Lim reiterates Oakwood agreement

Update: Agreement not binding: Esperon

In his 30 minute testimony at the hearing this morning, Brig. Gen. Lim reiterated that the agreement forged between representatives of the government and the Magdalo officers was binding because it was approved by Gloria Arroyo.

The agreement was soldiers would surrender but only five of the core leaders would be charged in a military and for the rest to return to barracks. The five are Ltsg Antonio Trillanes IV, Ltsg James Layug, Capt. Gerardo Gambala, Capt. Milo Maestrocampo and Capt. Gary Alejano.

There were also reforms in the military that the rebel junior officers wanted to be investigated. Those were never done.

When Lim was being escorted to the courtroom, he raised his fist (his other hand was handcuffed) as if saying ” The fight goes on!”. While testifying a uiniformed PNP personal was standing behind him.

All those who walked out last Nov. 29 were handcuffed all throughout the hearing. For the first time, Sen. Antonio Trillanes was accompanied to the hearing by his wife, Capt. Arlene Orejana-Trillanes.

Eleven of the accused officers who walked out last Nov. 29 apologized to the court. They said it was never their desire ” to show disrespect for the Honorable Court and the Honorable Presiding Judge.”

They said the action taken by them was “prompted by and was intended to call the public’s attention to the massive anomalies, persistent incidence of graft and corruption in the country and repeated and persistent abuses of the current administration.”

The manifestation was signed by Trillanes,Alejano, Ltsg James Layug, Ltsg Eugene Gonzales, Ltsg Andy Torato, Ltsg Manuel Cabochan, Ltjg Arturo Pascua, 2nd Lt. Jonnel Sanggalang, Ens. Armand Pontejos, Ex-P03 Julius Mesa, Ex-P03 Cezari Gonzales.

SEN. Antonio Trillanes IV and other Magdalo officers yesterday apologized to the Makati regional trial court trying their coup d’état case for walking out of the last hearing.

They said they hold Judge Oscar Pimentel in high regard because of his “fairness and equanimity.”

“It was not our desire and it was never our intention to show disrespect for the Honorable Court and the Honorable Judge when we did what we did during the hearing last November 29,” they said in a four-page apology.

“Accordingly, herein accused most respectfully beg and humbly beseech the apologies of the Honorable Court, the Honorable Presiding Judge as well as lawyers and other parties present during the hearing,” they also said.

“Apology is accepted but you will be dealt with severely if a similar incident took place,” Pimentel said.

Pimentel issued warrants for contempt against Trillanes and the rest of the accused after the walkout and sentenced them to 10 days imprisonment.

After the walkout, Trillanes and his group marched to the Manila Peninsula hotel and called for the ouster of President Arroyo. They holed out at the hotel for about six hours before surrendering to police authorities.

The accused said their walkout “was prompted by and was intended to call the public’s attention to the massive anomalies and persistent incidence of graft and corruption in the country and repeated and persistent abuses of the current administration.”

Among the signatories were Trillanes; Lieutenants (s.g.) James Layug, Eugene Louie Gonzalez, Andy Torrato, and Manuel Cabochan; Capt. Gary Alejano; Lt (j.g.) Arturo Pascua; 2Lt. Jonnel Sanggalang; Ensign Armand Pontejos; and former Petty Officers 3 Julius Mesa and Cezari Gonzalez.

Air Force Capt. Segundino Orfiano and 1Lt. Billy Pascua did not sign the apology.

Another Magdalo leader who joined the walkout, Marine Capt. Nicanor Faeldon, is unaccounted for.

Pimentel issued an arrest warrant for Faeldon.

The accused were “well behaved” during the entire proceeding yesterday, according to assistant chief state prosecutor Richard Anthony Fadullon.

“There was no disruption. Some were smiling, some were nodding. Nothing of that sort that you could construe as animosity,” he said.

Thirty-one Magdalo leaders are facing the coup charge. Only 25 were present during yesterday’s hearing.

Trillanes and 13 other Magdalo leaders on trial were involved in the Peninsula incident.

They were detained at the PNP Custodial Center in Camp Crame after the standoff.

Trillanes was seen smiling and waving when he arrived at the courtroom from Camp Crame.

Brig. Gen. Danilo Lim, who took the witness stand for the second time, had his fist clenched in apparent defiance.

Lim was a member of a government panel that negotiated for the surrender of the Magdalo leaders during the Oakwood mutiny in July 2003. He was called to the court as witness of the Magdalo group about a “gentleman’s agreement” that led to the peaceful surrender of the mutineers.

Before the Peninsula incident, Lim had been in detention in Camp Capinpin in Tanay, Rizal since last year for an alleged plot to oust government in February 2006.

Lim is among the 36 charged with rebellion for the Peninsula standoff.

Trillanes and the other Magdalo officers involved in the walkout were handcuffed during the entire proceedings while the rest of the Magdalo group, mostly Army officers led by Capt. Gerardo Gambala who have severed their ties with the group, were not handcuffed.

Two members of the Makati police Special Weapons and Tactics (SWAT) were posted inside the court. Their firearms were left with the clerk of court.

Security was tight. Court and city hall employees were subjected to checks by soldiers securing the area and asked to present ID cards.

Members of the media were not allowed inside the courtroom, as agreed Monday by the court, police and the military.

Aside from the hundreds of soldiers, two V-150 armored personnel carriers were also deployed at the back of the city hall.

