No arraignment took place yesterday in the court martial hearing of the 28 officers accused of withdrawing support from Gloria Arroyo two years ago.
The court, though, denied the motion of Atty. Homobono Adaza for a suspension of the hearings for 45 days as a cooling off period. He said there’s no point “for both parties to be shouting at each other now,” when considering the current political situation, the case might be “moot and academic” in a few weeks time.
The court also didn’t agree with the defense that they have to wait for five days after service of the corrected amended charge sheet which was yesterday before they can go to arraignment.The five- day wait, the court said, applies only to the original charge sheet.
The court agreed only to adjourn at 7 p.m. after Atty. Alex Lacson, counsel for Lt. Col. Custodio Parcon, appealed to the sense of justice of the president of the panel, Maj. Gen. Jogy Fojas, for a “proper conduct of the proceedings.”
Lacson, Adaza and Atty Vic Verdadero, counsel for Brig. Gen. Danilo Lim, moved for an adjournment because it was already way past end of office hours, everybody was tired, and they have to be with their families.
Motion granted. No schedule has been set for hearing next week.
Statement of the officers:
Continuously evolving as an institution that is a source of national security and pride, the Armed Forces of the Philippines is borne out of the life, blood, sweat and tears shed by our forebears. Our Military History is replete with heroism of combatant and non combatant valiant and noble members of the armed forces.
Apparently, a combatant has a lot of opportunity to show heroism by risking his life in the “field”. But for the non combatant who is equally endowed with nobility and courage, the opportunity is simply scarce. Such opportunity may not necessarily be in an armed confrontation in the “field”. For today in this chamber is one such opportunity. And the non combatants among us here specifically refer to the members of the prosecution and the law member of the panel.
Lawyers in uniform are primarily called upon into the service for the sake of upholding the law. And before the brave and proud men and women in uniform, these lawyers are the experts of the law. They are the primary vanguards of the law before the nozzle of a gun, the voice of a commander, the force of an order and even the expediency of a given situation. The uniform is not to deny the rule of law, but only to further it.
These lawyers are no less than the common soldier. A soldier is trained to fight in order to accomplish a mission in any adversarial situation. He should maneuver and counter maneuver every move of the perceived enemy. But not until he becomes the enemy himself.
Today in this chamber, 28 officers are accused of violating military laws and are projected as having acted beyond the constitutional mandate of the AFP, the organization in which they belong. But everyone is aware how the accuser has been trying to impose his will with total disregard to the rule of law-Laws which are embodied no less than in the court martial manual or the Constitution.
The tolerance to the whims and caprices of one man playing god has just stolen two precious years of the lives of these accused and their families. For two years, these officers have been incarcerated, far from the meaning of standardized “military confinement” given to an accused that is presumed innocent until proven guilty.
But foremost, this tolerance as may have been foreseen by Col Parreras, has perpetuated the lost of nobility among those who wittingly or unwittingly become cohorts in the tailoring of reports, fabrication of information and even planting of evidences just to strengthen speculations and lies. This does not only hurt the accused or the organization, but the nation as a whole. This does not augur well with that AFP as a pride of every Filipino.
Acting bigger than the institution and above the law, the accuser now continues as he has been even intending this court martial to be his instrument. This court, with the prosecution and the law member of the panel has to rise above this decadence. At the least, let legal remedies be accorded the accused for the sake of the rule of law. Let not legal remedies for the accused be understood as mere wit of the defense. Nor beating the deadline of prescription for the arraignment of the accused is the victory. For the fight we are in is not just between the accuser and the accused or the prosecution and the defense. More than anything, the fight is upholding the law. This in itself is the victory for us all, including the whole AFP and the Filipino nation.
As an appeal to the prosecution and the law member of the panel, let this opportunity for heroism be yours. Allow this military court to be a court of law amid the pressures of the powers that be.
This heroism is needed today, at a time when there is a growing national uproar against dysfunctional system of corruption in almost all government institutions, including the AFP. As well said in the paraphrase of a notable legal quotation, “when a soldier is on trial, the whole AFP is on trial.”

As usual and as expected, FG Mike Arroyo is leaving for Hongkong allegedly to get acupuncture treatment. Hindi siya sumipot sa hearing ng Ombudsman dahil daw hindi pinayagan ng doctor. Why is he able to travel again this time? Wala bang magaling na acupuncturist sa Pilipinas at kailangan pa siya pumunta sa Hongkong? If Ombudsman is fair and serious, it should demand that Mike Arroyo produces a certificate from the acupuncturist in Hongkong. Dahil kung hindi, nagpapalamig na naman siya doon (o nag-deposit ng pera). He has been consistently leaving the country whenever there’s a serious charge against him. People must not allow him to do this again. Recently, didn’t Malacanang explain that the reason why there were PSG men in the airport was for Mike Arroyo’s arrival. That was the reason why these PSG men were seen at the airport when Jun Lozada arrived. Wala pang isang buwan iyon at aalis na naman itong si FG. Eh saan naman siya pumunta noon? Para sa acupuncture? Enough is enough. This number one Mob Boss must be persecuted to the fullest!

PSB, I expect the prescription to be another contentious issue.
In some of the Scout Rangers’ case the charge of Conduct Unbecoming Officer and a Gentleman cites a Feb. 23. 2006 meeting in Bulacan. So that’s supposed to prescribe today.
In cases connected to the February 24 alleged withdrawal of support, that should be considered prescribed on Monday, a non-working holiday.
In cases connected to the Fort Bonifacio standoff, it’s supposed to expire on Tuesday, Feb. 26. But then, the panel may hold the next hearing on Tuesday and impose an arraignment.
Given how the panel deprived seven officers to exercise their right to peremptory challenge including Lt. Homer Estolas, I expect them to say the cases have not prescribed “and if you have any problem with our decision, you go to the Supreme Court.”
But then, miracles can happen.

The real arguments were conducted in close-door session between five lawyers and the GCM. Maybe in time, the heroes and the traitors there would be revealed.
