9 Magdalo officers sentenced 6 to 40 years in prison

No worry. Esperon has promised them pardon very soon.

The Makati Regional Trial Court on Tuesday handed down a sentence of imprisonment ranging from six years up to 40 years on nine members of the Magdalo group who pleaded guilty to charges of coup d’etat for the July 2003 Oakwood mutiny.

Makati RTC Branch 148 Judge Oscar Pimentel sentenced Captains Gerardo Gambala and Milo Maestrocampo – who are among the Magdalo’s core leaders – to reclusion perpetua or 20 to 40 years of imprisonment.

While Captains Alvin Ebreo, Laurence Louis Somera, Albert Baloloy and John Andres, 1Lt. Florentino Somera, 2Lt. Kristoffer Bryan Yasay and 1Lt. Cleo Dongga were sentenced to prision mayor or 6 to 12 years in jail.

A day before the promulgation, the Armed Forces on Monday lauded the nine Oakwood mutineers for pleading guilty and facing the consequences of their “wrong action” five years ago.

“What is very, very admirable on the case of the nine officers is their courage to accept that they have committed something wrong and they are willing to face the consequences of the wrong actions that they have committed,” said AFP public information officer Lt. Col. Bartolome Bacarro.

At the same time, Bacarro dismissed the possibility of the nine re-entering into the military service.

After five years of trial, the nine Army officers on Wednesday last week pleaded guilty, changing the plea earlier entered by the court on their behalf, prompting the prosecution to recommend 17 to 20 years imprisonment for Gambala and Mestrocampo, and 10 to 12 years jail terms to the seven others.

The nine are also among 31 military officers and men who were ordered to be dishonorably discharged from the military service in connection with the July 27, 2003 mutiny for violating Articles of War 96 or conduct unbecoming an officer and a gentleman. – Amita Legaspi, GMANews.TV

    What is wrong is, when you shut your mouth and your eyes while there are too many sinful acts that are being committed against your fellow man, your country and most importantly against your Creator. What is wrong also is when you dont stand firmly on what you beleive and you give up while you are being pressured or offered something just to make your self look like a fool and accept what you ought not to accept. What is wrong is when you let go of a mistake or a wrong doing. What is wrong is when this mistakes or wrong doings become systemic and the victims of such are the people around you that includes you and your family. You let go of these mistakes, hell is just waiting for you because you are a big mistake to be in heaven. Its not difficult to obtain a visa for all eternity in hell.
    It is wrong to have a fake president. It is wrong to have people in government who does not respect at leat the law of the land. It is also wrong to partake in what is being done that is to be considered a heinous crime. To cheat, to steal, to lie, to plunder and so on is really wrong.
    Now, what the heck is wrong with those people who cannot stand on their ground when they say you are wrong for being a cheater, liar and a robber? What happened to you?

Then, he made pronouncements na guilty na sila that they will be found guilty and he is working towards that now. This shows a pattern that he seem to get what he wants. Mukhang kayang kaya niyang magmando talaga to a point na he now encroaches sa power ni illegal president evil bitch. Talaga naman na kapag malaki ang utang ng isang tao( the evil bitch owes asspweron big time for cheating for her and he continues to cover up for her to this date)hindi siya makapiyok!     Soldiers are supposed to be different from you and I in terms of physical and moral training, discipline, courage, etc. I wouldn’t equate my personal sufferings to theirs because our respective experiences are just different!

    Just got back from kiddies’ term break/holiday in England.

    Sorry to hear about the sentence. One thing I don’t quite understand is how Esperon can promise to “pardon” the accused/sentenced Magdalo when it was the The Makati Regional Trial Court that handed down the prison sentence. Does that mean that Esperon holds higher moral and legal authority than what is considered the Philippine ‘judiciary’?

    In any case, I find this whole civil court trial and sentencing absurd. Those Oakwood mutineers surrendered on the condition that they would be tried by a military court. The agreement was reached for them to be tried under the Articles of War and not under civilian courts.

    Max Soliven would be turning over in his grave.

