ZTE witness ‘abducted” at the airport

by Dennis Gadil
Malaya

A team believed led by the security chief
of the Ninoy Aquino International Airport “snatched” NBN-ZTE prime witness Rodolfo Noel Lozada from Senate arresting teams as he arrived yesterday.

Reports said Lozada, who flew in from Hong Kong at around 4:40 p.m., was apparently whisked off by retired general Angel Atutubo, NAIA assistant general manager for security, and was directly taken down to the tarmac to a waiting van.

Atutubo reportedly was a former aide of President Arroyo. The van went toward Villamor Airbase in Pasay City.

Sen. Alan Peter Cayetano, Senate Blue Ribbon committee chair, said the Senate arresting team pursued the van but returned empty handed to the Senate shortly after 6 p.m.

Cayetano said Lozada was originally to be brought to the dignitaries lounge where his relatives and OSAA (Office of the Sergeant-at-Arms) members were waiting but was made to exit at the airport tarmac, skipping customs and immigration procedures.

Lozada’s relatives, his lawyer, OSAA members and Sen. Benigno Aquino III were unable to see him.

A member of the Senate party said they made contact with Lozada through his mobile phone when his plane landed but lost contact minutes after.

A source who asked not to be identified criticized the Senate arresting team for being clueless on what happened to Lozada.

The source said OSAA members learned that Lozada had taken by other men only from press airport photographers.

Carmen Lozada, elder sister of Lozada, said she is apprehensive about her brother’s safety.

“Where’s Jun? Ano’ng ginagawa nila sa kanya?” she said in a television interview.

“I’m very worried. I’d rather that he go to the Senate.”

Carmen said her brother called them up last week to inform them that he was coming home “to face the music, whatever that is.”

Art Lozada, a brother, told dzMM that he received two text messages from his brother after he was taken away by the unidentified men.

He said Lozada first sent a text that he was taken by to the Villamor Airbase and the second message was that they were on the C-5.

Aquino said another text message received by a family member a little after 6 p.m. said that Lozada was taken “out of town” and even asked the family member to inform the media about him.

A tearful Violet Lozada said over radio: “I just want my husband back. Please ibalik ninyo na ang asawa ko!”

The Senate issued the arrest warrant against former NEDA director general Romulo Neri and Lozada, his consultant, last Jan. 30.

The Senate sergeant-of-arms has yet to serve the arrest order on Neri.

The Supreme Court yesterday granted the petition of Neri to restrain the Senate from arresting him over his non-compliance with subpoenas to attend its hearing on the $329-million broadband deal with China’s ZTE that was cancelled by the Arroyo government last year.

In an en banc resolution, the SC told Senate committees to comment within 10 days on Neri’s petition questioning the legality of the arrest warrant.

The warrant was signed by 13 senators from the Blue Ribbon, trade and commerce, and national defense and security committees.

The magistrates set oral arguments on March 4.

Neri, when informed about the events at the airport, said he was worried about Lozada’s safety.

Aquino said a friend of Lozada approached Liberal Party stalwart and former Education Secretary Florencio “Butch” Abad last week to discuss his possible return.

Abad then contacted Aquino to help facilitate the surrender of Lozada to Senate sheriffs.

The negotiations were kept secret to avert leaks. Aquino said he then alerted Cayetano on the imminent return of Lozada.

Cayetano, in an earlier media briefing at the Senate, said Lozada was to be offered protective custody or arrested if he refused.

Cayetano also appealed to NAIA officials, PNP and Malacañang not to impede Lozada’s return of Lozada and his safe transit to the Senate.

He said the Senate probe would resume immediately when the Senate takes custody of Lozada.

A Senate source said Lozada dared that he be arrested by the OSAA than surrender voluntarily.

The source said Lozada was also expected to submit his resignation effective immediately as president and CEO of the Philippine Forest Corp. once he arrived at the Senate.

Agustin Maderazo, airport immigration officer-in-charge and duty supervisor, said the Cathay Pacific management has to explain why Lozada did not go through the usual arrival procedure.

“It is up to the airline management to explain why the passenger on their manifest did not present himself before us so that proper procedure should have been observed,” Maderazo said.

Lozada left last Wednesday aboard a Philippine Airlines flight for Hong Kong.

