Nothing has changed

Today, Dec.7 is the 25th year anniversary of the raid of We Forum, the forerunner of Malaya, by Marcos soldiers for publishing articles on his fake medals. Sen. Joker Arroyo,Makati mayor Jejomar Binay, Rene Saguisag were some of the lawyers who helped WEe Forum/Malaya foudner Jose Burgos, Jr. assert freedom of the press. The situation today is as bad, even worse, than during the Marcos dictatorship.

Makati Mayor Jejomar Binay, who is PDP Laban national president, yesterday expressed confidence that the Supreme Court will once again uphold press freedom as it did in its ruling on the case of Jose Burgos Jr. and other journalists who were arrested on sedition charges by the military 25 years ago.

In a raid on Dec. 7 1982, the military also closed down the offices of We Forum and its sister publication Metropolitan Mail, and seized all its printing machines, vehicles, equipment, and assorted documents and items.

“Twenty five years ago, press freedom came under siege from a despotic regime intent on suppressing the exercise of Constitutional rights. In ruling against the military, the Supreme Court firmly upheld the importance of a free press and admonished the authorities for imposing prior restraint on the exercise of press freedom,” Binay said.

The Makati mayor, who was one of the legal counsels for Burgos and his co-accused, added that it is unfortunate that 25 years after the closure of We Forum, “press freedom is still under siege from a regime that obviously abhors a free and independent press.”

“At this time when we face yet another crisis involving the exercise of Constitutional rights, I am very confident that the Supreme Court will once again display its judicial activism and stand squarely on the side of the Constitution,” he said.

Binay added that despite the restoration of democracy in 1986, there are still people in government “who are either dismally uninformed or refuse to acknowledge the right and duty of journalists to cover events.”

“In the case of Burgos, the authorities did not distinguish Joe as a journalist from the people that he covers, which was exactly what happened to the journalists who covered the Manila Peninsula incident,” Binay said.

    Today, the journalist has many options. It can file charges with the Commission on Human Rights Philippines which can recommend to Congress needed changes in laws. It can file administrative charges with the National Police Commission which can result to removal of police from the service. It can petition the Supreme Court to clarify legal issues on police vs press at the scene.

    These avenues were non-existing during Marcos martial law. During that time, the Judiciary was clamped down with powerful presidential decrees. Today’s Supreme Court removed the power of Gloria Arroyo in EO64. There is simply no basis that Gloria Arroyo is worst than Ferdinand Marcos. There was virtually no breathing room for the press and free speech during Marcos years.

    Even the lawyer Binay has faith in Supreme Court which struck down Gloria Arroyo EO64. This supports that the justice system is working in the Philippines and again today is not worst when the country was under Marcos martial law.

    However, Binay overestimated press freedom over inherent police power of state. There is a settled ruling in 1972 US Supreme Court on Branzburg v. Hayes that an area is off limits to the public, the media have no right to gain access to crime scenes or sites. Philippine SC oftentimes refers to settled jurisprudence in US SC.It will be most interesting if the Philippine SC will make a departure from police right on crime area.

    NCRPO chief General Geary Barias gave the order to arrest journalists covering the Nov. 29 Peninsula Manila standoff. He is a half-baked copycat of then MISG chief Col, Rolando Abadilla. Mr. Barias needs re-education in the Bill of Rights and should be demoted three ranks below. Media men should file arbitrary arrest and detention against Barias, DILG and PNP. Arbitrary arrest and detention are characteristic of a police state. The rule of law is dead under the corrupt and abusive Arroyo regime.

    Ofcource our existing laws are enough to guide us in all our undertakings but the problem is GMA, siya ang ugat ng lahat ng problema na ating kinakaharap.

    Yong mga Abogago natin (NOT ALL) eh bobo pala sa batas na kanilang pinag-aral, kasi di naman sila ang gumawa eh kundi yong mga corrupt na Tongresman at Senador (di lahat).