    Cimatu knows (as does Efren Abu and this stupid sonofagun Esperon) that the terms of rendition/surrender agreed upon meant that the Oakwood mutineers wouldn’t be handed over to civilian courts.

    There is no palabra de honor in this God-forsaken government, no recognition of honour at all where the military top brass is concerned. How do you expect the next crop of officers and men to be loyal to the military? Next time, it will be “patay kung patay” because they know this government and its henchmen, its so-called negotiators cannot be relied upon to honour terms of agreement.

    May Gloria, Esperon and their kind rot alive!

    Philippines injustices never ceases to amazes me! Those Magdalo officers never really had the chance, they were guilty right at the beginning even before the trial got started. Whore Gloria had no other choice but to find those officers guilty in order to justify her legitimacy or her claimed to the throne. Kinda feel sorry for those officers in a way. If anybody should’ve been prosecuted of coup d’etat and sentenced to years in jail, it should’ve been whore Gloria Arroyo, Gringo Honasan, Angelo Reyes and others. Whore Gloria and Angelo Reyes already set the precedent of overthrowing a legitimate gov’t, so you would think those Magdalo officers would’ve been found not guilty. But, this is Philippines on whore Gloria’s rule of law.

    Their plea of guilt cannot be used as evidence against Trillanes et al. The admission in the plea of guilt are only useful agains the pleader. Maraming jurisprudence diyan. The reason for that is that the accused have the right to confront witnesses against them. So, they still have to testify against Trillanes, and Trillanes’ lawyer will have the chance to cross-examine them.

    Because Esperon had already screwed them once, baka ang magiging prinsipyo nila ay parang mga hooker – money down before performance. Pardon muna bago testimony.

    If the pardon is given first, then the officers, can in turn screw Esperon. They cannot be tried again, because that would be double jeopardy. Hindi rin puwedeng conditional ang pardon, because that would reveal the cooking of the evidence. How will they couch the condition? You are pardoned if you testify against Trillanes?

    If the pardon is not given first, then the officers (anyway na-convict na) may exact their revenge, and say, no Trillanes did not instigate anything. We only pleaded guilty because we were pressured. Patay – nullified ang sentence, mayroon pang obstruction of justice.

    Whose brilliant idea was this anyway? Looks like they painted themselves into a corner.

    Nakakaawa talaga itong siyam na magigiting na sundalo. Una nakipag-deal sila para umamin ng kasalanan. Nagamit tuloy sila pang-PR. Pangalawa, nasintensiahan tuloy para magdusa ng anim hanggang 40 taon ng pagkakakulong. At pangatlo, nawalan pa sila ng kridibilidad sa prinisipiong ipinaglalaban. As of now this is their situation. But a month or two from now mabibigyan na iyan ng presidential pardon. Ang dapat abangan diyan ay ang paglabas nila, ano ang kanilang sasabihin, ano ang kanilang gagawin, at papaano nila gagamitin ang kalayaang natamo. Mag ala Erap kaya sila na bumabanat pa rin pagkatapos ng pardon niya? Paano na lang kung gagamitin sila o magpapagamit sa Malacanang sa counter propaganda? Marami pang puweding mangyari, as of now ang kanilang kalagayan ay nakakaawa talaga kung saan ay nangangailangan sila ng mas higit pang pangunawa ng publiko.

    PMS, I can be proven wrong. But gauging from how asspweron treats his men, he does not care kung mabulok sila sa bilangguan. If ever they are indeed pardoned, it is for a reason. The reason would be to entice those who are still facing trials to follow suit. Kaya lang, it will just be a “trap”. These incarcerated officers should not trust the asspweron and the evil bitch as these duo only have two things in mind, money and power. Anything else is not foremost!

    it is not coming in as a surprise that the 9 officers changed their plea to “guilty”. weren’t they the same officers who made their own ” Im Sorry” video several years ago? they were also the same officers who re pledged their allegiance to GMA? what would be coming in as a surprise was the verdict against Gambala and Maestrocampo–i think GMA and Esperon is screwing them big time—milking it as a publicity stunt–and yes I do believe that a sweetheart deal was done but who would bet against them being screwed one more time? Im not even betting a plugged centavo.