Clarify executive privilege

Senators expressed hope that the Supreme Court would immediately resolve the petition seeking clarification on the scope of President Arroyo’s executive privilege.

Senators made this appeal after the SC ordered the Senate to stop enforcing its arrest order on Neri.

“We welcome it (SC injunction) and I hope the Supreme Court would immediately resolve this question,” Cayetano said. – With Evangeline de Vera, Jay Chua and JP Lopez

Update from ABS-CBN online:

Atutubo: Lozada not missing, was picked up by cop

The airport official earlier identified as the one who escorted the “missing” Rodolfo Noel Lozada Jr. out of the Ninoy Aquino International Airport said that Lozada did not disappear but went voluntarily with a policeman who picked him up.

Angel Atutubo, assistant general manager for Security and Emergency Services (AGM-SES) of the NAIA, said Lozada was picked up by a certain SPO4 Roger Valerozo.

“Hindi ako ang sumundo… what happened was the PNP (Philippine National Police) coordinated with us tapos sinundo siya ni SPO4 Roger Valerozo,” Atutubo told abs-cbnNEWS.com.

(I did not pick him up… what happened was the PNP coordinated and he was fetched by SPO4 Roger Valerozo).

He also said it appeared that Lozada knows Valerozo.

“Hindi naman siya nawawala (He did not disappear),” added Atutubo, referring to the man touted as a key resource person in the Senate investigation into the scrapped national broadband network deal.

Meanwhile, Octavio Lina, NAIA’s assistant general manager for operations, said Lozada calmly went with his escorts when he was picked up after emerging out of Cathay Pacific flight 919.

He added that Lozada’s civilian escort and Atutubo were waiting at the doorstep of the plane.

Lina admitted that Atutubo’s actions were in violation of the airport’s security policies.

Immigration officials, meanwhile, said they will investigate the incident since Lozada’s departure from the airport did not undergo the normal disembarkation process.

They added that Lozada’s case can be compared to a human smuggling operation.

Lozada, chief executive officer of the government-run Philippine Forest Corp., disappeared as members of the Senate Sergeant-at-Arms office waited to serve an arrest warrant on him.

He was reported to have been met by Lina following his arrival from Hong Kong at 4:40 p.m. He remains unaccounted for.

Media men and members of the Senate’s Sergeant-at-Arms office were only given access to the airport’s arrival area. They were unable to see where Lozada went and who he was with.

Lozada left the country hours before a Senate hearing on January 30 on the NBN deal.

He was Sen. Panfilo Lacson’s supposed new witness for the NBN deal hearing. The senator said Lozada knows details about irregularities in the NBN deal. With a report from Dennis Gasgonia

Well, back to square 2 again! If there was a Hello Garci, itinago somewhere in Mindanao.

PNP? Palpak Na Police? Si Burgos..was kidnapped in broad day light and in a public place…Ngayon si Lozada nawala in broad day light also in a public place..Gone With the Wind and mukhang ang hangin ay galing sa palasyo..Pero lahat ng bagay ay may katapusan..With faith and trust in God, I put my hope in Him, He will save the Phil. and will deliver us from evil.. and this is what I pray each day.

Other than Malacanang, I don’t mean to blame anyone or group for Lozada’s kidnap; but I think the Senate, opposition and those who are concerned with Lozada’s testimony and safety are partly responsible for the incident. Given the several kidnappings of vital witnesses against GMA’s government, they should have anticipated it. Lacson even mentioned that Lozada might be kidnapped once he arrived at the airport.

If those warm bodies, who are in a position of power and influence, were unwilling to help the likes of Lozada, Burgos and others and yet more than willing to kowtow to the mole….

Indeed, the Philippine is fu____ and we are sc_____ !

One has to wonder…. Don’t we at least have a handful of patriots amongst our “leaked-driven” Senators? Or is that asking for too much?

Lozada’s backchannel betrayed him! Now, I’m beginning to understand why……….

    Ellen,

Who is this Dante Madriaga? Any credence? He volunteered quite a mouthful!

Based on his recollections, ZTE had made four installments! 1M, 5M, 10M and 30M totaling 46 Million to date.

GMA’s presence in the signing rite was to legitimatize a contract by an illegitimate President.

Let’s hope ZTE had learned their lesson. Write off the losses and using this Dante Madriaga to help out the Filipinos!

If you wish, may I know your take?

