The CA’s collective gall

It was about time someone exposed the wheeling and dealing at the Commission on Appointments.

Sen. Jamby Madrigal, by invoking Section 20 of the Senate rules last Wednesday, frustrated the plan of Malacañang to railroad the promotion of 24 military officers despite blatant violations of the law in their appointments.

I have attended three sessions of the CA because I’m closely watching the confirmation of the promotion of John Martir to brigadier general and it’s appalling to observe the “collective gall”, in the words of RC Constantino, of many of the administration allies, especially the CA chair, Rep. Roque Albano III.

Just like what happened in last Tuesday’s CA hearing. They were discussing the issue of Martir’s 447 days AWOL (absence without leave). That’s one year, two months and 22 days! An ordinary soldier who goes on AWOL would be court-martialed, imprisoned, subjected to hard labor or dismissed from service.

None of that happened to Martir. In fact Gloria Arroyo promoted him.

Martir considers himself a “constitutionalist” but is not bothered by his fellow officers allowing themselves to be used as cheating operators last 2004 elections. Martir is angry at officers who challenged Gloria Arroyo’s legitimacy. That’s why Arroyo and AFP Chief Hermogenes Esperon love him and will make sure that he gets his star. That’s the sense I got from the way Albano was moderating the hearing.

To explain his AWOL, Martir submitted an affidavit by his friend Col Julna Carillo, now retired, who said he was the one at fault because he forgot to file Martir’s application for extension of his leave when he was in the United States as requested of him. The problem with Carillo’s affidavit, executed at Taguig City on Aug. 1, 2007, was he left the country for the U.S. in late 2006 and he has since not returned.

Also, the affidavit was notarized by Col. Pedro Herrera-Davila on March 18, 2006. That means Davila notarized an affidavit that did not exist at the time he did it.

Carillo’s affidavit was not the only one that defied the logic of time. Martir executed an affidavit dated Aug. 6, 2006, notarized by Davila Oct. 8, 2007 answering issued raised in a letter sent by an anonymous person dated September 15, 2006. That means at the time Martir was answering the complaint, the letter did not yet exist.

Davila explained the time-defying dates in the affidavits and his notarization as “anticipatory”.

Lacson, who was shuttling at that time between the CA hearing and the Blue Ribbon ZTE investigation where his “surprise witness” Leo San Miguel was giving him the surprise of the day, moved for a deferment of Martir’s appointment.

Albano had a different take. He said, “let’s recommend him to the plenary. Anyway, it’s just a difference in dates.”

Just a difference in dates. That’s all it was to Albano.

It struck me that the likes of Albano do not understand the value of honesty and integrity, attributes that military officers are supposed to possess.

Despite the unresolved issue of Martir’s AWOL, he was at the plenary session last Wednesday because his confirmation was hidden under “other matters”. A sly trick that Sen. Madrigal denounced.

In invoking Sec. 20, Madrigal specifically mentioned Col. Arthur Abadilla, Gen. Ike Inserto and Gen. Nehemias Pajarito.

Pajarito, by the way, was mentioned as one of the “Hello Garci generals” as having allegedly allowed the canvassing to be done in their camps and prevented watchers from the opposition from observing the counting.

Section 20 of the Senate rules states “Any member may move for the suspension of action by the Commission on any nomination or appointment favorably recommended by a standing committee and the Chairman shall suspend the consideration of said nomination or appointment: Provided, that, such suspension may be taken up on the next succeeding session of the Commission; Provided, further, that this section shall not apply to nominations or appointments taken up by the Commission during the last session prior to an adjournment of Congress.”

Madrigal said: “Our Congress has been given the Constitutional mandate to properly scrutinize executive appointments and promotions, and our rules empower the members of the Commission on Appointments, to serve as a check and balance on whimsical, impractical, scandalous, or unworthy executive appointments, designations, and promotions. Our Congress and the Commission’s rules also grant the minority a means to counter the tyranny of the majority when, in the judgment of individual members, further reflection is required on an appointment or promotion.

“Our Congress in past administrations have zealously defended these prerogatives on the sensible assumption that the majority of today can be the minority of tomorrow; and that therefore, it is prudent to uphold the rights of individual members.

“Instead, the administration-affiliated members of the Commission have conspired to subvert the intent of the rules, to deprive its members of their prerogatives, and to resort to sleight-of-hand, if need be, to frustrate the rights of opposition members.

“I can only assume that this has been done because it is more important for the political godfathers of unworthy officers to secure their promotion, regardless of the damage it would do to the service and to Congress, to our rules and the Constitutional principles they are meant to uphold.

