim WAS complaining and during trial she had rejected all offers of settlement. After the favorable judgement of the court, and getting her vindication, she now wants justice to be served, to Smith?

    the jalosjos case is a statutory rape. an 11 years old girl cannot consciously understand her act regardless if she was selling her body at a young age. The prosecutor does not require evidence to prove guilt. A man can be automatically guilty if he engages into sex with a girl of less than legal age. This type of rape is statutory rape mandated by our Consitution. It is a strict liability law.

    On Nicole , no reasonable person will wait for Justice of an almost 3 years old case. It’s frustrating. Her testimony may not be relevant to a reversal of guilty verdict because Nicole’s recent testimony was not the direct or the proximate cause of the actual original offense. The guilty verdict still stands. Rape is a crime against society, public moral and public Law. The prosecutor initiate the case not the victim thus the case is republic of the Philippines versus Smith. Nicole becomes the victim and the witness. If an acquittal scenario is likely then she’s not the only loser but the whole Republic against Smith.

    Rape must be proven beyond reasonable doubt. Bail may have kept Smith from jail at the very beginning until proven guilty but settlement cannot be possible in criminal law proceeding. In criminal case, the prosecutor must prove beyond reasonable in behalf of the victim Nicole. This is not a civil case where the victim will initiate the suit and may settle the case prior to the court’s decision. Rape is a criminal offense with a different proceedings. Nicole’s rejection of all settlement was a strong evidence that she was indeed RAPE and seeking justice from the very beginning. She could have not known 2 years ago that this case has become her nightmare. That was her state of mine at that time which may not be relevant to her current decision.