  11. Hindi ba nahihiya ang mga ungas to be announcing that a prominent Filipino can be kidnapped in broad daylight at sa airport pa witnessed by members of the supposedly elite Philippine police detailed at the NAIA?

    Kawawang Pilipinas talaga!

  12. Brownberry Brownberry

Can this Dante Madriaga be requested to testify at the Senate to confirm what he stated in his e-mail to you, Ellen? Let’s finally pin down Abalos, Mike Arroyo and other crooks in Malacanang to close this matter once and for all. Madriaga could collaborate with Lozada if and when the latter is located (or still alive). Let’s hope the prepared video and affidavit are real. If Lozada is eliminated, we have evidence to hold against Malacanang.

Joey De Venecia was among those whom Lozada met the night before Lozada left for Hongkong and London. He and his family were willing to have him in the custody of the Senate. Lozada was even resigning from his government job when he returned. Who do you think are Malacanang’s spies in the Senate?

  15. Diego K. Guerrero Diego K. Guerrero

Probably Malacanang mafia is preparing Lozada’s affidavit or coaching him what to reveal in the Senate. It takes time to practice the art lying and memorize script.

  16. happy gilmore happy gilmore

even though i am curious how this NBN – ZTE deal will end –
the senate is not the ones to go after grafters and corrupt officials – that is the ombudsman’s job (and subsequently the courts of justice). we are in dire need of the senate’s services as a LEGISLATIVE arm. time and again – the senate has served as the “GRANDSTAND” of sorts for the senators. their love of media coverage blinds them as to the true legislative function of the senate. while it is true they have oversight functions – IT IS NOT THEIR SOLE FUNCTION.

  17. happy gilmore happy gilmore

the senators should take a look at the bigger picture – their actions are further dividing our people – but it seems that they do not care less – basta may pa-pogi points and ma cover sila ng media….

case in point – when Al Gore saw that the results of the elections were dividing the American people – he gave way – even though it was clear that he still has a big chance of taking away the presidency from Bush. I can only hope our senators have the same sense of patriotism as Al Gore.

  18. Diego K. Guerrero Diego K. Guerrero

Dapat kasuhan ng obstruction of justice itong airport security chief retired Gen. Angel Atutubo. Maliwanag na bibaboy niya ang Senado.

  19. Brownberry Brownberry

You’re even blaming the senators. We don’t mind your opposing the views of most of us here; pero huwag ka naman masyadong bulgar na pinahahalata mo na pakawala ka ng mga gago mong amo sa Malacanang.

  20. parasabayan parasabayan

Hah,hah, hah Happy Gilmore…”When Al Gore saw that the results of the election was dividing the people…”. Wasn’t that the scenario when the DOROBO announced that she was no longer intesterested to run for the presidency because she was causing the divisiveness of the people, in front of Jose Rizal’s monument ,no less and turn around to run again and CHEAT her way to the presidency? Cut that crap of yours!
For all purposes, the Tongress in now in the DOROBOS’ (take note of the plural) pockets, the Supreme Court just appointed two lapdog justices, who else is left with the “job” of defending the country? Only the senate with a few real opposition (I stress a FEW because even some of those who won on the opposition ticket are not really with the opposition- they are wolves disguised and as the days go by we will know who they are, the wolves, I mean). BEING A CONSCIENCE FOR THE PEOPLE is every arm of the government’s function! When most of the arms of the DOROBO regime are so compromised, at least we have a TOOTHLESS senate who comes to the rescue. I am so disgusted at how they handled the safety of LOZADA!

Malacanang is in the “KIDNAP the WITNESS / HOSTAGE the WITNESS’ family” mode again. Remember Mawanay? Same modus operation, right? Malacanang hoodlums are really ABOVE the law! Unless the gov’t comes up w/ a story of another NPA team who is well connected w/ the NAIA security and affluent enough to afford a SUV for a getaway car.

Senator Lacson with his background as the former head of the defunct PACC, has the best chance of finding Lozada. PACC used to solve KFR cases way back then, di ba?

  24. Jake Las Pinas Jake Las Pinas

Villar should fire the chief of OSSA for being imcompetent. He is probably the mole in the senate telegraphing every move of his office to the administration. They should put a non Pmayer in there, a policeman who rose from the ranks who doesnt give a hoot about the graduates from Bagiuo.