    Pag kaso na ang pinag-usapan eh butas-butas ang batas, kasi ito ay ginawa para lang sa mahihirap at pag sila ang naka-gawa ng krimen eh, NOT GUITLY kasi po pera pera lang ang pang pasak sa butas-butas nating mga batas.

    Branzburg v Hayes 408 US 665 is about compelling a newspaperman to appear before a grand jury. The newspaperman was compelled by a state trial judge to appear and answer questions; the Supreme Court upheld the lower court order. There is nothing in the case about crime scenes and media access to them.

    What? Malacanang had issued the same gag order. Nothing has changed. The Davide-led Supreme Court installed Gloria Arroyo as president of the republic contrary to the 1987 Philippine Constitution provisions on presidential succession. Chief Justice Davide invented ‘constructive resignation’ provision as the basis for installing Gloria Arroyo. The Supreme Court can be partly blamed on the present mess and sufferings under the corrupt and abusive Arroyo regime. Corrupt judges and prosecutors and rascal policemen have contributed to the Philippines’ rotten justice system. Trial courts are under administrative jurisdiction of the Supreme Court. It may take light years before we see a truly reformed justice system in the Philippines. Gloria Payola rewarded Mr. Davide a UN diplomatic post.

    Mostly of our Kababayang Pinoys ignored their double-talk and rubber stamp decisions.

    You are pointing the application in grand jury testimony. The substantive basis is relevant. Writing for the majority, Justice Byron White declared that the petitioners were asking the Court to grant newsmen privilege that other citizens do not enjoy. “This we decline to do.” Justice White acknowledged the argument that refusing to recognize such a privilege would undermine the ability of the press to gather news.

    Atty36252, maybe you can compel the Philippine Supreme Court to rule on the issue because DILG sec Puno is using the ruling to support the arrest of press claiming privilege to gather news.

    Eto ang sabi ni Erap: “I am confident that the Sandiganbayan will exonerate me.”

    Later: “I will no longer appeal my case to the Supreme Court, hindi na nila babaligtarin yung desisyon ipinilit nila sa akin nung 2001”.

    Even a defective car, a seriously dilapidated one will work. At least Marcos first made the law then used it for his personal gain.

    Gloria simply looked for the loopholes and exploited them.

    Justice system is working? The last time I checked, the Justice system still includes the lower and appellate courts. If it is the Supreme court that is the only one left functioning most of the time, my technical training tells me it is time to repair and restore the whole machinery up to specs and if it is impossible to do so, replace it with a new one.

    In case the Magdalo soldiers at the Manila Pen are armed with RPG launchers, then, APC armored vehicles are blown like a balikbayan cargo boxes. The risk of frontal armor attack is high.     That is in relation to refusing to obey a court order to appear before a grand jury. Walang sinabi doon tungkol sa crime scene. Masyadong elastic ang interpretation mo.

    Yung challenge sa Supreme Court, puwede lang kung may actual violation. Kaya lang, pinakawalan naman ni Puno, so moot and academic na. Ano? Natiyope? Kung talagang bilib sila sa argumento nila, they should have followed up the arrest with a charge against the media. Gumamit pa sila ng siyoking term, processing. Wala namang CPU ang utak ng mga pulis heads, anong processing?

    Why don’t you compare Macoy’s constitutional ratification case, Javellana v. Executive Secretary against the constructive resignation decision in favor of Glo? Sino ang mas plausible ang palusot.

    Yung manipis na palusot, nakaka-insulto. Parang kasing tanga ng nagpapalusot ang mga taongbayan.

    I asked you a question in an earlier thread not knowing there is this discussion here. I heard on radio that CIDG is threatening to slap ABS-CBN’s news chief Maria Ressa with contempt if she fails to hand them the raw videos of the stand-off. I’m not a lawyer but it’s the first time I heard an investigative police office subpoena evidences and also have the power to penalize. All-in-one justice system! Definitely worse than Marcos’ martial law!

    And it’s working, daw.

