Ambassador to Spain seeking Spanish citizenship?

Update: Bernardo denies applying for Spanish citizenship.

He said. “A check with the Spanish embassy on the veracity of this statement will certainly substantiate my claim.”

He did not apply with the Spanish embassy in Manila. His letter was addressed to Sr. Mendez, then a member of the Spanish parliament who is also a member ofthe cabinet.

Bernardo’s letter

Joseph Delano M. Bernardo, Philippine ambassador to Spain, has sought Spanish citizenship, to be taken up after his service with the government.

Bernardo expressed his wish to take up Spanish citizen during a meeting with an official of his host country in 2004 and followed up his request two months after the meeting.

Bernardo told the Spanish official that he is of Spanish lineage and is allowed to hold “dual citizenship” under a recently enacted Philippine law.

Bernardo could not be reached at his Madrid office yesterday.

DFA spokesman Claro Cristobal said he checked with Bernardo who he said told him “there is no truth to that claim.”

Bernardo, who was appointed by President Arroyo in 2002, coordinated the visit of Arroyo last month to Spain. During the visit, Arroyo was feted by Spanish King Carlos and was awarded a gold medal for her “defense of human rights.”

It was not clear if Bernardo officially filed an application for Spanish citizenship.

But in a meeting on June 22, 2204 with Delegado del Gobierno Constantino Mendez, Bernardo requested the latter to “expedite” his application.

Mendez was secretary of state for public administration in 1994 and 1995, member of parliament from 1993 to 1996 and general manager of the Social Security Institute from 1987 to 1993.

In a letter dated Aug. 19, 2004, Bernardo reminded Mendez of his visit and his request.

An insider in the Department of Foreign Affairs made available a copy of Bernardo’s letter.

The letter, written entirely in Spanish, was printed on what appears to be an official stationery bearing the seal of the Republic at the upper left corner and the words “Embajada de Filipinas Madrid.”

Bernardo informed Mendez that the Philippines has adopted a law on dual citizenship, adding that “I, being a Spanish descendant on my mother’s side, a daughter of a Spaniard, born in Montoro, Cordoba, would like to take advantage of the opportunity to apply for Spanish citizenship and request you to facilitate the processing.”

“I have with me now all the legal documents to establish my Spanish lineage although I understand that to be able to apply for citizenship you must have a resident visa and should have resided in Spain for at least one year,” wrote Bernardo.

Bernardo also suggested he, being a member of the diplomatic corps, be exempted from the residency rule.

“Would it be possible to apply for a resident permit with my Philippine passport as an ordinary citizen and not as an officer or would it be possible to apply directly for a Spanish passport being of Spanish origin?” he said.

Treason

Former Negros Occidental Rep. Apolinario Lozada, author of the dual citizenship law, called Bernardo a traitor.

“If the reports are proven true, what he did was treason. He should not even have contemplated being a Spanish citizen in the first place. As an ambassador, he represents the president and the country. He is also privy to state secrets,” said Lozada.

Lozada said the dual citizenship law applies only to Filipinos who lost their citizenship due to naturalization as citizen of other countries.

“It cannot apply to Bernardo who is supposedly a Filipino citizen. He has to give up his Filipino citizenship first and become a Spanish citizen. Only when he is already a foreign national can he apply to become a Filipino citizen again.”

“But that means that if ever he was granted Spanish citizenship, he instantly lost his Filipino citizenship which is a principal qualification for appointment to such posts as ambassador,” said Lozada.

Lozada said: “Bernardo should not only be recalled or be made to resign. He should be prosecuted and punished for betraying the Philippines.”

Pacifico Agabin, former dean of the UP College of Law, said “public officers are supposed to be citizens.”

“If they become citizens of another country, they lose their positions,” said Agabin.

Unethical

Lawyer Neri Javier Colmenares said Bernardo may face sanctions for violating the Constitution and R.A. 6713 or Code of Conduct and Ethical Standards for Public Officials and Employees.

“What he did was unethical. An administrative complaint may be filed with the Department of Foreign Affairs to have him recalled,” said Colmenares.

Colmenares said R.A. 6713 provides that “public officials and employees shall at all times be loyal to the Republic and to the Filipino people.”

The law also provides that “public officials and employees shall not solicit or accept, directly or indirectly, any gift, gratuity, favor, entertainment, loan or anything of monetary value from any person in the course of their official duties,” Colmenares said.

Maita Santiago, secretary general of Migrante International, said if Bernardo’s purported letter is proven authentic, the envoy should be held liable.

“Bernardo may have compromised his work as purported protector of Filipinos in Spain,” said Santiago.

Non-career

Before he was named ambassador by Arroyo, Bernardo was president of ink manufacturer CDI Sakata Inx Corp. and plastic colorant maker Chemdis Manufacturing.