Can you believe this Gen. Atutubo taking orders from a Sgt. Its just one big conspiracy.

    Ace;
If Razon has Lozada, that’s a good news.Razon is Ebdane’s boy,Ebdane’s Loyalty is on speaker De Venicia because his wife is related to De Venicia,We might see a big showdown in days to come.

  32. Brownberry Brownberry

What worries us is Lozada’s family now doesn’t want to talk or face the media.

  33. parasabayan parasabayan

Tongue, I thought about that too, that JDV and Tabako will be the prime suspects! It is not that I do not trust these two but maybe I can trust them better than the DOROBOS. Kung sila man ang nag-kidnap kay Lozada, it will be used against the DOROBOS for sure. Sana ganoon na nga. But first and foremost I hope he is okay. I feel for his family, really.
The DOROBOS underestimated the capabilities of JDV and the Tabako. All of the generals around the DOROBOS are all somehow connected to FVR. Kung magtraidor si FVR kay DOROBO, it will be a welcomed thing. The situation is very volatile right now. I can foresee more fireworks in the days to come! The sentiments of the people now are so different from the 2005 Hello Garci. At that time, the Dorobo was still at the height of her popularity but now she is perceived as the worst president we ever had! Whatever means employed to oust her will merit the peoples’ admiration!

  34. parasabayan parasabayan

The family is not talking kasi they were instructed not to talk. It will probably be better that way until we know Lozada is safe.

In other words, tinakot si Lozada at ang kanyang pamilya.

Before lahat sila ay nasa likod ni DOROBO but now the landscape has changed. Some of these generals were installed to power by FVR and you can not second guess what is in FVR’s mind now. Para bang the DOROBO put her hand in a beehive. Lahat yan sila Reyes, Mendoza, Ebdane, Ermita, asspweron(see how I did not capitalize his name-it is for a reason)and other high ranking generalas are all somehow connected to the TABAKO. Kaya nga the TABAKO could flex his muscle whenever he wanted to. But with his partner JDV ousted, medyo humina ang pull. The DOROBO has all the money to pay everyone off but there are instances when one has to consider whether or not he/she will remain a passenger in a sinking ship! For those who want longevity, siempre jump ship na muna. Masaya and round na ito!

Parasabayad, FYI lang…FVR was present at the PNP Anniversary today together with GMA as guest of honor. Baka kunwari lang o ano, di natin alam. If FVR is planning something, he has to pretend to be doing his normal activities. Pero etong si JDV, after only three days, his tone is a bit friendly to GMA already.

    Preng Cocoy,

Nograles was placed as speaker precisely to railroad CHACHA. Thus, if they have it their way, walang election sa 2010… how convenient for GMA, di ba?

Assuming hindi umubra yung CHACHA, I think Ernie Maceda has a point there when he said that LP had probably made a deal with GMA that the price of withdrawing support for De Venecia and support Nograles is the endorsement of Mar Roxas for presidential candidate and of course the funds and machinery of the administration…

So this early, there are some people who are going to be screwed this early… yung mga umaasa na maging presidential candidate ng administration ( Noli, Bayani, Teodoro ) … and later on Mar Roxas, kung biglang walang election sa 2010…

Posible rin na if talagang tuloy na may election sa 2010 and si Mar Roxas ang admin candidate, the price is to let these Arroyos scot free … ala FVR!

  48. parasabayan parasabayan

This will protect the police if a suit is filed against them in Lozada’s abduction. Puwede nilang sabihin na may request for protection eh! Yes, the request in dated prior to his arrival(doctored siyempre). Utak PNP talaga!

  49. Chabeli Chabeli

Just read a very interesting article in ABS-CBN News that the PNP is “clueless on Lozada but says cops guarding exec”. Here’s a link to the story:
    http://www.abs-cbnnews.com/topofthehour.aspx?StoryId=108249

“Officers of the Senate Sergeant-at-Arms office went to the Philippine National Police headquarters in Camp Crame Quezon City Wednesday afternoon to serve the arrest warrant on would-be witness Rodolfo “Jun” Lozada Jr., the government official who may be able to provide vital information to the scrapped national broadband (NBN) deal scandal.

But Lozada, according to PNP Director General Avelino Razon Jr., is not in Crame. Lozada is also not being held at the headquarters of the Police Protection and Security Office (PSPO), Razon added.