“Mr. President, I wish to place on record the case involving Col. Arthur Abadilla. The records of the Committee on National Defense Meeting No. 5 on 27 February 2008 before the Plenary Session No. 08 of even date will reveal that the nomination of Col. Abadilla was agreed to be resurrected even if the same had already been considered bypassed by the Commission by reason of the Adjournment of the 13th Congress without his nomination being acted upon by the Commission. This is even considering that Col. Abadilla was not re-appointed by Malacanang and he likewise reached the ban on promotion to Brigadier General one year before the mandatory retirement age. Moreover, this is in violation of Section 17 of the Rules of the Commission which requires that “nominations or appointments not acted upon at the close of the session of Congress shall be returned to the President and, unless new nominations or appointments are made, shall not again be considered by the Commission.”

“This is not an isolated incident, there are also others whose confirmations may be in violation of existing laws, I refer to the appointments of Generals Ike Inserto (who is due to retire on 21 January 2009); Nehemias Pajarito (due to retire on 24 February 2009). The appointments of these officers, whom I bear no personal grudge are not consistent with Section 4 of Republic Act 8186, which provides that, “except for the Chief of Staff of the AFP, no officer shall be assigned/designated to the aforementioned key positions or promoted to the rank of Brigadier General/Commodore or higher if he has less than one (1) year of active service remaining prior to compulsory retirement.”

“I invoke section 20 as well in behalf of the silent majority in the armed forces who do not have political godfathers to support their promotions, and have to wait for their several years before their names are submitted to this Commission for confirmation. Equity and fair-play demands that we level the playing field in the confirmation process.”

    Senator Jamby Madrigal might be perceived to be rude and combative in style; but she’s acting like a true opposition. It tooks someone like Jamby to put a stop to these appointments and confirmation of undeserving government officials and military officers. The corruption within the Committee of Appointment in Congress was exposed by no less than the older Rep. Teves, the current Finance Secretary Teves’ father. Leading those being accused was then Rep. Pichay. Whatever happened to that expose? I won’t be surprised that the Senate is as guilty. There are senators sitting in the CA who are similarly corrupt from way back. So, when Jamby prevented the confirmation invoking Section 20, some like Richard Gordon went balistic. Recently, a PNP official, a certain Alvarez, refused to be promoted and assigned a higher juicy position to protest against the corrupt system of appointing PNP officials due to patronage and connection with the politicians/Malacanang. It’s nice to see there are good and decent officers like Alvarez.

    I’m no fan of Jamby Madrigal. She looks like this Medy Poblador. She is no perfect. She is not generous and rude to her staff. She’s unfriendly to the media. She takes care of her dogs at home more than her house helpers.

    But when it comes to being a true oppositionist, she is consistent and loyal. At this time when Malacanang is so powerful and with paid defenders in the Senate in the persons of Joker, Santiago and Enrile, we just have to take Jamby in and appreciate all what’s she’s doing to counter these Malacanang actions. Jamby intends to run for Vice President, I don’t think she would win even if she spends all her money. I see a Lacson-Madrigal team.

    Gen Nehemias Pajarito – due to retire on 24 February 2009 is banned from promotion due to less than 1 year service is one of the “Hello Garci generals”.

    Gen John Martir – another cheating operator of 2004 elections and youngest general from class 79 is AWOL king with 447 days on absence.

    Col Arthur Abadilla – bypassed by 13th congress was reinserted despite banned from promotion due to less than 1 year service before retirement age.

    General Ike Inserto is due to retire on 21 January 2009 is banned from promotion.

    I can throw the same question and argument to you: Your Malacanang has the habit of saying charges and accusation are hearsays and without evidence. But when testimonies are favorable like the one Leo San Miguel did, Malacanang was elated and quick to say Leo was telling the truth. What reasonable doubt? At least three witnesses who directly knew and participated in the ZTE deal testified that Malacanang leading to your Midget President were involved. And we still have to hear from other witnesses who are being stopped from testifying even if they would want to.

