A military court trying 28 officers linked to the February 2006 alleged power grab attempt has moved the venue of the trial from Camp Capinpin in Tanay, Rizal, where most of the officers are detained, to the military’s general headquarters in Camp Aguinaldo, Quezon City.
The military also announced that eight of the accused will be arraigned on Tuesday.
The venue transfer was made on the request of defense lawyers, said Maj. Emilio Felicen, court spokesman. He said the lawyers have raised the issue of the long travel they have to take to make it to hearings.
The court has been holding proceedings in the camp since December 2006.
“The change of venue was actually a result of several motions made by the defense, private defense counsel… They are saying that they are having difficulty, Camp Capinpin is too far and its takes time to travel so the court considered those reasons,” Felicen said.
Twenty-six of the accused, led by Maj. Gen. Renato Miranda, former Marines commandant, are detained at the AFP custodial center in Camp Capinpin.
Brig. Gen. Danilo Lim, former Scout Ranger commander, was formerly detained in Tanay but was placed under detention at the PNP custodial center in Camp Crame last November for his involvement in the Manila Peninsula hotel standoff led by mutiny leader Sen. Antonio Trillanes IV.
Capt. Dante Langkit is detained at the Army’s Custodial Management Unit in Fort Bonifacio, Taguig.
Felicen said the accused would be arraigned “in batches.” The arraignment dates will be announced later, he said.
The court tried to arraign the accused in batches in the last hearing on January 11 but the defense opposed it, saying the accused should be arraigned in one group because the offenses for which they are being accused of allege conspiracy.
The accused also refused to be brought to the court in handcuffs.
Felicen said the right of the accused would not be prejudiced if they are arraigned in batches.
“The reading of the charges and the specifications is to be conducted individually to the accused and therefore those who are not present during the conduct of the arraignment will not be prejudiced. There will be no arraignment insofar as those accused not present in court are concerned,” he added.
He refused to identify the eight officers who will be brought to Camp Aguinaldo for the arraignment but said Miranda, Lim and Medal of Valor awardee Col. Ariel Querubin might be among them because they are the most senior among the accused.
Asked if the accused would also be detained in Camp Aguinaldo because of the change of venue of the court proceedings, Felicen said it would be the decision of the court which is presided by Maj. Gen. Jogy Leo Fojas.
Felicen also said the handcuffing of the accused is “legal and allowed by the Supreme Court,” contrary to the defense lawyers’ position that it was a violation of the rights of the accused.
“In fact, in a memorandum order issued by the Supreme Court, it says that a detention prisoner, while inside the premises of the court, should be in handcuffs, unless otherwise directed by the presiding judge,” he said.
The court earlier said accused should be handcuffed and arraigned in batches because of their unruly behavior in past proceedings.

The tabako is behind all these. Some of these incarcerated officers were those he pardoned in the fatal coup in Cory’s time. All the pardoned officers were given the chance to serve again and almost all of them excelled in their own way(General Lim and Col Querubin particularly). Could it be that the incarceration of these officers is tabako’s way of holding the DOROBO by her neck? Asspweron is tabako’s man.Tabako made sure that asspweron would be the next “cheat of Staff” when he used the “coup plot” in February 2006 as the basis of his promotion to the CS (aside from being one of the Garci Generals). Therefore this whole thing about the “alleged coup” was a concocted plot by tabako and asspweron to make the DOROBO helpless. This way, the asspweron will be an indispensable asset kuno and tabako is just watching with pleasure as he plays with his puppet strings.
The charter change is also the tabako’s brain child. After asspweron’s extention, this trio(tabako-dorobo and the asspweron) will create a scenario to impose the Martial Law (like they created the “alleged coup of 2006 and the coup plot of the five enlisted men-a very laughable thing) and they will push through anew with the charter change because this will be the only way the tabako will be powerful again(using JDV as his hatchet man on this one). Ang nakakaawa ay ang mga napaglalaruang mga sundalo at ang kawawang mga pamilya nila. Just to play their game, a lot of lives are sacrificed!
JAGO has hit an all time low, using Felicen as a spokesman. The guy doesnt know enough to find the rest room. By saying that the Supreme Court circular applies to the court martial is an admission that the court martial is under the administrative jurisdiction of the same Court, a matter that had previously been taken up in the proceedings. JAGO’s stand has always been to deny that the SC has any say at all in the trial, and in fact once asserted that Supreme Court decisions (which they themselves have been quoting) do not apply to them!Stupid and wrong of course, but now comes Felicen saying the complete opposite. Sige lang Felicen, follow that line of argument and the defense lawyers will use that to make the Rules of Court apply to court martial. Sann pupulutin ang JAGO then? They wouldnt know the Rules of Court if it hit them on the head!
Kahit na sabihin ng marami na mas mabuting i-extend si Esperon para lalong mag-alma ang mga dissatisfied nang mga sundalo, dapat kung ano ang rule, sinusunod like kung dapat nang magretiro, hindi na dapat pang ini-extend para iyong dapat na mapromote, ma-promote. Pero ano itong akala mo may right na ipamana ng mga ungas ang puwesto nila sa mga sipsip sa kanila like what this Esperon is saying that he wants Yano to succeed him. By batches? In alpabetically or according to heights? Taking count of the insurgents, terrorists, destabilizers, oppositors,undecided etc already apprehended and those still out, why, we are already the majority or more than half. They should build larger courthouses, enlist more guards and do what the law dictates in court procedures. But a better solution to all the problems is for the administration to quit. Saves money and wasteful time and effort. Good lawyers can not even practice properly anyway anymore. Pa insist insist pa si Esperon, still seeking more fame, eh? Normally, those due for retirement normally sort out their accountabilities in the last few months. Baka naman matatagalan pa ang last few months, sa 2010 pah.