The PNP chief, however, said that Lozada is being guarded by four PSPO officers.”

    ***********************

A theory comes to mind after reading that story: Maybe the PNP does not really know where Jun Lozada is but wants to appear like they are in control. Could it be that Jun is being held by “someone” else who wants to make sure that he can testify in the Senate, or the other way around.

ASIII, you said (February 6th, 2008 at 8:19 am) that “Jun Lozada is the new Bobby Dacer.” That were my initial thoughts, too !

  50. Chabeli Chabeli

ASIII, wasn’t Bobby Dacer on his way to meet FVR in Manila Hotel on that fateful day ? Dacer didn’t show up & FVR got worried & called his family up. The rest is history.

  51. Brownberry Brownberry

Bobby Dacer’s death was blamed to Erap and Lacson. However, it was most likely FVR perhaps in cahoot with Singson who did it.

I don’t know from where in Negros he came from…Iloilo, Bacolod or where. His last name reminds me of the late comedian Ike Lozada who was also an Ilonggo. I wonder if the two are related.

  52. Brownberry Brownberry

Thye following day, Razon admitted Lozada was in PNP’s custody. When the Senate sergeants-at-arm went to PNP to see Lozada today, they were told Lozada was not with PNP. Ano ba iyan? Ginagago na naman tayo!

  53. Brownberry Brownberry

Cocoy, Ebdane belongs to Razon’s group whatever group it is. Nagtutulungan at walang iwanan. I know those who belong to this Free Masonry uphold high moral values and discipline. Malas lang si Razon who’s under Esperon and GMA. He must follow whatever order comes from them. Kung ayaw niya, mag-resign siya. My reason of bringing this up here is not to defend Razon; but I know this guy is not as bad as the other Generals not only because he occupies a very high position in the Mason Fraternity, but his past records are not really that bad.

  54. Brownberry:
It should be pointed out to Rason (and others) the following Japanese proverb “The reputation of a thousand years may be determined by the conduct of one hour”

and by the way the Free Masons are known to be a corrupt secret society, there are many books available on the subject, no doubt thats where Razon got his promotion.

  55. ASIII ASIII

    Chabeli,

kaya nga Lozada looks like domino piece no. 2 to fall. no. 1 was JDV

    Brownberry,

ikaw talaga, pabor na nga sa anti-gloria si Lozada, tatawagin mo pang Ador Mawanay! kahit sabihin pa ni Mawanay na ‘I am a male’ di pa rin sya paniniwalaan!

FVR would never gain anything from Dacer’s death. Erap would.

The senators are still wasting too much time with investigations. Food for thought – the senate spends P 1 BILLION PESOS per bill passed. sobrang konti kasi ng bills na napapasa ng senate as compared to what we are all spending for them – the end result – P 1 BILLION per bill passed in the senate.

what im saying is that wala namang mangyayari sa mga investigation ng senate, past, present or future – BECAUSE IT IS NOT THE PROPER FORUM, it is not the place where those responsible for crimes against the filipino people will be made accountable. THE PROPER FORUM ARE THE COURTS OF JUSTICE.

in order for us to move forward – we have to trust our institutions – most of all the judiciary, as it is has the final say in matters concerning justice….

if one cannot find confidence / the strength to believe in the institutions – and would rather believe in mob rule – then that is just plain sad – because that shows that we have not grown mature as a people and are undeserving of the freedoms we now enjoy.

Strong peso daw pero sabi ng mga kano mismo, how can that be when Philippine economy is dependent on the sagging US dollar?! ‘Lol!

His family and the media immediately looked for him and followed the case. That was one time when the importance and value of media was tested. That was why Lozada’s family also asked the media’s help when he went to La Salle sanctuary and his way to the Senate. Media is a very effective means of preventing the evils from harming a witness like Lozada. Other than Lozada’s sons studying at La Salle Greenhills, I wonder why he didn’t choose Ateneo as his sanctuary.

Star witness siya ng opposition – its only logical and strategic na dyan sya magtago.

Do you know where Cory hide at the height of 1986 Edsa? She was inside the nuns’ convent in Cebu. As we all know, Cory is a very devoted or you can call fanatic Catholic. Irrelevant iyan sinabi mo ulol. Anyone would like to go to a place that he believes and feels secured.