    Appy, show us the documents of Jamby’s support of Trillanes as you allege. Even if she got all the 11 million votes for him is that a crime? I know that in my immediate family alone and amongst friends of my family and their friends, the exponential results could have easily reached thousands. My own sister talked to merchants in the market, passengers of public transportation, people on the street, employees in the offices where she had business in. My siter alone may have generated the thousands of votes for Trillianes. My sister in law made it her business to start and end her day campaigning for Trillianes, even raising funds for him. Everyone they got in touch with (whenever I was with them) pledged that they were voting for Trillianes. So the myth that you have(Jamby’s hand behind Trillaneses’win) is simply a myth! She probably helped in his win a lot but everyone I know personally campaigned for Sonny. Most of his votes, I heard most of his votes came from the families and friends of the soldiers as well. Even when asspweron did everything he could to dissuade the soldiers from voting for him, asspweron could not possibly have the charisma to dissuade the soldiers’ families and friends from voting for Trillianes! Trillianes was and still is a phenomenon! He may be jailed now but that is probably the best place for him for now because if he is outside, he may be one of the over 800 progressive thinkers that the Evil Bitch had abducted and killed so far. His incarceration alongside with that of the 28 men of honor may be the best way to protect them at this time from the Evil Bitch.

    Wow, that was neat! As far as I can remember, That was the best statement I ever come across from any member of congress. It’s a lttle emotional yet powerful. It’s a direct hit to the heart of the matter-the wheeling and dealing in the appointments, promotions and confirmation process in the CA. It served notice that it’s really about time to not only expose and denounce the irregularities and anomalies which gone out of control under evil gloria, but to reform and do something about to level the playing field. Fairness should be the guiding rule and the rules of the game should be at all times be followed. No sneaking in allowed.

    TO THE CHAIRMAN AND MEMBERS OF THE COMMITTEE ON NATIONAL DEFENSE OF THE COMMISSION ON APPOINTMENTS

    I am here once again as an oppositor to the confirmation of Colonel Jonathan C. Martir PN(M) to the rank of Brigadier General. My presence as a taxpayer is borne out of some knowledge that came to my attention thru my association with the colleagues of my husband, Col Ariel Querubin, and from documentary facts regarding the case of the aforementioned officer.

    I believe that some of the documents are already in the hands of the Honorable members of this August body.

    May I just emphasize three (3) things that would help the Honorable members arrive at an enlightened decision on Col Martir’s confirmation.

    Firstly, what we are trying to determine here is his fitness to wear the rank of a general. His professional, physical and moral competence are the things that he offers in front of you to get your nod. I do not question his professional and physical competence. However, I certainly have reservations about his moral side. Col Martir went on AWOL and that is a fact. He has been a DESERTER from the service for more than a year. To enlighten this August body, a military DESERTER is regarded as the lowest mammal in the armed services, next only to cowardice. I believe that some of you here who had been military officers before could bear me out. But what compounds this issue is the attempt of Col Martir to cover up for it by way of affidavits the preparation of which is even questionable, with careful look would have a semblance of perjury. Furthermore, he tries to cover his AWOL by stating that his absence could be covered by his leave balance anyway.

    Your Honors, this is a very dangerous precedent. How then could you stop our soldiers from leaving their post anytime they want by invoking the same distorted reason as Col Martir wants us to believe. Every soldier can now get away with hundreds of days of absence and just rectify the records after seven years, as in Col Martir’s case. In that way we just shut the room for military discipline. I shudder at the thought your Honors. This brings me to my second point……

    The case of Col Martir goes beyond him. It puts the Military justice system on trial too. I heard one senator say in the previous hearing that “…this is a problem of the AFP. All we need is a clearance”. While this body argues it is not a judicial body, I believe you are not exempt from observing justice. It will be an injustice if you simply overlook the fact that he committed a misconduct and he got away with it. Why was he able to get a clearance? Is he a cut above the rest? Does the Military Justice system not apply to him? It puts more questions than answers. Your Honors, as we say in the vernacular, nakalusot siya sa sistema, nakita nyong may mali, palulusutin na rin ba o itatama natin ang mali? And this brings me to my third point your Honors…

    It has come to my attention that this case of Col Martir is being closely watched by the rank and file of not only the Marines, but those of other members of the AFP. I could only surmise why. But I could hazard a guess… they want to know and are hoping to know that the system has not failed them.

    AWOL is a serious matter. It is not about friendship or classmates. It is not about majority or minority. It is not about pro GMA or anti GMA. It is about right or wrong.

    I am confident that the Commission on Appointments will not simply gloss over this serious objection because of party affiliation or friendships or “paki usap” from colleagues because by such action, it would have paved the way for the promotion of an officer so clearly undeserving. When a wrongdoing is staring you in the face, can it be simply shunned because of some clearance or just because this body is only a confirming body. Confirming him is confirming his misconduct. Conferring unto him a star rank is also conferring a dangerous precedent in the military institution.

    I trust that you will give this matter your preferential attention and kind consideration.