The entrance to the elevator of at the 14th floor of the city hall, where the courts are housed, was blocked. Those who wanted to go to the 14th floor had to take the elevator to the 15th floor and use the stairs to go down.

Soldiers lined the pathway to the city hall entrance. Two buses carried SWAT troops.

Angono and JP Rizal streets were closed to traffic.

Lax security was said to have enabled Trillanes and his group to walk out of the court on November 29.

Director Geary Barias, Metro Manila police chief, said the trip of Trillanes and his group to and from the court went on smoothly as planned.

The convoy left at 8:30 a.m. and returned to Camp Crame at around 11:25 a.m.

“There was no problem, their movement was very smooth,” Barias said.

As planned, Trillanes and the 24 soldiers were handcuffed to a police escort,.

Senators called an “overkill” the deployment of over a thousand policemen and soldiers for the hearing.

Military and police officers at the city hall would not confirm reports that 1,000 soldiers were deployed to secure the hearing, aside from the 260 police personnel from different units, including the SWAT.

Senate President Manuel Villar Jr. said: “Sayang naman baka marami tayong mga krimen na nangyari sa dami ng pulis na nagbabantay kay Trillanes.”

Sen. Francis Escudero said government was overacting. He said the walkout would not have materialized if the military police did their job.

Sen. Loren Legarda said the security preparation was unwarranted.

“Maybe that’s their interpretation of tight security measures,” she said in chiding authorities that she said were caught with their pants down.

“They were completely unprepared then. There were no precautionary measures. Now, they’re more than prepared for that kind of situation. It may be perceived as overkill but how much preparations do we need?” she said.

The Senate committees on justice and human rights and on public order and illegal drugs, chaired by Escudero and Sen. Gregorio Honasan, scheduled the inquiry on the Manila Pen incident tomorrow.

Among other things, the inquiry seeks to determine the legality of the arrest of media men who covered the standoff and the curfew imposed after the standoff.

    The die is cast, the events will unfold in the days, weeks, months, to come. Let us start by looking closely at our congressmen, governors, and mayors, make a list, who are those who support this administration and block any attempts of impeachment. Tell our family, our neighbors, our office mates, etc., about those in the list and vote them out of office (or not vote for them rather).

Everybody apparently still suffers from some painful legs for it was indeed a long walk that normally will take you 5 or 6 stations away by train, but it was worth the while, so they say.

    We all know — and Gloria’s govt knows, the terms of the Oakwood surrender agreement approved by Malacanang no less. Even Gen Efren Abu, who was then the commanding officer of the attack division at Oakwood knows this.

    I wonder if the govt can be sued for breach of promise?

    What pains me is that we have brothers on the other side, the PNP, who equally believe that following the chain of command is the honorable thing, our beer busting group before has split in two – both groups believing they are in the right! Brother against brother…

    The police is a perhaps a brother organization, but if you think about it, is a different kettle of fish altogehter.

    Perhaps, it’s because they engage in fighting crimes mostly in the “petty” civilian domain but in principle, unlike the military, they don’t have to fight an armed enemy whose aim is to kill, maim, destroy, annihilate, as in war conditions. In that sense, they have a tendecy to over-react when a fighting is perceived to be a notch higher than what they’re used to.

    Even the SWAT that milled in front of the Manila Pen during the stand off was rather laughable in their stance. They aren’t used to urban jungle warfare yet in war conditions hence, the OVERKILL stunt… That sort of stunt of milling in front of the Pen in that fashion would have made them sitting ducks had it happened in urban jungle which was Belfast a few years ago. (We lived in Belfast until 1996.)

    Gloria is reported to be the most corrupt president in the history of the Philippines — for one thing, her ascension to the highest office in itself is an act of corruption so am not surprised.

    Ellen, wondering why Pulse Asia “embargoed” their poll results and saw fit to publish them only today. What’s going on? Was it a tactical move, i.e, to publish it after the medalla de oro award to Gloria or is it because Pulse Asia was pressured not to reveal their results before Spain had awarded Gloria with a gold medal for human rights championning?

    (I still can’t believe that those idiotic university people in Spain could do that! Mais, quels cons! Absolument, monstruesement cons ces espagnols!!!!)

    Chi, you’re absolutely right! FVR and GLORIA wore the same color and profess the same motto! SELF-PRESERVATION.. FVR as far as i can remember is involved in the CLARK controversial and unaccounted funds? Huh! need to cling on with PANDAK pra iwas pusoy.

    Yes, Maestrocampo,Gambala, San Juan et al already despised MAGDALO.. Remember how they spit black saliva to TRillanes and other MAgdalo officer hoping that PANDAK will spare them from any legal consequences.

    Asst. Chief State Prosecutor Richard Anthony Fadullon conducted the cross examination on Gen. Danilo Lim. It was Sir Danny’s testimony that Esperon said, “Nagdala ng high powered firearms, tapos, reprimand lang?” when the latter heard the terms of the agreement. Asked for his reaction, Sir Danny said, “Gen. Esperon had interrupted me as I was enumerating the terms of the agreement. however, I did not pay any attention to him, since the agreement by that time was complete, there was already a meeting of the minds.”

    And yet, later we saw that despite the finality of the cotnract, GMA and Esperon reneged on the agreement, making liars out of the men who were sent to negotiate and who gave their words as officers and as gentlemen that they would see to it that the terms would be followed.
