Sa hearing ng House Committee on Human Rights na pinamumunuan ni Rep. Erin Tañada noong Martes, halatang shocked si de Lima sa mga ikinuwento ng mga asawa ng nakakulong na opisyal sa military na sinampahan ng kasong mutiny dahil sa nagplano raw silang mag-withdraw ng support sa pekeng administrasyon ni Gloria Arroyo noong Pebrero 2006.
Ikinuwento ni Maria Fe Aquino, asawa ni Maj. Jason Aquino ng Army Rangers, noong Feb. 27, 2006, inimbitahan ng Intelligence Security Group ng Philippine Army ang kanyang asawa. Diniretso na sa maximum security jail.Walang kasong isinampa.
Siguro naman alam natin kung anong hirap ang hindi mo alam kung may kasama ka sa pamilya mo na hindi nakakauwi ng bahay. Hindi mo alam kung saan hanapin. Hindi mo rin matawagan.
Sa pang-apat na raw lang nalaman ni Marife na nakabartolina na pala ang kanyang asawa. Kapag sinabi nating bartolina, kulungan yan na maliit ang butas sa itaas. May higaan. Nandoon na rin ang kubeta.
Limang buwan si Maj. Aquino sa bartolina. Kung bibisitahin siya ni Marife, nakaposas at nakatakip ang mata. Pahirapan kung magbibisita sila. Maliban sa pinapahintay sila ng matagal, kinakapkapan pa sila.
Binantaan pa si Marife ng mga taga ISG na kung sasampa siya ng kaso laban sa kanila, lalo siyang pahihirapan. Ang mga taong may kinalaman sa kaso ni Jason ay sina dating chief of staff Hermogenes Esperon, Brig. Gen. Jorge Segovia, Col. Eduardo Ano, Lt. Col Cristobal Zaragoza, Lt. Col. Marlu Guloy, Lt. Col Imbang, Maj. Joel Mariano at Maj. Joseph Canieso.
Hindi lang kay Maj. Aquino ito nangyari.Si Capt. Dante Langkit sampung buwan sa bartolina. Hanggang ngayon nasa ISG pa rin siya nakakulong.Nakahiwalay siya sa ibang kasama niyang akusado. Ilang beses siyang kinausap ng mga sugo ni Esperon na magbigay ng affidavit na ididiin si Brig. Gen.Danilo Lim. Ayaw ni Capt. Langkit dahil hindi naman yan totoo.
Nandoon din sa hearing sina Maria Flor Querubin, asawa ni Col Ariel Querubin; Gay Parcon, asawa ni Lt. Col. Custodio Parconm at ang kanilang anak na si Kiko; anak ni Col. Nestor Flordeliza na si Ronnie, Millet Almodovar, asawa ni Capt. Montano Almodovar; Winda Fontiveros, asawa ni Capt. Joey Fontiveros; Cletty Sababan, asawa ni Capt. James Sababan; Josephine Sales, asawa ni Cpat. Frederick Sales; Mazenith Cordero, asawa ni Lt. Jacon Cordero; at Helen Acosta, pinsan ni Lt. Belinda Ferrer.
Sabi ni de Lima, bawal ang torture.Ayon sa batas, lahat, sibilyan at military, ay inosente at dapat tratuhing inosente kung hindi pa siya nahatulan “guilty” ng korte.
At ano ba ang kasalanan na ginawa nitong mga opisyal? Hindi sila kasama sa nandaya, hindi sila nagsinungaling, hindi sila nagnakaw. Sila ay naninindigan na ang military ay hindi dapat ginagamit sa pandaraya sa eleksyon.
Sabi nga ni Rep. Carlos Padilla labag sa labas ang ginawa ng militar na pagpahirap sa mga opisyal at sila ang dapat kasuhan. Dapat ang kasuhan at parusahan ay ang mga nagpahirap sa mga walang kasalanan.
Ginawa itong hearing dahil sa privilege speech ni Rep. Teofisto Guingona III. Sabi ni Tañada titingnan nila kung pwede ma-amyendahan ang mga batas para masigurado na maprotektahan ang karapatan pantao ng lahat, sibilyan man o military.
Bilang sagot sa balita na iyan ay sinabihan ni Teodoro ang mga detenadong military officers na magharap ng reklamo sa supposed violation ng kanilang karapatang pantao sa AFP.
Isang gago pa rin itong si Teodoro. Ano, magharap ng another kaso sa kangaroo court ng AFP?! Para que?
Kung seryoso ang sekretaryong ito ay dapat paimbistigahan kaagad niya nag reklamo ng human rights violation dahil sa Kongreso na iyan isinawalat ng mga kabiyak pa mandin ng mga akusado.
Although I respect Leila de Lima, hintayin ko muna kung kaya niyang banggain si siRaulo na ngayon pa lang ay pinapalagan na ang kanyang “rubout” statement, at si GloriaAsspweron sa kaso ng human rights violation ng Tanay boys.
Nakakasuka itong si Teodoro, sa military daw isiwalat ang grievances ng mga nakakulong! Nagpapatawa ba siya? Ang military nga ang may problema. Sila ang gumagawa ng katarantaduhan. SA pamamagitan ng mga henerales na katulad ni asspweron, ginamit ang mga sundalo para mandaya sa elksyon. Tapos hindi pa natapos dun. Ginamit ulit si uto utong Mayuga para linisan ang pangalan ng mga ito. Bulag at tanga ang tawag doon! Alalahanin din ni Teodoro na kahit wala na si asspweron, nandyan pa sa AFP ang mga alipores niya-Calunsag, Espino, si John Rat Martyr at iba pa. The “Gangsters” in the AFP are very much in power! So, yung sinabi ni Teodoro na sa military dapat ibigay ang grievances? Forget it! Para lang kumanta ang mga nakakulong sa mga “baka”! Hindi nakakaintindi, bulag, bingi at walang mga kaluluwa!