    But i do not begrudge them their decision–my respect for them remains for having stood up for what they believed was right—and I think with this episode the torch has passed, Gambala et.,al have done their part and its time that others step up to that role. But, this time, there will be a huge difference–unllike Marcos and Erap, GMA will not step down without a fight–literally and figuratively. this time around, blood will be shed and needs to be shed to effect change. and i dont think–the shedding would be limited to military officers, junior or otherwise. i think this time the civilians should take a more active role in bringing GMA down. the people wants change—why ask the military to intervene for the plight of the people? the people should take matters in their own hands—and once we do, the soldiers will know what to do–whether Esperon likes it or not.

    i also believe that the people first must act and then the military officers can withdraw their support. withdrawal of support is a political act reserved to ordinary people. in a way all those involved in the oakwood mutiny were already forgiven by the people when sen. trillanes went into politics and won inspite of all the difficulties.

    Even during the period of trials, Garcia was reported to have been receiving VIP treatment. He was either faking illness staying at comfortable hospital or allowed to get out of jail to play golf. In the meantime, his family is abroad living a luxurious life. They could not and will never convict Garcia of anything. Garcia is no different from Neri because so many higher officials leading to Malacanang are involved.

    Over at the Supreme Court, former SC Chief Panganiban issued a very strong and bold opinion against his former colleagues as far as asking them to reconsider the decision on Neri’s case. He was immediately countered by Davide even if the latter is abroad obviously upon the instruction of Malacanang. One former SC Chief opposing another SC Chief balances it out. But at this time, who would believe Davide? He was the worst SC Chief this country ever had!

  62. Let’s put things in a proper perspective. What the 9 admitted guilty of is teh to the crime of coup’etat. Trillanes et al never admitted that they are guilty of coup d’etat because they are not.

    Here’s the meaning of coup d’etat under the revised penal code:

Coup D’ÉTAT. — How committed. — The crime of coup D’ÉTAT is a swift attack accompanied by violence, intimidation, threat, strategy or stealth, directed against duly constituted authorities of the Republic of the Philippines, or any military camp or installation, communications networks, public utilities or other facilities needed for the exercise and continued possession of power, singly or simultaneously carried out anywhere in the Philippines by any person or persons, belonging to the military or police or holding any public office or employment, with or without civilian support or participation, for the purpose of seizing or diminishing state power.”

    “Duly consituted authority”. Since when was Gloria Arroyo duly constituted. She grabbed power in january 2001. She cehated in 2004.

    Magdalo raised legitimate and unresolved social ills

    NO hidden deals for leniency brokered by Malacanang can address the root cause for the Magdalo soldiers’ acts, the United Opposition (UNO) said yesterday.

    “The conviction of the Magdalo soldiers will not insure that others will not indulge in the so-called military adventurism. Until the military institutes genuine reforms that will address corruption, then the cause of unrest of the younger idealistic soldiers will remain and continue to push some to do extreme acts.” UNO spokesman Atty. Adel Tamano said.

    Tamano pointed out that while extra-legal power grabs are unacceptable the causes of the social unrest in the country which prompted action on the part of the military remain unresolved.

    “While we strongly disagree with unconstitutional means to seek change, the conviction of the Magdalo soldiers should not blind us to the validity of their complaints and the idealism that animated their cause.” Tamano added.

    The 9 officers can admit that they intended to conduct a “swift attack”. But whether or not Oakwood is “any military camp or installation, communications networks, public utilities or other facilities needed for the exercise and continued possession of power…” must be proven by the government, because the government must prove every element of the offense.

    That a building is a military installation or such is proven by its use by the military. The nine officers admitting that Oakwood is a military installation does not make it so; in the same way that their admitting that a church or a sauna bath is a military installation will not make it so.

    Hmm. Looks like there is a strong basis for a reversal on appeal.