I attended some of the hearings and there was one hearing where one of the military lawyers was quoting one of the cases. When asked about the content of the case, he couldn’t answer. One of the civilian lawyers was the one who knew about the case and the quoted case had no bearing wahatsoever on the case at hand.
This last hearing struck me more than ever. The venue of the hearing was only about 20 meters from the detention cell and the military wanted the incarcerated officers to be handcuffed! Between the detention cell and the hearing venue were over a hundred of riot police(with complete riot gears)! The number was quadrupled in the early afternoon.The morning session started at about 11AM and hardly anything was covered except putting Col Marcos (the one in charge of the detention cell) to ask him why he was not able to get all the incarcerated officers to atttend the hearing. Marcos in turn told the panel that the officers refused to be handcuffed and he also revealed that Fojas(the president of the panel) had ordered to try the officers by batches(four at a time). Marcos also revealed that he received orders to handcuff the incarcerated officers from Col Espino (the commander of Camp Aguinaldo). What on earth is a commander of Camp Aguinaldo have to do with Tanay?
The court rested at around 12:30 noon. In the afternoon, the civilian lawyers were all in court at 2PM(as agreed upon earlier in court). The civilian lawyers waited until almost 3:30 pm. When the panel did not convene yet, most of the civilian lawyers had to leave the court to attend to prior appointments. It was only about 4PM(when all the civilian lawyers were gone) that the panel convened. At this time all the civilian lawyers were gone. It was so apparent that the panel really waited for the civilian lawyers to all leave before they came out again. The only thing the panel could do then( without the civilian lawyers) was to put back Col Marcos on the stand to continue asking him questions. In less than an hour, the hearing ended.
It seemed to me that the panel could not stand up to the civilian lawyers. Parang mga takot talaga. With Verdadero and Trixie ba naman!
Transferring the venue to Camp Aguinaldo may even make it worse for this IDIOT court martial panel because all the civilian lawyers would be able to attend the hearings and the more the court martial panel will be showing their inability to stand up to the civilian lawyers. Unless of course asspweron(with tabako’s indulgence) will be creating a scenario angering these incarcerated officers, thus making their situation worse. Wasn’t that what they did to Trillianes and Lim? To this day, I still think that Trillianes and Lim were framed up for the Manila Penn incident. The military had to do something to put these two away for quite sometime until the DOROBO’s term is over. The military will be cooking up something for the other incarcerated officers to anger them more. To the incarcerated officers, DO NOT FALL PREY to the military’s grand plan of DECEPTION! You have been through a lot already!
Esperon’s extension? That’s no news. It is in fact a logical consequence of his cheating for the Commander in Thief. It gives us, likwise, added time to feast on him during our Tanduay sessions. Hahahaha

The pronouncements so far of asspweron’s extention are coming from third parties. No actual pronouncement of his extension has come from Malacanang yet. His extension may be the last nail to seal the DOROBO’s coffin. Let him be extended!

Another reason why asspweron is extended could be that he has not finished off the “alleged coup” hearings of the incarcerated men of honor. —–Pardon me but there are Christian groups that don’t celebrate Christmas like Jehova and INC. If Yano served them the notices on Christmas Day, that doesn’t make him a less Christian. For all we know he could be just following order from the higher up. And are all the soldiers and detained enlisted men all Christians? There might be some who belong to the above Christian groups or Muslims. Walang connection iyan, kaibigan. However, Yano should have been more sensitive on performing such act even if he was instructed to do so out of respect for majority of people, the Catholics, the mainstream Christians who consider Christmas Day as very sacred.