CHR is supposed to be autonomous. That’s why we should be vigilant and support those who are standing up to the pressures of the powers-that-be.
This is what Defense Secretary Teodoro said:
“If their rights were violated, they should file a complaint through the chain of command, through the chief of staff, so that these will be investigated and, if it is proven, [then] appropriate action will be taken,” Teodoro told reporters in Camp Aguinaldo.
“We can’t allow them to go straight to Congress and use it as an alternative forum, and break military protocols and military controls,” he said.

i assume the commission on human rights is part of the judiciary, de lima having been sworn by the chief justice. she is also known as an election lawyer not as a human rights lawyer. she was also thought of as candidate for the comelec chair but did not get that appointment.nonetheless she is supposed to be brainy having been a bar topnotcher.

The CHR is an independent, constitutionally created body (Section 17, Article XIII)..
Among its powers are:
(4) Exercise visitorial powers over jails, prisons, or detention facilities;
So Commissioner De Lima can just walk in and check up on the detention facilities. She can investigate the physical conditions, and if the military does not cooperate, can cite the parties in contempt.
Of course, the teeth of the law are reposed in the police. Can she exercise moral force over the PNP? Who knows? Didn’t Pope Leo stop Attila the Hun from attacking Rome by sheer moral force? Kaya ba ni De Lima? Well nothing ventured nothing gained di ba?
(8) Grant immunity from prosecution to any person whose testimony or whose possession of documents or other evidence is necessary or convenient to determine the truth in any investigation conducted by it or under its authority;
Wow. I like this. Panay ang panakot ng mga Pidal about charging somebody testifying against their conjugal banditry with perjury, libel, etc. But De Lima can grant immunity to say, a witness about the disappearance of Jonas Burgos, or some other person who “was disappeared” (human rights slang, not mine) by Palparan.
Akala niyo walang kapangyarihan ha. Ganyan din ang US Supreme Court until Mr. Chief Justice John Marshall issued the immortal decision in Marbury v. Madison. Atras ang recalcitrant executive (Thomas Jefferson). There is no provision in the US Constitution granting the Supreme Court the power to strike down a law. The power was crafted from pure reason. Said power is expressly granted in the Philippine Constitution.
Following CJ Marshall, De Lima can expound on the law, by official acts. So far, the CHR has just been a worthless sinecure job for some political appointee, despite its potential.
They say that some are born great, and some have greatness thrust upon them. Maraming puwedeng itama ang CHR. Will it be greatness for De Lima, or ho-hum? I will watch as it unfolds.

Gloria’s administration has the most number of people who went missing and/or were summary executed than that of the previous administrations of Marcos, Aquino, Ramos and Estrada combined! On the other hand, Gonzales, of the DOJ believes there is no human rights abuse committed. His judgment is as corrupted as Gloria’s. What else is new? Figure this out.