    Ang galing naman ng mga pigs, talo pa ang congressman; they amended the law. Talo pa nga ang cha-cha, because tinamaan din ang Constitution.

    This is the argument that Amando Doronilla of Inquirer is espousing the media as the protector of Trillanes from massacre. This is double edge sword. If the media is taken in active capacity as protector, then it can be charge in aiding and abetting rebellion which is not the case if the media is only covering from safe distance. It is also ignore the fact that US and Australian government will send their own forensic experts (cannot be influenced by Philippine authorities) in case of massacre because they provide aid to the Philippine military.

    There is no aiding and abetting any crime if you are protecting the life of another. If the media allowed the rubout, that is aiding and abetting the salvaging.

    Please tell us – without the legalese – the basis of the Ermita (and Malacanan’s) reading that EO 464, or some of its provisions, are still in effect? Was it struck down completely, partially or what?

    Maybe that’s why Balweg used “double speak.”

I’m not impressed by the overly-serious types and I find them boring. However valid their arguments are, they don’t seem to be meaningful. But of course, it’s different in the written pleadings.

    Has anyone in here knows Aristotle’s Principles of Persuasion?
    2300 years ago, Aristotle, in his Discourse on Rhetoric reduced the principles of argument to four major points. Examination of these four points reveals that they serve those of us who labor in the vineyards of litigation as well today as they have served Aristotelian scholars for 23 centuries.

    Aristotle’s first principle: Well dispose your audience to you and ill dispose them to your enemy.

    Second : Maximize your salient points and minimize your weaknesses.

    Aristotle’s third principle: Refresh the memory of your audience frequently. Napoleon Bonaparte, who was a great orator as well as a military genius said that only one rhetorical device was needed to persuade: “repetition, repetition and repetition”. Repetition as used in the context of litigation means developing themes, and the messages inherent in the themes, and embedding the themes and messages throughout the trial through thematic repetitions from various evidentiary directions.

    Aristotle’s fourth principle: Execute the required level of emotion. This is probably the area in which juries are most disappointed by trial attorneys. Forensic psychologists tell us that the one word which would be most often used by jurors to describe jury service is “boring”.

    Unless, you understand this principles you can not be good and clever lawyer.

    They say a leopard doesn’t change spots. Carpio is said to be an excellent jurist, maybe he is and good on him. But when he was legal adviser to FVR, he was corrupt and I don’t mince my words (if Carpio wants to sue me for saying this, fine! I’ll counter sue him in the EU!)

    No major contract with FVR’s govt could go through without his OK if you didn’t put something on the table (up to you to imagine what it is); even if the contract was aboveboard, had been scrutinized at every level and approved by the end user, it will be rejected not by Tabako but by Carpio without a bribe.

    An anecdote: Until a few years ago or before Carpio was elevated to the SC by Gloria, Carpio used to contribute articles to a broadsheet against a project (defence).

    He would write a series articles AGAINST/ATTACKING the project then out of the blue — it’s all over and the defence project he attacked/wrote against will be implemented.

Mas malaki ang kurakot mo, mas malaki ang mailalagay mo sa mga boss, mas maganda ang posisyon mo. Nuong araw ang kurakutan ay libo libo lang, ngayon bilyones na, naku po! My point? Hindi mo na maaalis iyan, kung baga, imbeded na, or institutionalised na in the govt system. The words of Erap,’weather, weather lang’ speaks volume. He is resigned to that idea, so probably he bears no real rancor against Gloria.
    Sa ngayon, ganyan din naman ang nangyayari, kahit mga oposisyon dakdak ng dakdak, maya maya, tahimik na. Eh ano pa? Nagkaayusan na. Tayo na lamang dito sa blog ni Ellen ang dakdak ng dakdak, wlang katapusan. Wala pang umaayos dito? Lol. Kung tayo kaya ang lagyan din. OK kaya sa inyo basta dollars din hah, hindi peso, ano poor?