    Summary re: AWOL CASE of COL JONATHAN C MARTIR PN(M)(GSC) which was intentionally concealed to avoid punishment. The following are the facts:

    1. Based on his authenticated copy of the Military Leave Credit from the Philippine Marine Corps dated of July 14, 2006, he has 410.92 days sick leave credits and 163.92 days vacation leave credits, a total of 574.84 days. But that is the available balance as of July 2006.

    2. From 1979 to 1998, Col Martir’s accumulated only 285 days of vacation leave but used 225 days already for his authorized vacation during prior years without mentioning his other absences without authorized leave authority. For example: Col Martir’s authorized VL was from August 3 to Oct 2, 1998 but he already left the country on July 16, 1998.

    3. The available vacation leave balance as of Dec 1998 when he went on AWOL was only 60 days. He came back to the Philippines on January 4, 2000 after 537 days.

    4. Considering the AFP will be very lenient to grant him some leeway in exchange for the services he has rendered, his available vacation leave balance of 163.92 days as of July 2006 would not even be enough to offset the discrepancy.

    5. Based on the Military Leave Credit, it shows that as of July 2006, the 477 days of AWOL of Col Martir was never deducted from his leave balance. If he was in good faith then six years would have been more than enough to correct his leave records.

    6. Major Basilio Pooten, the Marine JAGO, investigated Col Martir only in 2007 after the anonymous complaints. However, Col Martir did not submit any counter affidavit. According to the Marine JAGO, Col Martir was recommended for court martial.

    7. Col Martir submitted four Affidavits to the Commission on Appointments on October 9, 2007 in answer to the sworn opposition filed by Mr. Francisco Catibayan.

    8. Based on his Affidavit dated August 6, 2006, he mentioned about a September 18, 2006 anonymous letter to Hon. Avelino J. Cruz, Jr. the then Secretary of National Defense which was dated 43 days after he prepared his Affidavit. The anonymous letter did not exist at the time he prepared his affidavit. And his Affidavit was subscribed and sworn by Col Pedro G. Herrera-Davila, the Staff Judge Advocate of AFP Chief of Staff Gen Hermogenes C. Esperon, Jr. on October 8, 2007 after more than one year and two months.

    9. Also in his Affidavit of August 6, 2006, he admitted that he was out of the country from July 16, 1998 to January 4, 2000, however, his friend Col Julna Jerry C. Carrillo PN(M)GSC forgot to extend his authorized leave. AFP rules states that vacation leaves should be personally applied for and during that time it was the President and Commander in Chief who approves the application for vacation leave thru the Sec of National Defense.

    10. He also further said in his Affidavit that of his 535 days of absences only 385 days can be deducted from his available leave balance because Saturdays, Sundays and holidays are not included. However, he has only 60 days of vacation leave balance as of December 1998 or 163.92 days of vacation leave balance as of July 14, 2006, but his AWOL was never deducted from his vacation leave balance.

    11. Col Martir is also guilty of altering true dates when he submitted to the Commission an Affidavit purportedly executed by Col Carrillo in Taguig City on August 1, 2007 when the same affidavit was supposed to have been subscribed and sworn by Col Davila on March 18, 2006, more than one year and four months before it was executed.

    12. According to the personnel of CA who delivered the Letter of Invitation to Col Carrillo (who can attest to this), they were only able to talk to the brother of Col Carrillo who is working with Seabees, Philippine Navy. The brother of Col Carrillo told them that Col Carrillo already left the country in 2006 and did not come back yet since he left.

    13. We tried to get the travel records of Col Carrillo from the Bureau of Immigration but the Bureau has no record at all of Col Carrillo in its data base.

    14. We were only able to get the travel information of Col Carrillo’s son, Julna Jerry Vinoya Carrillo II born on 1-8-1984 with Passport Number JJ408660. Last departure date from the country was on February 28, 2006 via PR 102 (LA, CA, USA). Last arrival date was on October 4, 2004.

    15. On four (4) occasions, he exceeded his authorized leave – one of which was more than a year or around 477 days. He was not declared AWOL, dropped from rolls nor punished.

    16. In all occasions, he continuously and illegally received his pay and allowances without rendering any service to the government.

    Bad News…Koko Pimentel lost his electoral protest against Zubiri. That again shows that the opposition cannot expect to win in the Supreme Court with 90% Justices appointed by GMA.

    When the supreme court ruled in favor of the opposition, lahat ng mga taga Ellen’s blog ay tuwang tuwa at halos umapaw ang papuri. And everytime it ruled against their personal opinion, they assail the court with their curses and fairy-tale stories of innuendos and lies.     He knows what the laws is: no officer who have one year before retirement can be promoted. Alam niya yan. bakit pinagpipilitan niyang i promote yung tatlo” abadilla, Insierto, Pajarito.