Bernardo, who is married to Conchitina Sevilla, holds a PhD in International Business Administration from the Kennedy-Western University of California and an MBA in Finance from the University of Navarra in Barcelona, Spain.

He obtained summa cum laude honors for two degrees, Bachelor of Arts and Bachelor of Science in Business Administration, from De La Salle College Manila.

    Kennedy Western University, although purporting to be based in California, is licensed by the State of Wyoming. What other good thing comes from Wyoming? Dick Cheney.

    I called seven years ago, asking if the Master’s from Kennedy Western would be recognized if I take my Ph.D. in say Columbia (NY) she sidestepped and said “I don’t know the laws in NY.” I asked again, “how about UCLA?” She said she doesn’t know the procedure in UCLA. “But I thought you were licensed in California?” I countered. She said no, KWU is licensed in Wyoming. I asked is there a University of Wyoming? She said yes. I asked, will your credits be recognized in the University of Wyoming? She said no.

    Bottom line, it is not an accredited school; polite way to say diploma mill.

    If the report is true, then it is Improper. If he intends to become a Spaniard, he should do what every Filipino who so wanted to be one should do, go into the process, or apply for Refugee, or Political asylum that is’ if he Suspected or Alleged to have committed illegal acts against the Law of the Philippines. Otherwise, a person serving as the Representative of the Country will severe his connection to the Position, and start from there…in espanol “common sense”

He’s only doing what any normal Pilipino would do in such situation and position, take advantage of it. Honor and integrity of Philippines officials, such as in the case of Bernardo are no longer important, whore Gloria made sure of it. Rats are jumping off the ship as the 2010 getting nearer, everyone for herself/himself. Anyway, we can’t blame Bernardo, yet the corrupt institution that made him do it.

    Solo unas palabras recordarle de lo que le comenté durante mi visita de cortesia en su despacho el pasado 22 de junio de 2004.

    Le agradeceria mucho si me puede ayudar para la tramitación de mis documentos con respecto a mi solicitud para nacionalidad española después de desampeñar mi cargo como Embajada de Filipinas de España.

    Para su información, los Filipinos ya pueden ostentar la doble nacionalidad y yo siendo descondiente de un español por parte de mi madre (ahora fallecidad) hija de un español, nacido en Montoro Cordoba, me gustaria aprovechar por derecho la oportunidad española y pedirle ese favor de felicitar el tramite.

    Tengo ya en mi poder la documentación legal necesaria para establecer mi linaje español pero entiendo que pare solicitar la nacionalidad deberia tener el visado de residencia y haber residido por lo menos un año en España. A pesar de que llevo dos años y 8 meses residiendo en España, me han imformado que estos años no cuentan porque estoy aqui en mi capacidad official como Embajador. Asimismo, me han informado que los documentos tendran caducidad a los seis meses despues de haberlos presentados.

    Seria possible solicitar la Tarjeta de Residencia con mi pasaporte filipina ordinario y no official o si fuera possible facilitar directamente la expedición de un pasaporte español por ser descendiente de un español?

    Sin mas me despido dandole mis más afectuoso saludos.

    Well, the Spanish Ambassador to the Philippines might be also seeking Philippine citizenship. Ano naman ang ipagtataka natin. Other than the US, Spain was another country that caused so much sufferings and hardship to the Filipino people. Maliban sa Kristiyanismo at Katoliko, mga fiesta at mga ugaling magastos at pagyayabong, ang isang pakinabang ng ating bansa ay mga magagandang mestisa at mestiso natin ngayon na may mga dugong Kastila.

They allow their own ‘OFWs’ to remain at large or get citizenships in the host countries.     Two former Ambassadors to Spain were aristocrats (who were also known to our family), shipping magnate ex-Amb. Juan Jose Rocha – who owns CF Sharp (Hapag-Lloyd), and Amb. Isabel Caro-Wilson – whose family owns Ramcar, KFC, and Dunkin Donuts among few others. Both returned to Pinas after their tour of duty.

    Pero itong isang ito, balak yatang mag-TNT sa Madrid. Mailulusot na naman nila iyan. If he has been given his Spanish citizenship, DFA can always reclassify him as honorary ambassador. With Sir Raul O. Gonzales at the helm, the DOJ’s opinion will consider all “silent” provisions to support the converse, as what has always been the case, diba atty36252?

    Okay, huminahon tayong lahat. Mukhang old news na ito, dahil ang sinulatan ni Bernardo ay nag-tender ng irrevocable resignation (dimisión “irrevocable”) noong August 8, 2006 according, to el mundo (www.elmundo.es/elmundo/2006/05/08/espana/1147107130.html), one of two major dailies, the other being el pais. The resignation came about after three pigs (police) were condemned by the audiencia provincial (provincial legislature) for illegally detaining militants. Sounds familiar?

