Inquest proceedings into a six-hour siege of the Manila Peninsula hotel Thursday in the Makati business district ended at 1:00 a.m. Saturday, but government prosecutors have yet to decide whether to bring charges of rebellion and inciting to rebellion against the persons arrested.
Senior State Prosecutor Emmanuel Velasco, who led the four-man prosecuting panel, said they would issue a resolution on or before Monday.
“Until we issue a resolution, those arrested will stay in detention or under the police custody,” Velasco told reporters after the inquest proceedings. “We will make a resolution as soon as possible. We also do not want to prolong the agony of the complaint respondents.”
State Prosecutor Aristotle Reyes said the 36-hour legal period for detention of those arrested would lapse at 7:00 a.m. Saturday but the decision-making of the prosecutors was not included in that timeframe.
Reyes said what was crucial was to conduct the inquest within 36 hours from arrest. “After this, we could decide within a reasonable time,” he told reporters.
An object of debate during the inquest was “clerical errors” in the complaint filed by the National Capital Region-Criminal Investigation and Detection Group (NCR-CIDG) of the Philippine National Police, such as in the names of four respondents.
Lawyer Theodore Te, who represented more than of the 10 persons arrested, filed a motion to dismiss the charges against several respondents because their names were not in the affidavit of arrest signed by the police operatives.
NCR-CIDG legal counsel Virgilio Pablico said the listed names of some of those arrested had only their middle names as last names but they were the same persons.
He admitted the name errors could be partly the fault of the NCR-CIDG.
“We’re just human,” he said. “We have been documenting a lot, working a lot. It’s human factor that affected that.”
NCR-CIDG chief Senior Superintendent Asher Dolina said investigators were working double-time and were also attending to other cases, including the explosion at the House of Representatives last month that killed several persons, including a congressman.
Meanwhile, several of those arrested Thursday and have since been released and placed in the custody of other persons are not guaranteed that no charges will be brought against them, Dolina said.
These include former Vice President Teofisto Guingona, actress Bibeth Orteza and former University of the Philippines president Francisco Nemenzo.
Dolina said Guingona was brought to a hospital for a medical checkup and placed in his wife’s custody.
Orteza was released to the custody of her husband, Carlos Siguion-Reyna, because of her health condition. Orteza is a cancer patient.
Nemenzo was also released during the proceedings, and will be placed in the custody of Representative Risa Hontiveros of the Akbayan party-list group.
