The Office of the Ombudsman on Friday junked the 2004 case filed by slain journalist Marlene Esperat against Agriculture Sec. Arthur Yap, former Agriculture undersecretary Jocelyn “Joc-Joc” Bolante, and other officials over the illegal use of public funds.
In a telephone interview with GMANews.TV, Anna Sanchez – media officer of Ombudsman Merceditas Gutierrez – confirmed the ruling on Esperat’s complaint but did not disclose any further details, saying a press conference will be held Monday regarding the resolution.
Lawyer Harry Roque, who has made it a personal crusade to find truth and justice in the fertilizer scam, said: “I hope that Merceditas Gutierrez can explain that to the children of Marlene Esperat who all witnessed her gruesome murder.
“Merceditas Gutierrez is a disgrace to her office and to this country.”
Roque warned that the dismissal of the Esperat case against Bolante, Yap and other officials “is apercursor of what will happen to the rest of the complaint.”
In an earlier report, radio dzBB’s Manny Vargas said the Ombudsman dismissed the case because the evidence presented failed to prove the guilt of the respondents.
The resolution was approved by Overall Deputy Ombudsman Orlando Casimiro and Assistant Ombudsman Jose de Jesus Jr upon the recommendation of Director Elvira Chua of the Ombudsman’s Preliminary Investigation, Administrative Adjudication and Monitoring Bureau, the radio report said.
To recall, Esperat, a former fact-finding investigator at the Department of Agriculture (DA) on July 27, 2004 filed before the Ombudsman charges of illegal use of public funds against Yap, Bolante, seven other senior officials of the department, and a fertilizer-firm owner for the distribution of some P432-million worth of fertilizers in 2003.
After blowing the whistle on an alleged fertilizer fund scam, Esperat was murdered in front of her 10-year-old son in their house in Tacurong City on March 24, 2005. Three of the several suspects in the killing of Esperat – Gerry Cabagay, Randy Grecia and Estanislao Bismanos – have been sentenced to life imprisonment for participating in her murder.
Meanwhile, Bolante, the alleged architect of the P728-million fertilizer fund scam, is currently under Senate custody at the St Luke’s Medical Center in Quezon City. He returned to the country last week after fleeing to the United States allegedly to escape the Senate investigation into the fertilizer controversy. – GMANews.TV

Got me confused here!!! Is the Ombudsman sitting in Judgement here or the Case is to be judged by the Court of Proper Jurisdiction in A Process we call Trial? The Guilt,the innocence of the respondents as could be proved by the evidence is for the Court to determine, not by the Ombuds.

We need to look deeper and locally. We need to be vigilant and be pro-active with our corresponding government officials at the local level. They are also corrupt.
Sept 16.2008: “The Department of Agriculture said yesterday its regional field units have already adequately answered the issues raised by the Commission on Audit on the implementation of certain DA programs and projects at the local level last year, but the COA had unfortunately failed to include most of such responses in its final 2007 report”
Yap pointed out that the DA does not purchase the inputs but only gives the subsidies or program funds to the accredited suppliers after a verification process based on the master lists of farmer-beneficiaries that had been submitted by the MAOs to the Department.
Earlier, Yap bared DA plans to investigate last year’s distribution by MAOs of government-subsidized seeds and fertilizer to farmer-beneficiaries in certain provinces where the COA claimed to have found certain irregularities.
The investigation will likewise pry into the COA-reported claim by some of the MAOs that the supposed discrepancies were a result of changes in the recipients due to “political intervention,” which the COA did not elaborate on, he added.
Yap pointed out that the DA recently forged an agreement with governors on the detail of MAOs to the Department’s regional units precisely to enable the DA to closely monitor from hereon the distribution by MAOs of DA-released fertilizer and seed subsidies to farmer-beneficiaries”

Mrs.Bolante walked into Joc-Joc room one day. Joc-Joc missed his wife so much and asked his wife.
“If I were disfigured, would you still love

In an earlier thread, I quoted the US Senate Resolution on the investigation of the Attorney General in McGrain v. Daugherty. Yan ang puwede gawin ni Mar Roxas, in regard to the glacier-like speed of Merceditas Gonzales in the cases before her office (Chavit, Bolante, et.al).
Yung IBP, na may mga reklamo rin, their Board of Governors can institute proceedings motu propio to investigate Merceditas for her gross misconduct and non-feasance. Kapag na-disbar yan, automatically disqualified yan bilang Ombudsman.
She can raise as defense that she is investigating, but it is taking time. We can turn the tables on this administration and develop the doctrine of constructive non-feasance; if an investigation is going through the motions, but takes longer than Erap’s court trial to find probable cause, then there is constructive non-feasance, tantamount to non-feasance. Non-feasance is a ground for disbarment for violation of the lawyer’s oath that “I will delay no man for money or malice.” In this case, the delay is not to one man, but to the sovereignty.

The Ombudsman serves for a term of seven years, and may only be removed by impeachment.
But the Ombudsman must be a lawyer. So, kung na-disbar, that automatically disqualifies her.
Also, all the dismissals of the Ombudsman are without prejudice, meaning, the cases may be revived. So, when they leave office, some new appointee may still go after the culprits, including this Ombudsman for corruptly aiding in the concealment of the offense. That is why they want to stay in office, or anoint a stooge to run for them.