    Still, it does not detract from the fact that, at the very least, in poor taste ang paggawa ng request ni Bernardo.

    Mukhang barking at the wrong tree pa, dahil parang factotum lang ang delegado del gobierno. Wala siyang tunay na poder.

    Spain has autonomous regions, which wield the true power. Decentralized sila, a cross between a unitary government and federalism, with a lean towards decentralized power. In fact, in the Cory Senate, inaaral ni Nene Pimentel at Santanina Rasul ang autonomous regions of Spain. Naimbita pa nga ang then Prime Minister, Felipe Gonzalez, na parang deaf-mute sa Philippine Senate, dahil no hablo Ingles.

    Malas naman. Factotum na nga lang, nag-resign pa.

    Kastila ba yan? Malapad pa kay Panchito ang butas ng long-i.

    Bernardo is a traitor in the political sense, regardless of his motives. His letter is a clear indication that he intend to defect after his term as a Philippine ambassador to Spain. Gusto pang maging kastilaloy.

    This I cannot understand…if he graduated with the highest honor (summa cum laude) at sa De La Salle pa at dalawa pa ang degree..why go to this Kennedy Western Unversity..     One does not have to be a political asylum seeker or a refugee to be a citizen of a country. I, myself, was not even an economic refugee when I opted to be naturalized. To facilitate the process, I just presented in fact documents proving that I had Japanese ancestry.

    I don’t know how they do it in Spain, but for a Philippine ambassador to be telling other people that he would prefer to be citizen of another country, I think it is unpardonable. He should be condemned for it, and sacked right there and then, but then, how many of these so-called “Philippine ambassadors” are as patriotic enough to be really be proud of their country?

    Many years back, a Philippine ambassador to Japan was actually criticized by the Japanese for saying that he would prefer to speak in English than in his native tongue! Napataas ang kilay ng mga patriotic Japanese who think that there was nothing better than to speak the language of their hearts!!!

    Di bale naman sana kung talaga namang magandang mag-ingles. Pero kung katulad lang naman ng ingles ni Gloria Dorobo, please, puede ba mag-tagalog o mag-kapampangan na lang! Ang sakit sa tenga ng accent at diction ni unano sa totoo lang! 😛 Nakakabangas!

    His stint in fact as ambassador of the Philippines to Spain does not qualify him for residency in Spain since in principle, he is representing a country with independent territory within a foreign state. I don’t know where he got the idea that his residency as ambassador should be considered as qualification of residency in applying for naturalization. Ang tindi!

    I would understand his resigning his position and asking for asylum for instance to criticize the present government of the criminal who is now named the “Most Corrupt (Questionable) President of the Philippines” but to seek citizenship on the basis of a claim that his mother was descended from someone born in Cordoba while he is still an ambassador of the Philippines to Spain is like rubbing salt to an injury. Sobrang paglait naman iyan sa pagkapilipino niya! Di bale sana kundi siya ambassador!

    I was just talking to a Filipino friend in the Bay Area re similarly thieving Japanese government officials. At least, over in the Land of the Fluctuating Yen, when they are caught, they resign, and if they still have some honor and self-respect, opt to hang themselves by some curtain rail or jump from some tall buildings that is indeed a good way to eliminate the creeps from this world. Majority prefer self-destruction than be ostracized with their families for life even when they get to serve terms in prison.

    I wonder when Philippine government officials, especially the thick-faced criminal squatting at the palace by the murky river, will have such sense of honor and decency to agree to go through prosecution and criminal procedure, not just agree to face the camera for a TV slot reading some ghost written “I am sorry” speech delivered with a very thick accent!

    Problema when someone in deep s–t there dies, more often than not, it is not suicide but murder committed to silence him especially if he threatens to spill out the beans.

    More often than not, the political appointees do not work for the country but are more interested in establishing monopolies and connections like those political appointees Malacanang temporary tenants assign to Japan until now.

    I would opt for encouraging career diplomats in the Philippines to specialize in the art of diplomacy, and learn more about the country and people they are being sent to like the kind of diplomats the British government for instance send to Japan who are mostly well-known Japanophiles.

    Yes, the Philippines should avoid sending someone like a “kabilaning traydor!”!

  45. Sinabi mo pa Magno. Sa Japan nga mas kailangan ng mga pilipimo legal adviser, not a labor attache, who actually cannot deal directly with Japanese authorities as all transactions have to pass through the Ministry of
    Foreign Affairs, and therefore, all deals have to be done by bona fide diplomats not attaches!