    In an earlier hearing, with all flourish he abstained to vote in the case of Martir because he said the two officers, Col. Querubin and Martir are both close to him.

    What kind of reasoning is that? As the superior officer, you should decide on what is right. And not based on the closeness of the officers involved.

    And it took a congressman to get on the bloody Congress floor to take on Esperon!!!! What the fuck was Biazon doing all that time? What a terrible disappointment!

    He visited those who were charged for the Feb. 2006 plan to withdraw support from Arroyo.

    That visit in fact did more harm than good because he made public the situation of the 47 enlisted personnel Scout Rangers who were detained for almost two years without charges. Because the military was “nabuking” they discharged dishonorably the EPs . Kinasuhan pa ang lima.

    As I told you earlier (I’ll search for the post later), the legal strategy would have been for the EPs to just suffer and keep quiet because by the end of two years without charges, whatever offense they were detained for would have been prescribed. They were still receiving their salaries.

    When the EPs were discharged, he did nothing.

He may have committed an act recently that surprised everyone but one thing I can tell you, palagay ko kailangan pa rin natin siya pang tapat sa mga wala sa ayos na katulad ni Joker, Enrile at Mirriam. Remember ang sabi ni McArthur, ‘old soldier never die, they just fade away..” so antayin na lang natin ang tapos ng kanyang term.

  130. Many years ago, a Philippine diplomat aspiring to be promoted to ambassadorship asked my help in endorsing her petition for such promotion. It was in fact a confirmation of what I actually have alredy known before and hated of how they get promotions in the Philippines that for me is the worse way one can destroy himself regardless of whether or not he is aware of it.

    I was appalled when I learned of how she would pay the members of the CA she asked to push for her promotion. There were even a number of them who proposed to sleep with her as she was unmarried and pretty enough. There was even a time when one daring horny Congressman came over, and wanted to sleep with her at her apartment when she approached him abouot her promomtion.

    My blood boiled when I heard of the amount of money the horny Congressman was asking from her and how he insisted that she should sleep with him. My heart cried for that helpless diplomat and the night she asked me to stay so he would not succeed as she could not bear to sleep with him but could not try to offfend and turn down the horny guy, I did. Galit na galit sa akin ang animal na Congressman!

    Tell me who the members of this CA is and I will tell you whom now to trust among them.

    As for Biazon, he would be doing his countrymen and even the Lord above, no doubt, better service if he would file a petition for a drafting of a law barring all fornicators, adulterers and philanderers from public office. Over where I am a national and based, it is strictly being practiced even when not everyone is acquainted with the Christian God’s Commandment against adultery, which to the non-Christian people of this land know to be an immoral act.

    Rose, Trillianes and company may not see any justice under the Evil Bitch! The more the hearings are delayed, the better for Trillianes and company. But some of his cases are being heard. Lately though, Trillianes ceased to attend the hearings! He is defying the kangaroo courts. Trillanes and Gen Lim may be in detention until the Evil Bitch is in power and so with the other 27 incarcerated officers. The AFP will try to protect the Evil Bitch by incarcerating all these officers while she is in power. If proven guilty, these officers may be incarcerated for life or dismissed from service.If absolved, they have to be put back in active duty and all their lost renumeration and positions will be given back to them. Trillianes is now a civilian. He gave up his military carreer when he ran for Senator.

    The minor cases of the 28 officers should have been dropped in February but according to asspweron, hindi daw. Then asspweron floated that he was going to slap new charges on these incarcerated officers anew because according to asspweron the incarcerated officers were isssuing statements from their cells against the Evil Bitch! But maybe he changed his mind in slapping more charges as he will be retiring from the AFP on the 9th of May unless the Evil Bitch will extend his term anew.

    Personally, I think that these incarcerated officers are safer where they are now. Because if they are sent back out in the field, baka papapatay lang sila ng mafia gang! The only thing I am praying for is for the AFP to treat these men with dignity. Right now they are put in bartolina cells, cramped and filthy! Afterall these officers are not proven guilty yet! Two of the incarcerated officers are even Medal of Valor awardees. Dapat sinasaluduhan pa ng tunay na presidente yang mga yan. Dahil sa fake si Evil Bitch, she does not know how to appreciate the efforts of these valiant men.

    Karma karma lang naman yan eh. Ngayon ang mga 28 opisyales ay nakakulong, bukas ang pekeng presidente naman kasama niya ang mga alipores niya na puro magnanakaw at sinungaling ang makukulong!
